LEO BURNETT USA, a division of Leo Burnett Company, Inc. (“Burnett”)
on behalf of Procter & Gamble Productions (“Client”). “Burnett” and “Client” together referred to as “Advertiser”

1. I, (“Artist”) agree to render my performance and photographic “posing” services for the production of one basic second television commercial (and unlimited edits, lifts, versions) and unlimited print advertising (as described below) during one twelve (12) (consecutive) hour day (from call time to release, inclusive of makeup, hairstyling, and wardrobe fitting time)(“Production Day”). For such services (including makeup, hairstyling and wardrobe fitting time), I agree to accept, and Advertiser agrees to pay, within thirty (30) days of successful completion of production, a total fee of 350,000 Chilean Pesos (“Session Fee”) for the production of Commercial(s) and print. This Release covers filming, photographs, taping and/or recordings of me made on (Date) in (City, Country).
2. The Initial Term for use of the Commercials and Print Materials shall be one year beginning with the first public use of any Commercial or Print Material.
3. I, grant Client, Leo Burnett USA, Leo Burnett Worldwide, Leo Burnett Company, Inc. and their respective agents, successors and assigns, (collectively referred to as “Advertiser”), the right, but not the obligation, to use and distribute throughout the United States, its territories, possessions and commonwealths, and Canada (the “Territory”) the Commercial(s). The Commercial(s) (including my likeness, recordings and footage of me, in whole or in part, in composite or altered form, in conjunction with my own or a fictitious name) may be used in all electronic and digital media, including but not limited to free TV, cable, industrial use, cinema, in-house promotions, and on the worldwide internet (the “Commercial Media”), for use in marketing, advertising, promotion, behind –the-scenes-video(s) and public relations materials (“Commercial Materials”) for Secret brand deodorant and antiperspirant products (the “Products”). For the right to use and distribute such Commercial Materials in Commercial Media, I agree to accept, and Advertiser agrees to pay, within thirty (30) days of successful production of the Commercial Materials, a total buyout fee of 1,345,000 Chilean Pesos (”Commercial Buyout Fee”) as payment for all use of the above-referenced Commercial Materials for the Initial Term.
4. I further grant to Advertiser the right, but not the obligation, to use and distribute in the Territory, any and all images or photographs of me for use in unlimited print media, including but not limited to traditional print (magazines and newspapers), point of sale, direct mail, out- of-home, collateral materials, in-house promotions, digital materials, mobile uses, and the worldwide internet (including intranet, social media sites (e.g., Facebook, Tumblr, etc., blogs) and/or online banners) (collectively “Print Media”) for use in marketing, advertising, promotional and/or public relations materials (“Print Materials”) in whole or in part, in composite or altered form, in conjunction with my own or a fictitious name, for the Products. For the right to use and distribute such Print Materials in Print Media, I agree to accept, and Advertiser agrees to pay, within thirty (30) days of successful production of the Print Materials, a total buyout fee of 1,345,000 Chilean Pesos (”Print Buyout Fee”) as payment for all use of the above-referenced Print Materials for the Initial Term.
5. I further grant to Advertiser at the end of the Initial Term, at Advertiser’s sole option, the right to use either or both the Commercial Materials and/or Print Materials created during the Initial Term, in the same Commercial Media or Print Media, for an additional second (2nd), third (3rd) or fourth (4th) consecutive one year period. If Advertiser exercises the 2nd or 3rd option year Terms, Advertiser agrees to pay a total buyout fee of 1,345,000 Chilean Pesos for use of the Commercial Materials, and an additional buyout fee of 1,345,000 Chilean Pesos for the separate optional use of Print Materials.
6. If Advertiser chooses to exercise an option for the fourth (4th) year, Advertiser agrees to pay a total buyout fee of 1,479,500 Chilean Pesos for use of the Commercial Materials and an additional buyout fee of 1,479,500 Chilean Pesos for the separate optional use of the Print Materials. Advertiser shall pay all option fees within 30 days of Advertiser exercising the option.
7. I agree that since accepting employment for the services to be rendered under the terms of this Release, I have not accepted employment in, nor authorized the use of my name or likeness or identifiable voice in, any commercial(s), advertising or public relations materials for any competitive product (deodorants and antiperspirants) or service, and that I will not hereafter, during the Initial Term or any optional Term, accept employment in, or authorize the use of my name or likeness or identifiable voice in, any commercial(s), advertising or public relations materials or projects for any competitive product or service.
8. I waive any rights that I might have to inspect or approve the final Commercial Materials or Print Materials produced under this Release.
9. I understand that under no circumstances shall I have any right to maintain any cause of action against Advertiser, or anyone else by virtue of the terms of this Release, unless Advertiser materially breaches the terms of this Release and is unable to cure such alleged breach within a
commercially reasonable period.

Por el derecho a usar y distribuir tales Materiales Impresos en Medios de Comunicación Impresos, estoy de acuerdo en aceptar, y el Anunciante acepta pagar, en un plazo de treinta (30) días contados desde la producción exitosa de los Materiales Impresos, un pago total de adquisición de 1.345.000 pesos chilenos ("Pago de Adquisición de Impresos") como pago por todo el uso, durante el Plazo Inicial, de los Materiales Impresos antes mencionados.

Además concedo al Anunciante al término del Plazo Inicial, y a exclusiva opción del Anunciante, el derecho a usar los Materiales del Comercial y/o los Materiales Impresos creados durante el Plazo Inicial, en los mismos Medios de Comunicación Comerciales o Medios de Comunicación Impresos, por un segundo (2°), tercer (3er) o cuarto (4°) periodo consecutivo de un año. Si el Anunciante ejerce las opciones del 2° o 3er Periodo anual, el Anunciante accede a hacer un pago total de adquisición de 1.345.000 pesos chilenos por el uso de los Materiales del Comercial y un pago adicional de adquisición de 1.345.000 pesos chilenos por el uso opcional separado de los Materiales Impresos.
6. Si el Anunciante escoge ejercer una opción durante el cuarto (4°) año, el Anunciante accede a hacer un pago total de adquisición de 1.479.500 pesos chilenos por el uso de los Materiales del Comercial y un pago adicional de adquisición de 1.479.500 pesos chilenos por el uso opcional separado de los Materiales Impresos. El Anunciante realizará todos los pagos opcionales dentro de un plazo de 30 días contados desde que el Anunciante ejerza la opción.
7. Estoy de acuerdo en que desde la aceptación del trabajo para prestar servicios bajo los términos de este Contrato, no he aceptado trabajar en, ni he autorizado el uso de mi nombre o mi imagen o mi voz reconocible en cualquier material comercial, publicitario o de relaciones públicas de cualquier producto o servicio de la competencia (desodorantes o antitranspirantes) y que no aceptaré, de aquí en adelante, y durante el Plazo Inicial o cualquiera de los Plazos opcionales, trabajar en, o autorizar el uso de mi nombre o mi imagen o mi voz reconocible en cualquier proyecto o material comercial, publicitario o de relaciones públicas de cualquier producto o servicio de la competencia.
8. Renuncio a cualquier derecho que yo pudiera tener para revisar o aprobar los Materiales Comerciales finales o Materiales Impresos producidos bajo este Contrato.
9. Entiendo que bajo ninguna circunstancia tendré algún derecho a mantener algún un procedimiento judicial contra el Anunciante, o cualquier otro por virtud de los términos de este Contrato, a menos que el Anunciante materialmente quebrante los términos de este Contrato y sea incapaz de remediar dicho supuesto quebrantamiento dentro de un periodo comercialmente razonable.
