Speedy disposal of Intellectual property rights cases
This case involved the controversy regarding the unauthorized application of the patent of the DTSi technology. The case became very vital regarding not only the financial stakes of the parties but also regarding the application of the doctrine of pith and marrow also termed as Doctrine of Equivalents.
This case was filed before the Madras High Court in 2007. The plaintiffs (Bajaj Auto Ltd), along with the state of Maharashtra alleged the defendants (T.V.S. Motor Company Ltd.) of infringement of the patents of the plaintiffs, which apprehended the invention of the technology of advanced internal combustion engine. The case engaged the questions of patent infringement by the defendant and the damages for the same.
The Supreme Court of India by this landmark judgement directed all the courts in India for speedy trial and disposal of intellectual property related cases. In this two-year-old dispute involving two companies, which had been locked in a patent dispute over the use of a twin-spark plug engine technology, the Supreme Court observed that suits relating to the matters of patents, trademarks and copyrights are pending for years and years and litigation is mainly fought between the parties about the temporary injunction. The Supreme Court directed that hearing in the intellectual property matters should proceed on day to day basis and the final judgment should be given normally within four months from the date of the filing of the suit.

Ce cas a impliqué la controverse quant à l'application non autorisée du brevet de la technologie DTSi. Le cas est devenu très vital quant à non seulement les intérêts financiers des partis mais aussi quant à l'application de la doctrine de “Pit et Marrow” ont aussi nommé comme la Doctrine d'Équivalents.
Ce cas a été déposé avant l'Haute cour de Madras en 2007. Les demandeurs (Bajaj Auto Ltd), avec l'état de Maharashtra ont accusé les défendeurs (T.V.S. Motor Company Ltd.) d'infraction des brevets des demandeurs, qui ont arreté l'invention de la technologie de moteur à combustion interne avancé. Le cas a engagé les questions de la violation de brevet par le défendeur et les dégâts pour le meme.
La Cour suprême de l'Inde par ce jugement de référence a adressé toutes les cours en Inde pour le procès rapide et la disposition de propriété intellectuelle des cas liés. Dans ce conflit de deux ans impliquant deux entreprises, qui avaient été enfermées dans un litige en matière de brevet sur l'utilisation d'une technologie de moteur de bougie d’allumage, la Cour suprême a observé que les affairs concernant aux matières de brevets, de marques déposées et de copyrights sont en suspens pendant des années et le litige est principalement battu entre les partis de l'injonction provisoire. La Cour suprême a ordonné qu'entendre dans les matières de propriété intellectuelle devrait passer au jour le jour et le jugement final devrait être donné normalement dans quatre mois de la date du classement du costume.
