Bei der XXX AG handelt es sich um die Konzernmutter eines weltweit tätigen Großkonzerns und zugleich den 4. größten Speicherchiphersteller der Welt mit zahlreichen in- und ausländischen Tochtergesellschaften sowie u.a. ca. 11,500 nationalen und internationalen Patenten und rund 4.000 Patentanmeldungen. Dies bedingt höchst komplexe Strukturen und Verflechtungen innerhalb des Konzerns aber auch im Verhältnis zu der Rechtsvorgängerin, der YYY AG. Aufgrund der weltweiten Ausrichtung des Konzerns bestehen darüber hinaus in sehr vielen Fällen Bezugspunkte zu ausländischen Rechtsordnungen, wodurch entsprechender Mehraufwand entsteht bzw. entstand.
So ergaben sich im Rahmen der bisherigen Verfahrensbearbeitung unzählige Problemstellungen und Sachverhalte, die intensiver und umgehender Bearbeitung bedurften, jedoch aufgrund der Vielzahl der Vorgänge nicht im Einzelnen, sondern allenfalls auszugsweise im Rahmen des bereits erstatteten Gutachtens sowie dieses Berichtes skizziert werden können. Die nachfolgenden Ausführungen erheben mithin keinen Anspruch auf Vollständigkeit und können die Komplexität und Vielschichtigkeit dieses Verfahrens, welches weit über die Anforderungen eines „normalen“ Insolvenzverfahrens hinausgehen, auch aufgrund der zur Verfügung stehenden Zeit und der vielfältigen, unter hohem Zeitdruck gleichzeitig zu bewältigenden Aufgaben nur auszugsweise beleuchten.

XXX AG is the parent company of a major corporation with global activities, as well as the 4th largest memory chip manufacturer in the world, with numerous domestic and foreign subsidiaries as well as approx. 11,500 national and international patents and around 4,000 patent applications, among others. Consequently, extremely complex structures and linkages exist within the corporation as well as in relation to its predecessor in interest, YYY AG. The global orientation of the corporation also accounts for references to foreign legal systems in a large number of cases, thus necessitating additional corresponding efforts.
Due to these circumstances, countless problems and issues that required intensive and prompt handling presented themselves within the framework of the processing of the case up to this point, which due to the multitude of procedures cannot be individually delineated within the framework of the assessment previously submitted or of this report, but at best addressed only in extracts. The following observations consequently do not claim to be complete, and due to the amount of time available and the many tasks to be completed under a tight deadline can only partially illuminate the complexity and multilayeredness of this case, which exceed by far the demands of “normal” bankruptcy proceedings.
