Em 2001, o governo brasileiro começou a regulamentar no País a cláusula da CDB sobre o acesso aos recursos da biodiversidade e conhecimentos tradicionais associados e os benefícios que resultam de seu uso (ABS). Uma medida provisória com **força de lei** criou o Conselho de Gestão do Patrimônio Genético (CGEN), formado por representantes do governo, sociedade civil e comunidades tradicionais. O conselho orienta-se por um amplo arcabouço legal, científico e técnico para autorizar o acesso ao patrimônio genético e aos conhecimentos tradicionais associados.
