It's not a legal term that I recognize. It appears to be just a fancy way of saying 'indirectly' or 'otherwise'.

Discussion
The key here is "as partes respondem" = the parties are LIABLE
That's what makes me think in terms of legalese for "via regressiva" and why I associated it with "direito de regresso" or "ação regressiva"......
