OPŠTE ODREDBE O STVARIMA I STVARNIM PRAVIMA
Glava I.
Član 1. Vlasništvo i druga stvarna prava
(1) Ovim zakonom uređuju se uslovi i načini sticanja, korištenja, raspolaganja, zaštite i prestanka prava vlasništva i drugih stvarnih prava i posjeda.
(2) Odredbe ovog zakona primjenjivat će se na stvarna prava ako posebnim zakonom nije drugačije uređeno.
(3) Odredbe ovog zakona koje se odnose na pravo vlasništva, shodno se primjenjuju na sva druga stvarna prava, osim ako za njih nije ovim zakonom drugačije propisano niti drugačije proizlazi iz njihove pravne prirode.
Član 2.
Ograničenja prava vlasništva
(1) Pravo vlasništva i druga stvarna prava mogu se protiv vlasnikove volje oduzeti ili ograničiti samo u javnom interesu i pod uslovima predviđenim zakonom i opštim principima međunarodnog prava. Zakonom se, u javnom interesu, a naročito radi zaštite prirodnih bogatstava, okoline i kulturnohistorijske baštine, može ograničiti ili posebno urediti način korištenja i raspolaganja određenim stvarima.
(2) Kada vlasnik mora nešto trpjeti ili propustiti u pogledu svoje stvari, to je dužan i nosilac drugog stvarnog prava na istoj stvari, koji svoje pravo izvodi iz prava vlasnika, ako nije drugačije određeno zakonom.
Član 3.
Nosioci vlasništva i drugih stvarnih prava
(1) Svako fizičko i pravno lice može biti nosilac prava vlasništva i drugih stvarnih prava na stvari, u skladu sa zakonom.
(2) Stvarna prava su: pravo vlasništva, pravo građenja, založno pravo, zemljišni dug, pravo stvarne i lične služnosti i pravo stvarnog tereta.
(3) Samo je jedna vrsta prava vlasništva neovisno o nositelju prava vlasništva

GENERAL PROVISIONS ON PROPERTIES AND PROPERTY RIGHTS
Chapter I
Article 1
Ownership and Other Property Rights
(1) Hereby this Law shall prescribe the conditions and manners of acquisition, exercise, disposition, protection and dissolution of ownership rights, and of other rights on a property (ius in re) and things (res).
(2) Provisions of this Law shall be applied to property rights, unless otherwise prescribe by separate law.
(3) Provisions of this Act pertaining to ownership rights shall be applied respectively to all other property rights, unless they are herein differently ordained, or their legal nature implies otherwise.
Article 2
Limitations of Ownership Rights
(1) Right of ownership or other property rights may be revoked or limited against an Owner's will solely in public interest and under conditions prescribed by Law and general principles of international law. The Law, in public interest, and especially on account of protection of natural resources, the environment, or cultural or historic heritage, may limit, or exclusively ordain the manner of use and disposition of certain properties.
(2) When an Owner is obligated to endure something, or cede in regard to their property, the same shall apply to the holder of other property right on the said property, who derives their right from the owner's right, unless otherwise defined by Law.
Article 3
Holders of Ownership and Other Property Rights
(1) Every natural person or legal entity (hereinafter: Legal Individuals) may be the holder of right of ownership and other property rights on a thing (ius in re), in accordance with Law.
(2) Property rights are: right to ownership, right of construction (building lease), right of lien, right of hypothec, right of real and personal servitude (easement) and right of burden of property.
(3) Ownership right exists in one kind solely, irrespective of the kinds of holder of the right of ownership.
