English to Czech: EU welcomes WTO ruling against Argentinian measures on imports General field: Other
Source text - English EU Trade Commissioner, Karel De Gucht, today welcomed a ruling by an independent panel at the World Trade Organisation (WTO) that certain conditions which Argentina introduced for firms wishing to import goods into the country break WTO law. Commenting on the ruling, Commissioner De Gucht said:
'I've made standing up to protectionism one of the hallmarks of my term as EU Trade Commissioner. This case sends an important signal that protectionism is not acceptable. I call on Argentina to move quickly to comply with the ruling of the WTO panel andremove these illegal measures, and open the way for EU goods to compete fairly on the Argentinian market.'
The EU submitted an official complaint about the measures in May 2012, along with the US and Japan. Today's WTO panel ruling upholds these claims and gives a clear verdict: Argentina may not require local importers or foreign firms to accept various practices forced upon them by the Argentinean authorities as a condition for being allowed to import goods into the country.
These practices include requirements to:
(a) offset the value of their imports into Argentina with at least the equivalent in exports;
(b) limit their imports, either in volume or in value;
(c) reach a certain level of local content in their domestic production;
(d) invest in Argentina; or
(e) keep any profits made in Argentina in the country.
The WTO panel also ruled against a procedure known as the Advanced Sworn Import Declaration ('DeclaraciónJuradaAnticipada de Importación', or DJAI). This requires firms to secure approval by the Argentine authorities before importing goods.
Translation - Czech Evropská unie vítá rozhodnutí Světové obchodní organizace (WTO) proti argentinským opatřením týkajícím se dovozu
Evropský komisař pro obchod Karel De Gucht dnes uvítal rozhodnutí nezávislého panelu Světové obchodní organizace(WTO) o tom,že některé podmínky, které Argentina zavedla pro firmy, jež chtějí dovážet zboží do země, porušují předpisy WTO. Ve svém komentáři k tomuto rozhodnutí komisař De Gucht uvedl:
„Postavit se protekcionismu se stalo jedním z charakteristických znaků mého funkčního období coby evropského komisaře pro obchod. Tento případ vysílá důležitý signál o tom, že protekcionismus není přijatelný. Vyzývám Argentinu, aby urychleně postupovala v souladu s rozhodnutím panelu WTO, odstranila nezákonná opatření a otevřela cestu zboží EU, aby mohlo spravedlivě konkurovat na argentinském trhu.“
EU podalaoficiální stížnost ohledně těchto opatřenív květnu 2012 společně s USA a Japonskem. Dnešní rozhodnutí panelu WTO tyto nároky potvrzuje a přináší jasný verdikt:
Argentina nesmí požadovat, aby místní dovozci nebo zahraniční firmy přijímali různé směrnice a pokyny, které jim argentinské autority vnucují jako podmínku pro povolení dovozu zboží do země.
Tyto pokyny zahrnují následující požadavky:
a) kompenzovat hodnotu svého dovozu do Argentiny alespoň ekvivalentem vývozu;
b) omezit svůj dovoz, buď co do objemu, nebo hodnoty;
c) dosáhnout určité úrovně místního podílu v domácí produkci;
d) investovat v Argentině; nebo
e) ponechat veškerý zisk vytvořený v Argentině v této zemi.
Panel WTO dále rozhodl proti postupu známému jako předběžné místopřísežné prohlášení o dovozu (Declaración Jurada Anticipada de Importación nebo DJAI). Ten vyžaduje, aby si firmy před dovezením zboží zajistily souhlas argentinských úřadů.
