For this reason, spray drift associated with the program will be more toxic to plants than drift from ‘normal’ Roundup. Because the efficacy of the spray mixture needed to be enhanced to make it effective on coca, it follows that many other species will be more sensitive to the spray. These could include many of the crop species grown in XXXX, such as yucca, plantain, corn, and fruit trees.”
x.xx In addition to the direct effects of the herbicide, this chemical can have significant secondary effects on non-target plants, inhibiting their vitality and productivity in the long-term:
“In addition to direct mortality to nontarget plants, there are several ways in which spray drift may result in chronic long-term effects, including loss of plant vigor for years following exposure. The purpose of this procedure is to describe the actions to be taken to implement the XXXX Dropped Object Management System (DOMS).
The program has used the Dropped Object Prevention Scheme (DROPS) and is designed to promote a philosophy of hazard control in the daily operation of the rig, which means that existing checklists and maintenance programs will be utilized wherever possible to provide the necessary hazard identification and controls.
This procedure is intended as a guide to eliminating the incidence of dropped objects within drilling derrick structures, areas below the rig floor, and from cranes. As such, the overall objectives of the DOMS model are:
• Eliminate injury to people
• Eliminate the incidence of damage sustained by dropped objects
• Eliminate damage to other associated equipment

Severability
To the extent permitted by law, the Parties waive any provision of law that would render any provision in this Agreement invalid, illegal or unenforceable. If any provision of this Agreement is held to be invalid, illegal or unenforceable, then such provision will be given no effect by the Parties and shall not form part of this Agreement. Provided that the rights and obligations of each Party are not materially and adversely affected, all other provisions of this Agreement shall remain in full force and effect and the Parties will use their best efforts to negotiate a provision in replacement of the provision held invalid, illegal or unenforceable that is consistent with applicable law and achieves, as nearly as possible, the original intention of the Parties.
Waiver and Non-exclusion of Remedies
A Party's delay or failure to enforce any provision of this Agreement, or to exercise any right or remedy shall not constitute a waiver of that provision, right or remedy or prevent such Party from enforcing any or all provisions of this Agreement and exercising any rights or remedies in the future. To be effective any waiver must be in writing. The doctrine of affirmation of contract by election shall not apply to this Agreement.
No remedy conferred by any provision of this Agreement is intended to be exclusive of any other remedy except as expressly provided for in this Agreement and each and every remedy shall be cumulative and shall be in addition to every other remedy given in this Agreement or existing at law or in equity, by statute or otherwise.

Renuncia y no exclusión de recursos
Cuando una de las Partes se demore en exigir o no exija una disposición del presente Acuerdo, o cuando se demore en ejercer o no ejerza un derecho o recurso, ello no constituirá renuncia a dicha disposición, derecho, o recurso, ni evitará que dicha Parte exija el cumplimiento de cualquiera o todas las disposiciones del presente Acuerdo, y que ejerza un derecho o recurso en el futuro. Toda renuncia se debe realizar por escrito para que tenga validez. La doctrina de ratificación del contrato por elección no se aplicará al presente Acuerdo.
Ningún recurso concedido por una disposición del presente Acuerdo tiene la finalidad de excluir a algún otro recurso salvo que esté expresamente establecido en el presente Acuerdo, y cada uno de los recursos tendrán carácter acumulativo y serán además de los otros recursos otorgados en el presente Acuerdo o que existan conforme al derecho o al sistema de equidad, por ley o de otro modo.
