Glossary entry (derived from question below)
German term or phrase:
glaubhaft machen
English translation:
...\"in which the previous owner had been able to furnish prima facie evidence of his tenure to the authorities
German term
glaubhaft machen
Apparently international law states that ships so purchased are then free from encumbrances but this does not apply to vessels registered in Turkey, they still remain Turkish following an auction in a foreign country.
I cannot completely fathom this sentence but in particular the "Besitzansprüche den Behörden hatte glaubhaft machen können". The full sentence is
XY (the buyer) wusste das nicht und musste erlben dass seine Schiffe arrestiert wurden, wenn sie Häfen anliefen, in denen der "FRÜHERE EIGENTÜMER SEINE BESITZANSPRÜCHE DEN BEHÖRDEN HATTE GLAUBHAFT MACHEN KÖNNEN".
Proposed translations
..."in which the previous owner could furnish priva facie evidence of his tenure to the authorities
...in which the previous owner could show credibly his tenure to the authorities...
both terms are used in legal terminology

I am no shipping expert, but the sentence you quote seems to mean that the buyer was unaware of the provision in Turkish law which affected his/her title to the ships, and so got the unpleasant suprise of seeing them impounded once they reached ports where the previous owner had been able to convince the local authorities that he/she had a valid claim to ownership of the vessels. For examples of the phrase "glaubhaft machen (können)" used in a context similar to this one, see the sentences and links below.
Hope this helps.
"So sprach vor gut einem Jahr ein englisches Gericht einen 22-jährigen Mann vom Vorwurf der Vergewaltigung frei. Er hatte glaubhaft machen können, dass er während der Tat schlief und deshalb unzurechnungsfähig war." (See link 1 below.)
"Auch in den USA hatte Rostovtzeff anfangs Schwierigkeiten: Er musste den Behörden glaubhaft machen, dass er weder ein Kommunist noch ein Jude war." (See link 2 below.)
Thanks so much for your help. I found this tough to award points as the answer I used was a combination of the given replies. Sorry but I felt dutchesrees34 came closest to the origina. |
