Problems with the general structure of this paraghraph:
It seems a bit confusing to me.
Thanks!!!

In particular, they are not valid
I would split this into two sentences. There may be a nuance in there that I missed but I think this is about the gist of it..
"Any terms and conditions seller included in the shipment of software product in print or in digital form are not valid without our prior written confirmation. In particular, they are not valid if they form the basis of a presumed contractual commitment by us or parties related to us…."

Horst Huber (X)
: "Particularly" wäre m.E. besser, denn "insbesondere" ist hier intensivierend, etwa wie "ganz besonders aber".

German term (edited):
gelten insbesondere auch dann nicht (für uns)
shall not be applicable (to us), even if
or:
shall not be binding (upon us), even if ...
(Any of) Seller’s terms and conditions supplied together with software products, made available in paper or digital form, shall, without our prior expressive written acceptance, not be applicable/not binding upon us, even if we or any third party/parties attributable to us (as in: subcontractors) set/commit an act that, pursuant to those terms and conditions, gives rise to/constitutes a contract (contractual commitment) or if we send registration or other cards, also provided to us, to Seller.
Here is XXXX.'s version of a almost identical text:

Unless expressly accepted by XXXX in writing, any terms and conditions of the Seller or any of its subcontractors made available in paper or digital form together the delivery of software products shall not be binding upon XXXX, particularly if XXXX or any third parties attributable to XXXX (e.g. employees, consultants, customers of XXXX) commit an act that, pursuant to those terms and conditions, constitutes a basis for the conclusion of a
contract, or if software registration or other cards are sent to the Seller.

: even if and particularly if have different nuances of meaning

both intensifyl My solution takes into account the whole phrase: insbesondere auch dann (long version specifically/particularly even if). I suggest "even if" suffices

Discussion
Another option for "auch dann nicht" is "are specifically not valid if"
