Source text - German Nach Abschluss der vertraglichen Arbeiten hat der Auftragnehmer sämtliche in seinen Besitz gelangten Unterlagen und erstellten Verarbeitungs- oder Nutzungsergebnisse, die im Zusammenhang mit dem Auftragsverhältnis stehen, dem Auftraggeber auszuhändigen.
Sämtliche Datenträger des Auftragnehmers sind datenschutzgerecht sicher zu löschen, so dass keine weitere Nutzung oder ein Rückschluss auf die Daten mehr möglich sind.
Test- und Ausschussmaterial ist unverzüglich datenschutzgerecht zu vernichten oder dem Auftraggeber auszuhändigen.
Die Löschung bzw. Vernichtung ist dem Auftraggeber mit Datumsangabe in schriftlicher Form zu bestätigen.
Die Beauftragung von Unterauftragnehmern ist nur mit vorheriger schriftlicher Zustimmung des Auftraggebers zugelassen.
Der Auftragnehmer hat in diesem Falle vertraglich sicherzustellen, dass die vereinbarten Regelungen auch gegenüber Unterauftragnehmern gelten.
Bei einer Beauftragung von Unterauftragnehmern, deren Sitz sich nicht im Gebiet der Bundesrepublik Deutschland, in einem Mitgliedsstaat der Europäischen Union oder in einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum befindet, muss der Auftragnehmer den Auftraggeber hierüber frühzeitig schriftlich unterrichten, damit der Auftraggeber die erforderliche Prüfung hinsichtlich der Zulässigkeit der Übermittlung und Eignung des Unterauftragnehmers (z.B. gem. BDSG, innerbetriebliche Vorgaben) durchführen kann.
Bei erfolgreicher Prüfung wird der Auftraggeber mit dem Unterauftragnehmer eine Datenschutzvereinbarung gemäß der Richtlinie 95/46/EG des Europäischen Parlaments und des Rates (Standardvertragsklauseln) abschließen, welcher der Auftragnehmer beitreten und die Pflichten des Unterauftragnehmers regelmäßig kontrollieren und dokumentieren muss.
Die Übermittlung von Daten ist erst zulässig, wenn der Auftraggeber gegenüber dem Auftragnehmer und Unterauftragnehmer schriftlich bestätigt hat, dass die erforderlichen Vereinbarungen unterzeichnet worden sind.
Die Unterauftragnehmer sind unter §11 des Vertrages als Anlage aufzuführen.

Die Verarbeitung und Nutzung der Daten findet ausschließlich im Gebiet der Bundesrepublik Deutschland, in einem Mitgliedsstaat der Europäischen Union oder in einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum statt.
Jede Verlagerung in ein Drittland bedarf der Erfüllung der in den einschlägigen EU-Richtlinien getroffenen Regelungen, der Erfüllung der gesetzlichen Regelungen nach dem Bundesdatenschutzgesetz und der vorherigen schriftlichen Zustimmung des Auftraggebers, und darf im Anschluss an diese Zustimmung nur erfolgen, wenn die besonderen Voraussetzungen der §§ 4b, 4c BDSG erfüllt sind.
Falls ein Subunternehmen beauftragt werden soll, gelten diese Anforderungen zusätzliche zu den Bestimmungen in § 3 Abs. 8 u. 9.
11.
Die Sicherheit der Datenverarbeitung und die angewandten Verfahren gemäß § 9 BDSG sind mit dem Auftraggeber im Vorfeld abzustimmen.

§ 8
Laufzeit
Diese Vereinbarung gilt für die Dauer des bestehenden Dienstleistungsvertrages zwischen den Parteien.

Der Auftraggeber kann die Vereinbarung jederzeit ohne Einhaltung einer Frist kündigen, wenn ein schwerwiegender Verstoß des Auftragnehmers gegen die Bestimmungen dieser Vereinbarung vorliegt, der Auftragnehmer eine Weisung des Auftraggebers nicht ausführen kann oder will oder der Auftragnehmer den Zutritt des Auftraggebers vertragswidrig verweigert.
§ 9
Haftung
Der Auftragnehmer haftet im Rahmen der gesetzlichen Bestimmungen für Schäden, die infolge schuldhaften Verhaltens gegen die Datenschutzbestimmungen oder gegen diese Datenschutzvereinbarung entstehen.
Ebenso haftet er für schuldhaftes Verhalten seiner Unterauftragnehmer sowie deren Unterauftragnehmer.

If verification is successful, the client is to conclude a data protection agreement with the subcontractor in accordance with Directive 95/46/EC of the European Parliament and the Council (standard contractual clauses), which the contractor must join. The contractor must also regularly monitor and document the subcontractor's obligations.
The transmission of data is only permissible if the client has confirmed to the contractor and subcontractor in writing that the necessary agreements have been signed.
The subcontractors are to be cited under Section 11 of the contract as an annex.

The processing and use of the data is to take place exclusively in the territory of the Federal Republic of Germany, in a member state of the European Union or in another contracting state of the Agreement on the European Economic Area.
Each transfer to a third country requires the compliance with the regulations of the relevant EU directives, the compliance with the legal regulations according to the German Federal Data Protection Act and the prior written consent of the client, and may only take place following this consent if the special requirements of Sections 4b and 4c of the BDSG are met.
If a subcontractor is to be commissioned, these requirements shall apply in addition to the provisions in Section 3, Paragraphs 8 and 9.

The security of data processing and the procedures applied in accordance with Section 9 of the BDSG are to be coordinated with the client in advance.

Duration

Section 9
Liability

Source text - German Belehrung über das Fahrverbot
Das Gericht hat mit dem anliegenden Strafbefehl gegen Sie ein Fahrverbot verhängt.
Bitte beachten Sie dazu folgende Hinweise:
Das Fahrverbot wird wirksam, wenn der Führerschein nach Rechtskraft des Strafbefehls in amtliche Verwahrung gelangt, spätestens jedoch mit Ablauf von einem Monat seit Eintritt der Rechtskraft.
Ab diesem Zeitpunkt dürfen Sie im öffentlichen Straßenverkehr kein Kraftfahrzeug mehr führen.
Tun Sie das trotzdem, machen Sie sich wegen Fahrens ohne Fahrerlaubnis (§ 21 Straßenverkehrsgesetz) erneut strafbar; außerdem kann das Kraftfahrzeug eingezogen werden.
Falls Sie nicht im Besitz einer Fahrerlaubnis sind, wird das Fahrverbot wirksam mit Rechtskraft der vorliegenden Entscheidung.
Die für die Wirksamkeit des Fahrverbots maßgebliche Rechtskraft tritt ein:
a)
zwei Wochen nach Zustellung des Strafbefehls, sofern Sie innerhalb dieser Frist nicht Einspruch einlegen,
in dem Zeitpunkt, in dem ein von den Rechtsmittelberechtigten erklärter Verzicht auf Einlegung eines Rechtsmittels bei Gericht eingeht oder
wenn ein Rechtsmittel rechtzeitig eingelegt war, in dem Zeitpunkt, in dem die Erklärung über die Rücknahme bei Gericht eingeht.
Beachten Sie hierzu bitte die Rechtsmittelbelehrung auf dem Strafbefehl.
Für die Dauer des Fahrverbots ist Ihr Führerschein amtlich zu verwahren, es sei denn, der Führerschein wurde von einer ausländischen Behörde ausgestellt und Sie haben Ihren Wohnsitz nicht in der Bundesrepublik Deutschland.
In diesem Fall ist die Dauer des Fahrverbots in dem ausländischen Führerschein zu vermerken.
Besonders wichtig:
Spätestens nach Ablauf von einem Monat nach Rechtskraft dürfen Sie kein Kraftfahrzeug mehr führen; die Verbotsfrist wird frühestens von dem Tage an gerechnet, an dem Ihr Führerschein in amtliche Verwahrung gelangt ist.
Translation - English Driving Ban Instructions

Your driver's license must be held by officials for the duration of the driving ban, unless the driver's license was issued by a foreign authority and you do not reside in the Federal Republic of Germany.
In this case, the duration of the driving ban must be recorded on the foreign driver’s license.
Important:
You may not drive a motor vehicle after one month has elapsed from the date on which it takes legal effect, at the latest. The period of prohibition is calculated at the earliest from the day on which your driver’s license has been placed in official storage.
