(1) 구체적 인간
민법에서의 인간은 합리적이고 이성적인 판단을 할 수 있는 인간을 기본으로 하고 있다. 따라서 합리적인 이성을 가진 자가 자신의 의사에 기하여 타인과 법률관계를 형성한 경우에 이를 최대한 존중해 주는 사적 자치의 원리가 민법의 최고 기본원리이다. 이와 같은 민법상의 추상적인 인간과 비교하여 소비자는 구체적인 인간이다. 사업자와의 거래에 있어서 소비자는 이성적인 판단하에 구매의사를 결정하는 것이 아니라 충동적으로 구매의사를 결정할 수 있다. 특히, 사업자가 제공하는 정보에 의존하여 구매의사를 결정하는 경우가 다수이며, 양자의 지위가 상이한 상태에서 소비자가 합리적인 판단하에 구매의사를 결정한다는 것은 형식적인 표현이다. | Translation - English 1) Characteristics of Consumers
(1) Irreasonable person
Civil Act is based on the premise that humans have capacity to make a reasonable and rational decision. When a rational person enters into a legal relation based on his/her intent with another person, this therefore shall be respected to the fullest, which is the principle of private autonomy that is the most basic principle of Civil Act. Compared to reasonable persons under Civil Act, consumers are considered irreasonable humans. As for transactions with enterprisers, consumers may not make a rational purchase decision but make an impulsive one. In particular, consumers make most purchase decisions relying on the information provided by enterprisers. To the extent that the two parties differ in their respective power, the idea that consumers make a reasonable purchase decision is a token expression. |
