xxxx, xxxx Klongtan Nua, Wattana, Bangkok 10110 (hereinafter referred to as “Landlord”)
- AND –
xxxx
(hereinafter referred to as "Tenant")
WHEREAS:
(1) The Landlord has the right to let on lease the Premises (as defined in Basic Terms)
(2) The Tenant wishes to lease the Premises on the terms and subject to the conditions set out in this
Lease Agreement.

Source text - English 4.1 The Tenant will pay the monthly rental installments as stipulated in Clause 1.7 of this Lease Agreement in advance each month at the address of The Landlord or at any other place notified in writing by the Landlord by the 1st of each month. If the 1st of each month is a holiday of The Landlord, then The Tenant must pay on the next working day regardless of the rent having to be demanded by The Landlord and regardless of whether The Tenant is using The Premises for his business or not. It is agreed that the Tenant shall be in possession of The Premises from the beginning of this Lease Agreement as stipulated in Clause 1.5 until The Tenant has handed over The Premises back to The Landlord according to Terms of this Agreement or in case there is a breach of agreement and The Landlord has exercised his right to terminate this agreement.
4.2 The Tenant agrees to pay for Electricity and Water Usage and any other utility charges according to the electrical meter, water meter and any other of The Premises and as per the rate in this agreement together with the payment of the rental installments. The Tenant agrees that The Landlord has the right to increase the utilities rate subject to any increment by the service provider.
4.3 If the Tenant is late in making any payment, the Tenant agrees to pay late payment penalty as stipulated in Clause 1.12 calculated from the due date until the date the full payment was made and if the payment is late by more than 15(fifteen) days then it shall be deemed The Tenant is deliberately agreement and breaching the terms of this agreement and The Landlord shall have to right to terminate This Agreement and The Tenant agrees to forfeit any security deposits and all payments already made to the Landlord and The Landlord shall have the right to stop the service of Electricity and Water to The Premises and The Tenant agrees to waive the right to demand any compensation or file any lawsuit against The Landlord.
4.4 In case it is required by law for The Tenant to withhold tax for any payment made as per this agreement, the Tenant may do so and submit such payment to the Revenue Department and provide The Landlord with the certificate of tax withheld as proof.
4.5 Any payment to the Landlord must be made by Check or direct transfer to the Landlord’s provided bank account only. The Tenant agrees to not make any cash payment or in any other method not listed above. Payments will only be considered as complete when the amount has successfully entered the Landlord’s bank account and The Landlord has issued receipts for such payments. The Tenant agrees to pay a penalty of 3,000 (Three Thousand) baht for any returned check for any reason on top of the late payment penalty.
