Allgemeine Geschäftsbedingungen von medimops.de
in der Fassung vom 21.08.2019
I. Geltungsbereich
Unsere Lieferungen und Leistungen an unsere Kunden aufgrund von Bestellungen in unserem Internetshop www.medimops.de (nachfolgend "Internetshop") erfolgen ausschließlich auf der Grundlage dieser Allgemeinen Geschäftsbedingungen in der jeweils aktuellen Fassung. Sie werden zum Zeitpunkt der Bestellung Inhalt des Vertrages.
Diese Allgemeinen Geschäftsbedingungen gelten für den Verkauf und die Lieferung von gebrauchten und neuen Büchern, CD, DVD, Software und Computerspielen (nachfolgend "Ware").
Diese Allgemeinen Geschäftsbedingungen gelten gegenüber Verbrauchern gemäß § 13 BGB.
Sie müssen mindestens 18 Jahre alt sein, um bei uns Produkte zu kaufen.
Wir bitten darum, sich pro Person ein Kundenkonto anzulegen.
II. Angebote, Vertragsschluss
Sämtliche Angebote in unserem Internetshop sind nicht bindend, sondern als Aufforderung an den Kunden zu verstehen, uns ein Vertragsangebot zu machen. Der Kunde gibt durch Absendung einer Bestellung an uns ein Angebot zum Kauf der bestellten Ware ab. Unverzüglich nach Eingang der Bestellung erhält der Kunde von uns eine Bestätigung über den Empfang der Bestellung, die keine Annahme des Angebots darstellt. Unsere Annahme erfolgt durch Mitteilung des Versands (per E-Mail). Ein Kaufvertrag kommt erst mit der Annahme zustande.
III. Widerrufsbelehrung
Widerrufrecht
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die letzte Ware in Besitz genommen haben bzw. hat.
Um Ihr Widerrufsrecht auszuüben, müssen Sie uns der momox GmbH - medimops.de, Schreiberhauer Straße 30, 10317 Berlin, (Telefonnummer: 0049 (0)30 / 488 288 200, Email: kundenservice[at]medimops.de), mittels eindeutiger Erklärung (z.B. ein mit der Post versandter Brief, Telefax oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Widerrufsfolgen
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet. Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.
Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an uns oder an medimops.de Retoure, Am alten Flughafen 100, 04356 Leipzig, zurückzusenden. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf von vierzehn Tagen absenden. Sie tragen die unmittelbaren Kosten der Rücksendung der Waren. Sie müssen für einen etwaigen Wertverlust der Waren nur aufkommen, wenn dieser Wertverlust auf einen zur Prüfung der Beschaffenheit, Eigenschaften und Funktionsweise der Waren nicht notwendigen Umgang mit ihnen zurückzuführen ist.
IV. Preise, Versandkosten, Lieferung
Unsere Preise verstehen sich einschließlich Mehrwertsteuer und Verpackung, jedoch ohne Versandkosten. Diese werden gesondert, wie jeweils im Internetshop ausgewiesen, in Rechnung gestellt.
Wir versenden die verfügbare Ware (Übergabe an das Versandunternehmen) nach der Annahme Ihrer Bestellung, nicht aber vor dem Tag des Eingangs des vollständigen Kaufpreises einschließlich Versandkosten. Hiervon ausgenommen ist der Kauf auf Rechnung. Versandweg und Versandart werden von uns gewählt. Für vom Versandunternehmen verursachte Verzögerungen sind wir nicht verantwortlich.
Die Gefahr für den zufälligen Untergang und die zufällige Verschlechterung der Ware geht mit Übergabe der Sendung an unseren Kunden über. Geht die Ware beim Versand verloren oder wird sie beschädigt, muss der Kunde sie nicht bezahlen.
V. Zahlungsbedingungen
Wir liefern nur gegen Zahlung gemäß den auf der Bestellseite angegebenen Zahlungsarten.
Bei der Wahl der Zahlungsart Lastschrift gilt folgendes:
a) Der Kunde ermächtigt bei der Auswahl der Zahlungsart Lastschrift, dass medimops.de bzw. dessen Zahlungsanbieter "PayOne" die fälligen Beträge mittels des Lastschriftverfahrens von der bei der Bestellung angegebenen Bankverbindung einzieht. Dieser Betrag wird unmittelbar nach Versand der Ware vom Konto des Kunden abgebucht.
b) Sofern das angegebene Konto über keine oder unzureichende Deckung verfügt und der Betrag per Lastschrift nicht eingezogen werden kann oder der Kunde die Lastschrift ohne Rechtsgrund widerruft, verpflichtet sich der Kunde, uns die für jede Rücklastschrift, die er zu vertreten hat, dadurch uns entstandenen Kosten zu erstatten.
c) Sofern der Kunde in der angemessenen Frist keine Vergütung des offenen Betrages vornimmt, entstehen weitere Kosten. Die Kosten für die erste Mahnung betragen zusätzlich EUR 1,00, für die zweite Mahnung EUR 2,00.
d) Eine Zahlung per Lastschrift ist nur bis zu einem Betrag von EUR 50,00 je abgeschlossenen Warenkorb möglich.
Bei der Wahl der Zahlungsart Kauf auf Rechnung gilt folgendes:
a) Deutschland
Für die Zahlungsart Kauf auf Rechnung müssen Sie mindestens 18 Jahre alt sein.
In Zusammenarbeit mit Klarna AB (publ), Sveavägen 46, 111 34 Stockholm, Schweden, bieten wir Ihnen den Rechnungskauf als Zahlungsoption an. Bitte beachten Sie, dass Klarna Rechnung nur für Verbraucher verfügbar ist und die Zahlung jeweils an Klarna zu erfolgen hat.
Beim Kauf auf Rechnung mit Klarna bekommen Sie immer zuerst die Ware und Sie haben immer eine Zahlungsfrist von 14 Tagen. Die vollständigen AGB zum Rechnungskauf finden Sie hier.
Bitte beachten Sie, dass bei einer Zahlung mit Klarna Liefer- und Rechnungsadresse mit Ihrer Meldeadresse übereinstimmen müssen.
Klarna AB prüft und bewertet Ihre Datenangaben und pflegt bei berechtigtem Interesse und Anlass einen Datenaustausch mit anderen Unternehmen und Wirtschaftsauskunfteien. I. Scope of contract
1. Our deliveries and services to our customers based on orders from our online store www.medimops.de (hereinafter referred to as "online store") are made exclusively on the basis of these Terms and Conditions in their current version. When the order is placed, you become part of the contract.
2. These Terms and Conditions apply to the sale and delivery of used and new books, CDs, DVDs, software and computer games (hereinafter referred to as "goods").
3. These Terms and Conditions apply to consumers in line with Section 13 of the BGB [German Civil Code].
4. You must be at least 18 years old to buy products from us.
5. Please open one customer account per person.
II. Offers, Conclusion of Contract
All offers on our online store are non-binding, they shall be rather regarded as an invitation to the customer to make us a contractual offer. By submitting an order, the customer makes us an offer to purchase the ordered goods. Without undue delay after the receipt of the order, we will send a confirmation of receipt, which does not constitute an acceptance of the offer. Our acceptance is confirmed by a notification of shipping (via e-mail). A purchase contract is concluded only upon acceptance.
III. Instructions for cancellation
Right to cancel
You have the right to cancel your contract within 14 days without giving any reason.
The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise your right to cancel, you must inform us momox GmbH - medimops.de, Schreiberhauer Straße 30, 10317 Berlin, Germany (telephone number: 0049 (0)30 / 488 288 200, email: kundenservice[at]medimops.de) of your decision to cancel this contract by making a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model cancellation form, but it is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and not later than 14 days from the day on which we are informed about your decision to cancel this contract. We will make this reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods to us or to medimops.de Retoure, Am alten Flughafen 100, 04356 Leipzig, Germany, without undue delay and in any case not later than 14 days from the day on which you informed us about the cancellation of this contract. The deadline is met if you send the goods within 14 days. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
IV. Prices, shipping costs, delivery
1. Our prices include VAT and packaging but exclude shipping costs. These will be invoiced separately, as shown on the online store.
2. We ship the available goods (handover to the shipping company) after your order is accepted, not before the day of receipt of the full purchase price including shipping costs. This does not apply to Pay later. We will select the type and route of shipping. We are not liable for delays caused by the shipping company.
3. The risk of accidental loss and damage of the goods is passed over onto the customer upon delivery. If the good are lost or damaged during shipping, the customer does not have to pay for them.
V. Payment terms
1. We only accept Delivery Versus Payment in accordance with the payment methods specified on the order page.
2. When choosing Direct Debit as payment option, the following applies:
a) When selecting the Direct Debit payment option, the customer authorizes medimops.de or its payment provider "PayOne", to collect the due amount by Direct Debit from the bank account specified in the order. This amount will be deducted from the customer's account immediately after the goods are shipped.
b) If the specified account has no or insufficient funds and the amount cannot be collected by Direct Debit or if the customer cancels the Direct Debit without a legal reason, the customer is bound to reimbursing us all expenses incurred for any returned Direct Debit he is responsible for.
c) If the customer does not reimburse the outstanding amount within a reasonable period of time, he will incur additional charges. The costs for the first reminder amount to an additional EUR 1.00, EUR 2.00 for the second reminder.
d) Direct Debit payments are available only up to an amount of EUR 50.00 per completed order.
3. When choosing Pay later as payment option the following applies:
a) Germany
For the payment option Pay later you must be at least 18 years old.
We offer Pay Later as a payment option in cooperation with Klarna AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Please note that Klarna Pay later is only available to consumers and that payment must always be made to Klarna.
With Klarna Pay later you always receive the goods first and you always have 14 days to pay. You can find the complete Terms and Conditions for Pay later here
Please note that when paying with Klarna your delivery and billing address must match your current address.
By legitimate interest and reason Klarna AB examines and evaluates your data and will exchange it with other enterprises and credit reference agencies. If the customer’s credit assessment cannot be performed, Klarna AB can decline Pay later and point out alternative payment options.
Your personal data is handled in accordance with applicable data protection law and will not be disclosed to third parties for advertising purposes. Klarna AB uses your personal data as part of the services offered to perform a credit assessment and authentication.

I am a Modern Languages, Translation and Interpreting (German and Chinese) graduate from Newcastle University and I am looking to gather more working experience in the translation field.
I am an Italian native speaker and have lived in the U.K. for over 4 years and in China/Germany for about one year.
I have already worked as an In-house Translator and Project Manager Intern in Germany and have learnt about translation theory and practice throughout my entire degree. At work I translated and proofread mostly technical texts, whilst at university, I translated websites, T&C's, government publications and documents in the medical, financial and business field (from DE/ZH into EN and vice versa). I also took on fairly big translation projects (over 3000 words) with Trados 2019 and subtitling projects using Aegisub.
