Buenos Aires, 20 de octubre de 2000.
Y VISTOS: Estos autos “XXX contra ZZZ y otros sobre Desalojo por falta de pago. Sumario”, para dictar sentencia de los que
RESULTA:
I.- A fs. 23/26 se presenta, por apoderado, XXX y promueve demanda contra ZZZ y subinquilinos y ocupantes, por desalojo por falta de pago, respecto del inmueble ubicado en la calle [dirección].
Para fundar su pretensión dice que dio en locación el inmueble mencionado el 17 de abril de 1997 por un período de dos años.
Expresa la actora que los locatarios se encuentran en mora en el pago de los alquileres a partir del mes de marzo de 1998.
Manifiesta que intimó por medio fehaciente el pago de los arriendos, sin respuesta alguna.
Funda el derecho y ofrece la prueba de su parte.
Solicita se notifique la presente acción a la fiadora Edit L.
II.- A fs. 29/30 se presenta, por propio derecho, ZZZ y contesta la demanda, solicitando su rechazo, con costas.
Opone la excepción de falta de personería por no haberse acreditado la titularidad del dominio del inmueble que se intenta desalojar.
Reconoce la relación locativa, pero dice que al no haberse acreditado el carácter de propietaria del inmueble se ha negado a pagarle los alquileres a la actora.
Funda el derecho y ofrece prueba.
III.- A fs. 54/56 la actora contesta la excepción opuesta por el locatario, solicitando su rechazo con costas.
V.- A fs. 76 se rechaza la excepción de falta de legitimación para actuar opuesta por el demandando.
VI.- A fs. 79 se declara la cuestión como de puro derecho. Con ello, a fs. 94 se llama a “Autos para sentencia”, providencia que se encuentra consentida.
Y CONSIDERANDO:
I.- La actora reclama el desalojo de los demandados y eventuales subinquilinos y ocupantes, del inmueble sito en [domicilio], séptimo piso, de Capital Federal, por la causal de falta de pago de los arriendos desde el mes de marzo de 1998 hasta el presente.
Al contestar la demanda, el accionado ZZZ ha reconocido el contrato de locación reservado en sobre cerrado perteneciente al juicio que sobre ejecución de alquileres tramita entre las mismas partes y que corre por cuerda y cuya fotocopia obra a fs. 14/19 de estos autos…
Por lo expuesto en los Considerandos que anteceden, llamada a dictar sentencia en definitiva, FALLO:

In re “XXX vs. ZZZ et al – Eviction proceedings based on default in payment – Speedy Trial Proceedings” the court is ready for judgment.
Whereas,
I.- On folios 23 to 26 Plaintiff XXX, represented by her attorney-at-law, files a complaint against Defendants ZZZ and any subtenants and occupants of the premises located at [domicile], for eviction due to default in payment.
In order to support her cause of action Plaintiff states that she leased Defendants the premises located at the place above mentioned on April 17, 1997 for a term of two years.
Plaintiff further states that tenants defaulted payment of rents as from March, 1998.
Plaintiff also states that notice demanding payment was sufficiently served on the Defendants, but there was no response.
Plaintiff supports her cause of action and submits evidence to the Court.
Plaintiff requested that surety, Edit L., be served with notice of the complaint.
II.- On pages 29 to 30, ZZZ, acting pro se, filed an answer to the complaint denying Plaintiff’s allegations and requesting the Court to impose litigation costs on Plaintiff.
Defendant raises the defense of lack of Plaintiff’s legal capacity to sue due to her failure to show good title to the leased premises.
Defendant admits the existence of landlord–tenant relationship and further states that payment was not furnished because of failure by Plaintiff to show good title to the property.
Defendant supports his cause of action and submits evidence to the court.
III.- On pages 54 to 56 Plaintiff replies to Defendant’s defense, requesting the Court to dismiss said defense and to impose litigation costs on Defendant.
V.- On page 76 defense of Plaintiff’s lack of standing to sue raised by Defendant is dismissed.
VI.- On page 79 the case is declared a mere question of law; therefore on page 94, the case is set for judgment, no objection having been raised in this regard.
AND CONSIDERING THAT:
I.- Plaintiff requests that Defendants, subtenants and occupants for the time being, be evicted from the premises located at [domicile], piso séptimo de Capital Federal due to default in payment of rents as from March 1998 to this date.
Defendant, ZZZ, in his answer to the complaint admitted the existence of the lease agreement which is kept in a closed envelope and being part of the civil action regarding collection of rents pending in separate proceedings between the same parties, the photocopies of which are entered on pages 14 /19.
Pursuant to the facts abovementioned, IT IS HEREBY ORDERED, ADJUDGED AND DECREED as follows:
