you wouldn't say "deemed to be" or "considered to be" in a contract in English because what is actually happening is that the parties are deciding to set aside that Article.

neutral James (Jim) Davis : I was wondering where you'd got to. You know more than me on the considered and deemed, but if you stick a "waived" in there, it seems that the rights of the bank are waived. Wouldn't "hereby set aside" be much clearer?

You're right about the waived, though that's a problem of sentence drafting which affects the Italian as well
