This procural rule stems from a decision of the Sureme Court in 2019 (I think) which stated that the court seised with handing down an enforcement judgment/order may suspend its decision whenever proceedings exist that raise issues pending regarding the division of property or such decisions have been delivered but they have been contested and/or appealed. For example, in the case of husband and wife with joint ownership of a property and where the wife is a debtor while the husband is not. A suit has been filed by a creditor to sell the property to recover the wife's debt. However the husband has filed a countersuit against such proceedings. And so weiter und sofort. Such circumstances require a court to decide and settle the division of the asset before any executive order can be handed down in favour of one party or another. The judgment/proceedings concerning the uncontested divison of the asset is/are the "endoesecutivo" judgment/proceedings. I hope this is clear.
