Source text - Portuguese As partes acima qualificadas, pelo presente instrumento, contratam a locação do imóvel supra-indicado, mediante as cláusulas e condições seguintes:
PRIMEIRA - O prazo da locação é de 30 (trinta) meses, inicia-se em xx/xx/xxxx e termina, de pleno direito, no dia xx/xx/xxxx , independentemente de notificação ou aviso judicial ou extrajudicial.
Parágrafo Único – O(A) LOCATÁRIO(A) poderá antecipar a entrega do imóvel após 12 (doze) meses de locação, mediante comunicação prévia com antecedência mínima de 30 (trinta) dias, ficando liberado da multa prevista na cláusula sexta.
SEGUNDA - O pacote acordado que inclui aluguel, condomínio, IPTU, limpeza diária, internet, TV a cabo, luz e água é de R$ XX,XXX.XX mensais, e vence no último dia de cada mês, devendo ser pago até o primeiro dia útil do mês seguinte, em moeda corrente, na conta corrente nº XXX da Agência XXX do Banco XXXXXXX em nome de XXXXXXXXXXXX. ou a quem o LOCADOR indicar. Os aluguéis e encargos não quitados dentro do prazo serão acrescidos da multa de 10% (dez por cento) e dos juros moratórios de 1% (um por cento) ao mês e ainda corrigidos pela variação acumulada do IGP-M/FGV até o dia do efetivo pagamento.
TERCEIRA - O pacote convencionado na cláusula segunda será reajustado a cada período de 12 (doze) meses, de acordo com a variação do IGP-M/FGV acumulado desde o início do contrato e/ou do último reajuste. Fica expressamente convencionado que, se na vigência deste contrato ou de sua prorrogação, nova Lei ou Ato Normativo do Poder Executivo vier a reduzir o prazo de reajuste, hoje vigente, o novo prazo será automaticamente aplicado nos futuros reajustamentos deste contrato, e que, se o IGP-M/FGV for extinto, será substituído por outro índice que venha a ser legalmente fixado.
Translation - English The parties above qualified, by this instrument, shall engage the real estate lease above mentioned, in accordance with the following clauses and conditions:
CLAUSE ONE - The lease term is of 30 (thirty) months, starting on xx/xx/xxxx and shall end, by operation of law, on xx/xx/xxxx , regardless of notice or judicial or extra judicial notice.
Single Paragraph – THE LESSEE might anticipate the return of the real estate after 12 (twelve) months of lease, by prior notice within at least 30 (thirty) days, being free of fine foreseen at the clause six.
CLAUSE TWO - The agreed package that includes rental, maintenance fee, real estate tax (IPTU), daily cleaning, internet, cable TV, power and water bill is R$ XX,XXX.XX monthly, with due date on the last day of each month, which must be paid until the first business day of the following month, in currency, to checking account n. XXXX, Branch XXXX of XXXXX bank on behalf of XXXXXXXXXXXXXXX. or to whom the LESSOR indicate. The rents and charges do not paid within the term shall be added with 10% (ten percent) fine and 1% (one percent) arrears interest monthly and readjusted by Getulio Vargas Foundation General Market Price Index (IGP-M/FGV) accumulated variation until the payment.
CLAUSE THREE - The package agreed at the clause two shall be readjusted every 12 (twelve) months, in accordance with accumulated IGP-M/FGV variation since the beginning of the agreement and/or the last readjustment. It is herein agreed that, if on the term of this agreement or on its amendment, new Law or Normative Act of the Executive Power reduces the readjustment term, current today, the new term shall be automatically applied on future readjustments hereof, and that, if IGP-M were extincted, it shall be replaced by another index that shall come to be legally established.
