The United States District Court for the Middle District of X presents its greetings to the judicial authorities of the Federal Republic of Germany and respectfully requests the assistance of the courts of the Federal Republic of Germany in connection with a criminal matter. The United States District Court for the Middle District of X assures the courts of the Federal Republic of Germany and the appropriate judicial authority designated to execute this request that the courts of the United States are authorized to assist foreign tribunals in the executions of letters rogatory for assistance in criminal matters. This Court also provides assurances that the physical evidence requested herein would be obtained pursuant to a compulsory order issued by this Court, i.e. a grand jury subpoena, if such evidence were located within the jurisdiction of this court and that the rights of third parties will not be impaired.
FACTS
Six foreign nationals were indicted by a federal grand jury on August 22, 1996, for violating United States criminal laws by participating in a conspiracy to smuggle reptiles into the United States. United States v. Smith et al. Two of the six persons indicted have been arrested in the United States and have pled guilty to charges related to wildlife smuggling. The United States Attorney, who is the federal prosecutor for this district, and the Environment and Natural Resources Division of the United States Department of Justice, are now investigating additional alleged violations of United States criminal laws, primarily by citizens of the United States who purchased smuggled animals from those already indicted.

El Tribunal de Distrito de los Estados Unidos de América para el Distrito Medio de X garantiza a los tribunales de la República Federal de Alemania, así como a la autoridad judicial competente designada para ejecutar esta petición, que los tribunales de los Estados Unidos de América están autorizados para prestar auxilio a tribunales extranjeros en la ejecución de comisiones rogatorias en asuntos penales. Este tribunal también ofrece garantías de que si la prueba física solicitada por la presente se hallara dentro de su jurisdicción, se obtendría de conformidad con una orden de obligado cumplimiento dictada por dicho tribunal, por ejemplo una citación con apercibimiento para comparecer ante el gran jurado. El día 26 de agosto de 1996, seis ciudadanos extranjeros fueron procesados por un gran jurado federal por haber participado en una conspiración para introducir reptiles de contrabando dentro los Estados Unidos de América, con violación de sus leyes penales. (United States v. Smith et al.). Dos de las seis personas procesadas han sido detenidas en los Estados Unidos y se han declarado culpables de los cargos relacionados con el contrabando de animales salvajes.
