Source text - English Respecto de las entidades financieras, las normas específicas establecen los sistemas de autoliquidación y liquidación de dichas entidades y, si bien las mismas no pueden acceder a un concurso preventivo, son sujetos susceptibles de ser declarados en quiebra, a través del régimen previsto por la ley 21.526, reformada por las leyes 24.144, 24.485 y una nueva norma legal sancionada el 21 de febrero de 1996 y promulgada el 11 de marzo de 1996 —consignada en su publicación como mera modificación de la ley 21.526.
El régimen —en este caso— es realmente particular.
La norma dispone que las entidades financieras no podrán solicitar la formación de concurso preventivo ni su propia quiebra, ni ser declaradas en quiebra a pedido de terceros hasta la revocación de su autorización para funcionar.
Cuando la quiebra sea pedida por circunstancias que la harían procedente según la legislación común, los jueces deben rechazar de oficio el pedido y deben dar intervención al Banco Central para que, si así correspondiere, se formalice la petición de quiebra. Si la resolución del Banco Central que dispone la revocación de la autorización para funcionar comprendiera la decisión de peticionar la quiebra de la ex-entidad, dicho pedido deberá formalizarse perentoriamente ante el juez competente, quien deberá pronunciarse al respecto.
Ahora bien, estando la entidad en proceso de liquidación judicial, el liquidador deberá solicitar de inmediato la declaración de quiebra, si advirtiera la cesación de pagos por si mismo, o en virtud de los pedidos de quiebra, formulados por terceros. El juez —en este caso— deberá disponerla si advirtiera la existencia de los presupuestos para declaración de la quiebra.
Translation - English Regarding financial entities the applicable rules provide for their self winding up and winding up and even though these entities cannot be submitted to a reorganization proceeding, they can be declared in bankruptcy, by means of the scheme provided under Law 21.526, amended by Laws 24.144, 24.485 and a new legal rule passed on February 21st, 1996 and enacted on march 11th, 1996 – which appeared in its publication just as a modification of law 21.526.
In this case, the scheme is really special.
The rule provides that financial entities can not be entitled to ask for their reorganization proceeding or declaration in bankruptcy, nor can they be declared bankrupt upon petition filed by third parties, until their authorization to operate be revoked.
In those cases where bankruptcy would apply pursuant to ordinary law, judges must deny ex officio the petition in bankruptcy and must notify the Central Bank so that if corresponding, the petition in bankruptcy be filed. If the resolution of the Central Bank providing for the revocation of the authorization to operate, included the decision to file a petition in bankruptcy of the former entity, said petition must be peremptory filed before the judge having power to hear the case, who shall decide thereon.
Now, if the entity is under a winding up proceeding ordered by the court, the trustee in bankruptcy must immediately file a petition in bankruptcy upon realizing there is cessation in payment or as a consequence of petitions filed by third parties. In this case, the judge must accept said petition if he finds the grounds for the declaration in bankruptcy are present.
