6. Concepto:
Habiéndose verificado el cumplimiento de todos los requisitos señalados en el Codigo de Procedimiento Penal de 2004, la Corte CONCEPTUA FAVORABLEMENTE a la extradición del ciudadano colombiano, ……., de conformidad con las notas verbales N° 0425 y 1054 del 16 de marzo y 26 de junio de 2015, respectivamente, suscritas por la Embajada de los Estados Unidos de America, por los cargos imputados en la Acusacion N° 4:12CR295 presentada el 12 de diciembre de 2012 ante la Corte Distrito de los Estados Unidos para el Distrito Este de Texas.
En todo caso, habida cuenta que las normas penales de los Estados Unidos aplicables a los delitos por los que solicitó la extradición prevén como sanción hasta la cadena perpetua, la cual está prohibida en Colombia (artículo 34 de la Constitución Política), le corresponde al Gobierno Nacional, en caso de conceder la entrega requerida, condicionarla a la conmutación de la misma, asi como imponer las exigencias que considere oportunas para que se respete la prohibición constitucional, y a fin de que ……..no vaya a ser juzgado por un hecho anterior al que motiva la extradición (artículo 494 del Código de Procedimiento Penal), ni sometido a tratos crueles, inhumanos o degradantes. Del mismo modo, para que se le reconozca como parte cumplida de la pena que se llegare a imponer en el país requirente, el tiempo que ha permanecido privado de la libertad por razón de este trámite.

Having verified that all the requirements, contained in the Procedural Criminal Code of 2004, were complied with, the Court ruled in favour of the extradition of the colombian citizen, ......, in accordance with the verbal notes N° 0425 and 1054, dated 3-16 and 6-26 2015, respectively, submitted by the United States of American Embassy, regarding the charges in this criminal case, pressed in the Accusation N°4:12CR295, issued on december 12th 2012, in the United States District Court of East Texas.
Notwithstanding, considering that the United States of America Criminal Law applicable to the crimes, regarding which the extradition was petitioned, have a penalty that could be up to life imprisonment, which is prohibited by Colombian law (article N°34 of the Politics Constitution), it is up to National Government, in case it is decided that the extradition should proceed, to do it on the condition that the penalty will be commuted, as well as to impose the legal provisions that the Government deems appropriate, in order to comply with constitutional prohibition, to avoid that ..... could be potentially prosecuted in connection to any crimes that could have been committed before the criminal offence that motivated the extradition (article N°494, Criminal Procedural Code), and to avoid that ..... could be subjected to any cruel, degrading or inhumane treatment. Equally, the Government should require that part of the sentence that may be imposed in the requesting country, should be considered as partly served, taking into account the time that the Colombian citizen has been deprived of his liberty due to this proceedings.-

I was born and raised in Argentina. In 2000 I married a UK citizen and lived in West Yorkshire (UK) from 2000 until 2010. In 2010, we decided to return to Argentina as a family. We now have two kids, who were born in the UK and currently attend school in Northern Patagonia, where we currently reside.
I have 2 Law Degrees: one obtained in Argentina (6 years-1994) and the other in the UK (4 years-2006). During this period of time, I worked as a mediator and lawyer in relation to family law cases, administrative law claims, road traffic accidents and accidents at work in Buenos Aires, Argentina. In the UK I worked as a legal assistant until I qualified as a solicitor/lawyer and family mediator, working particularly with clinical negligence cases, road traffic accidents, accidents at work, family law, criminal and mental health cases as well as personal injury claims.
This extensive work experience has allowed me to gain vast knowledge in the legal field over the past 26 years.
My professional experience as a lawyer includes important translation projects involving personal injury claims, medical reports, criminal law cases, court orders, interpreting in open court proceedings, legal contracts, property cases-transferring ownership/ leasing contracts-
These different projects took place over a 5-year period, which helped me introduce myself in the translation field. This rewarding experience have motivated me to pursue my career as a translator. I am committed to becoming a translator on a full time basis.
