It arose in the context of proceedings before the Austrian courts challenging the requirement imposed by national law on third-country nationals with long-term resident status to provide a particular type of proof of (German) language proficiency in order to be entitled to a social benefit in the form of housing assistance.
Translation - Dutch Op [...] is bij de griffie van het Hof het onderhavige verzoek van [...] van het Landesgericht Linz (rechter in tweede aanleg Linz, Oostenrijk) om een prejudiciële beslissing ingekomen. Dit verzoek is ingediend naar aanleiding van een procedure waarin bij de Oostenrijkse rechterlijke instanties wordt opgekomen tegen het naar nationaal recht geldende vereiste dat langdurig ingezeten onderdanen van derde landen op een specifieke wijze aantonen dat zij beschikken over kennis van de (Duitse) taal om recht te hebben op een sociale prestatie in de vorm van bijstand voor huisvestiging.
