"Internet no puede ser un territorio comanche"

Conciliar el desarrollo de Internet y la privacidad de los usuarios es uno de los grandes retos que tiene ante sí la industria.
El director de la Agencia Española de Protección de Datos (AEPD), Artemi Rallo, se ha convertido en una especie de guardián de los derechos de los ciudadanos en la Red.
Atento a las maniobras de Facebook que dejan al descubierto los perfiles de 100 millones de usuarios o a las polémicas grabaciones del callejero de Google, sostiene que el avance de Internet debe ir acompañado de unas ciertas barreras "que maticen esa tierra sin ley en que parece haberse convertido la Red".
Y eso es precisamente lo que hace la directiva de la UE que pone coto a las famosas cookies, sistemas de rastreo que dejan al descubierto datos sobre la navegación del usuario y son una herramienta fundamental para los anunciantes.
"La directiva implica un cambio muy sustancial.
Hasta ahora se exigía que al usuario o el abonado a un servicio se le informara de forma clara y completa para qué usos se iban a destinar los datos que pudiera generar.
A partir de ahora, se requiere que el usuario preste su consentimiento y que previamente haya tenido una información clara y completa".
Autoridades de protección de datos de toda Europa han constatado que los sistemas de información son insuficientes.
"El derecho a la protección de datos y la privacidad en Internet es irreal, ficticio, virtual.
Y a medida que se avanza en nuevos servicios, como la publicidad basada en el comportamiento, se constata la necesidad de dar un giro", apunta Rallo.
Sin dudar de que Internet es, hoy por hoy, la mejor mercadotecnia directa, apunta: "Hay que dejar claras determinadas reglas o en un futuro va ser muy difícil corregir realidades".
Para el anunciante, una de las grandes oportunidades que le brinda Internet es la posibilidad de personalizar su mensaje y dirigirlo a un nicho concreto.
Estas ventajas desaparecerán con la nueva normativa. O al menos se verán limitadas.
"Sí, pero solo si vemos Internet como territorio comanche, como territorio sin leyes y sin normas y donde lo único que tiene sentido es el negocio", matiza.
"Solo viéndolo así puede parecer un límite o un freno.
Internet es una herramienta de utilidad incuestionable, pero debe ser también un lugar donde los derechos de los usuarios tienen que estar garantizados".
Las cookies suministran información muy valiosa para la publicidad online, la mayoría de las veces sin que el usuario se entere. "Ahora solo de forma marginal se podía pedir el borrado de esas cookies, pero con el dictamen aprobado deberá arbitrarse un sistema a través del cual los usuarios tengan, por un lado, una información detallada y suficiente y, por otro, que autorizar el volcado de esas cookies en su ordenador para rastrear la navegación", apunta el director de la Agencia de Protección de Datos.
Crear los instrumentos para llevar a cabo este proceso será responsabilidad de la industria. "Si un usuario entra en una página web y busca de forma minuciosa acabará encontrando una ventana en la que se le diga que indique expresamente si desea que no se instale ninguna cookie en el ordenador. En un futuro los usuarios tendrán que autorizar expresamente su instalación para tales fines".
Frente a los grupos de presión creados para torpedear la normativa, Rallo es tajante: "No deberían invertir las energías en evitar el cumplimiento de normas destinadas a ampliar derechos sino en desarrollar tecnologías que permitan garantizarlos. Hay que conciliar el desarrollo del negocio y la garantía de los derechos de los usuarios".
Los expertos han certificado que prácticamente nadie lee las políticas de privacidad y que cuando se ofrece la posibilidad de desactivar mecanismos con la técnica del opt-out (optar por salirse, por borrarse), muy pocos lo hacen. "El usuario medio de Internet tiene un nivel de conocimiento básico y no se dedica a bucear en cada servicio sobre las posibilidades que tiene de garantizar plenamente sus derechos. Lo normal es que no haga uso de ninguna. La garantía de los derechos y de la privacidad está quedando marginada".
Los anunciantes han puesto asimismo sus ojos en las redes sociales, que agrupan a millones de personas. En este caso, Rallo considera que también hay límites que no deben rebasarse, como la cesión de la información que proporcionan los usuarios a terceros. Pero hay sospechas de que algunas redes sociales pueden estar cediendo información a empresas publicitarias.

“The Internet cannot be Comanche territory”
Reconciling Internet development with user privacy is one of the industry’s most important challenges. Artemi Rallo, Director of the Spanish Data Protection Agency (AEPD), somewhat of a citizens’ rights defender on the Web, with an eye on moves by Facebook that leaked the profile pages of 100 million users, or on controversial imagery collection by Google’s Street View, maintains that Internet advances must be balanced by safety barriers “that tame this lawless land the Web seems to have become”.
And this is precisely what the EU directive does, severely limiting those well-known tracking systems that reveal user navigation patterns and are basic tools for advertisers—cookies. “The directive implies a substantial change. Until now it has been required that a user or subscriber to a service be clearly and comprehensively informed about how the data he might generate would be used. From now on, a user must give his consent, after first having been given unambiguous and all-inclusive information.” Data protection authorities across Europe have affirmed that information systems are inadequate. “The right to data protection and privacy on the Internet is unreal, fictitious, virtual,” Rallo points out, “and as advances are made in new services such as behavior-based advertising, the need for a turnaround is obvious.” Without denying that today’s best direct marketing is done on the Internet, he warns, “We must make certain rules clear or reality will be very difficult to correct in the future.”
For an advertiser, one of the great attractions of the Internet is the possibility of personalizing his message and targeting a specific niche. The new legislation would eliminate or at the least limit this kind of advantage. “Yes, but only if we regard the Internet as Comanche territory, a no man’s land without laws or rules, where only business matters,” he clarifies. “It only comes across as a limit or brake if you view it with that perspective. The Internet is unquestionably a useful tool, but it should also be a place where user rights are guaranteed.”
Cookies provide extremely valuable information for online advertising, most often without the user’s knowledge. “As things stand now, one can only delete cookies as a sideline, but with this ruling a system would have to be agreed upon through which users would have complete, detailed information on the one hand about how these cookies track browsing, and on the other be required to authorize their wholesale introduction into his or her computer,” the Information Commissioner explains.
Creating the tools for carrying out this process is the responsibility of the industry. “If a user goes over a website with a fine-toothed comb he’ll end up finding a window where he is told to expressly indicate if he does not want cookies installed on his computer. In the future, users will have to expressly authorize their installation for determined ends.”
In the face of pressure groups which have formed to torpedo this legislation, Rallo is emphatic: “They shouldn’t try so hard to avoid compliance with rules designed to increase rights but rather to develop technologies that will guarantee them. We must reconcile the development of electronic commerce with the guarantee of user rights.”
Experts have affirmed that virtually no one reads privacy policies and that when offered the possibility of disabling mechanisms via opt-out (opt for exiting or deleting), very few do. “The average Internet user has a basic level of knowledge and doesn’t dig deeply into the possibilities each service has of fully guaranteeing his rights; most of the time he does not use any of them. The guarantee of rights and privacy is being marginalized.”
Advertisers also have their eyes on social networks that bring millions of people together. In this case as well, Rallo thinks that there are lines that should not be crossed, such as the ceding of user information to third parties. But there are suspicions that some social networks may be doing just that with advertising companies.
