Source text - English Over the last few years there have been a number of election commentators who have suggested that Australian electoral organisations should introduce electronic voting at Federal, State and Local Government elections.
The general observation is made that as we do more of our business using a number of media (eg, on-line banking, ATMs, and purchases over the internet), it should not be too difficult for us to vote using electronic equipment rather than turning up at a polling place on election day and voting in a booth using paper and pencils.
The phenomenal use of the internet as a vehicle for improved communication, access to information and e-commerce has led to the claim that the internet could be used as either a replacement to attendance voting or as an additional vote-casting option. Indeed, a US company (election.com) has actually set up a business in Australia aimed at providing internet voting services in the area of commercial and community elections.
Every now and then a small number of Federal and State Australian politicians and Parliamentary Committees have asked electoral authorities to ascertain the status of e-voting.
When considering such technology as a replacement for the traditional polling booth, it should be borne in mind that there is no evidence to suggest that there is any political or community support for doing away with the ballot box citizens are familiar with. In our view, the jury is still out on introducing any form of paperless voting that fails to support the present voting systems and voting culture.
Translation - Arabic الاقتراع إلكترونياًّ
على مدى السنوات القليلة الأخيرة، كان هناك عدد من المعلّقين على الانتخابات الذين اقترحوا أنه على منظمات الانتخاب ألأسترالية وضع الاقتراع إلكترونيّاً موضع الإستعمال في انتخابات الحكومة الفدراليّة وانتخابات الولاية والانتخابات المحليّة. طُرحت الملاحظة العامة انه بما أننا نقوم بالمزيد من أعمالنا باستخدام عددٍ من الوسائل (مثلا ً المعاملات المصرفية على الإنترنت، آلات الصرف الآلي للنقود ATM ، والمشتريات عبر الإنترنت) فلن يكون صعباً كثيراًعلينا أن ننتخب بواسطة معدّات إلكترونية عوضاً عن الذهاب إلى مكان اقتراع يوم الانتخاب والاقتراع داخل حجيرة بواسطة ورق وأقلام.
إن الاستعمال الهائل للإنترنت كوسيلة إتصالات محسّنة وكمنفذ للمعلومات والتجارة الإلكترونية قد أدّى إلى الإدّعاء بإمكانية استعمال الإنترنت إما كبديلٍ عن الاقتراع حضوراّ أو كخيارٍ إضافيّ للاقتراع . في الواقع، لقد أقامت شركة أميركية مشروع عملٍ في أستراليا يهدف إلى تأمين خدمات إقتراع عبر الإنترنت على نطاق الإنتخابات التجارية والإجتماعية.
يقوم بين الحين والآخر عدد قليل من سياسيّي أستراليا الفدراليين والولاياتيين والّلجان النيابية بمطالبة السلطات الإنتخابية تحقيق الوضع الشرعي للإقتراع إلكترونياّ .
عند إعتبار هكذا تكنولوجيا بديلاً لحجيرة الإقتراع التقليدية، يجب أن نتذكر أنه لا يوجد برهان لأن نقترح أن هناك أي دعم سياسي أو أجتماعي للتخلص من صناديق الإقتراع التي إعتادها المواطنون. في نظرنا، لا تزال الهيئة بعيدة عن وضع موضع الإستعمال أي شكل من إقتراع ٍ لاورقي يفشل في أن يمثّل الأجهزة الإنتخابية الحاليّة والثقافة الإنتخابية.
English to Arabic: Cancellation of Business Visas
Source text - English It is my view that the provisions of the Migration Act reflect a balancing of interests. On the one hand the provisions allow monitoring of a business visa holder's activities in Australia, and the ability to cancel a visa if those activities are judged not to satisfy various criteria. On the other hand, it is recognised that visa holders should not be under the threat of cancellation indefinitely, and hence the notice of intention to cancel must be made within a three-year period; moreover, the cancellation decision must be made within 90 days of the date specified in the notice of intention to cancel, if that date is after the end of the three-year period. (It must be remembered that once the three-year period has expired, the Department has no ability to issue a notice, and has lost the capacity to cancel the visa. Parliament must be taken to have intended as much.)
Parliament was obviously concerned to ensure that the visa holder has a reasonable opportunity to provide submissions about the intended cancellation. Consequently, in my opinion, if the Department failed to issue a notice of intended cancellation at all - so that the visa holder was unaware of the intention and had no opportunity to make submissions - then that non-compliance would render a subsequent cancellation decision invalid. The same might apply where substantially less than 28 days was given for the making of representations, and a cancellation was made immediately after the expiry of that shorter period.
Translation - Arabic إلغاء تأشيرات الأعمال
برأيي أن أحكام قانون الهجرة تعكس توازناً في المصالح. فمن ناحية تتيح مراقبة أنشطة حامل تأشيرة الأعمال في أستراليا، وإمكانية إلغاء تأشيرة ما، إذا ما وجدت هذه الأنشطة غير منطبقة على معاييرِ مختلفة. ومن ناحية أخرى، فأنه متعارف عليه أنه لا يجب أن يكون حاملي التأشيرات تحت التهديد الدائم بالإلغاء، وبالتالي فإن الإشعار بنيّة الإلغاء يجب أن يصدر خلال فترة ثلاث سنوات؛ هذا فضلاًَ عن أن قرار الإلغاء يجب أن يتّخذ خلال 90 يوماً من التاريخ المحدّد في الإشعار بنيّة الإلغاء، إذا كان هذا التاريخ بعد انتهاء فترة الثلاث سنوات. يجب أن نتذكّر أنه متى انقضت فترة الثلاث سنوات لا يعود للدائرة إمكانية إصدار إشعار، وتكون فقدت القدرة على إلغاء التأشيرة. يجب اعتبار بأن هذا هو مراد البرلمان.
من الواضح أن البرلمان كان معنيّاً بالتأكّد أن لحامل التأشيرة فرصة معقولة لتقديم ردود على النيّة بالإلغاء. بالتالي، فبرأيي أنه إذا لم تصدر الدائرة إشعاراً بنيّة الإلغاء مطلقاً – بشكل أن حامل التأشيرة لم يكن على علمِ بالنيّة ولم يتسنّى له التقدّم بردِ – فإن عدم التقيّد هذا سوف يجعل من الإلغاء اللاحق قراراً باطلاً. يطبّق الأمر ذاته عندما تكون المدّة المعطاة فعليّاً لإقامة الردّ أقلّ من 28 يوماً ، ويتمّ الإلغاء مباشرةً بعد انقضاء هذه الفترة الأقصر.
