German term

Überspannungsrecht

German to English Law/Patents Real Estate
From a Kaufvertrag:

Der Grundbesitz ist laut Grundbuchvortrag belastet wie folgt:
Abteilung II:
Überspannungs- und Betretungsrecht sowie Recht auf Belassung einer elektrischen Starkstromleitung für die Stadtwerke...

I've found things like 'surge' and 'over-voltage' for Überspannung but that sounds too dangerous to have a guaranteed right to it! Grateful for any suggestions - thanks in advance!

Isabel Could you please edit the glossary entry. You've just granted whomever a right to tear up half your plot. The German says nothing about underground power cables. It may be more costly but is possible: https://www.rochford.gov.uk/sites/default/files/planning_evi...

Cf.
"An existing high voltage overhead power main is located along the site’s southern boundary. This will be diverted underground by UK Power Networks to enable supply."
http://plan.scambs.gov.uk/swiftlg/MediaTemp/1135216-532103.p...

You may not need consent for that in the UK:
https://assets.publishing.service.gov.uk/government/uploads/...

But that doesn't seem to be true for Germany:
https://www.eigenheimerverband.de/tipps-fuer-recht-garten-ha...

https://www.bundesanzeiger-verlag.de/xaver/wertermittlerport...

(overhead)...would suffice.

Thanks.

Hello Isabel Here's some background information:
https://www.britannica.com/topic/servitude-property-law

Please note that these are overhead power/transmission lines. It says "Überspannung"; this should be about a "Freileitung" (see Wiki):
http://www.bfh.simons-moll.de/bfh_1995/XX950640.HTM

Also, please note that Betretungsrecht would be kind of redundant in English.

A UK example [p. 12] in the form of a permanent easement:

Best wishes

power line easement

I agree entirely with Birgit's interpretation but this is what I would call it.

agree jccantrell : Easement is what we call this in the USA. It is MY property, but I have to let them come on it to service their lines.

right of way for (transmission/power) lines

This seems to be part of "Leitungsrecht" and means that utility or telecom providers can string power or telecom lines (apparently called transmission lines) across your property. In this case it seems to be a power line, but apparently the same jurisdiction applies to transmission lines. If you allow or are ordered to allow this way of right, there is usually some form of compensation, and the right is of course recorded in the property records.
Note from asker:
Thank you very much, this helped me to understand what was actually going on. I wish I could split the points, but as I actually used Armorel's wording I'm afraid they're going to her. Thank you again.
Peer comment(s):

agree philgoddard : Armorel's answer is correct too, but you were first.
