Spanish term

prueba diabóllica

Spanish to English Law/Patents Law (general)
Es decir: la norma bajo estudio obliga a las demandadas a producir una prueba {MQ}diabóllica, {MQ}por cuanto deberán probar cuáles daños {MQ}no {MQ}causaron, en vez de que sea la actora la que prueba cuáles daños fueron causados.

I considered using "evil evidence" or "very difficult evidence", which was what I found as a definition on the RAE dictionary website... But I'd appreciate your comments.
Thanks in advance!

probatio diabolica/devil's proof

A legal requirement to achieve an impossible proof is called probatio diabolica. This is also called “devil's proof.” When a legal system requires an impossible proof, the only remedies available are reversing the burden of proof, or giving additional rights to the individual facing the probatio diabolica. When there is no proof to contradict a given statement, the statement can be considered true in some sense.

Spanish term (edited): (una) prueba diabóllica

(an) impossible-ranked (type of) evidence

I hardly think the answer in the example sentence of 'trial by fire' is a type of proof that can be produced in court.

Also difficult to incorporate the indefinite article, party from changing to any proof or evidence.

NB there is no ref. to devil's proof or probatio diabolica in any Anglo-Am law dictionary or textbook on evidence known to me. Perhaps someone can disabuse me of my ignorance.
