Source text - Finnish Unionin tuomioistuimen oikeuskäytännön mukaan tilanteessa, jossa direktiiviä ei ole saatettu osaksi kansallista lainsäädäntöä sille asetetussa määräajassa, direktiivien ehdottomilla sekä riittävän selkeillä ja tarkoilla määräyksillä on välitön oikeusvaikutus.
Uudistuksen keskeisimmät tavoitteet
Hankintalainsäädännön uudistuksen keskeisimpinä tavoitteina on ollut
• tehostaa julkisten varojen käyttöä
• yksinkertaistaa hankintamenettelyjä
• selkeyttää lain keskeisiä käsitteitä
• parantaa pk-yritysten mahdollisuuksia tarjouskilpailuissa
• parantaa mahdollisuuksia huomioida ympäristö- ja sosiaalisia näkökohtia sekä turvata tarjoajille tasapuolinen ja syrjimätön kohtelu julkisissa hankinnoissa.
Kynnysarvoja ehdotetaan nostettaviksi. Ehdotuksen mukaan kansalliset kynnysarvot nousisivat seuraavasti:
• Tavara- ja palveluhankinnat sekä suunnittelukilpailut 60 000 euroa
• Sosiaali- ja terveyspalvelut ym. erityiset palvelut 400 000 euroa;
• Käyttöoikeussopimukset 500 000 euroa;
• Rakennusurakat 150 000 euroa (säilyisi ennallaan)
Kansalliset kynnysarvot voivat vielä muuttua ehdotuksesta. Asiasta on jätetty eriäviä mielipiteitä. EU-kynnysarvot säilyvät ennallaan. EU-kynnysarvoja tarkastetaan kahden vuoden välein komission erikseen antamalla asetuksella, aiemman käytännön mukaisesti.

Lakiehdotus sisältää omat säännöksensä EU-kynnysarvot ylittäville hankinnoille, EU-kynnysarvot alittaville kansallisille hankinnoille, käyttöoikeussopimuksille, sosiaali- ja terveyspalvelujen (jäljempänä sote) hankinnoille sekä muille erityisille palveluhankinnoille. EU-kynnysarvot alittavien hankintojen sekä sote-hankintojen ym. erityisryhmään kuuluvien hankintojen suhteen jäsenmailla on ollut hyvin paljon harkintavaltaa päättää käytettävistä hankintamenettelyistä. Lakiehdotuksesta onkin nähtävissä, että kyseiset hankinnat on pyritty sääntelemään hyvin kevyesti. Sote-palvelut ja muut erityiset palvelut on lueteltu lakiehdotuksen liitteessä C.
Kansallisista menettelyistä entistä kevyempiä
Mietinnön mukaan kansalliset menettelyt olisivat jatkossa huomattavasti EU-menettelyjä kevyempiä. Hankintayksikkö voisi tarkoituksenmukaisesti valita käytettävän hankintamenettelyn, joka pitäisi ennalta kuvata hankinta-asiakirjoissa. Halutessaan hankintayksikkö voisi jopa luoda omanlaisiaan menettelyjä, esimerkiksi neuvottelumenettelyjä väljempiä neuvotteluja sisältäviä menettelyjä tai toimittajarekisteriin perustuvia järjestelmiä.
Hankintayksikön olisi kuvattava käyttämänsä menettely hankintailmoituksessa tai tarjouspyynnössä. Kuvaus tulisi esittää siten, että toimittajat pystyvät sen perusteella ennakoimaan käytetyn menettelyn luonnetta ja kulkua sekä tietävät oman roolinsa menettelyssä. Menettelyn valinnassa ja toteutuksessa tulisi kuitenkin huomioida lain 3 §:ssä mainitut periaatteet. Menettely ei lähtökohtaisesti saisi muodostua syrjiväksi tai kilpailua rajoittavaksi.
Sähköisyysvaatimus ei koskisi kansallisia hankintoja eikä sote-hankintoja / erityisryhmän hankintoja, eli kyseiset hankinnat olisi mahdollista toteuttaa ilman sähköisiä järjestelmiä. Jos hankintayksikkö kuitenkin toteuttaa tällaisenhankinnan täysin sähköisenä, tulee järjestelmien osalta huomioida lakiehdotuksen 62 §:n vaatimukset koskien sähköisiä järjestelmiä ja sähköistä tietojenvaihtoa.
Jatkossa suorahankintailmoituksen voisi tehdä myös kansallisista hankinnoista, josta käynnistyisi
14 vrk:n valitusaika.
Sote-hankinnoissa tulisi huomioida erityisesti näitä koskeva erityislainsäädäntö. Lisäksi tulisi huomioida asiakkaiden erityistarpeet sekä kuuleminen. Sopimusehtojen tulisi olla sellaisia, ettei ehdoista muodostuisi kohtuuttomia tai epätarkoituksenmukaisia seurauksia asiakkaille.
Yli 400 000 euron sote-hankinnoista tulisi aina julkaista EU-hankintailmoitus. Jos sote-hankinnassa käytetään valintaperusteena halvinta hintaa, valinta tulisi perustella hankinta-asiakirjoissa.
Keskeisiä uudistuksia EU-kynnysarvot ylittäviin hankintoihin
EU-kynnysarvot ylittäviin hankintoihin on ehdotettu lukuisia muutoksia. Keskeisimpiä ehdotuksia ovat:
• Hankintamenettelyyn liittyvä tietojen vaihto sähköiseksi yhteishankintayksiköiden osalta 18.4.2017 mennessä ja muiden hankintayksiköiden osalta 18.10.2018 mennessä. Sähköinen tietojenvaihto on määritelty tarkemmin lakiehdotuksen 62 §:ssä. Pykälässä asetetaan tiettyjä vaatimuksia sähköiseen viestintään käytettäville välineille ja laitteille sekä niiden teknisille ominaisuuksille. Jos hankintayksikkö esimerkiksi käyttää sähköisiä kilpailutusjärjestelmiä tai ottaa tarjouksia vastaan sähköisesti, järjestelmien on täytettävä pykälän asettamat vaatimukset.
• Hankintojen jakaminen osiin olisi periaatteellinen pääsääntö. Suositus hankintojen jakamisesta koskee kaiken kokoisia EU-kynnysarvot ylittäviä hankintoja. Mikäli hankintaa ei jaeta osiin, tulisi tämä perustella hankinta-asiakirjoissa. Jakamisella tavoitellaan pk-yritysten osallistumismahdollisuuksien parantamista. Jakamatta jättämisestä ei kuitenkaan voi valittaa.
• Liikevaihtovaatimus voi olla maksimissaan kaksi kertaa sopimuksen ennakoitu arvo.
• Tarjouskilpailun määräaikoja on lyhennetty kaikissa menettelyissä.
• Neuvottelumenettelyjen käyttöala on laajempi ja joustavampi. Itse menettelyn kulusta on säännelty tarkemmin.
• Innovaatiokumppanuus on täysin uusi hankintamenettely.
• Puitejärjestelyn voi luoda yhden tai useamman kumppanin kanssa.
• Hankintayksikkö voi vaatia tarjouksia jätettäväksi sähköisen luettelon muodossa.
• Hankintailmoitukset muuttuvat ja lisäksi tulee uusia ilmoituksia mm. sote- sekä muita erityispalveluja koskeva ilmoitus, käyttöoikeussopimuksia koskevat ilmoitukset, sopimusmuutoksia koskeva ilmoitus ja korjausilmoitus. Ilmoitus pitää julkaista ensin TEDissä ja vasta sen jälkeen HILMAssa.
• Pakollisiin ja harkinnanvaraisiin poissulkemisperusteisiin tulee lisäyksiä ja pieniä muutoksia.
• Terminologiaan tulee pieniä muutoksia, joilla tavoitellaan selkokielisyyttä.
• Käytettävät alihankkijat on ilmoitettava sekä näiden vaihdokset sopimusaikana. Hankintayksikön on vaadittava alihankkijan vaihtamista, jos pakollinen poissulkemisperuste on käsillä tai se voi vaatia vaihtoa, jos kyse harkinnanvaraisesta poissulkemisperusteesta.
• Hankintayksikön on hyväksyttävä yhteinen eurooppalainen hankinta-asiakirja (YEHA) alustavaksi näytöksi soveltuvuuden täyttymisestä. Pääsääntö olisi, että vain voittajalta pyydetään varsinaiset soveltuvuutta koskevat todistukset, paitsi jos nämä on jostain syystä tarpeen pyytää menettelyn aiemmassa vaiheessa.
• Halvinta hintaa voi käyttää valintaperusteena tavarahankinnoissa ilman perusteluja. Muissa hankinnoissa halvimman hinnan käyttö tulee perustella hankinta-asiakirjoissa. Valinnasta ei voi valittaa. Tavoitteena on tuoda laadun huomioiminen korostuneemmin esille pelkän hinnan sijasta.
• Hankintayksiköille velvoite selvittää poikkeuksellisen alhaisen tarjoushinnan taustat.

The central goals of the reformation
The most central goals of the reformation of the procurement law legislation have been
• to increase the efficiency of public fund allocation
• to simplify the procurement procedures
• the clarify the central interpretations of the law
• the improve the possibilities of SMEs in bidding competitions
• to improve the possibilities to notice environmental and social considerations as well as
• to secure fair and non-discriminatory treatment to bidders in public procurement
It is proposed to raise the threshold values. According to the proposal (bill in Parliament), the national threshold values would rise as follows:
• Procurement of goods and services as well as design/planning bidding competitions, 60 000 Euros
• Social and health services incl. special services 300 000 Euros;
• Licensing agreements 500 000 Euros;
• Construction works 150 000 Euros (it would stay the same as before)
The national threshold values are still subject to change. Varying opinions have been declared. The EU threshold levels will remain as they are. The EU threshold values are verified every two years via a separate decree issued by the Commission, in accordance with earlier practice.
The bill contains its own rules relating to EU procurement, national procurement, concessions, and procurement belonging to a special group.
The bill contains its own rules for procurement in excess of the EU threshold values, falling below the EU national procurement thresholds, concessions, social and health services procurement, as well as procurement of other specific services. With regard to contracts falling below EU procurement thresholds, as well as social and health care procurement and others belonging to a special group, the member states have been granted a great deal of discretion to decide the procurement procedures. It can be seen from the bill that the supplies are intended to be regulated very lightly. Social and health services and other special services are listed in Annex C.
Less stringent national procedures than before
According to the report, the national procedures would be noticeably less stringent than the EU requirements. The contracting authority could appropriately choose the procedure to be used, which should be described in the pre-contract documents. The competitive procedure would be chosen at the discretion of the contracting authority. If it should so desire, the contracting authority could even create its own procedures, such as less stringent negotiation procedures containing consultations or supplier-register-based systems.
The contracting authority would have to describe the procedure in either the procurement notice or the invitation to tender. The description would have to be presented in such a way that the suppliers would be able to predict, based on the description, the nature and course of the procedure used, as well as know their own role in the procedure. In selecting and executing the procedure, however, the principles mentioned in § 3 should be taken into account. The procedure should not, in principle, constitute a discriminatory or anti-competitive act.
The electronic procurement requirements would not apply to national procurement, nor to social/health procurement and special group procurement, meaning that such acquisitions could be executed without electronic systems. In the event that the contracting authority should still executes this type of procurement entirely electronically, with regards to the electronic system, it would be required that they follow the requirements of § 62 applying to electronic systems and the exchange of electronic data.
In the future, direct purchase notifications could also be carried out with regard to national procurement contracts, after which there would be a 14-day appeal period.
With regard to social and health procurement in particular, the specific legislation applicable to this area should be taken into account. In addition, the specific needs of the client, as well as the consultation, should be taken into account. The terms of the contract should be such that they would not be excessive or have unintended consequences for the client.
Public procurement notices should always be made in the EU register for social and health procurement above 300 000€ in value (ESPD https://ec.europa.eu/growth/tools-databases/espd/filter?lang=en ). If the lowest price is used as the selection criteria in social and health procurement, the choice should be justified in the procurement documents.
Key reforms to procurement in excess of EU thresholds
Numerous amendments have been proposed to procurement exceeding EU thresholds. The main proposals are:
• The exchange of information relating to electronic procurement procedure the contracting entities by 18.04.2017 and, for other entities, 18.10.2018 at the latest. Electronic information sharing is further defined in bill 62 §. The section defines certain requirements for instruments and apparatuses used in electronic communications, as well as for their technical characteristics. For example, when an entity uses electronic tendering systems or receives bids electronically, the systems must meet the requirements of the section.
• The division of purchases into parts should be the principle rule. This recommendation of division of purchases into parts applies to purchases of all sizes exceeding EU thresholds. Whenever the purchase is not distributed into parts, this should be justified in the procurement documents. The aim of this division is to improve accessibility for SME’s. An appeal cannot, however, be made on the basis of non-distribution.
• The revenue requirement can be at most 2X the contract’s estimated value.
• Time limits for the invitation to tender have been shortened in all procedures.
• Scope of use of the negotiation procedures is broader and more flexible. The fees for the procedures are regulated in more detail.
• Innovation Partnership is an entirely new procurement procedure.
• The framework agreement can be created with one or more partners.
• The procuring entity may require tenders to be submitted in the form of an electronic catalogue.
• Contract notices will change, and in addition, there will be new notices, including, among others, concerning social/health/other services, license agreements and changes to contracts, as well as notices for repairs. A notice must first be published in TED and only thereafter in HILMA.
• There will be additions and minor changes in mandatory and discretionary exclusion criteria.
• There will be minor changes in terminology, with the aim being clarity of language.
• Available subcontractors shall be notified of these changes, as well as during the contract period. The contracting entity must require the replacement of a subcontractor if a mandatory criterion for exclusion is met, or it may require the exchange in the case of a discretionary exclusion criteria.
• The contracting entity must adopt a common European procurement document (YEHA) to be used as prima facie evidence of compliance with requirements.
• The general rule should be that the actual certificates of suitability should only be demanded from the winners, unless there is, for some reason, a need to request them at an earlier stage of the proceedings.
• The cheapest price can be used as a selection criterion for supply contracts without justification. In other procurement, the use of the lowest price shall be justified in the procurement documents. The choice cannot be appealed. The aim of this is to bring greater attention on quality rather than price.
• The contracting authority shall have an obligation to investigate the background of an especially low bid price.

Les Français seront nombreux à subir des hausses d’impôt à compter du 1er janvier. Le budget 2011, qui a été validé hier soir par le Conseil constitutionnel, ouvre la voie à 11 milliards d’euros de charges supplémentaires, réparties à quasi-égalité entre les ménages et les entreprises. Le gouvernement souligne qu’il n’y a pas de hausse générale d’impôt. Cela aboutit de fait à la mise en oeuvre d’une kyrielle de mesures ciblées. L’Etat attend notamment plus de 1 milliard de la hausse de TVA sur les offres « triple play » (Internet, téléphonie fixe, télévision). Les quelque 70.000 particuliers employeurs déclarant leur employé au salaire réel vont perdre le bénéfice de l’abattement de 15 points sur les cotisations patronales. Les plusvalues immobilières seront taxées à 19 % au lieu de 16 %, tout comme les plus-values mobilières (actions, obligations). Les entreprises, quant à elles, vont être privées de 2 milliards d’euros d’allégements de charges. La valse des impôts va reprendre de plus belle l’an prochain.
