Source text - German Zur Realisierung des Projektes hat das Projektteam des Kunden ein Lastenheft entwickelt. Der Kunde hat dieses Lastenheft dem Anbieter als Grundlage für die Angebotserstellung am 23.11.2011 übergeben. Auf Grundlage dieses Lastenhefts entwickelt der Anbieter in einer Planungsphase ein Pflichtenheft, das die Umsetzung des Lastenhefts für das System um-fassend beschreibt. In der Realisierungsphase wird anschließend die Software entwickelt und eingeführt. Der Kunde hat das Recht, nach Abschluss der Planungsphase diesen Ver-trag zu kündigen. In diesem Fall schuldet der Kunde dem Anbieter nur das vereinbarte Ent-gelt für die Planungsphase. Der Kunde hat das alleinige Recht, die Ergebnisse aus der Pla-nungsphase zu nutzen und das Projekt mit einem anderen Anbieter fortzuführen, ohne das der Anbieter irgendwelche Rechte gegen den neuen Anbieter oder den Kunden geltend machen kann.
Translation - English The client’s project team has compiled requirement specifications for the implementation of the project. The client has handed over the requirement specifications to the service provider on 23.11.2011 as the basis to generate an offer. Based on these requirement specifications, the service provider shall develop functional specifications in a planning phase; these functional specifications shall comprehensively describe the implementation of the requirement specifications for the system. The software shall then be developed and installed in the implementation phase. The client shall be authorised to terminate this contract after the completion of the planning phase. In this case, the client shall be liable to pay the service provider only the agreed compensation for the planning phase. The client shall only be authorised to use the results from the planning phase and to continue the project with another service provider and the present service provider shall not be authorised to assert any rights against the new service provider or the client.
