Source text - English Quick research on the status of a Judge of the African Court who resigns and joins the ICC
I. Background
1. This research was requested by the Court following the election of Justice Bossa to the International Criminal Court (ICC) in December, 2017. Justice Bossa officially resigned as Judge of the Court on 26 February, 2018 and will be sworn in as Judge of the ICC on 9 March, 2018.
2. Prior to her election and subsequent resignation, Justice Bossa sat on the bench for both the public hearing and deliberations with respect to a number of cases, includingAnudoOchiengAnudo v. Tanzania.
3. When considering the Anudo matter during its 48thOrdinary Session, the Court wanted to determine whether following her resignation from the Court and subsequent swearing-in as Judge of the ICC, the name of Justice Bossa should continue to feature in the composition of the bench for that matter and whether indeed, she should ‘continue sitting’ on the matter.
II. Relevant provisions
4. Article 18 of the Protocol establishing the Court provides that “the position of judge of the Court is incompatible with any activity that mightinterfere with the independence or impartiality of such a judge or the demands of the office as determined in the Rules of Procedure of the Court”.
5. Rule 2 of the Rules of Courtprovides that:
(1) The newly elected Judges will assume duty on the first day of the firstordinary session following theirelection. Before assuming duty, the electedJudges shall take an oath of office or make a declaration in accordance withRule 4 of these Rules”.
(2) Notwithstanding the foregoing sub-rule, outgoing Members of the Courtshall remain in office until such time as they are replaced; after they arereplaced, they shall continue to sit until the completion of all stages of anycase in which the Court has met for an oral hearing prior to the date ofreplacement”.
6. Article 40 of the Statute of the International Criminal Court provides as follows:
1. The judges shall be independent in the performance of their functions.
2. Judges shall not engage in any activity which is likely to interfere with their judicial functions or to affect confidence in their independence.
3. Judges required to serve on a full-time basis at the seat of the Court shall not engage in any other occupation of a professional nature.
4. Any question regarding the application of paragraphs 2 and 3 shall be decided by an absolute majority of the judges. Where any such question concerns an individual judge, that judge shall not take part in the decision.
III. Registry’s analysis of the situation
7. A close reading of Article 18 of the Protocol reveals two main elements, that is, the position of judge of the Court is incompatible with any activity that might interfere with:
i. the independence or impartiality of such a judge; or
ii. the demands of the office[of Judge of the Court].
8. The questions to be addressed here are the following:
a. Does being a Judge of the ICC, interferes with her independence as Judge of the African Court?
9. Technically, it is not correct to assume that being a Judge of the ICC would interfere with one’s independence as Judge of the African Court at the same time. This may only arise where there is conflict of interest, for instance, where the judge is sitting on a matter that could have a potential to affect the relationship or jurisdictions of both or either of the courts. So, in this regard, the first question must be answered in the negative.
b. Does being a Judge of the ICC, interferes with the demands of her office (that is, Judge of the African Court)?
10. Justice Bossa worked on a part-time basis for the African Court, and was in a full time employment prior to being elected to the ICC.
11. Rule 2(2) of the Rules of Court provides that “notwithstanding the [sub-rule 2(1)], outgoing Members of the Court shall remain in office until such time as they are replaced; after they are replaced, they shall continue to sit until the completion of all stages of any case in which the Court has met for an oral hearing prior to the date of replacement”. Sub-rule, 2(1) provides for its part that “the newly elected Judges will assume duty on the first day of the first ordinary session following their election…”.
12. A joint reading of the two sub-rules presupposes that Rule 2 contemplated a situation where the term of office of a judge runs its natural course, be it one or two terms. It did not contemplate a situation of resignation, otherwise, sub-rule 2 would not provide that ‘outgoing members of the court shall remain in office until such time as they are replaced…’. A judge who has resigned, especially to take up employment elsewhere, cannot be compelled to remained in office until his/her replacement.
13. This is buttressed by the fact that Article 20 of the Protocol obliges the President of the Court to ‘immediately inform the [Chairperson of the AU], who shall declare the seat vacant…’
14. An even more compelling argument is expressed under Article 40 of the Rome Statute. Article 40(3) in particular provides that ‘Judges required to serve on a full-time basis at the seat of the Court shall not engage in any other occupation of a professional nature’. Emphasis mine.
15. The last part of this sub-article is clear and authoritative. Full time judges of the ICC must NOT engage in ANY OTHER OCCUPATION of a PROFESSIONAL NATURE. The use of the word ANY presumes that all types of activity are covered, be they short-term, consultancy, etc.
16. Article 40(3) of the Rome Statute thus bars Justice Bossa from taking up any other activity since she will be working on a full time basis with the ICC. This is in recognition of the fact that as a full time judge at the ICC, the demands of her office will not permit her to engage in other occupations.
17. While it is true that the Rules of Court provide for a judge to complete cases in which he/she has participated in the hearing or deliberations, the Protocol prevails over the Rules and, the fact that ICC Judges sit on a full time basis and at the seat of the Court in The Hague is a circumstance that may prevent an ICC judge from meeting the demands of the office of a judge of the African Court. Such circumstances are very likely to arise because a full time ICC judge may not be able to attend 3-4 week sessions of the African Court or even take off any such amount of time that will be necessary to properly attend to the completion of cases in the African Court.
18. If Justice Bossa continues to exercise the functions of Judge of the African Court while a full-time judge of the ICC, it will not only be contrary to the second arm of Article 18 of the Protocol, but also a contravention of Article 40(2) and (3) of the Rome Statute. Thus, even if the African Court were to take a softerapproach, the ICC will not allow the judge to serve on the African Court after she is sworn in as ICC judge.
IV. Conclusion: Is being a judge at the ICC incompatible with being a judge at the African Court at the same time?
19. The most simplistic synonym for the word incompatiblein the instant situation is ‘unsuited’. From the analysis above, it is clear that being a Judge, and for that matter, a full time Judge at the ICC, is unsuited for the demands of a Judge of the African Court.
V. An opportunity to find a lasting solution to this issue
20. Apart from the legal analysis above, there are other practical reasons why a judge who for any reason has left the court should not continue to engage in the judicial work of the court. Last year, although in the case of end of term, the judicial work of the court on some matters involving outgoing judges was almost paralysed when one or two of the outgoing judges were unable toattend court sessions. Secondly, the Court spent over $100,000 to cover the expenses of the outgoing Judges, for the 15 months that they continued sitting after their terms. This resulted in an over expenditure on the session budget.
21. It is therefore time for the Court to take a critically look at this matter, and in particular, establish stringent criteria for determining when a matter should warrant a public hearing. In the opinion of the Registry, the primary determinant should be, subject to availability of resources and time, insufficient information, lack of clarity despite exhaustion of all statutory rounds of submissions and time thereto allocated and need to examine witnesses or experts or amicus as per a specific request of the Applicant or Respondent. Rule 41 actually requires the Court to engage any of the parties to a matter before it, to get more information, documents, which may include information for clarifications. In most cases, parties come to the public hearing and repeat the same information in their written pleadings.
22. Ancillary factors (upon thorough consideration of relevance – and always upon availability of resources especially vis-à-vis all other such pending cases which fall under primary factors) - novel issue, publicity for the Court, etc.
23. Some Judges have also expressed the view that there is no need to require outgoing judges, where the quorum of the Court is attained, and given the staggered manner of the terms of the first Judges elected to the Court, which require that not more than 4 Judges are replaced at any one time, and the Rules which require that the newly elected judges are sworn in on the first session after their election, it is very unlikely that the Court will find itself without a quorum of 7.
24. The travauxpreparatoires of the Protocol envisaged,in the case of end of term that, when there is an outgoing judge, the incoming judge shall take over from where the outgoing judge stopped, and the drafters of the Protocol were explicit that the possibility of de novo consideration is ruled out.

Introduction
1. L’article 2 du Règlement intérieur de la Cour est libellé ainsi :
Durée du Mandat
i. Les Juges nouvellement élus prennent leurs fonctions le premier jour de la première session ordinaire de la Cour suivant leur élection. Avant leur prise de fonctions, les Juges élus prêtent serment ou font une déclaration en application de l’article 4 du présent Règlement.
ii. Les membres de la Cour restent cependant en fonction jusqu’à leur remplacement; ils continuent de siéger jusqu’à l’achèvement de toute phase d’une affaire en laquelle la Cour s’est réunie pour la procédure orale avant la date de ce remplacement.
2. La première question consiste à déterminer la «fin de mandat» d'un membre sortant de la Cour. La première articulation de l’article 2(2) prévoit qu’ils (les membres sortants de la Cour) restent en fonction « jusqu'à leur remplacement ».
3. Une lecture combinée de l'article 2(1) et de la première articulation de l'article 2(2) suggère qu'un juge sortant est remplacé, à compter de la prise de fonction du Juge nouvellement élu, c’est-à-dire, le premier jour de la session ordinaire qui suit immédiatement leur élection.
4. Cette interprétation, par ailleurs correcte, peut entraîner des problèmes sur le plan pratique. Si, par exemple, nous avons deux Juges sortants et deux juges nouvellement élus, comme c'est le cas actuellement, on pourrait supposer que les juges sortants seront remplacés lorsque les Juges nouvellement élus prendront leurs fonctions en vertu de l'article 2(1).
5. Une difficulté d’ordre pratique peut survenir si l'un des Juges nouvellement élus, pour une raison quelconque, ne prend pas ses fonctions le jour indiqué. Lequel des deux juges sortants sera donc remplacé? Il s’agit là d’une situation délicate car un Juge n’est pas élu en remplacement d'un Juge particulier.
6. Une interprétation pratique peut vouloir que la durée du mandat d'un Juge sortant prenne fin le premier jour de la session ordinaire qui suit immédiatement l'élection des nouveaux Juges. Cela éviterait que la durée du mandat d'un Juge sortant soit liée à la prise de fonction du Juge nouvellement élu, mais calculée plutôt sur la base de la durée définie dans le Protocole, qui est de six ans.
7. Ainsi, même s’il advient que le juge nouvellement élu ne prend pas ses fonctions en vertu de l’article 2 (1), le Juge sortant ne saurait demeurer au poste, car son mandat a officiellement pris fin et n’a pas été renouvelé (encore plus évident lorsque le Juge sortant n’a pas sollicité le renouvellement de son mandat).
8. L’article 2(2) prévoit en outre qu’après leur (les juges sortants) remplacement, « ils continuent de siéger jusqu’à l’achèvement de toute phase d’une affaire en laquelle la Cour s’est réunie pour la procédure orale avant la date de ce remplacement.»
9. Le premier constat à tirer est qu’ils ont été remplacés. Toutefois, en raison des nécessités de service et du besoin d'assurer un exercice cohérent de la justice, « ils continuent de siéger », jusqu’à l’achèvement de toute phase d’une affaire en laquelle la Cour s’est réunie pour la procédure orale. Dans la terminologie de la Cour, « procédure orale » est synonyme d' «audience publique ».
10. Toutefois, limiterla procédureorale à une audience publique serait trop restrictif, car cela impliquerait que le Juge sortantqui participe aux délibérations d'une affaire qui ne faisait pas l’objet d’une audience publique ne pourrait plus continuer de siéger dans cette affaire. Le Juge qui a participé aux délibérations relatives à une affaire, même si cette affaire ne faisait pas l'objet d'une audience publique, devrait être en mesure de continuer de siéger jusqu'à l’achèvement de l'affaire.
11. L'utilisation de l'expression «continuentde siéger» suppose que le rôle du juge sortant est limité seulement aux «séances» dans lesquellessa présence est nécessaire. Les articles 17 et 25(2) (d) du Règlement établissent clairement la différence entre session de la Cour et séances. Les séances se rapportent au nombre de fois que la Cour se réunit au cours d’une session donnée. Ainsi, une session peut avoir 15 séances, tandis qu'une autre peut en avoir 17.
Statut du Juge sortant
12. C'est dans le contexte de séance qu'un Juge sortant peut continuer à exercer ses fonctions. Il est possible que pour les besoins d'une affaire, la présence d’un Juge sortant soit requisepour une seule ou même dix séances, en fonction de la nature de l’affaire en question.
13. Dans la situation actuelle, les juges Mutsinziet Guindo seront remplacés lorsque les juges Guissé et Kiokoprendront leurs fonctions le 17 Septembre 2012. Cependant, ayant pris part aux procédures orales (audiences publiques) dans le cadre des requêtes 009/2011 et 011/2011, ilscontinueront à siéger jusqu'à l’achèvement desdites affaires.
14. Le Juge sortant reste donc un membre de la Cour aux seules fins d’achever les affaires dont les procédures orales ont eu lieu. Les deux Juges cessent d'être membres de la Cour pour toutes les autres circonstances en dehors de ces deux affaires. Ils ne peuvent donc pas représenter la Cour à titre officiel.
15. Le Greffe suggère, compte tenu de l’achèvement du mandat des Juges sortants, et de la nécessité pour la Cour de les maintenir pour l’achèvement des affaires ci-dessus mentionnées, que de nouveaux contrats leur soient établis assortis de nouvelles conditions de travail (ils pourraient par exemple être recrutés sur la base d’un contrat de travail à court terme par exemple, où ils pourraient être engagés sur une base contractuelle à court terme à des conditions similaires à celles appliquées pour les Consultants et la Cour devra déterminer à quel niveau les classer).
Quel est l’impact sur leurs avantages sociaux ?
16. De l’analyse qui précède, il ressort que les deux Juges sortants ont droit d’être invités « au moins » le premier jour de la première session ordinaire, au cours de laquelle les Juges nouvellement élus prendront leurs fonctions, marquant ainsi leur remplacement. Par la suite, ils continueront à travailler, sur la base de nouvelles conditions, en vue de l’achèvement des affaires pour lesquelles la Cour s’est réunie pour la procédure orale et auxquelles ils ont pris part. Leurs avantages sociaux comprennent notamment :
a. Avantages accordés à un Juge sortant qui continue à siéger
- Frais de Consultant - Àdéterminer par les Juges
- Billet d’avion - La Cour prendra en charge le billet d’avion – (classe affaires) chaque fois qu’ils seront invités à siéger dans une affaire
- Per diem ethébergement - La Cour leur versera un per diem comme de coutume, conformément à la politique adoptée par la Cour
- Honoraires - À inclure dans leur contrat.
- Crédit de communication - La Cour ne leur accordera pas de crédit de communication.
- Véhicule - Ils auront droit à un véhicule chacun pour la durée de leur séjour sur le lieu de la session.
- Indemnité de magistrature et primes d’intersession (salaire mensuel) - À déterminer dans le cadre du contrat.
- Frais administratifs - Ils auront droit à une allocation de communication proportionnelle à leur participation à l’examen de l’affaire.

Assurance-vie - En ce qui concerne l’honorable juge Modibo qui a souscrit une assurance auprès de MetlifeAlico dans le cadre du plan d’assurance-vie, la Cour devra continuer à payer ses primes d’assurance afin de maintenir sa police jusqu’à l’achèvement de l’affaire. En revanche, pour l’honorable juge Mutsinzi, la Cour devrait trouver une solution alternative, la compagnie d’assurances auprès de laquelle il avait souscrit sa police ayant rejeté sa demande de renouvellement en 2013 pour raisons d’âge.
- Prestations d’assurance-maladie - Les juges sortants auront droit à une couverture médicale payée par la Cour uniquement pour la période pendant laquelle ils mènent des activités officielles pour le compte de la Cour.
Obligations envers la Cour
17. Les Juges sont tenus de restituer à la Cour toute propriété de l’institution, y compris livres, ordinateur portable, téléphone cellulaire, etc. qu’ils détiennent par devers eux. À cet effet, ils sont appelés à signer un formulaire de non redevance.
18. Par ailleurs, toutes les sommes éventuellement dues à la Cour seront déduites de leurs droits, ou alors ils seront appelés à les rembourser si leurs droits s’avèrent insuffisants pour couvrir lesdites sommes dues.

My background experience include working for FSS South Africa Limited, a company specialised in the sale of computer softwares. I also did a six-week internship where I was trained in legal translation. Moreover, I was also and intern at the Ministry of Posts and Telecommunications.
