Source text - English Lately in legal literature one can often meet a description of Ukraine as a social, democratic state and a state of law since it is stipulated in the Article 1 of the Constitution of Ukraine. At the same time one author emphasizes that, proclaiming itself sovereign and independent, Ukraine became the state of law, and other states that creation of such a state is a matter of further prospect.
The idea of the state of law has passed a difficult and long way. As early as in ancient times people understood that only law may measure the power, restrict it in favor of people’s common interests, and state in which law contradicts with human nature and does not serve the common welfare would quickly perish.
After the disintegration of the Roman Empire political and legal studies didn’t develop for a long time (their revival is observed only in the XI–XII centuries), however spreading of the Roman law and Roman traditions in Europe resulted strengthening of the foundations of state system, understanding of law as people’s will, and consequently admission of state’s sovereignty being certainly bound up with the law.
In the XII–XIIIth centuries the medieval constitutionalism appeared in the form of parliamentary authorities; representative power and legislative assemblies were formed. Later the idea of restriction of a ruler’s power by law and justice develops in works of many scientists. The ruler’s responsibility comes mainly to responsibility only before God and nature.
However, ideas of the Dark Ages became a foundation on which the systematic studies about the state of Law grown. The milestones in development of political science during Medieval ages can be considered as the understanding of temporal nature of a state, state sovereignty and supreme power.
The French Reformation in XIV–XVI centuries brought the idea of restriction of king’s supreme power by the power of people and his responsibility before people and parliament. The proclamation of political power intention to serve common goodness assisted to the revival of an ancient idea of the political power belonging to the people. Later this idea became the ground for the whole integral doctrine of human rights and state’s service to the nation.
An ancient contractual theory was used by the representatives of political and legal sciences and ideologists of American and French revolutions with a purpose of grounding the restrictions of political power and the right to resist the tyranny.
Translation - Ukrainian Останнім часом в юридичній літературі можна часто зустріти характеристику України як правової, соціальної, демократичної держави, оскільки це передбачено ст.1 Конституції України. При цьому однi автори виходять з бажання пiдкреслити, що, проголосивши себе суверенною i незалежною, Україна стала i правовою державою, а iншi - з прагнення довести, що побудова такої держави є справою бiльш вiддаленої перспективи.
Ідея правової держави пройшла складний і тривалий шлях. Ще в античні часи розуміли, що лише право може дати владі міру, обмежити її в інтересах народу, а держава, в якій закон суперечить людській природі і не слугує загальному благу, швидко загине.
Після розпаду Римської імперії тривалий час політико-правове вчення не розвивалось (його пожвавлення спостерігається лише з XI–XII століття), однак поширення в Європі римського права і римських традицій призводить до зміцнення підвалин державності, розуміння закону як волі народу, а відтак і визнання певної зв’язаності верховної влади цим законом.
З XII–XIII століття бере витоки середньовічний конституціоналізм у формі парламентських органів, формується представницька влада та законодавчі збори. В подальшому ідея обмеження правителя законом і справедливістю знаходить свій розвиток у працях багатьох вчених. Відповідальність правителя зводиться переважно до відповідальності його лише перед Богом і природою.
Ідеї середньовіччя, одначе, стали фундаментом, на якому виросло систематичне вчення про правову державу. До ключових віх у розвитку політичної науки варто віднести обґрунтування світського характеру держави, державного суверенітету та верховної влади.
Епоха Реформації у Франції в XIV–XVI століттях привнесла ідею обмеження суверенітету влади короля владою народу та відповідальністю його перед народом і парламентом. Обґрунтування призначення політичної влади для встановлення загального добра сприяло відродженню давньої ідеї належності політичної влади народові. З цієї ідеї пізніше виникає цілісна доктрина народних прав, підпорядкованість держави служінню усій громаді та скеровуванню природним правом.
Стародавня договірна теорія була використана представниками політико-правової науки та ідеологами Американської і Французької революцій для обґрунтування обмеженості політичної влади та права на опір тиранії.

Source text - English Dear Sirs,
The Hungarian Party has received and discussed the joint Protocol of Intentions. We consider it important to inform you about the following:
- our party does not mind signing the joint Protocol of Intentions in the way and contents which you have given us;
- we consider the terms indicated in the Protocol quite real to keep. However we would like to keep the right of slight changes about different terms in case of unpredictable circumstances, and we intend to agree it with your party beforehand though;
- the Hungarian party delegates the right to do all the negotiations on Protocol # 1 dated 19/12/2006 about the future investing agreement as well as working out and legal support of other necessary papers connected to your project, to our representative in Ukraine Mr. X, who has been granted the necessary Power of Attorney.
Because of the fact that since 22/12/2006 all private and state companies stop their activity due to long Christmas holidays the Hungarian party delegates the power of doing the negotiations to our Ukrainian representative Mr. X. as to point 2.5. in Protocol of Intentions #1 dated 19.12.2006 in the section about making down payment for the factory on quarry production of the American company Y, because the such down payment can be performed only by a daughter company of a Hungarian firm. This commercial operation will be in the future legalized by a necessary agreement and the factory will be given to you with a separate agreement either for a long-term management with the right of purchasing it or into leasing use.
We hope that all the points of the signed Protocol in Intentions #1 dated 19.12.2006 will be kept and put into practice within the indicated terms.
Translation - Russian Уважаемые господа,
Венгерская сторона, получив и рассмотрев совместный Протокол о намерениях, считает необходимым сообщить следующее:
- наша сторона не возражает против подписания совместного Протокола о намерениях в той редакции и с тем содержанием, которые Вы нам представили;
- мы считаем реальным выдержать сроки, указанные в протоколе о намерениях. Однако мы хотели бы зарезервировать за собой право незначительного изменения тех или иных сроков в случае непредвиденных обстоятельств, предварительно согласовав это с Вашей стороной;
- все переговоры по Протоколу о намерениях №1 от 19.12.2006г. по редакции будущего инвестиционного соглашения, а также по разработке и юридическому сопровождению других необходимых документов, связанных с Вашим проектом, венгерская сторона поручает своему представителю на территории Украины Мистеру X, которому выдана соответствующая доверенность.
Поскольку начиная с 22.12.2006г., все частные и государственные фирмы и организации прекращают свою деятельность в связи с предстоящими Рождественскими праздниками, венгерская сторона возлагает на своего представителя на Украине Мистеру X проведение переговоров в части пункта 2.5. Протокола о намерениях №1 от 19.12.2006г. об осуществлении предоплаты за завод по производству щебня американской фирмы Y, поскольку подобная предоплата может быть осуществлена только со стороны дочернего предприятия венгерской фирмы. Эта коммерческая операция будет в дальнейшем оформлена соответствующим договором, а завод передан Вам по отдельному соглашению, либо в долгосрочное управление с правом выкупа, либо в лизинговое пользование.
Выражаем надежду, что все пункты подписанного Протокола о намерениях №1 от 19.12.2006г. будут претворены в жизнь в указанные сроки.
