ART. 1662 ***Fidejusorul*** nu este tinut a plăti creditorului, decât când nu se poate îndestula de la debitorul principal asupra averii căruia trebuie mai întâi să se faca discutie122, afară numai când însusi a renuntat la acest beneficiu, sau s-a obligat solidar cu datornicul. În cazul din urmă, efectul obligatiei sale se regulează după principiile statornicite în privinta datoriilor solidare (C. civ. 1039 si urm., 1055, 1056, 1663 si urm., 1677, 1794 ; C. civ. fr. 2021).

Contractul de fidejusiune

Contract prin care o persoana (***fidejusor***) se obliga sa garanteze fata de creditor executarea obligatiunii de care este tinut debitorul, in cazul cand acesta nu o indeplineste. Este reglementat in cartea III, t. XIV, cap. I, art. 1652 si urm. Codul civil, fiind cunoscut de dreptul roman sub denumirea de fidejussio, iar in vechiul drept romanesc se numea chezasie. Este un contract accesoriu, fata de contractul principal, consensual si unilateral.

With a simple probate-avoidance living trust, the person who creates the trust is also the trustee.

surety

surety is a person (or company) who agrees to be responsible for the debt or obligation of another. Furthermore, a surety is also a "security against loss or damage or for the fulfillment of an obligation, the payment of a debt, etc.; a pledge, guaranty, or bond."[1]

The situation in which a surety is most typically required is when the ability of the primary obligor or principal to perform its obligations under a contract is in question, or when there is some public or private interest which requires protection from the consequences of the principal's default or delinquency. In most common law jurisdictions, a contract of suretyship is subject to the statute of frauds (or its equivalent local laws) and is only enforceable if recorded in writing and signed by the surety and the principal.
