Source text - English Beruft sich ein Beteiligter darauf, dass er Informationen nicht geben oder Aufzeichnungen nicht vorlegen kann, weil ausschließlich eine nahe stehende Person darüber verfügt und die Herausgabe verweigert, liegt kein Verstoß des Beteiligten gegen seine Mitwirkungspflichten vor, wenn er weder rechtlich (z.B. gesellschaftsrechtlich) noch tatsächlich die Möglichkeiten hat, die Informationen oder Unterlagen bei dem Nahestehenden zu beschaffen und ihm auch eine Beweisvorsorge (Tz. 3.3.3) nicht möglich oder nicht zumutbar war. Die Mitwirkungsverweigerung einer nahe stehenden Person kann durch Vorlage des entsprechenden Schriftverkehrs glaubhaft gemacht werden. Die Möglichkeiten der internationalen Rechts- und Amtshilfe bleiben unberührt (Tz. 2.4). Verweigert eine nahe stehende Person nachweislich ihre Mitwirkung, hat der Steuerpflichtige seine erhöhten Mitwirkungspflichten dennoch im Übrigen zu erfüllen, soweit ihm dies möglich ist.
Translation - German If a party to the proceeding alleges its inability to provide information and/or produce documentation because such information and/or documentation is in the exclusive control of a related party that refuses to release it, there is no breach of the party's duties of cooperation if the party has neither the legal ability (e.g. under corporate law) nor the practical ability to obtain such information and/or documentation from such related party and it was not possible or would have been unreasonably burdensome for the party to the proceeding to have prospectively collected such evidence (sec. 3.3.3 below). The related party’s refusal to cooperate may be credibly shown by producing relevant correspondence. The foregoing is without prejudice to the avenues of international administrative and legal assistance (sec. 2.4 above). If a related party has demonstrably refused to cooperate, the taxpayer must nevertheless fulfill its heightened duties of cooperation in other respects to the extent of its ability.

It also does not include amounts of original issue discount arising from a sale and repurchase transaction completed within a period of two weeks or less, or amounts described in Treas. Reg. § 1.6049-5(b)(7), (10), or (11) (relating to certain foreign targeted registered obligations and certain obligations issued in bearer form).
