Source text - Dutch X had een testament gemaakt waarbij zij haar dochter in de legitieme heeft gesteld en zij het vrijkomende gedeelte van haar nalatenschap aan Y vermaakt heeft. De in de legitieme stelling houdt in dat Z voor een gedeelte van 1/4e gerechtigd was in de nalatenschap van haar moeder. X had in haar testament een zogenaamde ouderlijke boedelverdeling opgenomen. Deze verdeling heeft tot gevolg (kort samengevat) dat aan Y alle goederen van de nalatenschap van X zijn toegedeeld, onder de verplichting alle schulden voor zijn rekening te nemen. De dochter van X heeft haar erfdeel tegoed gehouden in de vorm van een vordering (in geld) op Y. Y heeft hierdoor dus een schuld aan de dochter van X gekregen welke door haar in beginsel pas opgeëist kon worden bij overlijden van Y. In het testament van X is bepaald dat er een rente op de vordering wordt bijgeschreven. De rente is zes procent per jaar vanaf de dag van overlijden van X tot de dag van de voldoening, zonder dat er sprake is van rente op rente. Deze rente is slechts samen met de vordering opeisbaar.
Translation - English X had drawn up a will, limiting her daughter's rights to her forced share in the estate and bequeathed what was left of the estate to Y. The limitation of her rights to her forced share implicates that Z had a right to one fourth part of her mother's estate. X had included a so called division of the parental estate in her will. Briefly stated, this division results in the allocation to Y of all assets of X's estate, subject to the obligation of equally accepting the transferal of all claims against it. X's daughter has retained her forced share in the estate by way of a (pecuniary) claim against Y. Y thus owes a debt to X's daughter, which debt can, in principle, only be claimed by her upon the death of Y. X's will stipulates that an interest will be added to the claim, amounting to six percent a year, from the date of death of X to the day the sum is paid in full, but without a compound interest. This interest can only be claimed simultaneously with the principle claim.
