Source text - English The Memorandum of Understanding (MOU) is entered into on this day---------- between the ECOWAS Competition Authority (ECA) and hereinafter referred to as the "Party" and jointly the "Parties."
PREAMBLE
Whereas the Parties-
RECOGNISING:
The provisions of Article 1 of the Supplementary Act establishing the ECOWAS Competition Authority (The Authority) under which the ECOWAS Competition Community Rules ("the Rules") are promulgated;
The provisions of Article 1 of the Act establishing the Authority and Article 3(1) mandates the Authority to apply the provisions of the Act with regard to trade between Member States and be responsible for promoting competition within the Community Market;
The provisions of Article 3 of the Act which empowers the Authority among others to: review commercial activities with the of ascertaining practices that may distort the efficient operation of the market or economic interests of consumers; investigate anti-competitive practices within the Community Market; eliminate anti-competitive practices; cooperate with competition authorities of Member States; help Member States promote national competition laws and institutions with the objective of harmonization with the Regulations and ensure uniform application of the same; assist Member States in the implementation of its decisions; support to Member States in promoting and protecting consumer welfare; facilitate the exchange of relevant information and expertise;
The need for Member States to give effect to the principles of regional competition Regulations and Rules and to use moderation and self-restraint in the interest of co-operation in the field of anti-competitive business practices;
The desirability of setting standards for procedures by which the regional competition agency can act as a forum for exchange of views, consultations and conciliations on matters relating to anti-competitive practices affecting ECOWAS regional and international trade;
The provisions of Articles 7 of the Regulations which provides for the referral of a merger application for consideration under the Member State's national competition law, and for the CCC to work with the relevant Member States in conducting merger enquiries, respectively;
The provisions of Article 3(f) of the ECOWAS Establishing Rules ("the Rules") which provides for close and constant liaison between the Commission and the competition authorities of the Member States in implementing the obligations arising from the Supplementary Act
The provisions of Article 3(a-d), of the Rules which mandates the Commission to: obtain all necessary information from the Governments and competition authorities of the Member States and from undertakings and association of undertakings; to request competition authorities of Member States to undertake investigations which the Commission deems to be necessary; and for officials of the Commission to carry out investigations in Member States in consultation with the competent authorities of Member States in whose territory the investigation is to be made, respectively;
CONSIDERING:
That Member States should cooperate at regional level in the implementation of their respective national competition and consumer legislation in order to eliminate the harmful effects of anti-competitive practices;
That closer cooperation between the Commission and competition authorities of ECOWAS Member States in the form of notification, exchange of information, coordination of actions., and consultation among Member States should be encouraged;
CONSCIOUS OF:
Article 7(2) (d) of the Rules which mandates the Commission to cooperate with competition authorities of Member States in order to accomplish the mandate of promoting competition in the Community Market.
Now therefore, the Parties agree as follows:
Article 1
Definitions In this MOU
1. "Anti-competitive practice" means any practice coming from a physical or moral person, the object or effect of which is to restrain competition to the disadvantage of the common market’
2. "The Authority" means ECOWAS Competition Regulation Authority established by Article 13 of the Supplementary Act.
3. "Enforcement activities" means any application of competition law by way of investigation or proceedings conducted by the competition authority of a Party.
4. "Member State" means any Member State or Member States of ECOWAS as defined in Article 2, paragraph 2, of the Revised ECOWAS Treaty;
5. 'Regional Dimension" means conduct or practice affecting two or more Member States
6. "Territory" means:
a) For ECOWAS, the territory of any Member State or Member States of ECOWAS as defined in Article 2, paragraph 2, of the Revised ECOWAS Treaty;
b) .…………….
7. "Treaty" means the Treaty establishing the Common Market for ECOWAS
Article 2
Purpose of this MOU
1. The Purpose of this MOU is to promote and facilitate cooperation and coordination between Parties in the harmonization of regional and national laws and policies of Member States and lessen the possibilities or impact of difference.
Article 3
Notification
1. Each Party shall notify the other Party in writing whenever it becomes aware that its enforcement activities may affect interests of the other Party.
2. Enforcement activities as to which notification generally will be appropriate include those that:
a) Are relevant to enforcement activities of the competition authority;
b) Involve anticompetitive activities (other than a merger or acquisition) carried out in whole or significant part of the Common Market;
c) Involve conduct believed to have been required, encouraged or approved by a Patty; or
d) Involve remedies that would, in significant respects, require or prohibit conduct affecting the Common Market.
3. With respect to mergers or acquisitions, each Party will notify the other Party with any significant information that comes to its attention regarding mergers with a regional dimension that it believes is relevant to, or may warrant, enforcement activity by the ECOWAS Competition Regulation Authority
4. Each Party shall notify the other Party whenever it intervenes or otherwise participate in a regulatory or judicial proceeding that does not arise from its enforcement activities, if the issues addressed in the intervention or participation may affect the interests of the other Party.
5. Notifications shall be made as soon as possible and shall include the nature of the activities under investigation and the legal provisions concerned and will be sufficiently detailed to enable the notified Party to make an initial evaluation of the effect of the activities on its territory.
Article 4
Obligations of the Parties
1. The Parties shall take all appropriate measures, whether general or particular, to ensure fulfillment of the obligations arising out of this MOU or resulting from action taken by the Parties under this MOU. The Parties shall facilitate the achievement of the objective of the ECOWAS Treaty and purpose of the MOU and in so doing, shall abstain from taking any measure which could jeopardise the attainment of the objectives of this MOU.
2. The Parties may, but shall not be obliged to, implement in their laws more extensive provisions against restrictive business practices than is required by this MOU, provided that such provisions do not contravene the provisions of this MOU.
3. The Parties shall be free to determine the appropriate method of implementing the provisions of this MOU within their national legal system and practice as long as such method of implementation enhances the efficient and effective attainment of the objectives of this MOU.
Article: 5
Exchange of Information
1. The Parties acknowledge that it is in their interest to cooperate in the detection of anticompetitive practices to the extent compatible with Article 3 of the Supplementary Act and important interests, and within their reasonable available resources. The Parties further acknowledge that it is in their common interest to share information which will facilitate the effective application of the Regulations and promote better understanding of each other’s enforcement policies and activities.
2. Each Party will provide the other Party with any information that comes to its attention regarding anti-competitive business practices that the Party believes is relevant to, or may warrant, enforcement activity by the other Party.
3. The information shared between the Parties shall be used solely for the purpose of implementing this MOU
Article 6
Coordination of Enforcement Activities
1. The Parties shall render assistance to each other in their enforcement activities, to the extent compatible with their respective competition laws and the respective interests, and within the reasonably available resources.
2. The Parties shall cooperate in the enforcement of the competition laws and share information which will facilitate effective implementation of the respective laws.
3. The Parties shall, in this regard, assist each other in the enforcement of the competition laws through:
a) assisting the Party, upon request, in locating and securing evidence and voluntary compliance with requests for information from undertakings or natural persons within the respective jurisdiction
b) assisting the requesting Party with such information within the other Party's possession as the requesting Party may specify as relevant to the enforcement of the Regulations:
c) assisting the Party with any information that comes to the attention of the other Party about anti-competitive activities that may be relevant to or may warrant enforcement activity of the beneficiary Party
4. A Party may notify the other Party and may request that the other Party initiate appropriate enforcement activities. The notification shall be as specific as possible about the nature of the anti-competitive activities and their effects on its territory.
5. Upon receipt of a notification, the notified Party shall advise the notifying Party of its decision. If enforcement activities are initiated, the notified Party shall advise the notifying Party of their outcome and, to the extent possible, of interim developments.
6. The requested Party shall assist in the investigations which the requesting Party considers to be necessary. Such investigations shall be carried out with the assistance of officials of the requesting Party, upon request, in accordance with the respective Party's laws.
7. In cases where the Parties have an interest in pursuing enforcement activities with regard to related situations, they may agree that it is in their mutual interest to coordinate their enforcement activities. In considering whether particular enforcement activities should be coordinated, the Parties shall take account of the following factors, among others:
a) the opportunity to make more efficient use of their resources devoted to the enforcement activities.,
b) the relative abilities of the Parties to obtain information necessary to conduct the enforcement activities;
c) c, the effect of such coordination on the ability of both Parties to achieve the objectives of their enforcement activities; and
d) the possibility of reducing costs incurred by persons subject to the enforcement activities,
8. In any coordination arrangement, each Party shall conduct its enforcement activities expeditiously and, insofar as possible, consistently with the enforcement objectives of their respective competition laws.
9. The Parties shall carry out the investigations expeditiously and consistent with their relevant laws and shall take into account the enforcement objectives of the respective laws and the deadlines stipulated in their respective competition laws.
10. Nothing in this Article limits the discretion of the notified Party under its competition laws and enforcement policies as to whether or not to undertake enforcement activities with respect to the notified anti-competitive activities, or precludes the notifying Party from undertaking enforcement activities with respect to such anticompetitive activities.
Article 7
Avoidance of Conflicts over Enforcement Activities
1. The Parties agree that it is in their common interest to minimize any potentially adverse effects of their enforcement activities in as far as the application of the respective competition laws are concerned.
2. Each Party shall seek, at all stages in its enforcement activities, to take into account the important interests of the other Party in decisions as to whether or not to initiate an investigation or proceeding, the scope of an investigation or proceeding, the nature of the remedies or penalties sought, and in other ways, as appropriate.
3. Any divergent views arising out of the enforcement of the respective competition laws will be addressed in a timely and practicable manner as circumstances may permit.
Article 8
Consultation
1. Each Party agrees to consult promptly with the other Party in response to a request by the other Party for consultations regarding any matter related to this MOU and to attempt to conclude consultations expeditiously with a view to reaching mutually satisfactory conclusions
2. Any request for consultations shall include the reasons thereof and shall state whether procedural time limits or other considerations require that the consultations to be expedited. These consultations shall take place at the appropriate level, which may include consultations between the heads of the competition authorities concerned.
3. In each consultation under paragraph 1, each Party shall take into account the principles of cooperation set forth in this MOU and shall be prepared to explain to the other Party the specific results of its application of those principles to the issue that is the subject of consultation.
4. A Party shall, as soon as it is practical, inform the other Party of any amendment made to its competition laws as well as any change in the enforcement practice of its competition authority that may affect the operation of this MOU. Upon request of either Party, the Parties shall hold consultations in order to assess the specific implications of such amendments or changes for this MOU, and in particular to determine whether this MOU should be amended pursuant to paragraph 3 of Article 14.
5. The Parties shall meet at the appropriate level, at the request of either Party to among others:
a) update each other on their current enforcement efforts and priorities in relation to the competition laws of each Party;
b) exchange views on economic sectors of common interest;
c) discuss policy issues of mutual interest; and
d) discuss other matters of mutual interest relating to the application of the competition laws of each Party.
Article 9
Technical Assistance and Capacity Building
1. The Parties shall pursue technical assistance and capacity building programs through integrated strategies that incorporate economic, social, cultural, environmental and institutional elements that are unique to each Party. In this context and within the framework of development policies and reforms pursued by the Parties; the Parties' cooperation framework and orientation shall take into account the different levels of development as well as the economic needs of each Party and the difficulties faced in meeting their obligations under this MOU.
2. The technical assistance and capacity building programs shall pay systematic attention to institutional aspects and in this context shall support the efforts of either Party to develop and strengthen structures, institutions and procedures that help to enhance the effective enforcement of the competition laws and policies in their respective territories. In this context, the Parties shall:
a) jointly mobilize resources for capacity building aimed at assisting the Parties in the establishment and/or strengthening of the respective competition laws and enforcement agencies.
b) jointly facilitate and develop competition and consumer protection advocacy programmes involving the sensitisation of policy makers, parliamentarians, the judiciary, the business community, and the general public about the role of competition and consumer laws and policies;
c) jointly facilitate the establishment of a mechanism to enable the Parties to take the necessary steps to adopt, strengthen and implement the necessary competition and consumer protection laws in their respective territories.
Article 10
Confidentiality of Information
1. Notwithstanding any other provision of this MOU, neither Party is required to provide information to the other Party if disclosure of that information to the requesting Party is prohibited by the law of the Party possessing the information, or would be incompatible with important interests of the Party possessing the information.
2. Each Party agrees to maintain, to the fullest extent possible, the confidentiality of significant information provided to it in confidence by the other Party under this MOU and to oppose, to the fullest extent possible, any application for disclosure of such information by a third party that is not authorized by the Party that supplied the information.
3. Each party may request that any documents or information submitted be treated as confidential by submitting a reasoned request for confidentiality in the Request for Confidentiality Form…. Parties may consult with the Authority prior to notification regarding such a request. If the Authority determines that disclosure of such information or documents or parts thereof would likely result in disclosure of business secrets, destruction or appreciable diminution of the commercial value of any information or cause serious injury, it will confirm within a reasonable time to the notifying party that the authority will treat such information or documents as confidential and not disclose them publicly. To the extent that the Authority refers to confidential information in its decisions, it will respect the confidential nature of such information by redacting it.
4. No party should make blanket requests for confidential treatment of the application, as the Authority will likely reject such requests. The applicants should make requests relating to specific documents, or identified information contained in documents, and provide the related reasons for the request. Such reasons should be detailed, in particular showing the nature and materiality of the harm that will result from public disclosure in order to convince the Authority of the importance of confidential treatment.
5. The Authority will only disclose information or documents designated as confidential to a Member State or authority of a Member State or any other nation where such Member State or authority is obliged to respect the confidentiality of such information or documents under their national laws. The Authority shall procure that the Member State or authority of a Member State confirms that the information shall be treated with confidentiality.
Article l I
Communication under this MOU
1. Communications under this MOU shall be made in English Language which is the preferred official language of communication of ECOWAS Commission.
2. Communications under this MOU shall be carried out in writing and by direct communication among the Parties.
3. Each Party shall designate a Desk Officer for the purpose of liaison with each other in the enforcement of the respective competition laws.
Article 12
Existing Law
1. Nothing in this MOU shall be interpreted in a manner inconsistent with the existing laws, or as requiring any change in the competition laws of the Parties.
Article 13
Entry into Force, Termination and Review
1. This MOU shall enter into force upon signature by the Parties.
2. This MOU will remain in force in respect of both Parties until 60 days after the date on which any Party notifies the other in writing that it wishes to terminate it.
3. The Parties shall, at any time feasible but not earlier than twenty-four (24) months after entry into force, review this MOU with a view to adopting such further arrangements as may be feasible and desirable to enhance cooperation in the enforcement of the respective competition laws.

Translation - Portuguese O Memorando de Entendimento (MOU) é celebrado, neste dia, _________ entre a Autoridade da Concorrência da CEDEAO (ACC), e a seguir, a designada “Parte” e conjuntamente as “Partes”.
Preâmbulo
Considerando que as Partes-
Reconhecem:
As disposições do Artigo 1 da Lei Complementar que estabelecem a Autoridade da Concorrência da CEDEAO (A Autoridade) sob as quais as Normas de Concorrência Comunitária da CEDEAO (“as Normas”) são promulgadas:
As disposições do Artigo 1 da Lei que estabelece a Autoridade e o Artigo 3 (1) autoriza a Autoridade para executar as disposições da Lei em relação ao comércio entre os Estados Membros e é responsável por promover a competição dentro do Mercado Comunitário:
As disposições do Artigo 3 da Lei que dá poderes à Autoridade dentre outros para: supervisionar as atividades comerciais no que tange determinadas práticas que podem conspurcar as operações eficientes relativas aos interesses econômicos e de mercado dos consumidores; investigar as práticas anticoncorrenciais dentro do Mercado Comunitário, erradicar práticas anticoncorrenciais, cooperar com as autoridades da concorrência dos Estados Membros, auxiliar os Estados Membros a promoverem as normas relativas à concorrência nacional e instituições com o objetivo de harmonização com os Regulamentos e garantir a execução uniforme dessas, auxiliar os Estados Membros na execução das suas decisões, dar o suporte aos Estados Membros na promoção e proteção do bem-estar do consumidor, facilitar o intercâmbio de infomações relevantes e competência.
A necessidade dos Estados Membros para dar efeito dos princípios dos Regulamentos e Normas de competição regional e para usar a moderação e autolimitação do interesse da cooperação na área das práticas comerciais anticoncorrenciais.
A pertinência de fixar normas para procedimentos pelas quais a agência de concorrência regional pode atuar com um fórum com a finalidade do trocar impressões, fazer consultas e conciliações de assuntos relativos às práticas que aferam o comércio refional e internacional da CEDEAO.
As disposições do Artigo 7 dos Regulamentos as quais possibilitam a referência da aplicação da fusão para a consideração de acordo com a legislação da concorrência nacional dos Estados Membros, e para o CCC afim de trabalhar com os Estados Membros relevantes na condução dos pedidos de fusão, respectivamente.
As disposições do artigo 3 (f) das Normas de Estabelecimento da CEDEAO (“as Normas”) que possibilitam uma ligação próxima e constante entre a Comissão e as autoridades de concorrência dos Estados Membros no cumprimento das obrigações advindas desta Lei Complementar.
As disposições do Artigo 3 (a-d) delega poderes e responsabilidades à Comissão para obter toda a infomação necessária dos Governos e às autoridades da concorrência dos Estados Membros e das empresas e das associações de empresas para requerer às autoridades da concorrência dos Estados Membros em cujo território foi criada para realizar inquéritos que a Comissão julga necessários, e para os funcionários da Comissão realizar os inquéritos nos Estados Membros em consulta com as autoridades competentes dos Estados Membros em cujo território a investigação foi realizada respectivamente,
Considerando:
Que os Estados Membros deveriam cooperar no nível regional na execução da competição nacional respectiva e a legislação do consumidor com o objetivo de erradicar os efeitos nocivos das práticas anticoncorrenciais;
Que a cooperação mais próxima entre a Comissão e autoridades da concorrência dos Estados Membros do CEDEAO na forma de notificação, intercâmbio de informações, coordenação de ações e consulta entre os Estados Membros devam ser encorajadas.
Consciente do:
Artigo 7 (2) (d) das Normas que delegam poderes e responsabilidades à Comissão para cooperar com as autoridades da concorrência dos Estados Membros com a finalidade de cumprir o mandato de promover a concorrência no Mercado Comunitário.
Agora as Partes concordam como a seguir:
Artigo 1
Definições neste MOU
1. “Prática anticoncorrencial” significa qualquer prática proveniente de uma pessoa física ou jurídica cujo objeto ou efeito é limitar a concorrência em desfavor do mercado comum.
2. “A Autoridade” significa A Autoridade Reguladora da Concorrência da CEDEAO instaurada pelo Artigo 13 da Lei Complementar.
3. “Atividades de Aplicação” significa qualquer execução da lei da concorrência através do inquérito ou processo conduzidos pela autoridade da concorrência da Parte.
4. “Estado Membro” significa qualquer Estado Membro ou Estados Membros da CEDEAO como disposto no Artigo 2, parágrafo 2, do Tratado da CEDEAO Revisto.
5. “Dimensão Regional” significa a condução ou prática que afetam dois ou mais Estados Membros.
6. “Território” significa:
a) Para a CEDEAO, o território de qualquer Estado Membro ou Estados Membros da CEDEAO como disposto no Artigo 2, parágrafo 2, do Tratado da CEDEAO Revisto.
b) .…………….
7. 13. “Tratado” significa o Tratado que estabelece o Mercado Comum para a CEDEAO.
Artigo 2
Propósito deste MOU
1. O Propósito deste MOU é promover e facilitar a cooperação e coordenação entre as Partes na
harmonização das leis regional e nacional e políticas dos Estados Membros e reduzir as possibilidades ou impacto de diferença.
Artigo 3
Notificação
1. Cada Parte deve notificar a outra Parte por escrito sempre que tomar ciência que as suas atividades de aplicação afetem interesses da outra Parte.
2. As atividades de aplicação cuja notificação geralmente será apropriada incluindo aquelas que:
a) São relevantes para as atividades de aplicação das autoridades de concorrência;
b) Envolvem atividades anticoncorrenciais (além da fusão e da aquisição) realizadas abrangendo a totalidade ou uma parte significante do Mercado Comum;
c) Envolvem conduta supostamente exigida, encorajada ou aprovada por uma Parte; ou
d) Envolvem soluções que, em aspectos significativos, exijam ou proíbam uma conduta que afete o Mercado Comum.
3. No que respeita a fusões ou aquisições, cada Parte notificará a outra Parte com qualquer informação significativa que chegue ao seu conhecimento relativamente a fusões com uma dimensão regional que considere relevante ou que possa justificar a atividade de aplicação pela Autoridade Regulamentadora da Concorrência da CEDEAO.
4. Cada Parte notificará a outra Parte sempre que intervenha ou participe num processo regulamentar ou judicial que não resulte das suas actividades de aplicação, se as questões abordadas na intervenção ou participação puderem afectar os interesses da outra Parte.
5. As notificações serão feitas o mais rapidamente possível e incluirão a natureza das atividades sob inquérito e as disposições legais em causa e serão suficientemente pormenorizadas para permitir à Parte notificada fazer uma avaliação inicial do efeito das atividades no seu território.
Artigo 4
Obrigações de Partes
1. As Partes tomarão todas as medidas adequadas, gerais ou particulares, para assegurar o cumprimento das obrigações decorrentes do presente MOU ou resultantes das medidas tomadas pelas Partes ao abrigo do presente MOU. As Partes facilitarão a realização do objectivo do Tratado da CEDEAO e da finalidade do MOU e, ao fazê-lo, abster-se-ão de tomar qualquer medida susceptível de comprometer a realização dos objectivos do presente MOU.
2. As Partes podem, mas não serão obrigadas a executar nas suas leis disposições mais amplas contra as práticas comerciais restritivas do que as exigidas pelo presente MOU, desde que tais disposições não infrinjam as disposições do presente MOU.
3. As Partes são livres de determinar o método adequado de execução das disposições do presente MOU no âmbito do seu sistema jurídico e práticas nacionais, desde que esse método de execução aumente a realização eficiente e eficaz dos objetivos do presente MOU.
Artigo 5
Troca de Informações
1. As Partes reconhecem que é do seu interesse cooperar na detecção de práticas anticoncorrenciais na medida compatível com o Artigo 3 da Lei Complementar e interesses importantes, e dentro dos seus recursos razoáveis disponíveis. As Partes reconhecem ainda que é do seu interesse comum partilhar informações que facilitem a aplicação efetiva dos Regulamentos e promovam uma melhor compreensão das políticas e atividades de aplicação da lei umas das outras.
2. Cada Parte fornecerá à outra Parte qualquer informação que chegue ao seu conhecimento relativamente a práticas comerciais anticoncorrenciais que a Parte considere ser relevante para, ou possa justificar, a atividade de aplicação da lei pela outra Parte.
3. As informações partilhadas entre as Partes serão utilizadas exclusivamente para efeitos de implementação do presente Memorando de Entendimento.
Artigo 6
Coordenação das Atividades de Aplicação
1. As Partes prestar-se-ão assistência mútua nas suas atividades de aplicação, na medida compatível com as respectivas leis da concorrência e os respectivos interesses, e dentro dos recursos razoavelmente disponíveis.
2. As Partes cooperarão na aplicação das leis da concorrência e partilharão informações que facilitarão a aplicação efectiva das respectivas leis.
3. As Partes prestar-se-ão, a este respeito, assistência mútua na aplicação das leis da concorrência:
a) assistência à Parte, mediante pedido, na localização e obtenção de provas e cumprimento voluntário dos pedidos de informação de empresas ou pessoas singulares dentro da respectiva jurisdição
b) Assistência à Parte requerente com tal informação na posse da outra Parte, uma vez que a Parte requerente pode especificar como relevante para a aplicação dos Regulamentos:
c) Assistência à Parte com qualquer informação que chegue ao conhecimento da outra Parte sobre atividades anticoncorrenciais que possam ser relevantes ou que possam justificar uma actividade de aplicação da lei da Parte beneficiária
4. Uma Parte pode notificar a outra Parte e pode solicitar que a outra Parte inicie as atividades de execução adequadas. A notificação deve ser tão específica quanto possível sobre a natureza das atividades anticoncorrenciais e os seus efeitos no seu território.
5. Após recepção de uma notificação, a Parte notificada informará a Parte notificadora da sua decisão. Se forem iniciadas atividades de aplicação, a Parte notificada avisará a Parte notificadora do seu resultado e, na medida do possível, dos desenvolvimentos provisórios.
6. A Parte requerida prestará assistência nos inquéritos que a Parte requerente considere necessários. Tais inquéritos serão realizados com a assistência de funcionários da Parte requerente, mediante pedido, de acordo com as respectivas leis da Parte.
7. Nos casos em que as Partes tenham interesse em prosseguir as suas atividades de aplicação da lei relativamente a situações afins, podem concordar que é do seu interesse mútuo coordenar as suas atividades de aplicação da lei. Ao considerar se determinadas atividades de aplicação da lei devem ser coordenadas, as Partes devem ter em conta, entre outros, os seguintes fatores:
a) a oportunidade de fazer uma utilização mais eficiente dos seus recursos dedicados às atividades de aplicação,
b) as capacidades relativas das Partes para obter as informações necessárias à realização das atividades de aplicação;
c) o efeito de tal coordenação sobre a capacidade de ambas as Partes para alcançar os objetivos das suas atividades de aplicação da lei; e
d) a possibilidade de reduzir os custos incorridos pelas pessoas sujeitas às atividades de aplicação da lei,
8. Em qualquer acordo de coordenação, cada Parte deverá conduzir as suas atividades de aplicação da lei de forma expedita e, na medida do possível, coerente com os objectivos de aplicação das suas respectivas leis de concorrência.
9. As Partes efetuarão as investigações de forma expedita e coerente com as suas leis pertinentes e terão em conta os objetivos de aplicação das respectivas leis e os prazos estipulados nas suas respectivas leis de concorrência.
10. Nada neste artigo limita a discrição da Parte notificada ao abrigo das suas leis de concorrência e políticas de aplicação quanto à realização ou não de atividades de aplicação da lei relativamente às atividades anticoncorrenciais notificadas, ou impede a Parte notificante de realizar actividades de aplicação da lei relativamente a tais atividades anticoncorrenciais.
Artigo 7
Prevenção de Conflitos sobre Atividades de Aplicação da Lei
1. As Partes concordam que é do seu interesse comum minimizar quaisquer efeitos potencialmente adversos das suas atividades de aplicação da lei no que diz respeito à aplicação das respectivas leis de concorrência.
2. Cada Parte almeja, em todas as fases das suas atividades de aplicação da lei, ter em conta os importantes interesses da outra Parte nas decisões relativas ao início ou não de um inquérito ou processo, ao âmbito de um inquérito ou processo, à natureza dos recursos ou sanções procurados, e de outras formas, conforme o caso.
3. Quaisquer opiniões divergentes resultantes da aplicação das respectivas leis de concorrência serão abordadas de forma atempada e praticável, conforme as circunstâncias o permitam.
Artigo 8
Consulta
1. Cada Parte concorda em consultar rapidamente a outra Parte em resposta a um pedido da outra Parte para consultas sobre qualquer assunto relacionado com o presente MOU e em tentar concluir as consultas rapidamente, com vista a chegar a conclusões mutuamente satisfatórias.
2. Qualquer pedido de consultas deve incluir os respectivos motivos e indicar se os prazos processuais ou outras considerações exigem que as consultas sejam aceleradas. Estas consultas devem realizar-se ao nível adequado, o que pode incluir consultas entre os chefes das autoridades de concorrência em causa.
3. Em cada consulta nos termos do parágrafo 1, cada Parte terá em conta os princípios de cooperação estabelecidos no presente MOU e estará preparada para explicar à outra Parte os resultados específicos da sua aplicação desses princípios à questão que é objecto de consulta.
4. Uma Parte deverá, logo que tal seja prático, informar a outra Parte de qualquer alteração feita às suas leis de concorrência, bem como de qualquer mudança na prática de aplicação da lei da sua autoridade de concorrência que possa afetar o funcionamento do presente MOU. A pedido de qualquer das Partes, as Partes realizarão consultas a fim de avaliar as implicações específicas de tais emendas ou alterações ao presente MOU, e em particular para determinar se o presente MOU deve ser alterado nos termos do parágrafo 3 do artigo 14.
5. As Partes reunir-se-ão ao nível adequado, a pedido de qualquer das Partes, entre outras:
a) atualizar-se mutuamente sobre os seus atuais esforços e prioridades de aplicação em relação às leis de concorrência de cada Parte;
b) trocar pontos de vista sobre sectores económicos de interesse comum;
c) discutir questões políticas de interesse mútuo; e
d) discutir outros assuntos de interesse mútuo relacionados com a aplicação das leis de concorrência de cada Parte.
Artigo 9
Assistência Técnica e Desenvolvimento de Capacidades
1. As Partes prosseguirão programas de assistência técnica e de capacitação através de estratégias integradas que incorporem elementos económicos, sociais, culturais, ambientais e institucionais únicos para cada Parte. Neste contexto e no âmbito das políticas de desenvolvimento e reformas prosseguidas pelas Partes; o quadro e a orientação da cooperação das Partes terão em conta os diferentes níveis de desenvolvimento, bem como as necessidades económicas de cada Parte e as dificuldades enfrentadas no cumprimento das suas obrigações ao abrigo do presente MOU.
2. Os programas de assistência técnica e de capacitação devem prestar atenção sistemática aos aspectos institucionais e, neste contexto, apoiar os esforços de qualquer das Partes para desenvolver e reforçar estruturas, instituições e procedimentos que ajudem a melhorar a aplicação efectiva das leis e políticas de concorrência nos seus respectivos territórios. Neste contexto, as Partes deverão:
a) mobilizar conjuntamente recursos para o desenvolvimento de capacidades destinadas a assistir as Partes no estabelecimento e/ou reforço das respectivas leis de concorrência e agências de aplicação da lei.
b) facilitar e desenvolver conjuntamente programas de defesa da concorrência e da defesa do consumidor envolvendo a sensibilização dos decisores políticos, parlamentares, o poder judicial, a comunidade empresarial e o público em geral sobre o papel da concorrência e das leis e políticas de defesa do consumidor;
c) facilitar conjuntamente o estabelecimento de um mecanismo que permita às Partes tomar as medidas necessárias para adotar, reforçar e implementar as leis de concorrência e de proteção dos consumidores necessárias nos seus respectivos territórios.
Artigo 10
Confidencialidade da informação
1. Não obstante qualquer outra disposição deste MOU, nenhuma das Partes é obrigada a fornecer informações à outra Parte se a divulgação dessas informações à Parte requerente for proibida pela lei da Parte que possui as informações, ou for incompatível com interesses importantes da Parte que possui as informações.
2. Cada Parte concorda em manter, na medida do possível, a confidencialidade de informações significativas fornecidas a ela em confiança pela outra Parte sob este MOU e em opor-se, na medida do possível, a qualquer pedido de divulgação de tais informações por terceiros que não seja autorizado pela Parte que forneceu as informações.
3. 5. Cada parte pode solicitar que quaisquer documentos ou informações submetidos sejam tratados como confidenciais, apresentando um pedido fundamentado de confidencialidade no Formulário de Pedido de Confidencialidade.... As Partes podem consultar a Autoridade antes da notificação de tal pedido. Se a Autoridade determinar que a divulgação de tais informações ou documentos, ou partes dos mesmos, poderá resultar na divulgação de segredos comerciais, destruição ou diminuição apreciável do valor comercial de qualquer informação ou causar danos graves, confirmará dentro de um prazo razoável à parte notificante que a Autoridade tratará tais informações ou documentos como confidenciais e não os divulgará publicamente. Na medida em que a Autoridade se referir a informações confidenciais nas suas decisões, respeitará a natureza confidencial de tais informações, redigindo-as.
4. Nenhuma parte deve fazer pedidos de tratamento confidencial da aplicação, uma vez que a Autoridade provavelmente rejeitará tais pedidos. Os requerentes devem fazer pedidos relacionados com documentos específicos, ou informações identificadas contidas em documentos, e fornecer as razões relacionadas com o pedido. Tais motivos devem ser detalhados, em particular mostrando a natureza e materialidade dos danos que resultarão da divulgação pública, a fim de convencer a Autoridade da importância do tratamento confidencial.
5. 10. A Autoridade apenas divulgará informações ou documentos designados como confidenciais a um Estado Membro ou autoridade de um Estado Membro ou de qualquer outra nação em que esse Estado Membro ou autoridade seja obrigado a respeitar a confidencialidade de tais informações ou documentos ao abrigo da sua legislação nacional. A Autoridade procurará que o Estado Membro ou autoridade de um Estado Membro confirme que as informações serão tratadas com confidencialidade.
Artigo I I
Comunicação sob este MOU
1. As comunicações sob este MOU devem ser feitas em inglês, que é o idioma oficial preferido de comunicação da Comissão da CEDEAO.
2. As comunicações ao abrigo do presente MOU serão efetuadas por escrito e por comunicação direta entre as Partes.
3. Cada Parte designará um responsável geográfico para efeitos de ligação entre si na aplicação das respectivas leis de concorrência.
Artigo 12
Lei em vigor
1. Nada neste MA deve ser interpretado de forma não condizente com as leis em vigor, ou como exigindo qualquer alteração nas leis de concorrência das Partes.
Artigo 13
Entrada em Vigor, Rescisão e Revisão
1. Este Memorando de Entendimento entrará em vigor após assinatura pelas Partes.
2. Este MOU permanecerá em vigor em relação a ambas as Partes até 60 dias após a data em que qualquer Parte notifique a outra por escrito que deseja terminá-lo.
3. As Partes deverão, a qualquer momento viável mas não antes de vinte e quatro (24) meses após a entrada em vigor, rever este Memorando de Entendimento com vistas à adoção de outras disposições que possam ser viáveis e desejáveis para melhorar a cooperação na aplicação das respectivas leis de concorrência.

1. The above -mentioned Communication was considered at the 66th Ordinary Session of the Commission on Admissibility.
2. The Commission has reached a consensus that the Admissibility requirements under Articles 56 (2), (4), (5), (6) and (7) have been satisfied.
3. Regarding Article 56 (1), which was the contentious Article that required further scrutiny, Commissioners expressed reservation on the Authors of the Communication, as well as the Victims involved. Specifically, they noted that the “Robert F. Kennedy Human Rights” co-representing the Complainant, is not an African NGO, not based in Africa, and therefore does not have a standing (Locus Standi) before the Commission.
4. The Commission also noted that the Communication is filed on behalf of the entire “Ethiopian Electorate” who cannot be identified, therefore raising questions relating to the Actio Popularis principle and identification of Victims.
5. In light of the above, the Commission was of the view that the case file should be revisited to firmly establish that Article 56(1) has been met before taking a final decision on the Communication. The Commissioner Rapporteur was requested to work with the Legal Officer to review Article 56(1) and revert only on this issue for consideration.
6. The review of Article 56 (1) has been done and the revised submissions can be found from paragraphs 49 to 66 of the draft Decision.
7. This Brief however, provides a more convincing detailed research on the issues for the Commission’s consideration and most of the arguments have been imported into the draft decision under the above referenced paragraphs.
Locus Standi
8. Locus standi, according to Black’s Law Dictionary, refers to the right to bring an action or to be heard in a given forum. It is therefore a right to appear as a party before a judicial tribunal or a quasi-judicial body, and it is also “an absolute precondition of all legal actions.”
9. The African Charter on Human and Peoples’ Rights (the African Charter) does not expressly deal with the issue of standing before the Commission. Since the language of the African Charter does not expressly state the locus standi of the Complainants filing Complaints pursuant to Article 55, the latter has been able to do so by adopting the actio popularis approach, ‘which allows everyone access to the Commission.’ By this approach, victims of human rights violations, non-victim individuals, groups and NGOs are allowed to submit Communications to the Commission. The Commission has hitherto demonstrated great flexibility in the interpretation and application of the principle of locus standi, different from the United Nations Treaty Monitoring Bodies, the European Court of Human Rights, and the Inter-American Commission on Human Rights (IACHR).
10. In the Inter-American Human Rights System, class actions are recognized without authorization from the victims. Article 44 of the American Convention which sets forth the competence of the IACHR establishes that, “Any person or group of persons, or any nongovernmental entity legally recognised in one or more member states of the Organisation may lodge petitions containing complaints of violations of the Convention by a State Party before the Commission…..”
11. The IACHR also recognises standing of NGOs without recognition by Member States. In Castillo Petruzzi et al. v Peru, the Court held that, for human rights violations to be effectively addressed, “Certain formalities (are) excused, provided there is suitable balance between justice and legal certainty.”
12. The Commission on its part, has demonstrated its willingness to continue using the actio popularis approach in its jurisprudence. For instance, in World Organisation Against Torture, Lawyers’ Committee for Human Rights, Union Interafricaine des Droits de l’homme, Les Temoins de Jehovah (WTOAT) v Zaire, the Commission held that, “The Charter is distinctive in that, while it requires that Communications indicate their authors …they do not necessarily have to be the victims or members of their families.” The same position was held by the Commission in Krishna Achutan on behalf of Aleke Banda), Amnesty International (on behalf of Orton, and Vera Chirwa) v Malawi.
13. The Commission has therefore adopted a very broad approach on locus standi, extending access to victims, non-victims and NGOs. Thus, even though the African Charter does not expressly deal with this question in Article 55 of the African Charter, anyone who files on behalf of the victim becomes the author of the ‘other Communications.’
14. Furthermore, in its jurisprudence, the Commission has shown that the authors of a Communication need not be victims, their families or persons authorised by them. In addition, they need not be citizens or residents of a State Party to the African Charter, or located in any African Union Member State. This was the position in Maria Baes v. Zaire, where a Complaint was submitted by a Danish national on behalf of her colleague, Dr. S.N Kandola of the University of Kinshasa in Zaire.
15. Other examples include: Annette Pagnoule(on behalf of Aboulaye Mazou) v Cameroon, submitted by Ms. Pagnoulle of Amnesty International; and Curtis Francis Doebbler v Sudan, filed by an American citizen.
16. Indeed, the Commission has entertained Communications from international NGOs such as; Amnesty International, Interights, International Commission of Jurists, International PEN, and the Lawyers’ Committee for Human Rights, all based outside the continent. The Commission therefore continues to entertain Communications addressed to it by individuals and NGOs based in Africa or elsewhere, whether on their own behalf or on behalf of others, and their location or nationality has always not been a hindrance to locus standi, as long as the Communication reveals prima facie violation of the African Charter by a State Party.
17. In the present Communication, even though Robert F. Kennedy Human Rights is outside the continent, based on the Commission’s jurisprudence several foreign NGOs have successfully filed Complaints before the Commission. It is therefore established that Robert F. Kennedy Human Rights has locus standi before the Commission.
Actio Popularis and Identification of Victims
18. The present Communication is filed on behalf of the entire Ethiopian Electorate, and does not specifically identify the Victims because it is filed as a class action. In other words, on the basis of the actio popularis Principle. According to the Commission’s jurisprudence, the Commission has seized and admitted Communications submitted on the grounds of actio popularis without the requirement of identifying the victims. Indeed the Commission has regularly admitted cases, found violations of the African Charter, and made recommendations for remedies with respect to entire populations of individuals, including Legal Resources Foundation v Zambia , Kevin Mgwanga Gunme et al v Cameroon, The Nubian Community in Kenya v The Republic of Kenya, and Open Society Justice Initiative v. Côte d’Ivoire, amongst others.
19. As stated in the summary of facts of the Communication, the Ethiopian Government’s systematic crackdown on media, public demonstrations, human rights organizations, and political opponents in the 2015 electoral period, unlawfully restricted civic space in the country, including the rights to freedom of assembly, freedom of association, and freedom of expression. Each unlawful restriction to civic space, as well as the broader chilling effect produced by this systematic pattern of repression prevented the free flow of information, public debate and dialogue from taking place in the 2015 electoral period. As a result no Ethiopian was able to fully exercise their right to vote as protected under Articles 9 and 13(1) of the African Charter
20. Due to the very nature of the violations alleged in this Communication, the facts equally apply to every single Ethiopian citizen who was denied the free flow of information, public debate and dialogue during the 2015 electoral period, regardless of their political affiliation or proclivity to exercise their vote or not.
21. Furthermore, in Malawi African Association v. Mauritania, the Commission recognized that in a situation of grave and massive violations, it may be impossible to give a complete list of names of all the victims. The Commission specifically noted that ….”Article 56(1) demands simply that Communications should indicate the names of those submitting and not those of all the victims of alleged violations.”
22. In Kevin Mgwanga Gunme et al v Cameroon , the Communication was filed on behalf of the people of Southern Cameroon. The Commission noted that “Article 56.1 of the African Charter requires a Communication to indicate its authors and not the victims of the violations.”
23. Additionally, in Lawyers for Human Rights (Swaziland) v The Kingdom of Swaziland the Commission again found the Communication brought by an NGO to be admissible and that the State had violated the African Charter with respect to the entire population of a country. Specifically the Commission acknowledged that the “...Complainant avers that the Swazi people in particular, political parties in general, and their members who desire to put in place a Government of their choice through a multi-party system, have since 12 April 1973 suffered and continue to suffer irreparable harm as a result of the denial of free political activity and the banning of political parties to lawfully and effectively contest elections.”
24. The Commission also took the same position regarding Communications submitted against other State Parties, including Benin, Zaïre and Rwanda, where the Commission focused more on the nature of grave/mass violations rather than identification of the Victims involved.
25. This brings us to the criteria for determining whether the Victims should be identified or not. The first criteria proposed by the Secretariat, and which was endorsed by the Working Group on Communications during its Meeting of 8th September 2020 is that the violations alleged by the Victims should be grave and massive in nature to pass the test of non-identification. It should be noted that the draft decision under Article 56(5), has already established that the violations were grave and massive, and therefore the first criteria has been met.
26. The second criteria proposed pertains to the nature of the prayers and compensation. Giving that the Victims need to be identified to enable the Respondent State to be able to compensate the Victims, in the present Communication, the Secretariat notes that the Complainants are not seeking material compensation for the entire electorate of Ethiopia. They instead focus mainly on reparations of satisfaction and guarantees of non-repetition, including:
i. Recognition of a violation of Articles 1 and 13(1) of the African Charter;
ii. Amendment of legislations that are incompatible with the African Charter and have served to unduly restrict the right of all Ethiopians to effectively participate in government; and
iii. That the Respondent State undertakes institutional and practical reforms to open up civic space in advance of the [2021] elections to facilitate the free flow of information, public debate, and dialogue.
27. In view of the forgoing, it is the Secretariat’s view that the Victims do not need to be identified in this Communication and therefore Article 56(1) has been met.
Translation - Portuguese Nota informativa sobre a Comunicação 599/16 - Conselho dos Direitos Humanos da Etiópia (Representado por F. Kennedy Human Rights e IHRDA) c. a República Federal Democrática da Etiópia
1. A Comunicação acima mencionada foi examinada durante a 66ª Sessão Ordinária da Comissão no que respeita à sua Admissibilidade.
2. A Comissão chegou a um consenso de que os requisitos de Admissibilidade nos termos dos Artigos 56 (2), (4), (5), (6) e (7) foram satisfeitos.
3. Em relação ao Artigo 56 (1), que era o artigo controverso que exigia uma análise mais aprofundada, os Comissários expressaram reservas sobre os Autores da Comunicação, bem como sobre as Vítimas envolvidas. Mais especificamente, observaram que o "Robert F. Kennedy Human Rights", co-representando o Queixoso, não é uma ONG africana, não tem sede em África e, por conseguinte, não têm legitimidade de apresentar uma queixa (Locus Standi) perante a Comissão.
4. A Comissão registou igualmente que a Comunicação é apresentada em nome de todo o "Eleitorado Etíope" que não pode ser identificado, levantando assim questões relacionadas com o princípio Actio Popularis e a identificação das Vítimas.
5. À luz do acima exposto, a Comissão considerou que a peça processual deveria ser reexaminado a fim de estabelecer claramente que o disposto no Artigo 56 (1) foi cumprido antes da tomada de uma decisão final sobre a Comunicação. Foi solicitado ao Comissário Relator que trabalhasse com o Responsável Jurídico para analisar o Artigo 56 (1) e que voltasse a debruçar-se apenas sobre a questão para consideração.
6. A análise do Artigo 56 (1) foi feita e as observações revistas podem ser encontradas nos parágrafos 49 a 66 do projecto de decisão.
7. Esta exposição sumária, no entanto, fornece uma investigação detalhada mais convincente sobre as questões para a apreciação da Comissão e, ao abrigo dos parágrafos acima referidos, a maioria dos argumentos foi incorporada no projecto de decisão.
Locus Standi
8. Locus standi, segundo o Black's Law Dictionary, refere-se ao direito de intentar uma acção ou de ser ouvido num determinado tribunal. É, por conseguinte, um direito de comparecer como parte perante um tribunal judicial ou um órgão quase-judicial , e é também "uma condição imprescindível de todas as acções legais" .
9. The A Carta Africana dos Direitos Humanos e dos Povos (a Carta Africana) não trata expressamente da questão da capacidade judiciária perante a Comissão. Visto que a língua da Carta Africana não declara expressamente o locus standi dos Queixosos que apresentam Queixas nos termos do Artigo 55, estes últimos puderam fazê-lo através da adopção da abordagem actio popularis, "que dá a todos acesso à Comissão". Através desta abordagem, as vítimas de violações dos direitos humanos, indivíduos, grupos e ONG não-vítimas são autorizados a apresentar comunicações à Comissão. Até agora, a Comissão tem até agora demonstrado grande flexibilidade na interpretação e aplicação do princípio do locus standi, diferente dos Organismos de Controlo do Tratado das Nações Unidas, do Tribunal Europeu dos Direitos Humanos e da Comissão Interamericana dos Direitos Humanos (CIDH).
10. No Sistema Interamericano de Direitos Humanos, as acções colectivas são reconhecidas sem autorização das vítimas. O Artigo 44 da Convenção Americana, que estabelece a competência da CIDH, estipula que "Qualquer pessoa ou grupo de pessoas, ou qualquer entidade não governamental legalmente reconhecida num ou mais Estados-membros da Organização, pode apresentar perante a Comissão petições contendo queixas relativas a violações da Convenção cometidas por um Estado Parte...".
11. A CIDH reconhece também a capacidade judiciária das ONG sem reconhecimento por parte dos Estados-membros. Em Castillo Petruzzi et al. c. Peru , o Tribunal decidiu que, para que as violações dos direitos humanos sejam efectivamente tratadas, "certas formalidades (são) isentas, desde que haja um equilíbrio adequado entre justiça e segurança jurídica".
12. A Comissão, pela sua parte, demonstrou a sua vontade de continuar a utilizar a abordagem actio popularis na sua jurisprudência. Por exemplo, em Organização Mundial contra a Tortura, Lawyers’ Committee for Human Rights, Union Interafricaine des Droits de l'Homme, As Testemunhas de Jeová (WTOAT) c. Zaire , a Comissão conclui que "A Carta é distinta na medida em que, embora exija que as Comunicações indiquem os seus autores... eles não têm necessariamente de ser as vítimas ou os membros das suas famílias". A mesma posição foi defendida pela Comissão em Krishna Achutan (em nome de Aleke Banda), Amnistia Internacional (em nome de Orton e Vera Chirwa) c. Maláui .
13. A Comissão adoptou uma abordagem muito ampla sobre o locus standi, alargando o acesso às vítimas, não-vítimas e ONG. Assim, apesar de a Carta Africana não tratar expressamente desta questão no seu Artigo 55, qualquer pessoa que apresente uma queixa em nome da vítima torna-se o autor das "outras Comunicações".
14. Além disso, na sua jurisprudência, a Comissão demonstrou que os autores de uma Comunicação não precisam de ser vítimas, as suas famílias ou pessoas por elas autorizadas. Além disso, os autores de uma Comunicação não precisam de ser cidadãos ou residentes de um Estado Parte na Carta Africana, ou localizados em qualquer Estado-membro da União Africana. Esta foi a posição aceite em Maria Baes c. Zaire , em que uma Queixa foi apresentada por um cidadão dinamarquês em nome da sua colega, Dr. S.N Kandola da Universidade de Kinshasa no Zaire.
15. Outros exemplos incluem: Annette Pagnoule (em nome de Aboulaye Mazou) c. Camarões , apresentada pela Sra. Pagnoulle da Amnistia Internacional, e Curtis Francis Doebbler c. Sudão , apresentada por um cidadão americano.
16. Na verdade, a Comissão recebeu Comunicações provenientes de ONG internacionais, tais como da Amnistia Internacional, Interights, Comissão Internacional de Juristas, International PEN e Lawyers’ Committee for Human Rights, todas sediadas fora do continente. Por conseguinte, a Comissão continua a receber Comunicações que lhe são enviadas por indivíduos e ONG sediadas em África ou noutros lugares, quer em seu próprio nome ou em nome de outros, e a sua localização ou nacionalidade nem sempre tem sido um obstáculo ao locus standi, desde que a Comunicação revele a violação prima facie da Carta Africana por um Estado Parte.
17. Na presente comunicação, embora Robert F. Kennedy Human Rights se encontre fora do continente, com base na jurisprudência da Comissão, várias ONG estrangeiras apresentaram Queixas à Comissão com sucesso. Está portanto estabelecido que Robert F. Kennedy Human Rights tem locus standi perante a Comissão.
Actio Popularis e Identificação das Vítimas
18. A presente Comunicação é apresentada em nome de todo o Eleitorado Etíope e não identifica especificamente as Vítimas porque é apresentada como uma acção colectiva. Por outras palavras, com base no Princípio actio popularis. De acordo com a sua jurisprudência, a Comissão aceitou as Comunicações apresentadas com base no actio popularis sem a exigência de identificação das vítimas. Com efeito, a Comissão tem regularmente admitido casos, encontrado violações da Carta Africana e emitido recomendações de soluções em relação a populações inteiras de indivíduos, nomeadamente Legal Resources Foundation c. Zâmbia , Kevin Mgwanga Gunme et al c. Camarões , The Nubian Community in Kenya v República do Quénia , e Open Society Justice Initiative v. Côte d'Ivoire , entre outros.
19. Tal como se afirma no resumo dos factos da Comunicação, a repressão sistemática do Governo da Etiópia contra os media, as manifestações públicas, as organizações de direitos humanos e os opositores políticos no período eleitoral de 2015, restringiu ilegalmente o espaço cívico no país, nomeadamente os direitos à liberdade de reunião, à liberdade de associação e à liberdade de expressão. Cada restrição ilegal do espaço cívico, bem como o efeito dissuasor mais amplo provocado por este padrão sistemático de repressão impediram a livre circulação da informação, o debate público e o diálogo no período eleitoral de 2015. Em resultado deste facto, nenhum etíope pôde exercer plenamente o seu direito de voto tal como protegido pelo Artigo 9 e 13 (1) da Carta Africana.
20. Dada a verdadeira natureza das violações alegadas na presente Comunicação, os factos aplicam-se igualmente a todos os cidadãos etíopes a quem foi negado a livre circulação da informação, os debates públicos e o diálogo político durante o período eleitoral de 2015, independentemente da sua filiação política ou propensão a exercer ou não o seu voto.
21. Além disso, no caso Malawi African Association et al c. Mauritânia , a Comissão reconheceu que, numa situação de violações graves e maciças, pode ser impossível fornecer uma lista completa dos nomes de todas as vítimas. A Comissão observou especificamente que.... "O Artigo 56 (1) exige simplesmente que as Comunicações indiquem os nomes das pessoas que apresentam e não os de todas as vítimas de alegadas violações".
22. Em Kevin Mgwanga Gunme et al c. Camarões , a Comunicação foi apresentada em nome da população dos Camarões do Sul. A Comissão observou que "o Artigo 56 (1) da Carta Africana exige que uma Comunicação indique os seus autores e não as vítimas das violações".
23. Além disso, em Lawyers for Human Rights (Suazilândia) c. Reino da Suazilândia , a Comissão voltou a considerar admissível a Comunicação apresentada por uma ONG e que o Estado tinha violado a Carta Africana no que diz respeito a toda a população de um país. Especificamente, a Comissão reconheceu que "...o Queixoso avança que o povo suázi em particular, os partidos políticos em geral, e os seus membros que desejam instituir um Governo à sua escolha através de um sistema multipartidário, sofreram e continuam a sofrer danos irreparáveis desde 12 de abril de 1973 em resultado da negação da livre actividade política e da proibição dos partidos políticos de concorrerem legal e efectivamente às eleições".
24. A Comissão também tomou a mesma posição relativamente às Comunicações apresentadas contra outros Estados Partes, nomeadamente o Benim, o Zaire e o Ruanda, em que a Comissão se centrou mais na natureza das violações graves/maciças e não na identificação das Vítimas envolvidas.
25. Isto leva-nos aos critérios que permitem determinar se as Vítimas devem ser identificadas ou não. O primeiro critério proposto pelo Secretariado, e que foi aprovado pelo Grupo de Trabalho sobre as Comunicações durante a sua Reunião de 08 de setembro de 2020, exige que as alegadas violações denunciadas pelas Vítimas devem ser de natureza grave e maciça para passarem no teste da não-identificação. É de salientar que o projecto de decisão ao abrigo do Artigo 56 (5), já estabeleceu que as violações eram graves e maciças e, por conseguinte, o primeiro critério foi satisfeito.
26. O segundo critério proposto diz respeito ao carácter das orações e da reparação. Dado que a identificação das Vítimas é necessária para permitir que o Estado Demandado possa indemnizar as Vítimas, o Secretariado observa, na presente Comunicação, que os Queixosos não estão a procurar uma reparação material para todo o Eleitorado Etíope. Em vez disso, centram-se principalmente em indemnizações de satisfação e garantias de não repetição, nomeadamente:
i. O reconhecimento de uma violação dos Artigos 1 e 13 (1) da Carta Africana;
ii. Alterações de leis incompatíveis com a Carta Africana e que contribuíram para restringir indevidamente o direito de todos os etíopes a participarem efectivamente no Governo; e
iii. De que o Estado Demandado empreenderá um conjunto de reformas institucionais e práticas para abrir o espaço cívico antes das eleições (de 2021) para facilitar a livre circulação da informação, os debates públicos e o diálogo político.
27. Tendo em conta a renúncia, o Secretariado considera que as Vítimas não precisam de ser identificadas na presente Comunicação e, por conseguinte, as disposições do Artigo 56 (1) foram satisfeitas.
English to Portuguese: 50 Million African Women Speak (50MAWSP) Communication Strategy

It is clear that one person or let alone the Content Managers will not be able to manage 50MAWSP communications efforts alone.
COMESA’s, EAC’s and ECOWAS’s communications units require a range of different skills. These are listed in the diagram below, but broadly include four categories of specialist skills: outreach, content, technology and design.
It’s almost impossible to find all these skills (outreach, content, technology and design) in all one Content Manager or let alone one Communications Unit. So, the project or Communications Units of the implementing RECs need to have a budget for commissioning support and the strength of character to manage a series of external suppliers and ensure quality and timeliness. This should be reviewed, as there is just as much risk of wasting money on repeated and costly external suppliers and consultants as there is of internal ‘deadwood’. The balance between in-house capacity and external expertise is a difficult one.
For 50MAWSP, it will consider value for money based on the 4 ‘e’s:
- Economy (how cheap can we shop?)
- Efficiency (how likely are they to get it right first time?)
- Effectiveness (how well can they do what we’re asking?)
- Equity (running through each of the three ‘e’s above, does the way the provider will deliver contribute to the 50MAWSP goals and objectives?)
Whether commissioning a large-scale one-off product (like a website or portal redevelopment) or a small-scale service (like media relations from a local PR agency), using effective commissioning principles will help:
• Start with a clear brief (or develop one based on a proposal)
• Ask for and listen to feedback from experts in their field
• Be clear about which facts need to be used but allow creative professionals the space to express their creativity – don’t micromanage
• Give feedback sooner rather than later on early drafts (e.g. logos), wireframes, storyboards and so on
• Take responsibility to collate feedback internally and reconcile conflicting feedback – ideally just one person in the PIU should speak to the consultant the project is commissioning (to ensure clarity)
• At the end of each interaction (meeting, call or email) be clear about who does what next – is the ball in your court (perhaps to draft website content) or their court (perhaps to upload website content onto mocked up pages)?
• Be clear about the ultimate deadline from the get-go but also set interim deadlines (sometimes called ‘critical path timelines’) to keep projects on track and keep commissioned providers motivated
• Pay invoices in a timely fashion
Overall, 50MAWSP heads also need to play a key role. If the project adopts an ‘orchestra approach’ to communications, project heads must see communications not as an ‘add on’ but a central part of their work. They need to view communications as a strategic management function. Where training is needed to help them fulfil this role, it should be provided, if necessary, by external expert consultants.
For 50MAWSP to communicate using the ‘orchestra approach’ the PIU need to understand the expectations of them, buy-into the reason for playing an active role in the project communications and must have the skills they need to do so. These skills vary from: letter writing/correspondence; technical writing skills, including grammar; story-telling and presentation; public speaking to producing high quality digital content, including using social media (especially Twitter); writing blogs and articles; giving broadcast interviews (for audio/visual content).
To gain confidence in these skills, PIU need to participate in workshops and have ongoing opportunities for practice and feedback, rather than simply be told about techniques or theory.

É claro que uma pessoa ou, muito menos, os gestores de conteúdos não poderão gerir os esforços de comunicação do 50MAWSP sozinhos.
As unidades de comunicação do COMESA, EAC e ECOWAS exigem uma variedade de habilidades diferentes. Eles estão listados no diagrama abaixo, mas incluem amplamente quatro categorias de habilidades de especialistas: divulgação, conteúdo, tecnologia e design.

O equilíbrio entre capacidade interna e expertise externa é difícil.
Para o 50MAWSP, ele considerará o valor pelo dinheiro com base nos "4 es":
- Economia (quão barato podemos comprar?)
- Eficiência (qual a probabilidade de acertarem na primeira vez?)
- Eficácia (quão bem eles podem fazer o que estamos a perguntar?)
- Equidade (percorrendo cada um dos três "e's acima, a maneira como o provedor fornecerá contribuirá para as metas e os objetivos do 50MAWSP?)
Se o comissionamento de um produto único de grande escala (como um site ou redesenvolvimento de um portal) ou um serviço de pequena escala (como relações com a rede social de uma agência de RP local), usando princípios efetivos de comissionamento, ajudará:
• Comece com um resumo claro (ou desenvolva um baseado em uma proposta)
• Peça e ouça comentários de especialistas das suas áreas
• Seja claro sobre quais os factos que precisam de ser usados, mas permita que os profissionais criativos do espaço expressem a sua criatividade - não microgerencie
• Dar feedback, mais cedo ou mais tarde, sobre os primeiros rascunhos (por exemplo, logotipos), wireframes, roteiros e assim por diante
• Assuma a responsabilidade de coletar feedback internamente e conciliar feedback conflitante - idealmente, apenas uma pessoa na PIU deve falar com o consultor que o projeto é comissionando (para garantir clareza)
• No final de cada interação (reunião, telefonema ou e-mail) fique claro sobre quem faz o próximo passo - é a tua responsabilidade (talvez para redigir o conteúdo do site) ou a dos outros membros (talvez para enviar conteúdo do site para páginas simuladas)?
• Seja claro sobre o prazo final desde o início, mas também defina prazos intermediários (às vezes chamados de "cronogramas do caminho crítico") para manter os projetos em andamento e manter os provedores comissionados motivados
• Pagar faturas em tempo hábil
• Para que o 50MAWSP se comunique usando a abordagem de orquestra, a PIU precisa entender as expectativas do público alvo, acreditar no motivo de desempenhar um papel ativo nas comunicações do projeto e ter as habilidades necessárias para isso. Essas habilidades variam de: carta escrita / correspondência; habilidades de redação técnica, incluindo gramática; contação de histórias e apresentação; falar em público para produzir conteúdo digital de alta qualidade, incluindo o uso de redes sociais (especialmente o Twitter); escrevendo blogues e artigos; dando entrevistas de transmissão (para conteúdo de áudio / visual).
Para ganhar confiança nessas habilidades, as PIUs precisam de participar em oficinas e ter oportunidades contínuas de prática e feedback, em vez de simplesmente serem informadas sobre técnicas ou teoria.
