Ich verstehe die "Erfüllungsleistung" als die Leistung des Vertragsgegenstandes (subject matter of contract) und die Ersatzleistung eben als Ersatz für diese vertraglich festgelegte Leistung.
Aber wie kann ich das übersetzen ?

I prefer using the term service/s for Leistung/en. Yes one can say performing services but substitute performance IMO would be harder to use. A substitute service is an ersatzleistung not a supplemental or complimentary. Insurance companies provide services, like we say financial service/s. The idea of performing/ance is rather tied to how well they do in providing these or if generally saying company ABC performs services listed... etc. Also the term performance as in the firms own financial standing. I agree the word performance is relevant in an around the subject but find the word services very appropriate to use. It is 100% to the point especially with "dienstleistungen".

A loose way of interpreting it could be "replacement for the service rendered" Just to brainstorm on the term.

However, I think in my context "performance" fits better as it's more general and like a generic term, because the insurance company is here talking about the performance of its insurance holders. |
