English term

production

English Law/Patents
From a confidentiality agreement: "information which was generally known or available to the public at tht time of its disclosure, discovery or PRODUCTION hereunder". Question: is this "production" more a synonym of "generation" or of "presentation", as when you produce your passport at the border?

presentation

I believe it to be the latter of your ideas for the following reasons:

1) We are talking about information in terms of general knowledge, not computer data, and such information is not commonly known to be generated, but it is known to be presented.

2) In the context, "production" was paired with "disclosure" and "discovery", which, since we're talking about information, give a connotation of people getting such information from others and not making it up on their own. Especially "disclosure"; when somebody discloses information, it means that it was presented/produced.

If I think of anything else, I'll add the note.

Good luck.

It depends on the information and how it is produced, but the meaning is related to the "making" of the information. I do not opt for the presentation meaning because it would be too close to disclosure and hence redundant.

I understood that your answer is based on that view. I took a different view, which is that the phrase lists significant points in the life of the information in question. Based on that understanding, the meaning of each point has to be significant to be listed.

I realize that the text can be taken either way, may the asker can determine which is the correct intent of the phrase based on the rest of the text.

My Note is answer to Dan Mencher\'s comment.
Peer comment(s):

disagree Daniel Mencher : Redundancy is the point. All 3 words, disclosure, discovery, and presentation, are meant in the same sense but with their own slight connotations, so that the one idea can be conveyed without any question as to which aspect is meant.

"presentation"

It seems as though they are using the term "production" in the same sense police officers/detectives "produce a document" for evidence, which in plain language would be like "hand over that document!" (= present the document).

Especially if they are talking about an "information" they want, they are looking for you to "disclose" (= tell what you know now!), or for them to "discover" (= we'll find it out even if you're hiding it from us!), then it's natural to assume that they'll want you to "produce" (= hand it over to us!).

That's what I think.
