Source text - English 지식 재산권법과 독점규제 및 공정거래에 관한 법률(이하 ‘공정거래법’이라 한다)은 서로 양립하기 어렵다고 생각될 수 있다. 지식재산권, 그 중에서도 특허권은 산업발전을 촉진하는 수단으로 새로운 발명을 한 자로 하여금 발명을 공개하게 하고 그에 대한 보상으로 일정한 기간 동안 등록된 청구범위 내에서 발명을 독점적․배타적으로 소유 또는 이용할 수 있는 권리를 의미하는데, 공정거래법은 원래 이러한 ‘독점’을 규제하기 위하여 만들어진 법이기 때문이다.
그러나 근래에 들어서는 양자가 서로 충돌하는 측면을 강조하기 보다는, 양자가 모두 새롭고 더 발전된 기술과 제품 등을 보다 저렴한 가격에 소비자들에게 공급하려는 측면이 있음을 주목하여 지식재산권법과 공정거래법의 목적이 모두 소비자 후생의 증대에 있다는 인식이 점차 확대되고 있다.
Translation - Korean Intellectual Property Right Act and the Acts about monopoly regulation and fair trade (Hereinafter referred to as the Fair Trade Act), may be considered incompatible.
IPR Act, in particular patent rights, which means the right of a person who invented a new invention for promoting industrial development to disclose the invention and to own or use the invention monopolistically or exclusively within the scope of claims registered for a certain period of time as a reward for it, but the Fair Trade Act was originally designed to regulate these monopolies.
However, instead of emphasizing the conflicting aspects, people have started to pay attention to the fact that these two acts were both trying to supply consumers with new and more advanced technologies and products at a lower cost in recent years, it is increasingly recognized that the IPR Act and the Fair Trade Act are both aiming at improving consumer welfare.
