Source text - Spanish La Comisión Nacional para Refugiados, órgano interministerial encargado de la resolución de las peticiones de refugio, analiza las solicitudes tomando en consideración los casos de aquellas personas que pudieren haber sido víctimas de trata y temieran enfrentar persecución al regresar a su país de origen por esa razón.
En cuanto a los aspectos procedimentales, cuando exista la sospecha de que se está frente a una víctima de trata, las solicitantes mujeres son entrevistadas por personal femenino, en forma separada y sin la presencia de personal masculino de la familia ni terceros allegados, garantizando así que tengan la libertad de exponer su caso en un ámbito de confianza.
A su vez, se les proporciona información no solo sobre el procedimiento para determinar la condición de refugiados sino también sobre los mecanismos existentes a nivel nacional vinculados a la protección y asistencia a las víctimas de trata de personas.
Para la resolución del caso se tienen presentes también, las costumbres sociales y culturales del país y las consecuencias de su transgresión, la prevalencia de prácticas tradicionales perjudiciales, la incidencia y formas de violencia contra las mujeres denunciadas, la protección de que disponen, las penas impuestas a los que ejercitan la violencia y los peligros que la mujer puede enfrentar si regresa a su país de origen después de haber realizado una solicitud de asilo.
Translation - English The National Committee of Refugees, the interministerial body in charge of refugee status determination, assesses the applications taking into consideration those cases of persons who might have been victims of human trafficking and fear persecution if they were to return to their countries.
Regarding procedure, female applicants suspected to be trafficking victims are interviewed by female police officers, separately and with no presence of males from their families or any third parties in order to guarantee freedom to explain their case circumstances in a trusting environment.
They are also provided with information about the process to apply for refugee status and about the national mechanisms available for protection of and assistance to trafficking victims.
Resolutions of the cases take into account elements such as social and cultural customs of the country and consequences of their violation, the prevalence of endangering customary practices, the incidence and different forms of violence against women, the protection they may have access to, the penalties imposed on those who exert violence and the dangers women face when returning to their countries after having applied for asylum.
