Since I'm using "press charges" for ratificar las querellas, I'm not sure how to translate formular acusación.

De todas las denuncias penales, la mitad prescribió por falta de actuación, en tiempo y forma, de la Procuraduría Fiscal; otras fueron sobreseídas, porque la misma Procuraduría no ratificó las querellas, se abstuvo de ***formular acusación*** a pesar de que había delito señalado por la Comisión Bancaria, además de que la PGR no ejerció acción penal por supuesta falta de elementos, y otras las envió a la reserva.

I just thought I'd add this about "en reserva" in Mexico: archivados con las reservas de ley (reserved). This means the preliminary findings failed to prove the existence of a crime and probable cause. (this is from a criminologist in Guadalajara)

Gracias, Lucia, Widenmann, y Carol. Con la ayuda de Uds. creo que ya entiendo. Cierro la pregunta después de los 24 horas, y por ahora, voy a lanzar una pregunta acerca de "ratificar querella". Aunque los sistemas judiciales son muy distintas, sin duda, es necesario que cuando alguien aquí hace una denuncia que los oficiales la ratificaran (o no, si sale estar sin mérito).

También creo que es "in spite of". La parte de "envió a la reserva" quiere decir que se mantienen las investigaciones en una especie de archivo — en espera — porque no hay, de momento, suficiente prueba para seguir adelante.No es sobreseimiento definitivo

De acuerdo con Widenmann: El querellante es un particular; en los casos en que se admite un querellante privado, la Fiscalía confirma la denuncia del particular-

It appears that ratificar una querella referers to ratifying or confirming a legal complaint (not sure what we call that here in the US). See http://www.pgjecoahuila.gob.mx/admin/uploads/Documentos/modu... , Art 59.

Hi Patricia: I'm not sure if filing a charge is exactly the same as pressing charges. In any case, I feel that your first reading is correct, as it's "in spite of" and not "because of"... the crime having been identified...

I guess what I'm not clear on here is the distinction between ratificar las querellas and formular acusación -- do they mean the same thing (press charges, file charges, prosecute)? From my reading of this, it seems as if they are two distinct things, but maybe the point is that in the first part, the prosecutor didn't investigate to determine if a crime had been committed, and in the second, that would not even have been necessary since the crime had been identified by the banking commission, and yet he still did not press charges? My apologies if I didn't read this carefully ...
