I am translating material for several books writtten by the Société Baudelaire's President, to be published serially from today onwards. Translating literary sources of a high standard is demanding, since one is dealing with something living, rather like kneading dough for breadmaking, when one feels the dough rising as one handles it. It calls on all the resources of one's mother tongue, unlike technical translation, for which the word choice is comparatively limited.

Sans discuter de la pertinence de la distinction traditionnelle entre systèmes de common law et systèmes romano germaniques, on doit isoler les fondements juridictionnels spécifiques de la Grande-Bretagne ou de l’Irlande. Ils retiennent l’autorité du précédent, l’effet relatif des jugements entre parties au procès est consacré, mais une décision de la cour peut être citée comme précédent dans un procès principal engageant des questions similaires de fait ou de droit. En outre, le principe du “ stare decisis ”, respect des décisions des tribunaux supérieurs, s’applique à toutes les décisions de la cour d’appel, de la chambre des Lords et aux décisions de la divisional court de la cour administrative. Les autres pays se conforment en général à l'autorité res judicata. Des cas particuliers existent néanmoins, tel Malte, qui tout en respectant l'autorité de la chose jugée, considère que la décision peut être utilisée comme précédent dans d'autres procès où apparaissent des questions similaires. Ces précédents n'ont cependant qu'une valeur persuasive. En général, on peut bien sûr mettre à part les affaires de série, qui imposent qu'une solution soit répétée.
L’autorité de la chose jugée est appréciée généralement comme ayant un effet relatif, en revanche les décisions d’annulation des actes administratifs ont un effet erga omnes, comme en Belgique. En outre, peut exister une possibilité d’extension de l’autorité de chose jugée à des tiers pour des cas strictement identiques. D’autres Etats, comme la Lettonie, soulignent que l’interprétation d’une norme juridique dans un jugement de cassation est obligatoire pour la juridiction qui statue à nouveau.
Translation - English A/ The traditional affirmation of relative authority
Without discussing the relevance of the traditional distinction between Common-Law legal systems and Romano-Germanic systems, it is necessary to pinpoint the special judicial foundations in Great Britain or Ireland. Those countries' legal systems refer to the authority of precedent; the relative effect of judgements between parties to the action is firmly established, but a court ruling may be cited as a precedent in a main action involving similar points of fact or law. In addition, the principle of stare decisis, of abiding by the rulings of the higher courts, applies to all decisions of the Court of Appeal, the House of Lords and the rulings of the administrative appeals Divisional Court. As a rule, the other countries conform to the authority of res judicata. Special cases nevertheless exist, such as Malta which, while deferring to the authority of res judicata, considers the decision to be usable as a precedent in other cases in which similar issues arise. Even so, these precedents are only of persuasive value. In general, obviously, class actions can be set apart, since they require a solution to be repeated.
The authority of res judicata is usually construed as having a relative effect; on the other hand, rulings annulling administrative acts have an erga omnes effect, as in Belgium. Furthermore, scope may exist for extending res judicata authority to third parties in strictly identical cases. Other States, such as Latvia, emphasise that the interpretation of a legal standard in a judgement on cassation [ruling solely on points of law] is binding upon the jurisdiction making a further ruling.
