Sofern der Kunde den Schaden und die Kosten aus Rechtsstreitigkeiten vorab sicherstellt, wird XXX allfällige Prozessverfahren nach den Instruktionen verfolgen, sofern diese vernünftig sind und dem Grundsatz von Treu und Glauben entsprechen und nicht zu einer zusätzlichen Schädigung von Zühlke führen können.

I am a bit lost in this particular context... maybe it is me, maybe it is the (swiss) German...maybe I am just tired.

Can somebody please enlighten me?

agree Horst Huber (X) : Agree, in so far as the phrasing leaves no doubt that the damages and costs so far are strictly potential? It does say "vorab".

Thanks. The meaning of 'vorab' is intrinsic to 'indemnify'.
