Source text - Arabic ACCESS TO JUSTICE FOR CHILDREN: ALGERIA

I. What is the legal status of the Convention on the Rights of the Child (CRC)?
A. What is the status of the CRC and other relevant ratified international instruments in the national legal system?
The People’s Democratic Republic of Algeria (Algeria) ratified the CRC by adopting a Presidential Decree n° 92-09 of 17 November 1992, which was published on 23 December 1992.
In addition, Algeria has also ratified the Optional Protocols to the CRC on the Sale of Children, Child Prostitution and Child Pornography (2 September 2006, Algerian Official Journal No. 55) and on the Involvement of Children in Armed Conflict (2 September 2006, Algerian Official Journal No. 55).
B. Does the CRC take precedence over national law?
The principle that ratified treaties take precedence over domestic law is enshrined in the Algerian Constitution. Article 132 stipulates that “treaties ratified by the President of the Republic, in the circumstances provided for by the Constitution, shall take precedence over the law”.
This principle was confirmed by the Constitutional Council in a decision of 20 August 1989, which held that “after ratification and upon publication, any convention is incorporated into domestic law and, pursuant to article 132 of the Constitution, acquires a higher status than the law, thereby permitting any Algerian citizen to invoke it before the courts".
C. Has the CRC been incorporated into national law?
Yes. The decision of the Constitutional Council of 20 August 1989 confirms that once the CRC was ratified it became incorporated into national law.
Although Algeria has ratified the CRC, it has issued Interpretative Declarations regarding Articles 13, 14 paragraphs 1 and 2, 16 and 17 of the CRC. The purpose of these declarations is for Algeria to express its views on these Articles in light of the Algerian Constitution which provides that Islam is the official religion of the State.
D. Can the CRC be directly enforced in the courts?
Yes. The decision of the Constitutional Council of 20 August 1989 confirms that any Algerian citizen can invoke the CRC before the courts.
E. Are there examples of domestic courts using or applying the CRC or other relevant international instruments?
None of the decisions of the Constitutional Council since 1989 concern children's rights or human rights in general. There are no other online tools or databases that allow access to decisions rendered by the Algerian tribunals and courts.

أولا: ما هو الوضع القانوني لاتفاقية حقوق الطفل؟
أ.ما هو وضع اتفاقية حقوق الطفل وغيرها من الصكوك الدولية ذات الصلة المصادق عليها في النظام القانوني المحلي؟
صادقت جمهورية الجزائر الشعبية الديمقراطية (الجزائر) على اتفاقية حقوق الطفل باعتمادها "مرسوم رئاسي رقم 92-09 بتاريخ 17 نوفمبر 1992 و صدر في 23 ديسمبر 1992.
بالإضافة، صادقت الجزائر أيضا على البروتوكولات الإختيارية الملحقة باتفاقية حقوق الطفل بشأن بيع الأطفال، واستغلال الأطفال في البغاء وفي إنتاج المواد الإباحية (2 سبتمبر 2006، الجريدة الرسمية الجزائرية رقم 55) و بشأن مشاركة الأطفال في الصراعات المسلحة (2 سبتمبر 2006، الجريدة الرسمية الجزائرية رقم 55).
ب. هل اتفاقية حقوق الطفل لها الأسبقية على القانون المحلي؟
تأكد هذا المبدأ من قبل المجلس الدستوري في القرار المؤرخ 20 أغسطس 1989، الذي نص على أنه بموجب المادة 132 من الدستور بأن "المعاهدات التي صادق عليها رئيس الجمهورية، في الحالات المنصوص عليها في الدستور، لها الأسبقية على القانون"، و الذي عقد أن "بعد التصديق عليها وعند النشر، أي اتفاقية أدمجت في القانون المحلي وعملا بالمادة 132 من الدستور، يكتسب مركزا أعلى من القانون، مما يتيح لأي مواطن جزائري بالاستناد إليها أمام المحاكم" .
ج. هل أدرجت اتفاقية حقوق الطفل في القانون المحلي؟
نعم. ويؤكد القرار الذي اتخذه "المجلس الدستوري" في 20 أغسطس 1989 أنه متى تم التصديق على اتفاقية حقوق الطفل تدرج في القانون الوطني. و على الرغم من أن الجزائر قد صادقت على اتفاقية حقوق الطفل، فقد أصدرت "الإعلانات التفسيرية" بشأن المادتين 13، 14 من الفقرات 1 و 2 و 16 و 17 من اتفاقية حقوق الطفل. والغرض من هذه الإعلانات للجزائر للتعبير عن وجهات نظرها بشأن هذه المواد في ضوء "الدستور الجزائري" الذي ينص على أن الإسلام هو الدين الرسمي للدولة.

Source text - Arabic Human Rights Watch Criticises Corruption, Conditions in Dimitrovgrad, Serbia
Refugees entering Serbia from Bulgaria through Dimitrovgrad face bad conditions and corrupt Serbian police, according to a report this week by the international organization, Human Rights Watch.
Visiting Dimitrovgrad camp on November 30, HRW lawyer and researcher Lydia Gall confirmed reports by volunteers and Serbian rights organisations, previously cited by NewsThatMoves, on police extortion in registration processes.
She quotes 22-year-old Mohammed as saying, “The police ask for money in return for swift processing. They ask 25 euros, but I don’t have any money and I have been here for seven days waiting for my turn. Some came yesterday, paid the police, and have left.”
Gall also criticized the lack of facilities for the refugees passing through.
"Housing at the makeshift registration facility consists of eight containers that can accommodate only about 80 people. The rest are forced to endure harsh and cold weather in the open, with inadequate humanitarian aid efforts provided by the Serbian state," Gall’s report said. As many as 200 people pass through the facility on a given day.
These are not the most difficult situation the refugees who come through Bulgaria are dealing with. As previously reported by NewsThatMoves, refugees interviewed by the Belgrade Centre for Human Rights and others consistently tell of being threatened, beaten and pistol-whipped by Bulgarian police.

فقد أكدت محامية منظمة هيومان رايتس ووتش والباحثة، غال ليديا، في زيارة لها إلى معسكر ديميتروفغراد في 30 تشرين الثاني/نوفمبر، التقارير الواردة عن المتطوعين ومنظمات الدفاع عن حقوق الصرب، و التي سبق أن أوردتها منظمة "نيوز- ذات-موفز (الأخبار التي تنتقل)، حول ابتزاز الشرطة في عمليات التسجيل.
و نقلت عن أحد اللاجئين و اسمه محمد و عمره 22 عاما قوله "الشرطة يطلبون المال مقابل إنجاز المعاملة بسرعة. أنهم يطلبون 25 يورو، ولكن ليس لدى أي أموال و أنا هنا منذ سبعة أيام في انتظار دوري. و البعض جاء بالأمس فقط و دفعوا إلى الشرطة وغادروا.."
كما انتقدت المحامية ليديا غال الافتقار إلى مرافق للاجئين الذين يعبرون الموقع.
"تتكون مرافق السكن في مرفق تسجيل المؤقت من ثمانية من الحاويات التي لا يمكن أن تستوعب إلا حوالي 80 شخصا. و يضطر الباقون إلى تحمل ظروف الطقس القاسية والباردة في العراء و ضعف المعونة الإنسانية غير الكافية التي تقدمها الدولة الصربية ". كما ذكرت المحامية أنه ما يقرب من 200 شخص يمرون من خلال المرفق في اليوم الواحد.
و هذه ليست هي الأوضاع الأكثر مشقة التي يضطر اللاجئون القادمون عن طريق بلغاريا للتعامل معها. و كما سبق أن ورد في تقارير منظمة "نيوز-ذات-موفز" أن اللاجئين الذين أجريت مقابلات معهم من قبل مركز بلغراد لحقوق الإنسان و غيرهن قد افادوا أنه يجري تهديدهم و ضربهم من الشرطة البلغارية.
