Source text - English A mortgage is the transfer of or the creation of an interest in real or personal property by a borrower, called the mortgagor, in favour of a lender, called the mortgagee, by way of security for the repayment of money borrowed, together with interest.
A mortgage of personal property is generally by way of bill of sale. A mortgage of freeholds is, in law, a long lease for a term of 3.000 years granted as security to the mortgagee subject to an agreement for the determination of a lease on repayment of the loan on a fixed day, usually at the expiration
of six months from thr date of the advance, with interest. By the common law, upon failure of the mortgagor to make such repayment within the stipulated period, the mortgagee could eject the mortgagor and turn him out of possession and take the land himself. The Court of the Chancery considered that this was not fair dealing, and it therefore decided that after the stipulated period had elapsed the mortgagor had still the right to redeem on payment of the debt, interest and costs, and this right is accordingly known as the " equity of redemption ". The mortgagee cannot deprive the mortgagor of this right.
Translation - Spanish Una hipoteca es la transferencia o creación de un interės en una propiedad legítima o personal por un pestatario, llamado "deudor hipotecario" a favor de un prestamista, llamado "acreedor hipotecario", mediante el pago del dinero prestado más el interés. Una hipoteca de pleno dominio es, por ley, un largo usufructo durante un plazo de tres mil años, otorgado como garantía al acreedor hipotecario sujeto a un acuerdo para la resolución de un arrendamiento en pago del préstamo en el día fijado, generalmente al vencimiento del plazo de seis meses desde la fecha anticipada más el interės. Por derecho, al no efectuar el deudor el pago en el tiempo estipulado, el acreedor podría deshauciar al deudor, expulsándole de la posesión y quedándose con la propiedad.
