Source text - Spanish Ref.: Evento ambiental – legal: Descarga no autorizada de agua de contacto hacia el medio ambiente y reboce de agua de contacto desde la poza de la plataforma N°5 (LQW)
Por medio de la presente tengo a bien informar a usted, que los días 12 y 13 de enero de 2023 ocurrieron dos eventos ambientales que a continuación detallo.
12 de enero 2023: Reboce de agua de contacto hacia quebrada Sin Nombre, desde la poza sedimentadora ubicada en la plataforma N° 5 de la futura planta LQW. El reboce de agua fue ocasionado por falta de un sistema de bombeo que se encontraba en proceso de instalación pero que debió instalarse antes del inicio de temporada de lluvias.
13 de enero 2023: Personal (operadores de cisternas de agua no potable) de la Empresa JSJ Quishuar, descargan agua de contacto hacia el canal de derivación del pad La Quinua etapa 3. Este canal deriva agua de no contacto hacia la quebrada Callejón (afluente de Rio Grande), de acuerdo a la investigación preliminar se advierte la falta de aseguramiento de la continuidad de las directivas en el cambio de guardia del personal involucrado.
En ambos casos los eventos sucedidos representan un potencial riesgo de impacto ambiental/social, desmedro a la imagen de Newmont e inicio de Procesos Administrativos Sancionadores (PAS) por parte de la Autoridad Peruana (OEFA). De acuerdo a la normativa vigente de sanciones, la potencial multa asociada a este proceso y de acuerdo a la normativa de OEFA RCD-N°-043-OEFA podría ser tipificada como grave, esto detalla en el supuesto hecho infractor a las obligaciones generales de los titulares de la actividad minera en el numeral 1.1 “No evitar o impedir que las emisiones, efluentes, vertimientos… y cualquier otro aspecto de las operaciones generen o puedan generar efectos adversos al ambiente durante todas las etapas del desarrollo del proyecto”, Subtipo infractor: Generar daño potencial a la flora o fauna constituye una sanción monetaria de 25 a 2500 UIT (Valor de cada UIT S/. 4,950.00).
Por tanto, por la gravedad y potencial detallado anteriormente se solicita tomar las acciones correctivas que evite la reincidencia de eventos similares durante la ejecución del servicio contratado y se nos comunique formalmente sobre las mismas.
Translation - English Ref.: Legal – Environmental Event: Unauthorized discharge of contact water to the environment and contact water overflow from the pond of platform 5 (LQW)
This is to inform you that two environmental events took place on January 12 and 13, 2023, as detailed below:
January 12, 2023: Overflow of contact water towards the Sin Nombre creek, from the settling pond located on platform 5 of the future LQW plant. The water overflow was caused by the lack of a pumping system that was in the process of being installed, but which should have been installed before the rainy season started.
January 13, 2023: Personnel (non-potable water tank operators) from the Company JSJ Quishuar, discharge contact water towards the by-pass channel of the La Quinua Stage 3 pad. This channel sends non-contact water to the Callejón creek (Rio Grande affluent). According to preliminary investigation, it is noted that there is failure in ensuring continuity of directives during change of shift of the personnel involved.
In both cases, the events occurred represent a potential risk of environmental/social impact, deterioration of Newmont’s image and lodging of Sanctioning Administrative Processes (PAS) by the Peruvian Authority (OEFA). Under the current legal provisions, there is a potential fine associated to this process – and according to the provisions of OEFA RCD-Nr.-043-OEFA it could be classified as serious. It details the presumed infringement to the general obligations of the holder of the mining activity under Item 1.1: “Failure to prevent or avoid that any emissions, effluents, discharges… and any other aspect of the operations generate or may generate negative effects to the environment during all the development stages of the project”. Sub-class of infringement: Generating potential damage to the flora or fauna entails a monetary sanction of 25 to 2,500 Tax Units (UIT) (value of each Tax Unit: S/ 4,950.00).
Therefore, due to the seriousness and potential risk detailed above, it is hereby requested to take corrective actions to prevent recurrence of similar events during the performance of the engaged services and to formally inform us accordingly.
