1. Introdução
O Decreto-Lei nº 107/2008 de 25 de Junho determina a elaboração por cada instituição de ensino superior, de um relatório anual, público, acerca do progresso na concretização do Processo de Bolonha.
Reportando-nos ao articulado neste DL, este relatório deverá integrar o contributo dos estudantes e docentes, através de formas de participação e auscultação a promover pelos Conselhos Pedagógico e Científico, e adoptar indicadores objectivos que evidenciem o progresso das mudanças realizadas na instituição e em cada curso.
Deve igualmente incluir informação sobre os quadros de qualificação adoptados na organização dos cursos, as metodologias e indicadores adoptados para a aferição, por unidade curricular, da relação entre os créditos fixados e as competências a alcançar, e os métodos de trabalho adoptados para a integração da aprendizagem e da avaliação de conhecimentos.
O relatório deverá ser elaborado para os anos lectivos de 2006-07 a 2010-11, inclusive, e publicado no sítio da Internet da Instituição até 31 de Dezembro seguinte ao término do ano lectivo a que se reporta.
Assim, o presente relatório dá conta do processo de implementação de Bolonha na Universidade do Minho (UM) para os anos 2006/07 e 2007/08, com referência particular à oferta formativa dos três ciclos de estudos, às novas metodologias de ensino/aprendizagem e de avaliação, à internacionalização e mobilidade, ao estímulo à inserção na vida activa e aos resultados de um estudo exploratório tomando em consideração as percepções de estudantes e docentes acerca do processo de concretização das mudanças operadas. O relatório termina com a apresentação de algumas considerações finais em torno das exigências colocadas às instituições pelo Processo de Bolonha e às condicionantes internas e externas que afectaram a sua prossecução.
2. Evolução da Concretização do Processo de Bolonha na UM
Procurando garantir a qualificação dos seus estudantes no quadro do Espaço Europeu, a Universidade do Minho encarou a concretização de Bolonha como uma oportunidade para melhorar a qualidade e a relevância das formações ministradas e para fomentar a mobilidade dos estudantes e diplomados e a internacionalização das formações. Neste sentido, aliás, na Avaliação Institucional da UM pela European Universities Association (EUA), que decorreu em 2007, o foco especial escolhido para a análise da Comissão foi precisamente, a Implementação de Bolonha na UM.
Retrospectivamente, no final dos anos noventa, a Universidade tomou consciência dos desafios que se impunham ao Ensino Superior para responder aos objectivos do Processo de Bolonha, assim como para o desenvolvimento de um programa com vista a clarificar os seus quadros de qualificação. Por exemplo, a UM reconheceu a importância do Sistema de Transferência de Créditos (ECTS) e da correcta aplicação deste instrumento, e já em 1994/95 participou num programa piloto na área da História e, a partir de 1995, iniciou uma implementação sistemática e gradual do novo sistema de créditos aos seus cursos.
De acrescentar que, já em 2002, a UM implementou pela primeira vez o Suplemento ao Diploma, através de um programa piloto direccionado ao curso de Engenharia de Sistemas de Informática. 1. Introduction
According to the provisions laid down by Executive Law no. 107/2008, of 25 June, each and every higher education institution shall elaborate an annual public report on progress made towards the implementation of the Bologna Process.
As provided for by the above-mentioned Executive Law, the present report shall include contributions from the students and the teachers, collected by the Pedagogical and Scientific Councils through the means of participation and hearing developed, and shall adopt objective indicators providing evidence on the progress of changes introduced in the University, as well as in each study programme.
The report shall further include information on the qualification frameworks introduced in each study programme organisation; the assessment methodologies and indicators adopted for each course unit; the relation between credits and competences to be acquired, as well as on the working methods adopted with a view to integrate learning and knowledge assessment.
The report shall be performed for the academic years 2006/07 to 2010/11 inclusive, and published in the Institution’s website no later than 31 December of the year following the academic year concerned by the report.
Therefore, the present report provides an account of the implementation of the Bologna Process at the University of Minho (UM) for the academic years 2006/07 and 2007/08. In this report, we will focus, in particular, on UM’s educational offer regarding the three study cycles, the new teaching/learning and evaluation methodologies introduced, internationalisation, mobility, and the promotion of employability, as well as to the results of an exploratory study which takes into account students and teachers’ perceptions of the process of implementation of change. The report ends with some final remarks on the demands imposed by the Bologna process upon the institutions, as well as on the internal and external limitations affecting its full implementation.
2. Progress on the implementation of the Bologna Process at UM
The University of Minho seeks to assure the qualification of its students within the framework for the European Higher Education Area, therefore it has embraced the implementation of Bologna as an opportunity to improve the quality and the importance of the qualifications granted, as well as to promote students and graduates mobility and the internationalisation of its courses. In this regard, already at the time of UM’s Institutional Evaluation by the European Universities Association (EUA), which took place in 2007, the Committee’s special focus was precisely Implementing Bologna at UM.
Back in the late nineties, the University became aware of the challenges Higher Education faced in order to meet the objectives of the Bologna Process, as well as of the difficulties in developing a plan to clarify its qualification structures. For instance, the UM recognised the importance of the European Credit Transfer System (ECTS), as well as of the correct application of this instrument. Hence, in 1994/95, the University participated in a pilot program in the area of History and since 1995 has initiated a gradual and systematic implementation of the new credit system to its degree programmes.
Additionally, as early as 2002, the UM implemented the Diploma Supplement for the first time, in a pilot program directed at the degree in Information Systems. Preâmbulo
1. A Universidade do Minho, criada pelo Decreto-Lei n.º 402/73, de 11 de Agosto, adoptou, desde o seu início, e para a prossecução dos seus objectivos, um modelo de organização designado por Grupos de Projecto, cuja malha básica constituía um sistema matricial envolvendo projectos – de ensino, de investigação e de serviços – e unidades de recursos. A respectiva estrutura orgânica foi materializada no Regulamento Interno Provisório, homologado por despacho do Secretário de Estado do Ensino Superior e Investigação Científica, de 10 de Fevereiro de 1976, que vigorou durante o seu período de instalação, e se manteve, com as adaptações necessárias determinadas pelos órgãos de governo da Universidade, até à homologação dos seus estatutos, pelo Despacho Normativo n.º 80/89, do Ministro da Educação, publicado no Diário da República n.º 198, I Série, de 29 de Agosto de 1989.
2. Com a aprovação dos estatutos, elaborados ao abrigo da Lei n.º 108/88, de 24 de Setembro (Lei da Autonomia Universitária), a Universidade do Minho manteve o modelo matricial e de gestão por objectivos, dotando-se de uma organização flexível, capaz de se adaptar à inovação e evolução do saber, e de prover à crescente interdisciplinaridade do conhecimento, bem como à racionalização da gestão dos recursos.
Os estatutos foram depois objecto de alterações, aprovadas pela Assembleia da Universidade, homologadas por Despachos Normativos publicados nos Diários da República n.º 296/1995 (26 de Dezembro), n.º 41/1998 (18 de Fevereiro) e n.º 119/2000 (23 de Maio). A última revisão, com vista à integração, na Universidade do Minho, da Escola Superior de Enfermagem de Calouste Gulbenkian, e à criação e reestruturação de Unidades Orgânicas, foi publicada no Diário da República n.º40/2005 (25 de Fevereiro).
3. A Lei n.º 62/2007, de 10 de Setembro, definiu um novo enquadramento jurídico para as Instituições de Ensino Superior. Neste contexto, os presentes estatutos, tendo em conta a experiência acumulada e a realidade da Instituição, enquadram um novo modelo de Universidade adequado aos desafios do espaço europeu de ensino superior e de investigação. Este modelo considera a necessidade de reforçar a articulação entre a orientação estratégica da Universidade e as suas políticas, desenvolvidas pelos órgãos de governo previstos no Regime Jurídico das Instituições de Ensino Superior, e a orientação estratégica das suas Unidades, no âmbito das respectivas autonomias.
Para o cumprimento da sua missão, a Universidade assume-se como Universidade de Projectos, valorizando a cultura e a experiência construída em muitos anos de vivência do modelo matricial. As unidades orgânicas de ensino e investigação, designadas por Escolas ou Institutos, são as estruturas basilares de desenvolvimento daqueles projectos, que, para o efeito, adoptam um modelo de organização e gestão capaz de propiciar abordagens multidisciplinares e garantir uma utilização racional de recursos.
A existência de um Senado Académico, como órgão de consulta em matérias definidas pelos estatutos, garante condições de coesão e de coordenação científica e pedagógica da Universidade, e de participação das suas unidades orgânicas. O Conselho Cultural dá continuidade a uma tradição própria da Universidade e visa assegurar o cumprimento de funções relevantes em matéria de política cultural e de coordenação das unidades culturais da Universidade.
Numa época em que o conhecimento se tornou a base principal do desenvolvimento sócio-económico, são precisamente as Universidades o espaço por excelência de criação, difusão de conhecimento e inovação. Neste sentido, a Universidade do Minho assume tais ditames como sua missão indeclinável – geração, difusão e aplicação do conhecimento, assente na liberdade de pensamento e na pluralidade dos exercícios críticos, visando uma sociedade mais justa e democrática –, cujo desígnio prossegue como Universidade de Projectos, valorizando a cultura e experiência construídas em muitos anos de vivência do modelo matricial, com as necessárias adaptações ditadas, quer pelo novo enquadramento jurídico, quer pela necessidade de prover a Instituição de uma organização para melhor cumprir as exigências que lhe são cometidas.
A Universidade do Minho identifica-se como “Universidade numa Região”, em contraposição ao conceito de universidade regional, desta forma estabelecendo o que a sua actividade exige como agente privilegiado do desenvolvimento económico e cultural da região em que se insere. Ademais, os seus campi são espaços de incremento da sua missão e de valorização do labor de ensino e de investigação, tornando-se pólos de atracção dos melhores estudantes, professores e investigadores. Deste modo, como universidade completa que é, assumindo-se como centro de investigação, de construção e consolidação do conhecimento no espaço europeu de ensino superior, nas mais variadas áreas científicas – ciências humanas e sociais, artes, ciências e tecnologias –, vem consequentemente aferindo a realização dos seus objectivos por exigentes padrões internacionais.
Título I
Natureza, missão e princípios orientadores
Artigo 1.º
(Natureza)
1. A Universidade do Minho, doravante designada abreviadamente por Universidade, é uma pessoa colectiva de direito público, dotada de autonomia estatutária, científica, pedagógica, cultural, administrativa, patrimonial, financeira e disciplinar.
2. As suas unidades orgânicas podem ser dotadas de autonomia científica, pedagógica, cultural, administrativa e financeira, nos termos dos presentes estatutos.
Artigo 2.º
(Missão e objectivos)
1. A Universidade tem como missão gerar, difundir e aplicar conhecimento, assente na liberdade de pensamento e na pluralidade dos exercícios críticos, promovendo a educação superior e contribuindo para a construção de um modelo de sociedade baseado em princípios humanistas, que tenha o saber, a criatividade e a inovação como factores de crescimento, desenvolvimento sustentável, bem-estar e solidariedade.
2. O cumprimento da missão referida no número anterior é realizado num quadro de referência internacional, com base na centralidade da investigação e da sua estreita articulação com o ensino, mediante a prossecução dos seguintes objectivos:
a) a formação humana ao mais alto nível, nas suas dimensões ética, cultural, científica, artística, técnica e profissional, através de uma oferta educativa diversificada, da criação de um ambiente educativo adequado, da valorização da actividade dos seus docentes, investigadores e pessoal não docente e não investigador, e da educação pessoal, social, intelectual e profissional dos seus estudantes, contribuindo para a formação ao longo da vida e para o exercício de uma cidadania activa e responsável;
b) a realização de investigação e a participação em instituições e eventos científicos, promovendo a busca permanente da excelência, a criatividade como fonte de propostas e soluções inovadoras e diferenciadoras, bem como a procura de respostas aos grandes desafios da sociedade;
c) a transferência, o intercâmbio e a valorização dos conhecimentos científicos e tecnológicos produzidos, através do desenvolvimento de soluções aplicacionais, da prestação de serviços à comunidade, da realização de acções de formação contínua e do apoio ao desenvolvimento, numa base de valorização recíproca e de promoção do empreendedorismo;
d) a promoção de actividades que possibilitem o acesso e a fruição de bens culturais por todas as pessoas e grupos, internos e externos à Universidade;
e) o intercâmbio cultural, científico e técnico com instituições e organismos nacionais e estrangeiros, através da mobilidade de estudantes, docentes e pessoal não docente e não investigador, do desenvolvimento de programas educacionais e da investigação com base em parcerias, da contribuição para a cooperação internacional, com especial destaque para os países europeus e de língua oficial portuguesa, e da construção de um ambiente multilinguístico na Universidade;
f) a interacção com a sociedade, através de contribuições para a compreensão pública da cultura, da análise e da apresentação de soluções para os principais problemas do quotidiano, e de parcerias para o desenvolvimento social e económico, nos contextos regional, nacional ou internacional;
g) a contribuição para o desenvolvimento social e económico da região em que se insere e para o conhecimento, defesa e divulgação do seu património natural e cultural;
h) a promoção da sua sustentabilidade institucional e da sua competitividade no espaço global.
Artigo 3.º
(Princípios orientadores)
1. A Universidade cumpre a sua missão e prossegue os seus objectivos baseada no respeito pela dignidade da pessoa humana e na sua promoção, interditando qualquer espécie de tratamento desumano.
2. A Universidade respeita os princípios da igualdade, da participação democrática, do pluralismo de opiniões e de orientações, garantindo as liberdades de aprender, ensinar e investigar.
3. A Universidade desenvolve o seu labor impregnada por uma cultura de qualidade fundada na responsabilidade, na eficácia da sua acção e na prevalência do interesse geral.
Artigo 4.º
(Graus e títulos)
1. A Universidade, no cumprimento da sua missão, confere os graus de licenciado, mestre e doutor, o título de professor agregado e outros certificados e diplomas, bem como a equivalência e o reconhecimento de graus e habilitações académicas.
2. A Universidade confere ainda graus e títulos honoríficos, designadamente o grau de doutor honoris causa.
Artigo 5.º
(Autonomia académica)
1. A Universidade, no exercício da autonomia académica, define a sua missão, os seus objectivos e os seus projectos de ensino, de investigação e de interacção com a sociedade, de forma a contribuir para o avanço do conhecimento, a qualidade da formação dos seus estudantes e o desenvolvimento do meio em que se insere.
2. A autonomia académica da Universidade exerce-se nos domínios científico, pedagógico, cultural e disciplinar, com responsabilidade social e pautada por valores éticos.
Artigo 6.º
(Autonomia científica)
1. Compete à Universidade definir, programar e executar livremente os seus projectos de investigação e demais actividades científicas, sem prejuízo dos critérios e procedimentos de financiamento público da investigação.
2. No âmbito da autonomia científica, compete à Universidade estabelecer a sua política institucional de investigação e desenvolvimento, definindo prioridades em termos dos seus contributos para o avanço do conhecimento, a qualidade da sua oferta educativa e o aprofundamento da interacção com a sociedade.
3. Para a prossecução cabal dos objectivos da investigação, os orçamentos dos projectos de investigação são consignados.
Artigo 7.º
(Autonomia pedagógica)
1. Compete à Universidade aprovar a criação, modificação ou extinção de ciclos de estudos e de cursos não conducentes a grau, bem como elaborar os respectivos planos de estudos, definir o objecto das unidades curriculares, decidir os métodos de ensino e aprendizagem, afectar os recursos e escolher os processos de avaliação de conhecimentos.
2. A autonomia pedagógica tem como princípio subjacente a liberdade de ensinar e aprender, nomeadamente a liberdade intelectual dos professores e dos estudantes nos processos de ensino e aprendizagem, observando-se os valores de independência, rigor de pensamento e pluralismo de opiniões.
3. A decisão sobre a criação, modificação ou extinção de ciclos de estudos compete aos órgãos de governo, envolvendo os órgãos de consulta, designadamente o senado académico, e as unidades orgânicas.
Artigo 8.º
(Autonomia cultural)
1. Compete à Universidade definir livremente as suas políticas, programas e iniciativas culturais, sem outras restrições para além das que resultam da Constituição, da lei e das convenções internacionais.
2. A Universidade, sem perda da autonomia referida no número anterior, pode interligar os seus programas culturais com programas congéneres, promovidos por outras instituições ou organismos, públicos ou privados.
3. Na sua acção cultural, a Universidade promove a democratização do acesso aos bens culturais.
Artigo 9.º
(Autonomia disciplinar)
1. A autonomia disciplinar exerce-se segundo regulamento próprio da Universidade, nos termos da lei e dos presentes estatutos, num quadro de referência que valoriza os princípios da vida académica, designadamente a independência, o rigor e a honestidade intelectual, a responsabilidade, a ética do trabalho e o respeito pela dignidade humana.
2. A acção disciplinar em relação aos estudantes é enquadrada por um código de conduta académica e obedece a um regulamento disciplinar, aprovados pelo reitor, ouvido o senado académico.
3. O poder disciplinar pertence ao reitor, para o efeito assessorado por um conselho disciplinar, podendo ser delegado nos presidentes das unidades orgânicas, sem prejuízo do direito de recurso para o reitor.
Artigo 10.º
(Constituição de pessoas colectivas)
A Universidade, para a realização dos seus objectivos, pode constituir ou participar na constituição de pessoas colectivas, nos termos da lei.
Artigo 11.º
(Acordos)
A Universidade, directamente por si ou através das suas unidades orgânicas, pode estabelecer consórcios, convénios, contratos, protocolos e outros acordos com instituições públicas ou privadas, nacionais, estrangeiras ou internacionais.
Artigo 12.º
(Sede, símbolos e dia da Universidade)
1. A Universidade tem a sua sede na cidade de Braga, dispõe de pólos nas cidades de Braga e Guimarães, e poderá, se necessário para a realização dos seus fins, criar pólos em outras localidades.
2. Os pólos da Universidade do Minho poderão integrar uma ou várias unidades orgânicas e desenvolver actividades de natureza universitária e politécnica.
3. A Universidade adopta as cores branca e vermelha.
4. A Universidade adopta emblemática e traje professoral próprios.
5. O dia da Universidade é o dia 17 de Fevereiro.
Artigo 13.º
(Fundação Carlos Lloyd Braga)
A Universidade é apoiada, na consecução da sua missão e objectivos, pela Fundação Carlos Lloyd Braga, instituição de direito privado e utilidade pública, que se rege por estatutos próprios.
Título II
Projectos
Artigo 14.º
(Enquadramento)
Projectos são actividades desenvolvidas pela Universidade, visando a realização da sua missão e objectivos, que, consoante a sua finalidade dominante, podem ser:
a) projectos de investigação;
b) projectos de ensino;
c) projectos de interacção com a sociedade.
Artigo 15.º
(Projectos de investigação)
Consideram-se projectos de investigação as actividades de investigação científica ou científico-tecnológica, com objectivos específicos, de duração limitada e com execução programada no tempo.
Artigo 16.º
(Projectos de ensino)
Consideram-se projectos de ensino os ciclos de estudos conducentes à obtenção de graus e cursos não conferentes de grau, previstos no mapa da oferta educativa da Universidade.
Artigo 17.º
(Projectos de interacção com a sociedade)
Os projectos de interacção com a sociedade constituem acções desenvolvidas pela Universidade, integradas na sua missão, não inseridas directamente no âmbito do ensino ou investigação formais, visando a satisfação de interesses ou necessidades da comunidade, num quadro de reciprocidade.
Título III
Governação e estrutura organizativa
Capítulo I
Modelo de governação e princípios de gestão
Artigo 18.º
(Governação e organização)
1. O governo da Universidade baseia-se nos princípios da participação, democraticidade, descentralização, autonomia e pública prestação de contas.
2. A Universidade adopta um modelo organizacional de base matricial, que promove a interacção entre as suas unidades, com vista à realização dos projectos que concretizam a sua missão e objectivos, assegurando a eficiência na utilização dos seus meios e recursos.
Artigo 19.º
(Autonomia administrativa)
1. A Universidade é titular de autonomia administrativa, podendo emanar regulamentos, praticar actos administrativos definitivos e celebrar contratos administrativos.
2. A autonomia administrativa da Universidade abrange designadamente:
a) a gestão corrente dos seus assuntos próprios;
b) o recrutamento e a atribuição de tarefas ao seu pessoal;
c) a sua organização interna e a dos seus serviços.
3. Para além do pessoal referido nos estatutos das carreiras docente universitária, politécnica e de investigação, e nos mapas de pessoal, a Universidade pode contratar, nos termos definidos por lei, individualidades nacionais e estrangeiras para o exercício de funções docentes ou de investigação, bem como outro pessoal para o desempenho de actividades necessárias ao seu funcionamento.
Artigo 20.º
(Gestão e avaliação do desempenho)
A Universidade tem a faculdade de proceder a adaptações ao regime estabelecido para a gestão e avaliação do desempenho da administração pública, nos termos da lei, em razão das atribuições e organização dos serviços, das carreiras do seu pessoal ou das necessidades da sua gestão.
Artigo 21.º
(Autonomia financeira)
A Universidade é titular de autonomia financeira, dispondo de património, orçamento e receitas próprias.
Artigo 22.º
(Autonomia patrimonial)
1. Constitui património da Universidade o conjunto de bens e direitos de que é titular e os que, pelo Estado ou outras entidades, públicas ou privadas, sejam afectados à realização da sua missão e à prossecução dos seus objectivos.
2. Constitui também património da Universidade o conjunto dos seus elementos simbólicos, cujo uso está subordinado ao princípio do benefício comum.
3. Os espaços da Universidade estão sujeitos ao princípio de uso comum e gratuito, apenas podendo ser estabelecido o seu uso privativo e oneroso nas condições expressamente previstas em regulamento próprio.
4. Impende sobre todos os que usufruem do património da Universidade, designadamente professores, investigadores, estudantes e pessoal não docente e não investigador, o dever de o conservar e defender.
Artigo 23.º
(Autonomia orçamental e receitas próprias)
1. O orçamento da Universidade está sujeito aos princípios da anualidade, unidade, universalidade, especificação, equilíbrio e publicidade.
2. O orçamento da Universidade é aprovado nos termos dos presentes estatutos.
3. Constituem receitas da Universidade:
a) as dotações que lhe forem concedidas pelo Estado;
b) o produto da venda dos bens de que possa dispor;
c) os rendimentos de bens próprios ou de que tenha fruição;
d) as receitas provenientes de actividades de investigação e desenvolvimento;
e) as receitas derivadas da prestação de serviços e da venda de publicações;
f) os rendimentos da propriedade intelectual e industrial;
g) as receitas provenientes do pagamento de propinas;
h) o produto de taxas, emolumentos, multas e coimas;
i) os juros de contas de depósitos;
j) os saldos da conta de gerência de anos anteriores;
k) outras receitas, designadamente subsídios, subvenções, comparticipações, doações, heranças e legados.
Artigo 24.º
(Isenções tributárias)
A Universidade e as suas unidades orgânicas estão isentas, nos mesmos termos que o Estado, de impostos, taxas, custas, emolumentos e selos.
Artigo 25.º
(Transparência e publicidade)
Sem prejuízo das formas legalmente exigidas, os actos deliberativos emanados por todos os órgãos devem ser adequadamente publicitados pela Universidade.
Capítulo II
Estrutura organizativa
Secção I
Órgãos da Universidade
Artigo 26.º
(Órgãos)
1. O governo da Universidade é exercido pelos seguintes órgãos:
a) conselho geral;
b) reitor;
c) conselho de gestão.
2. Aos órgãos de governo compete dirigir a Universidade na sua actividade científica, pedagógica, cultural e de interacção com a sociedade, bem como assegurar o planeamento e a gestão administrativa e financeira da Instituição.
3. A Universidade tem os seguintes órgãos de consulta:
a) senado académico;
b) conselho cultural;
c) conselho disciplinar.
4. Compete aos órgãos de consulta aconselhar o conselho geral e o reitor no desempenho das suas funções e emitir pareceres nos termos dos presentes estatutos.
Artigo 27.º
(Incompatibilidades e impedimentos)
1. Os titulares e os membros dos órgãos de governo e de gestão da Universidade estão exclusivamente ao serviço do interesse público e são independentes no exercício das suas funções.
2. O reitor, vice-reitores, pró-reitores, presidentes e vice-presidentes das unidades orgânicas e directores das subunidades não podem pertencer a quaisquer órgãos de governo ou de gestão de outras instituições de ensino superior, público ou privado.
3. A verificação de qualquer incompatibilidade acarreta a perda do mandato e a inelegibilidade para os cargos previstos no número anterior, durante o período de quatro anos.
Secção II
Conselho geral
Artigo 28.º
(Definição)
O conselho geral é o órgão colegial máximo de governo e de decisão estratégica da Universidade, integrando representantes dos seus corpos e personalidades externas, vinculando a sua acção à realização da missão da Universidade e à prossecução do interesse público.
Artigo 29.º
(Competências)
1. Compete ao conselho geral:
a) eleger o seu presidente, por maioria absoluta, de entre os seus membros externos;
b) aprovar o seu regimento;
c) aprovar as alterações dos estatutos da Universidade, nos termos da lei e dos presentes estatutos;
d) organizar o procedimento de eleição e eleger o reitor, nos termos da lei, dos presentes estatutos e do regulamento aplicável;
e) apreciar os actos do reitor e do conselho de gestão;
f) propor as iniciativas que considere necessárias ao bom funcionamento da Universidade;
g) desempenhar as demais funções previstas na lei ou nos presentes estatutos.
2. Compete ao conselho geral, sob proposta do reitor:
a) aprovar o plano estratégico de médio prazo e o plano de acção para o quadriénio do mandato do reitor;
b) aprovar as linhas gerais de orientação da Universidade nos planos científico, pedagógico, financeiro e patrimonial;
c) criar, transformar ou extinguir unidades e subunidades orgânicas;
d) aprovar os planos anuais de actividades da Universidade e apreciar os respectivos relatórios;
e) aprovar a proposta de orçamento;
f) aprovar as contas anuais consolidadas, acompanhadas do parecer do fiscal único;
g) fixar as propinas devidas pelos estudantes;
h) propor ou autorizar, conforme disposto na lei, a aquisição ou alienação de património imobiliário da Universidade, bem como as operações de crédito;
i) aprovar propostas de contratos-programa com as unidades orgânicas;
j) pronunciar-se sobre os restantes assuntos que lhe forem apresentados pelo reitor.
3. As deliberações a que se referem as alíneas a) a d) e f) do n.º 2 são obrigatoriamente precedidas pela apreciação de um parecer, a elaborar e aprovar pelos seus membros externos.
4. As deliberações do conselho geral são aprovadas por maioria simples, ressalvados os casos em que a lei ou os presentes estatutos requeiram maioria absoluta ou outra mais exigente.
5. Requerem maioria qualificada de dois terços, as decisões seguintes:
a) a suspensão ou a destituição do reitor;
b) a destituição de seus membros;
c) o previsto na alínea c) do n.º 2.
6. Em todas as matérias da sua competência, o conselho geral pode solicitar pareceres a outros órgãos da Universidade, nomeadamente aos órgãos de natureza consultiva e às unidades orgânicas, bem como a entidades externas.
Artigo 30.º
(Composição)
1. O conselho geral tem a seguinte composição:
a) doze representantes de professores e investigadores;
b) quatro representantes de estudantes;
c) um representante do pessoal não docente e não investigador;
d) seis personalidades externas de reconhecido mérito, com conhecimentos e experiência relevantes para a Universidade.
2. Para efeitos da alínea a) do n.º 1, consideram-se professores e investigadores os professores e investigadores de carreira universitária e politécnica, e os doutores que exercem funções docentes e ou de investigação na Universidade, em regime de tempo integral, com contrato de duração não inferior a um ano, qualquer que seja a natureza do seu vínculo laboral.
Artigo 31.º
(Eleição e cooptação)
1. Os membros do conselho geral a que se referem as alíneas a), b) e c) do n.º 1 do artigo anterior são eleitos, respectivamente, pelo conjunto dos seus pares.
2. As eleições referidas no número anterior são efectuadas através do sistema de representação proporcional, sendo os lugares repartidos pelas listas concorrentes de acordo com o método de Hondt, nos termos de regulamento próprio a aprovar pelo conselho geral.
3. As personalidades a que se refere a alínea d) do artigo anterior são cooptadas pelo conjunto dos demais membros, por maioria absoluta, nos termos de regulamento específico, com base em propostas fundamentadas subscritas por, pelo menos, um terço daqueles membros.
4. Os procedimentos necessários às eleições dos membros e à cooptação das personalidades externas são desencadeados pelo conselho geral, antes do termo do respectivo mandato, sendo os processos presididos pelo representante dos professores e investigadores mais antigo, de categoria mais elevada.
Artigo 32.º
(Mandatos)
1. O mandato dos membros eleitos e cooptados é de quatro anos, excepto no caso dos estudantes, em que é de dois anos.
2. Nenhum membro do conselho geral pode ser destituído, salvo pelo próprio conselho geral, em caso de falta grave, nos termos do seu regimento.
3. Os membros eleitos pelo respectivo corpo cessam o seu mandato quando, por alguma razão, deixem de pertencer ao corpo que representam.
4. Em caso de vacatura ou cessação de mandato, a substituição é assegurada, no caso dos membros referidos nas alíneas a), b) e c) do artigo 30.º, pelo primeiro candidato eleito na respectiva ordem de precedência da mesma lista e, no caso dos membros cooptados, pelo membro seguinte na ordenação estabelecida na respectiva acta de apuramento.
5. Em caso de vacatura do cargo de qualquer membro, o novo membro completa o mandato do substituído.
Artigo 33.º
(Independência e conflito de interesses)
1. Os membros do conselho geral não podem fazer parte de outro órgão de governo da Universidade, nem do senado académico.
2. Os membros cooptados do conselho geral não podem exercer funções nos órgãos de governo de outras instituições de ensino superior.
3. O mandato dos membros do conselho geral que se apresentem como candidatos à eleição para reitor, bem como o dos membros integrantes da candidatura, como vice-reitores ou pró-reitores, é suspenso durante todo o processo eleitoral, sendo a sua substituição temporariamente assegurada nos termos do disposto no n.º 4 do artigo anterior.
Artigo 34.º
(Presidente)
1. Compete ao presidente do conselho geral:
a) convocar e presidir às reuniões, com voto de qualidade;
b) verificar as vagas no conselho e promover os procedimentos conducentes à designação de novos membros.
2. Cabem ainda ao presidente do conselho geral as competências constantes do regimento.
3. O presidente não interfere no exercício de competências dos demais órgãos da Universidade.
Artigo 35.º
(Reuniões)
1. O conselho geral reúne, ordinariamente, quatro vezes por ano e, extraordinariamente, mediante convocação do seu presidente, por sua iniciativa ou a pedido do reitor ou de um terço dos seus membros.
2. O reitor participa nas reuniões, sem direito a voto.
3. O conselho pode, nos termos do seu regimento, convidar para as suas reuniões, sem direito a voto, membros da Universidade e elementos externos para se pronunciarem sobre matérias da sua especialidade.
Secção III
Reitor
Artigo 36.º
(Definição)
O reitor é o órgão uninominal que superiormente dirige e representa a Universidade.
Artigo 37.º
(Competências)
1. Compete ao reitor:
a) elaborar e apresentar ao conselho geral as seguintes propostas:
i) plano estratégico de médio prazo e plano de acção para o quadriénio do seu mandato;
ii) linhas gerais de orientação da Universidade no plano científico e pedagógico;
iii) plano anual de actividades e respectivo relatório;
iv) orçamento e contas anuais consolidadas, acompanhadas do parecer do fiscal único;
v) aquisição ou alienação de património imobiliário da Universidade, e de operações de crédito;
vi) criação, transformação ou extinção de unidades e subunidades orgânicas, unidades culturais, de serviços e diferenciadas;
vii) propinas devidas pelos estudantes.
b) aprovar a criação, suspensão e extinção de ciclos de estudos;
c) aprovar os valores máximos de novas admissões e de inscrições de estudantes, nos termos da lei;
d) superintender na gestão académica, decidindo, designadamente, quanto à abertura de concursos, à nomeação e contratação de pessoal, a qualquer título, e à designação dos júris de concursos e de provas de doutoramento e de agregação;
e) aprovar os sistemas de auto-avaliação da Universidade e de avaliação dos docentes e investigadores, bem como do pessoal não docente e não investigador;
f) promover a obtenção dos meios financeiros necessários ao bom funcionamento da Universidade;
g) prover as unidades orgânicas com os recursos financeiros provenientes do orçamento de Estado, após parecer prévio do conselho geral, em sede de elaboração do orçamento anual da Universidade, salvaguardada a necessidade de garantir mecanismos de coesão;
h) atribuir apoios aos estudantes no quadro da acção social escolar, nos termos da lei;
i) aprovar a concessão de títulos ou distinções honoríficas;
j) conceder o estatuto de professor emérito;
k) instituir prémios escolares;
l) homologar as eleições dos membros do conselho das unidades orgânicas e do seu presidente, só podendo recusar com base em ilegalidade, e dar-lhes posse;
m) nomear e exonerar, nos termos da lei e dos presentes estatutos, os dirigentes das unidades culturais e unidades diferenciadas, observados os respectivos regulamentos;
n) superintender os serviços de acção social;
o) nomear e exonerar, nos termos da lei e dos presentes estatutos, o administrador e os dirigentes dos serviços da Universidade;
p) exercer o poder disciplinar, em conformidade com o disposto na lei e nos presentes estatutos;
q) assegurar o cumprimento das deliberações tomadas pelos órgãos de governo da Universidade;
r) aprovar os regulamentos previstos na lei e nos estatutos, designadamente os regulamentos gerais em matéria pedagógica, sem prejuízo do poder regulamentar das unidades orgânicas no âmbito das suas competências próprias;
s) reafectar recursos humanos e financeiros entre unidades e subunidades, se necessário, tendo em consideração parecer prévio do conselho geral e audição do senado;
t) velar pela observância das leis, dos estatutos e dos regulamentos;
u) propor as iniciativas que considere necessárias ao bom funcionamento da Universidade;
v) comunicar ao ministro da tutela todos os dados necessários ao exercício desta, designadamente os planos e orçamentos e os relatórios de actividades e contas;
w) tomar as medidas necessárias à garantia da qualidade do ensino e da investigação na Universidade e nas suas unidades orgânicas;
x) desempenhar as demais funções previstas na lei.
2. Cabem ainda ao reitor todas as competências que por lei ou pelos presentes estatutos não sejam atribuídas a outros órgãos da instituição.
3. A decisão sobre as matérias a que se referem as alíneas a.iii), a.vi) e a.vii), b), c), i), j) e k) do n.º 1 é precedida de consulta obrigatória ao senado académico.
4. O reitor pode delegar nos órgãos de governo das unidades orgânicas as competências que se revelarem necessárias a uma gestão mais eficiente e descentralizada.
5. O reitor é coadjuvado por vice-reitores e pró-reitores, nos quais pode delegar ou subdelegar parte das suas competências.
Artigo 38.º
(Eleição do reitor)
1. O reitor é eleito pelo conselho geral nos termos estabelecidos pelos presentes estatutos e segundo o procedimento previsto no respectivo regulamento.
2. O procedimento de eleição inclui, designadamente:
a) o anúncio público da abertura de candidaturas;
b) a apresentação de candidaturas;
c) a audição pública dos candidatos, com apresentação e discussão do seu programa de acção;
d) a votação final do conselho geral, por maioria, por voto secreto.
3. Podem ser candidatos a reitor professores ou investigadores doutorados da Universidade ou de outras instituições de ensino universitário ou de investigação, nacionais ou estrangeiras.
4. Não pode ser eleito reitor:
a) quem se encontre na situação de aposentado;
b) quem tenha sido condenado por infracção disciplinar, financeira ou penal no exercício de funções públicas ou profissionais, nos quatro anos subsequentes ao cumprimento da pena;
c) quem incorra noutras inelegibilidades previstas na lei.
Artigo 39.º
(Mandato do reitor)
1. O mandato do reitor tem a duração de quatro anos, podendo ser renovado uma única vez, nos termos dos presentes estatutos.
2. Em caso de cessação antecipada do mandato, o novo reitor inicia novo mandato.
Artigo 40.º
(Vice-reitores)
1. O reitor é coadjuvado, nos termos dos presentes estatutos, por vice-reitores, até um máximo de quatro.
2. Os vice-reitores são escolhidos e nomeados pelo reitor de entre os professores ou investigadores da Universidade.
3. Os vice-reitores podem ser exonerados a todo o tempo pelo reitor e o seu mandato cessa com a cessação do mandato deste.
Artigo 41.º
(Pró-reitores)
1. O reitor pode ainda ser coadjuvado por pró-reitores, no máximo de cinco, por ele livremente escolhidos e nomeados, podendo ser exteriores à Universidade.
2. Os pró-reitores desenvolverão as suas actividades, por delegação do reitor, em tarefas específicas.
Artigo 42.º
(Suspensão e destituição do reitor)
Em situação de gravidade para a vida da Universidade, o conselho geral, convocado pelo presidente ou por um terço dos seus membros, pode deliberar, por maioria de dois terços dos seus membros, a suspensão do reitor e, após o devido procedimento administrativo, por idêntica maioria, a sua destituição.
Artigo 43.º
(Dedicação exclusiva)
1. O cargo de reitor é exercido em regime de dedicação exclusiva.
2. Quando sejam docentes ou investigadores da Universidade, o reitor e vice-reitores ficam dispensados da prestação de serviço docente ou de investigação, sem prejuízo de, por sua iniciativa, o poderem prestar.
Artigo 44.º
(Substituição do reitor)
1. Quando se verifique a incapacidade temporária do reitor, bem como nas suas ausências e impedimentos, assume as suas funções o vice-reitor por ele designado ou, não sendo possível, o vice-reitor mais antigo.
2. Caso a situação de incapacidade se prolongue por mais de 90 dias, o conselho geral deve pronunciar-se acerca da conveniência da eleição de um novo reitor.
3. Em caso de vacatura, de renúncia ou de incapacidade permanente do reitor, deve o conselho geral determinar a abertura do procedimento de eleição de um novo reitor no prazo máximo de oito dias.
4. Durante a vacatura do cargo de reitor, bem como no caso de suspensão, nos termos do artigo 42.º, será aquele exercido interinamente pelo vice-reitor escolhido pelo conselho geral ou, na sua impossibilidade, por um professor ou investigador da universidade, escolhido pelo mesmo órgão.
Secção IV
Conselho de gestão
Artigo 45.º
(Definição)
O conselho de gestão é o órgão colegial que conduz a gestão administrativa, patrimonial e financeira da Universidade, bem como a gestão dos seus recursos humanos.
Artigo 46.º
(Competências)
1. Compete ao conselho de gestão conduzir a gestão administrativa, patrimonial e financeira da Universidade, bem como a gestão dos recursos humanos, sendo-lhe aplicável a legislação em vigor para os organismos públicos dotados de autonomia administrativa.
2. Compete ainda ao conselho de gestão fixar as taxas e emolumentos.
Artigo 47.º
(Composição)
1. O conselho de gestão, designado e presidido pelo reitor, é composto por cinco membros.
2. O conselho de gestão inclui obrigatoriamente um vice-reitor e o administrador.
3. A convite do reitor, podem participar nas reuniões do conselho de gestão, sem direito a voto, elementos da equipa reitoral, os presidentes das unidades orgânicas, os responsáveis por outras unidades da Universidade, representantes dos estudantes e outros membros da comunidade académica, sempre que as matérias o justificarem.
Artigo 48.º
(Funcionamento)
1. O funcionamento do conselho de gestão rege-se por princípios de transparência, responsabilidade, racionalidade e eficiência, numa perspectiva de gestão estratégica.
2. O conselho de gestão pode delegar no reitor, nos órgãos próprios das unidades orgânicas e nos dirigentes dos serviços as competências consideradas necessárias a uma gestão mais eficiente.
3. O regime de funcionamento do conselho de gestão é definido em regulamento próprio.
Secção V
Órgãos consultivos
Subsecção I
Senado académico
Artigo 49.º
(Definição)
1. O senado académico é o órgão consultivo que assegura a coesão da Universidade na prossecução da sua missão, cumprindo funções de coordenação, prospectiva e planeamento em matérias pedagógicas e científicas que ultrapassem o âmbito das unidades orgânicas.
2. O senado académico funciona em plenário e em comissões especializadas.
3. São comissões especializadas do senado académico a comissão científica, a comissão pedagógica e a comissão de planeamento.
4. Mediante decisão do plenário, em função de matérias de natureza específica, o senado académico pode ainda funcionar em comissões eventuais.
Artigo 50.º
(Competências do plenário)
1. Compete ao plenário do senado académico:
a) a análise estratégica da oferta educativa, da actividade científica e da actividade de interacção com a sociedade, tendo em conta o quadro de referência internacional;
b) pronunciar-se sobre o regulamento disciplinar dos estudantes;
c) pronunciar-se sobre outras matérias que lhe sejam apresentadas pelo conselho geral ou pelo reitor.
2. Compete ainda ao plenário do senado académico a emissão de pareceres sobre:
a) as linhas gerais de orientação da Universidade no plano científico e pedagógico;
b) o plano estratégico de médio prazo;
c) o plano anual de actividades e o respectivo relatório;
d) a criação, transformação ou extinção de unidades e subunidades orgânicas, culturais, de serviços e diferenciadas;
e) as propinas devidas pelos estudantes;
f) os valores máximos de novas admissões e de inscrições de estudantes, nos termos da lei.
Artigo 51.º
(Composição do plenário)
1. O plenário do senado académico tem a seguinte composição:
a) o reitor, que preside;
b) os presidentes das unidades orgânicas;
c) os responsáveis dos conselhos pedagógicos das unidades orgânicas;
d) o presidente do conselho cultural, o presidente da Associação Académica, o administrador e o administrador dos serviços de acção social;
e) um estudante por cada conselho pedagógico das unidades orgânicas, procurando-se assegurar a presença de representantes de estudantes dos ciclos de estudos conducentes aos graus de licenciado, mestre e doutor, eleitos nos termos de regulamento próprio;
f) três representantes dos professores e investigadores doutorados;
g) três representantes dos estudantes;
h) dois representantes do pessoal não docente e não investigador.
2. Os membros referidos nas alíneas f), g) e h) do número anterior são eleitos, respectivamente, pelo conjunto dos professores e investigadores doutorados, pelo conjunto dos estudantes, e pelo conjunto do pessoal não docente e não investigador da Universidade, nos termos de regulamento próprio.
Artigo 52.º
(Competências da comissão científica)
1. Compete à comissão científica do senado académico:
a) a análise prospectiva da actividade científica e de interacção com a sociedade desenvolvida pela Universidade;
b) a análise dos processos e resultados da avaliação dos projectos científicos da Universidade;
c) pronunciar-se sobre matérias de natureza científica que lhe sejam apresentadas pelo conselho geral ou pelo reitor.
2. Compete ainda à comissão científica do senado académico a emissão de pareceres sobre:
a) a criação, transformação ou extinção de unidades orgânicas e suas subunidades;
b) os regulamentos das unidades orgânicas;
c) a concessão de títulos ou distinções honoríficas.
Artigo 53.º
(Composição da comissão científica)
A comissão científica é composta pelo reitor, que preside, e pelos presidentes das unidades orgânicas.
Artigo 54.º
(Competências da comissão pedagógica)
1. Compete à comissão pedagógica do senado académico:
a) a análise prospectiva da oferta educativa da Universidade;
b) a análise dos processos e resultados da avaliação dos projectos de ensino;
c) a análise dos programas de promoção da qualidade do ensino ministrado;
d) pronunciar-se sobre outras matérias de natureza pedagógica que lhe sejam apresentadas pelo conselho geral ou pelo reitor.
2. Compete ainda à comissão pedagógica do senado académico a emissão de pareceres sobre:
a) as alterações ao mapa da oferta educativa da Universidade;
b) a criação, suspensão e extinção de ciclos de estudos;
c) as políticas e os programas de promoção da qualidade do ensino ministrado;
d) os regulamentos genericamente aplicáveis em matéria pedagógica;
e) a atribuição de prémios escolares;
f) os regulamentos dos ciclos de estudos.
Artigo 55.º
(Composição da comissão pedagógica)
A comissão pedagógica é composta pelo reitor, que preside, pelos responsáveis dos conselhos pedagógicos das unidades orgânicas e pelos estudantes representantes das unidades orgânicas.
Artigo 56.º
(Competências da comissão de planeamento)
Compete à comissão de planeamento pronunciar-se sobre:
a) a análise integrada e prospectiva da oferta educativa, científica e de interacção com a sociedade;
b) o orçamento e contas anuais consolidadas, acompanhadas do parecer do fiscal único;
c) a criação, transformação ou extinção de unidades culturais, de serviços e diferenciadas;
d) o regulamento orgânico dos serviços e das unidades diferenciadas;
e) os processos e os resultados da avaliação do pessoal não docente e não investigador;
f) o regulamento dos projectos de interacção com a sociedade;
g) as políticas e os programas da acção social escolar;
h) os estatutos dos serviços de acção social;
i) outros assuntos que lhe sejam apresentados pelo conselho geral ou pelo reitor.
Artigo 57.º
(Composição da comissão de planeamento)
A comissão de planeamento é composta pelo reitor, que preside, pelos presidentes das unidades orgânicas, pelo presidente do conselho cultural, pelo administrador, pelo administrador dos serviços de acção social, pelo presidente da Associação Académica, por três representantes dos professores, por três representantes dos estudantes e por dois representantes do pessoal não docente e não investigador da Universidade.
Artigo 58.º
(Funcionamento)
1. O senado académico funciona em plenário, pelo menos duas vezes por ano, e em comissões especializadas, com a periodicidade fixada no respectivo regimento.
2. As deliberações das comissões especializadas, nas matérias das suas competências, são definitivas, só podendo ser submetidas a reapreciação do plenário, nos termos e em condições a definir no regimento.
3. Os vice-reitores podem presidir às reuniões das comissões especializadas, por delegação do reitor.
4. Os vice-reitores e os pró-reitores podem ser convidados a participar nas reuniões do plenário ou das comissões especializadas, sem direito a voto.
Subsecção II
Conselho cultural
Artigo 59.º
(Definição)
O conselho cultural é o órgão colegial de consulta do reitor e do conselho geral em questões de política cultural da Universidade.
Artigo 60.º
(Competências)
1. Compete, genericamente, ao conselho cultural a emissão de pareceres sobre a política cultural da Universidade, assegurando a ligação com a comunidade, bem como promover a coordenação das actividades das unidades culturais.
2. Compete, designadamente, ao conselho cultural:
a) dar parecer sobre as linhas gerais de orientação da Universidade no plano cultural;
b) dar parecer sobre a criação, transformação e extinção de unidades culturais;
c) promover a interligação dos programas e iniciativas culturais da Universidade com os programas desenvolvidos por outras instituições ou organismos públicos ou privados;
d) submeter ao reitor os planos de actividades das unidades culturais;
e) submeter ao reitor o modelo de gestão das unidades culturais;
f) propor ao reitor a designação dos dirigentes das unidades culturais;
g) promover a coordenação e a cooperação entre as unidades culturais;
h) elaborar e aprovar o regulamento interno, a submeter ao reitor;
i) dar parecer sobre os demais assuntos de natureza cultural que lhe sejam solicitados pelos órgãos de governo ou consultivos da Universidade, bem como pelos órgãos das unidades orgânicas;
j) divulgar as iniciativas desenvolvidas pelo conselho cultural, bem como pelas unidades culturais.
Artigo 61.º
(Composição)
O conselho cultural da Universidade tem a seguinte composição:
a) o presidente, designado pelo reitor;
b) os responsáveis das unidades culturais;
c) um estudante, nomeado pelo reitor, ouvida a Associação Académica;
d) até dez personalidades com intervenção relevante no domínio da cultura, nomeadas pelo reitor, ouvida a comissão permanente do conselho cultural.
Artigo 62.º
(Funcionamento)
1. O conselho cultural reúne em plenário, pelo menos uma vez por ano, e em comissão permanente, com a periodicidade fixada no respectivo regulamento.
2. A comissão permanente do conselho cultural é constituída pelo presidente e pelos responsáveis das unidades culturais.
Subsecção III
Conselho disciplinar
Artigo 63.º
(Definição e competências)
1. O conselho disciplinar é o órgão consultivo do reitor no exercício do poder disciplinar.
2. Compete ao conselho disciplinar a emissão de parecer para aplicação de penas graves.
Artigo 64.º
(Composição)
1. O conselho disciplinar tem a seguinte composição:
a) o reitor ou um professor por ele designado, que preside;
b) dois professores ou investigadores;
c) dois estudantes;
d) dois representantes do pessoal não docente e não investigador.
2. Os membros do conselho disciplinar são indicados pelos representantes eleitos do respectivo corpo no senado académico, sendo designados pelo reitor.
Artigo 65.º
(Mandatos)
O mandato dos membros do conselho disciplinar é de quatro anos para os professores e investigadores, bem como para os representantes do pessoal não docente, e de dois anos para os estudantes.
Artigo 66.º
(Funcionamento)
1. O conselho disciplinar reúne sempre que convocado pelo presidente.
2. Os membros do conselho disciplinar não podem abster-se.
3. A comparência às reuniões do conselho disciplinar prefere a todos os outros serviços, salvo nos casos previstos na lei.

Unidades
Capítulo I
Disposições gerais
Artigo 67.º
(Tipologia das unidades)
1. A Universidade tem diferentes tipos de unidades, que se distinguem pelos seus objectivos, estrutura, natureza e grau de autonomia:
a) unidades orgânicas de ensino e investigação;
b) unidades orgânicas de investigação;
c) unidades culturais;
d) unidades de serviços.
2. A Universidade tem ainda unidades diferenciadas, com objectivos e natureza distintos das anteriores, criadas por si ou conjuntamente com entidades do exterior, dotadas de autonomia e estrutura próprias, nos termos dos respectivos estatutos.
Capítulo II
Unidades orgânicas de ensino e investigação
Secção I
Unidades
Artigo 68.º
(Enquadramento)
1. As unidades orgânicas de ensino e investigação são estruturas com órgãos e pessoal próprios, através das quais a Universidade faz a afirmação da sua missão, numa determinada área do conhecimento, com especial ênfase nas dimensões do ensino e da investigação.
2. As unidades orgânicas de ensino e investigação congregam recursos humanos e materiais coerentes e adequados ao desenvolvimento das suas actividades pedagógicas e científicas, no âmbito de projectos autónomos ou em parceria com outras unidades, que se enquadrem na missão e objectivos da Universidade.
3. As unidades orgânicas de ensino e investigação, por sua iniciativa ou por determinação dos órgãos de governo da Universidade, podem compartilhar meios materiais e humanos, bem como desenvolver projectos conjuntos, incluindo projectos de ensino, de investigação, culturais e de interacção com a sociedade.
Artigo 69.º
(Criação de unidades orgânicas de ensino e investigação)
1. A criação de unidades orgânicas de ensino e investigação é da competência do conselho geral, observados, cumulativamente, os critérios seguintes:
a) identidade, natureza diferenciada e necessidade da sua criação, tendo em conta a missão e os objectivos da Universidade;
b) coerência científica do domínio de actividade;
c) existência de um projecto científico e pedagógico de qualidade, compatível com os restantes projectos da Universidade;
d) dimensão e perspectiva de crescimento da sua estrutura de recursos humanos, tendo em conta referenciais nacionais e internacionais da respectiva área do conhecimento.
2. Excepcionalmente, podem ser criadas, na dependência directa do reitor, unidades que não reúnam todas as condições definidas no número anterior, regidas por regulamento próprio, aprovado pelo reitor, ouvido o senado académico.
3. As unidades criadas nos termos do número anterior devem submeter à aprovação do conselho geral um plano de desenvolvimento que descreva e suporte a sua evolução para um estatuto autónomo.
Artigo 70.º
(Enumeração e denominação das unidades de ensino e investigação)
1. Existem na Universidade as seguintes unidades de ensino e investigação:
a) Escola de Ciências;
b) Escola de Engenharia;
c) Instituto de Educação;
d) Instituto de Letras e Ciências Humanas;
e) Instituto de Ciências Sociais;
f) Escola de Economia e Gestão;
g) Escola de Direito;
h) Escola de Ciências da Saúde;
i) Escola de Arquitectura;
j) Escola de Psicologia;
k) Escola Superior de Enfermagem.
2. A Escola Superior de Enfermagem é uma unidade orgânica com especificidades decorrentes da sua natureza politécnica, no que diz respeito, nomeadamente, à composição dos órgãos e à carreira académica dos seus membros.
Artigo 71.º
(Autonomia académica)
As unidades orgânicas de ensino e investigação gozam de autonomia científica, pedagógica e cultural, contribuindo para a realização dos objectivos estratégicos da Universidade numa determinada área do conhecimento.
Artigo 72.º
(Autonomia administrativa e competência de gestão)
1. As unidades orgânicas de ensino e investigação dispõem de autonomia administrativa, com o âmbito e extensão definidos nos presentes estatutos, não sendo embora dotadas de autonomia financeira.
2. A autonomia administrativa e a competência de gestão traduzem-se na capacidade dos seus dirigentes para autorizar a realização de despesas e para praticar, no mesmo âmbito, actos administrativos definitivos no que se refere à gestão corrente.
3. Os actos de gestão corrente são todos aqueles que integram a actividade que as unidades orgânicas normalmente desenvolvem para a prossecução das suas atribuições.
4. Excluem-se do âmbito da gestão corrente os actos que, nos termos da lei e dos presentes estatutos, são da competência exclusiva dos órgãos de governo da Universidade, bem como a autorização para a realização de despesas cujo montante ou natureza ultrapassem a execução nos limites aprovados.
5. As unidades gozam dos seguintes poderes ao nível da sua gestão financeira:
a) elaborar, aprovar e executar os planos anuais e plurianuais, orçamentos e outros documentos previsionais relativos às verbas de funcionamento;
b) elaborar o relatório e o mapa de execução orçamental;
c) dispor das dotações provenientes do orçamento geral do Estado e demais receitas disponibilizadas pelos órgãos competentes da Universidade, nos termos de mecanismos claros de transferência que salvaguardem a necessidade de garantir a coesão e o equilíbrio financeiro;
d) dispor das receitas provenientes das propinas de cursos não conducentes a grau e de outras receitas provenientes de projectos e de prestação de serviços, deduzidos os custos gerais de funcionamento imputáveis pela Universidade;
e) autorizar a realização de despesas nos limites que vierem a ser fixados pelos órgãos de governo competentes
6. As unidades de ensino e investigação estão obrigadas ao princípio da eficiência na utilização dos seus recursos, à transparência e ao cumprimento de todas as normas legais em vigor.
Artigo 73.º
(Participação nos recursos financeiros da Universidade)
1. A participação das unidades orgânicas de ensino e investigação nos recursos da Universidade resulta do plano estratégico, visando o equilíbrio financeiro vertical e horizontal.
2. O equilíbrio financeiro vertical visa adequar os recursos das unidades orgânicas de ensino e investigação às respectivas competências e dimensão.
3. O equilíbrio financeiro horizontal pretende promover a correcção de desigualdades entre unidades orgânicas, resultantes, designadamente, de diferentes capacidades na captação de receitas ou de diferentes necessidades de despesa resultantes da natureza científica e pedagógica das unidades orgânicas de ensino e investigação.
Artigo 74.º
(Auditoria e controlo)
1. As unidades ficam sujeitas à fiscalização financeira da Universidade, através do órgão competente.
2. Os serviços disponibilizarão as informações relevantes às unidades orgânicas de ensino e investigação e respectivas subunidades.
Artigo 75.º
(Modelo de governação e órgãos)
1. As unidades têm órgãos de governo próprios, regendo-se por estatutos próprios, no respeito da lei e dos presentes estatutos.
2. Os órgãos de governo das unidades orgânicas de ensino e investigação são:
a) o conselho da unidade;
b) o presidente;
c) o conselho científico;
d) o conselho pedagógico.
3. Caso o regulamento da unidade o preveja, poderão ainda ser criados:
a) o conselho de gestão;
b) o conselho consultivo.
4. As unidades orgânicas de ensino e investigação do ensino superior politécnico têm um conselho técnico-científico, com as competências adaptadas à sua especificidade, de acordo com a lei e os presentes estatutos.
Artigo 76º
(Conselho da unidade)
O conselho da unidade é o órgão colegial representativo da unidade.
Artigo 77.º
(Competências do conselho da unidade)
Compete ao conselho da unidade:
a) definir as linhas gerais de orientação da unidade;
b) aprovar os regulamentos internos da unidade;
c) aprovar o plano anual de actividades, o orçamento, o relatório de actividades e as contas;
d) eleger o presidente da unidade, nos termos do respectivo regulamento;
e) pronunciar-se sobre a criação, modificação e extinção de subunidades orgânicas;
f) exercer outras competências fixadas nos estatutos da unidade.
Artigo 78.º
(Composição do conselho da unidade)
1. O conselho da unidade é composto por um máximo de quinze membros, do seguinte modo:
a) por, pelo menos, 60% de professores e investigadores doutorados, podendo nestes incluir directores de departamentos e directores de centros de investigação, caso os estatutos da unidade assim o prevejam;
b) por, pelo menos, 20% de estudantes dos vários ciclos de estudos ministrados;
c) por representantes do pessoal não docente e não investigador, até 10%.
2. O conselho da unidade pode incluir ainda membros externos.
3. O resultado dos cálculos para determinação da constituição do conselho, quando tiver parte decimal, é arredondado para o inteiro imediatamente inferior.
Artigo 79º
(Presidente da unidade)
O presidente da unidade é o órgão uninominal que superiormente dirige e representa a unidade.
Artigo 80.º
(Competências do presidente da unidade)
Compete ao presidente da unidade orgânica de ensino e investigação:
a) representar a unidade perante os demais órgãos da Universidade e perante o exterior;
b) dirigir os serviços da unidade;
c) exercer o poder disciplinar estabelecido pelos estatutos ou delegado pelo reitor;
d) elaborar o orçamento e o plano de actividades, bem como o relatório de actividades e as contas;
e) exercer as demais funções previstas na lei e nos estatutos da unidade.
Artigo 81.º
(Eleição do presidente da unidade)
1. O presidente é um professor catedrático ou coordenador, ou um investigador coordenador, eleito pelo conselho da unidade, através de regulamento próprio, para um mandato de três anos, renovável uma única vez.
2. Em situações devidamente fundamentadas, por decisão do reitor, sob proposta do conselho da unidade, o presidente pode ser eleito entre os professores catedráticos e associados.
3. O presidente pode ser coadjuvado por vice-presidentes, até um máximo de três, podendo neles delegar as competências necessárias para o adequado funcionamento da unidade.
Artigo 82.º
(Conselho científico e conselho técnico-científico)
1. O conselho científico é o órgão que define e superintende a política científica da unidade de ensino e investigação de natureza universitária.
2. O conselho técnico-científico é o órgão que define e superintende a política científica da unidade de ensino e investigação de natureza politécnica.
Artigo 83.º
(Competências do conselho científico e técnico-científico)
1. Compete ao conselho científico:
a) definir a política de investigação da unidade, tendo em conta as linhas gerais de orientação da Universidade;
b) aprovar os planos de actividades e os relatórios anuais das respectivas subunidades;
c) aprovar as propostas de admissão e recondução do pessoal docente, bem como do pessoal investigador;
d) pronunciar-se sobre a transferência de professores;
e) propor a abertura de concursos de professores e a composição dos júris, depois de ouvidos os respectivos departamentos;
f) decidir sobre as propostas de constituição dos júris para as provas de mestrado;
g) propor a composição dos júris de outras provas académicas;
h) pronunciar-se sobre pedidos de concessão de equivalência de doutoramento e propor a nomeação dos respectivos júris;
i) propor a criação de novos ciclos de estudos e aprovar os planos de estudo referentes à criação ou reestruturação de ciclos de estudos em que a unidade seja parte interveniente;
j) decidir ou pronunciar-se sobre os demais assuntos previstos na lei e nos regulamentos internos da Universidade;
k) desempenhar as demais funções previstas na lei e nos presentes estatutos.
2. As competências do conselho técnico-científico são as previstas no número anterior, com excepção da alínea h).
3. O conselho científico ou técnico-científico pode delegar no seu presidente as competências que entenda adequadas ao seu bom funcionamento.
Artigo 84.º
(Composição do conselho científico)
1. O conselho científico é composto por um máximo de vinte e cinco membros, assim distribuídos:
a) o presidente da unidade, que preside;
b) representantes eleitos pelos respectivos corpos dos professores e investigadores de carreira que serão, pelo menos, 50% dos membros;
c) representantes dos centros de investigação associados à unidade, reconhecidos e avaliados positivamente, nos termos da lei, entre 30% a 40% dos membros;
d) representantes eleitos pelos respectivos corpos dos outros docentes e investigadores em tempo integral, detentores do grau de doutor e contratados há mais de um ano, até um máximo de 10% dos membros.
2. O resultado dos cálculos do número anterior, para determinação da constituição do conselho científico da unidade, quando tiver parte decimal, é arredondado para o inteiro imediatamente inferior.
3. Os directores das subunidades orgânicas podem ser convidados a participar nas reuniões do conselho científico, sem direito a voto.
4. Os mandatos dos representantes referidos nas alíneas b), c) e d) do n.º 1 têm a duração de três anos.
5. A eleição dos membros do conselho científico obedece a regulamento próprio, a aprovar pelo reitor.
Artigo 85.º
(Composição do conselho técnico-científico)
1. O conselho técnico-científico é composto por um máximo de vinte e cinco membros, assim distribuídos:
a) o presidente da unidade, que preside;
b) representantes eleitos pelos respectivos corpos dos professores e investigadores de carreira que serão, pelo menos, 50% dos membros do conselho;
c) representantes dos centros de investigação associados à unidade, reconhecidos e avaliados positivamente, nos termos da lei, que serão, pelo menos, 20% dos membros;
d) equiparados a professor em regime de tempo integral, com contrato com a Escola há mais de 10 anos, até um máximo de 10%;
e) docentes com o título de especialista, não abrangidos pelas alíneas anteriores, em regime de tempo integral, com contrato com a instituição há mais de 2 anos, até um máximo de 20%.
2. O resultado dos cálculos do número anterior, para determinação da constituição do conselho científico da unidade, quando tiver parte decimal, é arredondado para o inteiro imediatamente inferior.
3. Os directores das subunidades orgânicas podem ser convidados a participar nas reuniões do conselho técnico-científico, sem direito a voto.
4. Os mandatos dos representantes referidos nas alíneas b), c), d) e e) do n.º 1 têm a duração de três anos.
5. A eleição dos membros do conselho técnico-científico obedece a regulamento próprio, a aprovar pelo reitor.
Artigo 86.º
(Conselho pedagógico)
O conselho pedagógico é o órgão que define e superintende a política pedagógica da unidade.
Artigo 87.º
(Competências do conselho pedagógico)
1. Compete, designadamente, ao conselho pedagógico:
a) pronunciar-se sobre as orientações pedagógicas e os métodos de ensino e de avaliação;
b) promover a realização de inquéritos regulares ao desempenho pedagógico da unidade orgânica e a sua análise e divulgação;
c) promover a realização da avaliação do desempenho pedagógico dos docentes, por estes e pelos estudantes, e a sua análise e divulgação;
d) garantir mecanismos de auto-avaliação regular relativa ao desempenho dos projectos de ensino;
e) apreciar as queixas relativas a falhas pedagógicas e propor as providências necessárias;
f) aprovar o regulamento de avaliação do aproveitamento dos estudantes;
g) pronunciar -se sobre o regime de prescrições;
h) pronunciar-se sobre a criação de ciclos de estudos e sobre os planos dos ciclos de estudos ministrados;
i) pronunciar-se sobre a instituição de prémios escolares;
j) assegurar a gestão corrente dos assuntos comuns aos ciclos de estudos, designadamente no que concerne ao calendário lectivo e ao calendário de avaliação;
k) propor a afectação de recursos para um correcto funcionamento dos ciclos de estudos;
l) aprovar as equivalências de unidades curriculares e de planos de estudos, segundo as normas e critérios fixados pelo senado académico;
m) moderar e arbitrar os conflitos que venham a ocorrer no funcionamento dos ciclos de estudos;
n) exercer as demais competências que lhe sejam conferidas pela lei ou pelos estatutos.
2. O conselho pode delegar parte das suas competências no seu presidente.
3. Nas reuniões do conselho pedagógico poderão participar, sem direito a voto, elementos externos ao conselho, nos termos previstos no respectivo regulamento.
Artigo 88.º
(Composição do conselho pedagógico)
1. O conselho pedagógico da unidade é composto paritariamente por elementos dos corpos docente e discente.
2. O conselho pedagógico é composto por um máximo de vinte e quatro membros, do seguinte modo:
a) o presidente, que deverá ser um vice-presidente da unidade;

Preamble
1. The University of Minho, first established by Executive Law no. 402/73, of 11 August, has adopted, since the beginning and for the fulfilment of its objectives, an organisational model, called Project Groups, based on a matrix system that involved Projects - teaching, research and services projects -, and Resource Units. The University’s governing structure emerged, for the first time, in the Provisional Internal Regulation, approved by means of a dispatch of the Secretary of State for Higher Education and Scientific Research, on 10 February 1976. This Provisional Internal Regulation would be in force during the setting up period, and, after amendments determined by the University’s governing bodies, would remain in force until the Statutes of the University were eventually approved by Normative Dispatch no. 80/89 of the Ministry for Education, published in the Diário da República no. 198, Series I, of 29 August 1989.
2. Following to the enactment of the Statutes, laid down in accordance with Law no. 108/88, of 24 September (University Autonomy Law), the University’s matrix and management model were kept, and a flexible organisational structure adjusted to knowledge and innovation evolution, to the growing interdisciplinarity of knowledge, as well as to the need for rational resources’ management was set up.
Afterwards, the University Statutes went through several amendments, duly approved by the University Assembly, and enacted by Normative Despatches published, respectively, in the Diário da República no. 296/1995, of 26 December; in the Diário da República no. 41/1998, of 18 February; and in the Diário da República no. 119/2000, of 23 May. The last revision, which aimed at the integration of the Calouste Gulbenkian Nursing Higher School, and at the creation and restructuring of Organic Units, was published in the Diário da República no. 40/2005, of 25 February.
3. In September 2007, a new legal framework for Higher Education Institutions was brought forth by the enactment of Law no. 62/2007, of 10 September. In this new legal context, and taking into due account the experience gained over the years and the Institution’s reality, the present statutes create a new University model adjusted to the challenges of higher education and research in the European context. This new model highlights the need to reinforce the articulation between the University’s strategic guidelines and the policies developed by the governing bodies provided for in the Legal Framework for Higher Education Institutions, as well as the strategic guidelines for its Units, within the scope of their autonomy.
To accomplish its mission, the University assumes itself as a “University of Projects”, cherishing its culture as well as the maturity grown over the many years of its experience of the matrix model. The Teaching and Research Units, also designated Schools or Institutes, are the basic structures for the implementation of those projects, which have, for this purpose, adopted a management and organisation model that enables cross-disciplinary approaches and guarantees rational use of the resources.
The existence of a University Senate, as advising body for all matters as provided for in the Statutes, ensures University’s pedagogical and scientific cohesion and coordination conditions, as well as the conditions for Organic Units’ participation. As for the Cultural Council, it ensures the continuity of a tradition unique to the University and aims at ensuring the fulfilment of relevant functions in terms of cultural policy, as well as of coordination of the University’s Cultural Units.
In a time where knowledge has become the pillar of socio-economic development, the Universities are, indeed, a privileged space for the creation and dissemination of knowledge and innovation. Accordingly, the University of Minho embraces those principles as its fundamental mission – knowledge creation, dissemination and application, based on the freedom of thought, plural critical judgements, thus contributing to a fairer and more democratic society -, the accomplishment of which the University pursues as a ‘Project-oriented University’, cherishing its culture and maturity developed over the many years of its experience of the matrix model, with the necessary adjustments imposed, in one hand, by the new legal framework, and on the other, by the necessity of providing the Institution with the adequate organisation in order to respond to all the demands addressed to the University.
The University considers itself to be a “University within a Region”, as opposed to the concept of a Regional University, thus assuming all the responsibility and demands of its role as a key agent in the economic and cultural development of its region. Additionally, its campi are the ground for the development of its mission and for the valorisation of teaching and research effort, consequently attracting the best students, the best teachers and the best researchers. Therefore, as a complete university and being a centre for research, knowledge development and consolidation in the European context of higher education, in various scientific areas – human and social sciences, artistic studies, sciences and technologies –, the University of Minho has undertaken periodical assessment concerning the fulfilment of its goals according to the highest international standards.
Title I
Nature, mission and guiding principles
Article 1
(Nature)
1. The University of Minho, hereinafter called the University, is a legal person governed by public law, which shall autonomously draw up its own by-laws and shall enjoy scientific, cultural, administrative, economic, financial and disciplinary autonomy.
2. Its Organic Units may, under the present statutes, be given scientific, pedagogical, cultural, administrative and financial autonomy.
Article 2
(Mission and goals)
1. The University’s mission shall be the creation, dissemination and application of knowledge, under the spirit of freedom of thought and plural critical judgements, through the promotion of higher education and the construction of a society paradigm based on humanistic principles, and having knowledge, creativity and innovation as cornerstones for growth, sustainable development, welfare and solidarity.
2. The mission stated in paragraph 1 above shall be fulfilled within an international reference framework, based primarily on research and on its articulation with teaching, through the pursuit of the following goals:
a) Human training, at the highest level, covering all dimensions, ethical, cultural, scientific, artistic, technical and professional, through diversified educational offers; the creation of the proper learning environment; the valorisation of the activity of the teaching, researching as well non-teaching and non-researching staff; and the personal, social, intellectual and professional development of its students, thus contributing for lifelong education and the exercise of an active and responsible citizenship.
b) Research development, and the participation in scientific institutions and events, with a view to promote permanent search for excellence, to encourage creativity as a source of innovating and differentiating proposals and solutions, and to promote the search for the best way to address society’s greatest challenges.
c) Transfer, interchange and valorisation of scientific and technological knowledge, created through the development of application solutions; the provision of specialised services to the community; the promotion of initiatives in the context of lifelong education and development supporting actions, in a basis of reciprocal valorisation and entrepreneurship fostering.
d) Promotion of activities enabling access to and enjoyment of cultural assets to everyone, individually and in groups, both internal and external to the University.
e) Cultural, scientific and technical interchange, with both national and international institutions and bodies, through the promotion of students, teaching staff and non-teaching and non-researching staff’s mobility; as well as the development of learning and research programmes through the establishment of partnerships; and the contribution for international cooperation, particularly with Portuguese speaking countries, and the creation of a multilingual environment at the University.
f) Interaction with society, through contributions to a public understanding of culture, to the analysis and presentation of proposals to address the main problems of daily life, as well as through the establishment of partnerships in order to promote social and economic development at regional, national and international level.
g) Contribution to social and economic development of its neighbouring region and to the knowledge, preservation and dissemination of its natural and cultural items.
h) Promotion of the University’s institutional sustainability and competitiveness in a global context.
Article 3
(Guiding principles)
1. The University shall fulfil its mission and pursue its goals on a basis of respect for the dignity of the human person and its promotion, forbidding any form of dehumanized treatment.
2. The University shall abide by the principles of equality, democratic participation, pluralism of opinions and orientations, and the freedom to learn, teach and research shall be guaranteed.
3. The University shall develop its labour inspired by a quality culture founded on responsibility, the efficiency of its action and the prevalence of common interest.
Article 4
(Degrees and titles)
1. In pursuing its mission, the University shall confer undergraduate, post-graduate and doctoral degrees, and the title of aggregate professor, and other types of certificates and diplomas, as well as the conversion and recognition of academic degrees and qualifications.
2. The University shall also award honorary degrees and titles, namely the honorary degree honoris causa.
Article 5
(Academic autonomy)
1. In the exercise its academic autonomy, the University shall define its mission, goals and teaching, research and society interaction projects, in such a way as to contribute to the advancement of knowledge, the quality of its students’ education and the development of the surrounding region.
2. The University shall exercise its academic autonomy at scientific, pedagogical, cultural and disciplinary level, with social responsibility and ruled by ethical principles.
Article 6
(Scientific autonomy)
1. The University shall be responsible for freely defining, programming and implementing its research projects as well as other scientific activities, without prejudice to the criteria and procedures of research public funding.
2. The University shall be further responsible, within the scope of its scientific autonomy, for establishing its own research and development institutional policy, and shall define priorities concerning its own contribution to the advancement of knowledge, the quality of its educational offer and deepening of its interaction with society.
3. With a view to the effective pursuit of the University’s research objectives, budgets shall be assigned to the research projects.
Article 7
(Pedagogical autonomy)
1. The University shall be responsible for creating, modifying and extinguishing study cycles, as well as courses not leading to a degree, and for designing their study plans, defining the object of the course units, defining teaching and learning methodologies, as well as for allocating the necessary resources and for choosing learning assessment methodologies.
2. The principle underpinning pedagogical autonomy is the freedom to teach and to learn, namely teachers’ and students’ intellectual freedom towards learning and teaching processes, in which due regard is given to the principles of independence, thoroughness of thought and freedom of opinion.
3. The decision on the creation, modification or extinction of study cycles shall be taken by the University’s bodies, and shall involve the advising bodies, namely the University Senate and the Organic Units.
Article 8
(Cultural autonomy)
1. The University shall be responsible for freely defining its cultural policies, programmes and initiatives, without any other restrictions than those derived from the Constitution Law, the law of the land and international agreements.
2. Without losing the autonomy mentioned in paragraph 1 above, the University may associate its cultural programmes with similar programmes promoted by other private or public institutions or bodies.
3. Through its cultural activity, the University shall promote the democratisation of access to cultural items.
Article 9
(Disciplinary autonomy)
1. Disciplinary autonomy shall be exercised according to regulation laid down to this effect by the University, as provided for in the law and the present statutes, and within a reference framework for enhancement of the principles governing academic life, namely independence, intellectual thoroughness and honesty, responsibility, work ethics, and respect for human dignity.
2. Disciplinary proceedings against students shall be upheld in accordance with the academic code of conduct and in compliance with a disciplinary regulation, approved by the Rector, after first consulting the University Senate.
3. Disciplinary power shall lie with the Rector, and for that purpose he shall be assisted by a Disciplinary Council. The Rector may delegate the disciplinary power to the presidents of the Organic Units, without prejudice to the right of appeal to the Rector.
Article 10
(Constitution of legal persons)
The University may, in the terms of the law, and in order to fulfil its objectives, constitute or participate in the constitution of external autonomous entities.
Article 11
(Agreements)
The University may, directly or through its Organic Units, set up consortia, agreements, contracts, protocols or any other agreements with national, foreign or international public or private institutions.
Article 12
(Headquarters, symbols and the day of the University)
1. The University’s headquarters shall be in the city of Braga (Portugal), and it shall have two campi, one in the city of Braga, and another in the city of Guimarães and it may, if necessary for the fulfilment of its goals, establish other campi in other locations.
2. The University of Minho’s campi may host one or several Organic Units and may, as well, promote activities of an academic or polytechnic nature.
3. The University’s official colours shall be white and red.
4. The University shall adopt its own coat of arms and academic dress.
5. February 17 shall be the day of the University.
Article 13
(Carlos Lloyd Braga Foundation)
In order to accomplish its mission and goals, the University shall be supported by the Carlos Lloyd Braga Foundation, a private-law and public utility institution, governed by its own statutes.
Title II
Projects
Article 14
(Framework)
Projects are activities promoted by the University, which contribute to the fulfilment of its mission and goals, and which shall, according to their main purpose, correspond to:
a) Research projects;
b) Teaching projects;
c) And society interaction projects.
Article 15
(Research projects)
Scientific or scientific and technological activities, with specific objectives, limited duration and planned implementation, shall be deemed research projects.
Article 16
(Teaching projects)
Study cycles leading to a degree or courses not leading to a degree, as provided for in the University’s educational offer plan, shall be deemed teaching projects.
Article 17
(Society interaction projects)
Society interaction projects shall be those actions promoted by the University, and covered by its mission, although not falling directly within the scope of formal teaching and research activities, with a view to addressing particular interests or needs of the surrounding community, on a basis of reciprocity.
Title III
Governing and organisational structure
Chapter I
Governing model and principles of management
Article 18
(Governance and organisation)
1. The University’s governing model shall be founded upon the principles of participation, democracy, decentralisation, autonomy and public accountability.
2. The University shall adopt an organisational model based on a matrix system which promotes cross-institutional interaction between its units, with a view to the implementation of those projects which accomplish the University’s mission and goals, thus guaranteeing efficient use of means and resources.
Article 19
(Administrative autonomy)
1. The University shall be entitled to administrative autonomy, and shall issue regulations, practice definite administrative acts and enter into administrative contracts.
2. In the scope of its administrative autonomy, the University shall:
a) Undertake the day-to-day management of its own matters;
b) Recruit and assign tasks to its staff;
c) Be responsible for its internal organisation and for that of its services.
3. Additionally to the staff mentioned in the Teaching Staff Career Statutes – the academic, polytechnic and researching staff -, and in the permanent staff chart, the University may recruit, in accordance with the law, prominent national or foreign persons for teaching and researching positions, as well as any other staff to promote all activities deemed necessary for the University proper functioning.
Article 20
(Management and performance assessment)
The University has the power to undertake adjustments to the existing rules of procedure regarding performance management and assessment of the public administration, based on each service organisation and responsibilities, and of staff careers and management needs.
Article 21
(Financial autonomy)
The University shall hold financial autonomy, and shall have assets, budget and own revenues.
Article 22
(Property autonomy)
1. The University’s property shall be all the assets as well as the rights it lawfully owns, as well as those allocated to it by the State, and other public and private entities for the pursuit of its mission and goals.
2. It shall, furthermore, be the University’s property its symbolic elements, which use shall be subject to the principle of common benefit.
3. The University’s premises shall be subject to the principle of free and common usage, and private and chargeable use may solely be established under the provisions of the relevant regulation.
4. All the beneficiaries of the University’s property, namely teachers, researchers, students and non-teaching and non-researching staff shall be under the obligation to protect and safe keep it.
Article 23
(Budgetary autonomy and own resources)
1. The University’s budget shall be subject to the principles of annuity, unity, universality, specification, balance and publicity.
2. The University’s budget shall be approved as laid down by the present statutes.
3. The following are the University’s revenues:
a) The public budget allocated by the State;
b) The revenue from the sale of any assets that the University may possess;
c) The revenues from the assets the University owns or from those the University holds the right of enjoyment;
d) The revenues from research and development activities;
e) The revenues from services provision and from the sale of publications;
f) The revenues from intellectual and industrial property;
g) The revenues from students’ fees;
h) The proceeds of charges, administrative fees, penalties, and fines.
i) The interests paid on deposit accounts;
j) Balances of revenue and expenditure accounts from previous years;
k) Other revenues, namely, allowances, grants, loans, gifts, inheritances, and legacies.
Article 24
(Tax exemption)
The University and its Organic Units shall be, under such provisions as applied to the State, entitled to exemption from the payment of taxes, charges, administrative fees and stamp duty.
Article 25
(Transparency and publicity)
Without prejudice to any other legally required forms, all official decisions issued by all the bodies shall be duly publicised by the University.
Chapter II
Organisational structure
Section I
Bodies of the University
Article 26
(Bodies)
1. The University shall be governed by the following bodies:
a) The General Council;
b) The Rector;
c) The Management Council.
2. The governing bodies shall be responsible for running the University with regard to its scientific, pedagogical, cultural and society interaction activity. They shall be further responsible for ensuring the Institution’s planning, as well as administrative and financial management.
3. The following are the University advisory bodies:
a) The University Senate;
b) The Cultural Council;
c) The Disciplinary Council.
4. The advisory bodies shall be responsible for advising the General Council and the Rector on the performance of their functions and shall deliver their opinion on several matters, in accordance with the present statues.
Article 27
(Incompatibilities and prevention form exercise of office)
1. The University officeholders, as well as the members of the governing and management bodies of the University shall be exclusively at public interest service and shall be independent in the exercise of their functions.
2. The Rector, Vice-rectors, Pro-rectors, Presidents and Vice-presidents of the Organic Units as well as the Directors of the Subunits shall not be members of governing or management bodies of other public or private higher education institutions.
3. If any incompatibility should be verified, it shall, consequently, cause loss of seat and ineligibility for any of the officers mentioned in the previous number for a period of four consecutive years.
Section II
General Council
Article 28
(Definition)
The General Council shall be the highest collegial governing and strategic decision-making body of the University, which consists of the representatives of the University bodies, as well as external persons, whose action shall be bound to the fulfilment of the University’s mission as well as to the pursuit of public interest.
Article 29
(Responsibilities)
1. The General Council shall:
a) Elect its own president, by an absolute majority, from among its external members;
b) Approve its own rules of procedure;
c) Approve amendments to the University statutes, in accordance with the law and the present statutes;
d) Set up the procedure for the holding of elections and shall elect the rector, as laid down by the law, by the present statutes and by the relevant regulation;
e) Consider the Rector’s and the Management Council decisions;
f) Propose all initiatives it deems necessary for the University proper functioning;
g) Carry out such other functions as shall be assigned to it by the law and the present statutes;
2. Upon proposal of the Rector, the General Council shall be responsible for:
a) Approving the medium term strategic plan, as well as the action plan for the Rector’s four years term of office;
b) Approving the University’s general guidelines at scientific, pedagogical, financial and property level;
c) Creating, modifying or extinguishing Organic Units and Subunits;
d) Approving the University’s annual activities plans and considering the respective reports;
e) Approving the budget bill;
f) Approving the annual consolidated accounts, which shall be accompanied by the report of the sole auditor;
g) Fixing students’ fees;
h) Proposing or authorising, under the provisions of the law, the purchase or sale of University’s estate, as well as credit operations;
i) Approving contract-programmes with the Organic Units;
j) Pronouncing upon all matters submitted to it by the Rector.
3. The decisions mentioned in subparagraphs a) to d) and f) of paragraph 2 above must be preceded by the consideration of an opinion, which shall be drawn up and approved by its external members.
4. The General Council’s decisions shall be approved by a simple majority vote, except in the cases in which the law and the present statutes require absolute majority or a more demanding means of approval.
5. A two-thirds qualified majority is always required in the following cases:
a) The Rector’s suspension or removal from office;
b) The removal from office of any of its members;
c) In the cases provided for in (2)c above.
6. In all matters that fall under its responsibility, the General Council may ask other University bodies, namely those with advisory status, the Organic Units, as well as the external entities, to issue opinions on those matters.
Article 30
(Composition)
1. The General Council shall consist of:
a) Twelve representatives of the teachers and researchers;
b) Four representatives of the students;
c) A representative of the non-teaching and non-researching staff;
d) Six external personalities of acknowledged merit, whose knowledge and experience are relevant to the University.
2. For the proposes of (1)a above, teachers and researchers of the academic and polytechnic career, and teachers holding a doctoral degree, exercising full time teaching and researching functions at the University, and having a working contract for at least one year, whichever the nature of the working relationship, shall be deemed teachers and researchers.
Article 31
(Election and co-optation)
1. The members of the General Council, as mentioned in number (1)a, b and c of the previous Article, shall be elected by all their peers.
2. The elections referred to in the previous number are set up in accordance with the system of proportional representation, where the seats shall be distributed as a whole among the competing lists using d’Hondt’s rule, as laid down in the relevant regulation, which shall be approved by the General Council.
3. The personalities mentioned in subparagraph d) of the previous Article, shall be co-opted by all other members, by absolute majority, under the provisions of the relevant regulation, and according to the substantiated proposals subscribed by, at least, a third of those members.
4. The General Council shall be responsible for initiating the necessary proceedings to the election of its members or the co-optation of the external personalities, before the end of their term of office, and the processes shall be chaired by the senior teacher and researcher representative, holding the highest academic standing.
Article 32
(Terms of office)
1. The elected or co-opted members shall hold a four years term of office, except for the students, whose term of office shall be two years.
2. None of the General Council members shall be removed from office, except by the General Council, for serious misconduct, in accordance with the relevant regulation.
3. The term of office of a body’s elected members shall end when, for any reason, they are no longer members of the body they represent.
4. In the event of vacancy or termination of term of office, replacement shall be ensured by the first elected candidate next in list by order of precedence, in the case of the members provided for in Article 30a, b and c, and, in the case of co-opted members, by the next person in order as set out in the respective selection minutes.
5. If a vacancy arises before a member’s completion of office, the person next appointed shall hold office for the remainder of the period of office of the person replaced.
Article 33
(Independence and conflict of interests)
1. The members of the General Council shall not be members of any other governing body of the University, nor of the University Senate.
2. The co-opted members of the General Council shall not exercise any functions at the governing bodies of other higher education institutions.
3. The General Council members running for the Rector’s election, as well as the members of the candidates’ teams, such as vice-rectors or pro-rectors, shall be suspended from office during the course of the election process, and their temporary replacement shall be ensured in accordance with paragraph 4 of the previous Article.
Article 34
(President)
1. The President of the General Council shall be responsible for:
a) Calling for and chairing the Council’s meetings, where he shall have a casting vote;
b) Verifying vacancies at Council and for implementing the necessary proceedings for the appointment of new members.
2. The President of the General Council shall further exercise all the functions assigned to it by the rules of procedure.
3. The President shall not interfere in the exercise of the function of other University’s bodies.
Article 35
(Meetings)
1. The General Council shall meet, on an ordinary basis, four times a year and, on an extraordinary basis when called by its president, at its own initiative, at the Rector’s request or that of a third of the Council’s members.
2. The Rector shall attend the meetings but shall not be entitled to vote at any such meetings.
3. The Council may, as laid down in its rules of procedure, invite to its meetings any members of the University, as well as external members, who shall give their opinions on matters of their expertise.
Section III
Rector
Article 36
(Definition)
The Rector shall be the uninominal body who shall govern and represent the University at the highest level.
Article 37
(Responsibilities)
1. The Rector shall be responsible for:
a) Drawing up and submitting to the General Council the following proposals:
i) The medium term strategic plan, as well as the action plan for his or her four years term of office;
ii) The University’s general guidelines at scientific and pedagogical level;
iii) The annual activities plan and the respective report;
iv) The budget and consolidated accounts, which shall be accompanied by the report of the sole auditor;
v) The purchase or sale of University’s estate, as well as credit operations;
vi) The creation, modification or extinction of Organic Units and Subunits, as well as Cultural, Services and Differentiated Units;
vii) Student’s fees.
b) Approving the creation, suspension or extinction of study cycles;
c) Approving maximum limits for new admissions and students enrolment, as laid down by the law;
d) Superintending University’s management, by taking decisions concerning, namely, public calls for application of candidates, staff appointment and recruitment, for any position, as well as juries qualification for the competitions, and for doctorate and aggregation examinations;
e) Approving the University’s self-evaluation systems, as well as those used for the evaluation of teachers, researchers, non-teaching and non-researching staff;
f) Taking steps for obtaining the financial means necessary for the University proper functioning;
g) Allocating to the Organic Units the financial resources from the Public Budget, which shall be preceded by the General Council’s opinion, by way of the University’s annual budget, without prejudice to the necessity of ensuring cohesion mechanisms;
h) Granting support to students in the framework of school social services, as laid down by the law;
i) Approving the award of titles or honorary distinctions;
j) Conferring the status of professor emeritus;
k) Establishing school prizes;
l) Confirming the election of the members of the Organic Units’ Council, as well as that of the respective President, which he or she shall refuse to do only on the grounds that it is illegal, and installing them;
m) Appointing and discharging, in accordance with the law and the present statutes, the heads of Cultural and Differentiated Units, subject to compliance with the relevant regulations;
n) Superintending the social services;
o) Appointing and discharging, as laid down by the law and by the present statutes, the Administrator and the heads of the University services;
p) Exercising disciplinary power, as provided for by the law and by the present statutes;
q) Ensuring compliance with the decisions taken by the University’s governing bodies;
r) Approving the regulations provided for by the law and by the statutes, namely, on pedagogical matters, without prejudice to Organic Units regulatory power within the ambit of their own responsibilities;
s) Preceded by an opinion from the General Council and after first consulting the Senate, reallocating human and financial resources between the units and subunits;
t) Ensuring compliance with the law, the statutes and the regulations;
u) Proposing all initiatives he or she thinks fit for the University proper functioning;
v) Reporting to the relevant Minister all the necessary data to enable the exercise of oversight over the University, namely plans and budgets as well as accounts and activities reports;
w) Taking steps as he or she considers necessary for ensuring the University and its Organic Units teaching and researching quality;
x) Exercising all other functions as provided for by the law.
2. The Rector shall also perform all other responsibilities as are not, by the law or by the present statutes, assigned to other bodies of the Institution.
3. The decisions taken on the matters mentioned in subparagraphs a.iii, a.vi and a.vii, b, c, i, j e k of paragraph number 1 above shall always be preceded by consultation of the Senate.
4. The Rector may delegate to the Organic Units governing bodies all the responsibilities he or she shall deem fit for a more efficient and decentralised management.
5. The Rector shall be assisted by Vice-rectors and Pro-rectors, to whom he or she may delegate or sub-delegate some of his or her responsibilities.
Article 38
(Rector’s election)
1. The Rector shall be elected by the General Council, in compliance with the provisions of the present statutes and under a procedure provided for in the relevant regulation.
2. The election procedure provides, namely, that:
a) Public notice calling for the submission of nominations for election shall be made;
b) The nominations for election shall be submitted;
c) The public hearing of the candidates for presentation and discussion of their action plans shall take place;
d) A final voting of the General Council, by secret ballot, by majority, shall take place.
3. The University’s teachers and post doctoral researchers, or those of other higher education and researching national or foreign institutions shall be eligible for election.
4. The following shall not be eligible for election:
a) The person or persons who are already retired;
b) The person or persons who have been convicted for disciplinary, financial or criminal misconduct while exercising public or professional functions, within the four years after having served a sentence.
c) The person or persons to whom any other such ineligibilities, as provided for by the law, may apply.
Article 39
(Rector’s Term of office)
1. The term of office of the Rector shall be four years and may be renewed only once, in accordance with the present statutes.
2. In the event of an early termination of mandate, the new Rector shall commence a new term of office.
Article 40
(Vice-rectors)
1. In accordance with the present statutes, the Rector shall be assisted by, at most, four Vice-rectors.
2. The Vice-rectors shall be chosen and appointed by the Rector from among the University teachers and researchers.
3. The Rector may, at any time, discharge his or her Vice-rectors, and their term of office shall end when the Rector’s term of office does.
Article 41
(Pro-rectors)
1. The Rector shall be, furthermore, assisted by, at the most, five pro-rectors, who he or she shall freely chose and appoint, and who may be external members.
2. The pro-rectors shall develop their activities, which shall be delegated to them by the Rector, in specific areas.
Article 42
(Rector’s suspension and removal from office)
In the event of any situation which jeopardizes the University life, the General Council shall be called by its President or by a third of its members, and may pass the decision, by a majority of two thirds of all its members, for the Rector’s suspension or, following to the conclusion of the necessary administrative proceeding, and again by majority, for his removal from office.
Article 43
(Exclusive engagement)
1. During his or her term of office, the Rector shall be exclusively engaged in exercising his or her functions.
2. In cases where the Rector and Vice-rectors are teachers or researchers of the University, they shall be relieved of their teaching and researching duties, although they may, on their own initiative, perform those duties.
Article 44
(Rector’s substitution)
1. In the event that the Rector is temporarily incapacitated, as well as absent or somehow unable to perform his or her functions, he or she shall be replaced by such Vice-rector as he may appoint, or in the event that the latter is unable to do so, by the senior Vice-rector.
2. If the Rector remains unable to perform his functions for more than ninety days, the General Council shall pronounce upon the convenience of electing a new rector.
3. In the event that the Rector becomes permanently unable to perform his or her functions, or that he or she resigns, or that the office falls vacant, the General Council shall pass the decision for the holding, within at the most eight days, of the proceedings for electing a new rector.
4. During the time the office is vacant, as well as in the event of the Rector’s suspension, as provided for in Article 42, his or her functions shall be performed, as acting Rector, by the Vice-rector the General Council shall appoint, or, in the event that the latter is unable to do so, by a University teacher or researcher selected by the same body.
Section IV
Management Council
Article 45
(Definition)
The Management Council shall be the collegial body responsible for conducting the administrative, economic and financial management of the University, as well as for human resources management.
Article 46
(Responsibilities)
1. The Management Council shall be responsible for the administrative, economic and financial management of the University, as well as for human resources management, and it shall be subject to the provisions of the law in force concerning public bodies entitled to administrative autonomy.
2. The Management Council shall be responsible for fixing charges and administrative fees.
Article 47
(Composition)
1. The Management Council shall be appointed and chaired by the Rector, and shall comprise five other members.
2. The Management Council shall always include a Vice-rector and the Administrator.
3. The members of the Rectorate team, the Presidents of the Organic Units, as well as the heads of other University units, students representatives and other academic community members may, subject to invitation addressed to them by the Rector, attend the Management Council meetings, if and when the matters under discussion so require, although they shall not be entitled to vote at any such meetings.
Article 48
(Proceedings)
1. The Management Council proceedings shall be governed by the principles of transparency, responsibility, rationality and efficiency, all with a view to strategic management.
2. The Management Council may delegate to the Rector, the bodies of the Organic Units and to the heads of the services all the responsibilities it shall deem fit for a more efficient management of the University.
3. The Management Council rules of procedure shall be provided for in the relevant regulation.
Section V
Advising bodies
Sub-section I
University Senate
Article 49
(Definition)
1. The Senate shall be the University’s advising body which ensures cohesion in the pursuit of the University’s mission, and which shall exercise coordination, prospect and planning functions concerning pedagogical and scientific matters falling outside the Organic Units scope.
2. The University Senate shall sit in plenary sitting or in specialized committees.
3. The University Senate specialized committees are the Scientific Committee, the Pedagogical Committee and the Planning Committee.
4. Subject to a decision passed in plenary sitting, the Senate may form ad hoc committees according to the specific nature of the matters concerned.
Article 50
(Responsibilities of the plenary sitting)
1. The University Senate plenary sitting shall be responsible for:
a) The strategic analysis of the educational offer, as well as the University scientific and society interaction activities, having due regard to the international reference framework;
b) Giving its opinion on students’ disciplinary regulations;
c) Giving its opinion on any other matters that may be submitted to it either by the General Council or by the Rector.
2. The University Senate plenary sitting shall be further responsible for issuing opinions on:
a) The University general guidelines at scientific and pedagogical level;
b) The medium term strategic plan;
c) The annual activities plan, as well as the respective report;
d) The creation, modification or extinction of Organic, Cultural, Services and Differentiated Units and Sub-units;
e) Students’ fees;
f) Maximum values for new admissions and students enrolment, as laid down by the law.
Article 51
(Composition of the plenary sitting)
1. The University Senate plenary sitting shall be composed of the following members:
a) The Rector, who shall chair the plenary sitting;
b) The Presidents of the Organic Units;
c) The heads of the Organic Units pedagogical councils;
d) The President of the Cultural Council, the President of the Student Union, the Administrator and the Social Services Administrator;
e) A student in representation of each organic unit pedagogical council, where it should be ensured representation of every study cycles leading to undergraduate, post-graduate and post-doctorate degrees, elected under the provisions of the relevant regulation;
f) Three representatives of teachers and researchers holding a doctoral degree;
g) Three representatives of the students;
h) Two representatives of the non-teaching and non-researching staff.
2. The members provided for in number (1)f, g and h above shall be elected, respectively, by the post-doctorate teachers and researchers as a whole, by the students as a whole, and by the non-teaching and non-researching University staff as a whole, in accordance with the relevant regulation.
Article 52
(Responsibilities of the Scientific Committee)
1. The University Senate Scientific Committee shall be responsible for:
a) The long-term analysis of the scientific and interaction with society activities developed by the University;
b) Analysing of the University’s scientific projects’ assessment processes and results;
c) Giving its opinion on scientific matters submitted to it by the General Council or by the Rector.
2. The Senate Scientific Committee shall be further responsible for issuing opinions on:
a) The creation, modification or extinction of Organic Units and Sub-units;
b) The Organic Units own regulations;
c) The awarding of titles and honorary distinctions.
Article 53
(Composition of the Scientific Committee)
The Scientific Committee shall be composed of the Rector, who chairs it, and of the presidents of the Organic Units.
Article 54
(Responsibilities of the Pedagogical Committee)
1. The University Senate Pedagogical Committee shall be responsible for:
a) The long-term analysis of the University’s educational offer;
b) Analysing the teaching projects assessment processes and results;
c) Analysing quality programmes for promoting the University teaching performance quality;
d) Giving its opinion on other pedagogical matters submitted to it, either by the General Council or by the Rector.
2. The University Senate Pedagogical Committee shall be further responsible for pronouncing upon the following matters:
a) The modifications introduced to the University’s educational offer plan;
b) The creation, modification or extinction of study cycles;
c) The policies and programmes for promoting teaching performance quality;
d) The overall regulations governing pedagogical matters;
e) The awarding of school prizes;
f) The regulations governing study cycles.
Article 55
(Composition of the Pedagogical Committee)
The Pedagogical Committee shall comprise the Rector, who chairs it, the heads of the Organic Units and the Organic Units’ students’ representatives.
Article 56
(Responsibilities of the Planning Committee)
The Planning Committee shall be responsible for pronouncing upon:
a) The joint and long-term analysis of the educational, scientific and interaction with society offer;
b) The budget and the consolidated accounts, as well as the report of the sole auditor;
c) The creation, modification or extinction of Cultural, Services and Differentiated Units;
d) The organic regulation governing the Services and Differentiated Units;
e) The non-teaching and non-researching staff assessment processes and results;
f) The regulation governing interaction with society projects;
g) The Social Services’ policies and programmes;
h) The statutes governing the Social Services;
i) Any other matters which may be submitted to it by the General Council or by the Rector.
Article 57
(Composition of the Planning Committee)
The Planning Committee shall be composed of the Rector, who chairs it, of the presidents of the Organic Units, the president of the Cultural Council, the Administrator, the Social Services Administrator, the president of the Student Union, of three teachers’ representatives, three students’ representatives and two representatives of the non-teaching and non-researching University’s staff.
Article 58
(Proceedings)
1. The University Senate shall function in plenary sitting at least twice a year and in specialised committees with the periodicity provided for in the applicable rules of procedure.
2. The decisions taken by the specialised committees, in all the matters assigned to them, are definitive, and they shall only be submitted to the plenary sitting for reconsideration under the provisions which shall be defined in the regulation.
3. When so delegated by the Rector, Vice-rectors may chair the meetings of the specialised committees.
4. The Vice-rectors and the Pro-rectors may be invited to attend the plenary sitting or the specialised committees meetings, but shall not be entitled to vote at any such meetings.
Sub-section II
Cultural Council
Article 59
(Definition)
The Cultural Council shall be the Rector’s and the General Council advising collegial body on all University’s cultural policy matters.
Article 60
(Responsibilities)
1. The Cultural Council shall have overall responsibility for issuing opinions on the University’s cultural policy, by ensuring the bond with the community, as well as by promoting the coordination of Cultural Units’ activities.
2. The Cultural Council shall be, namely, responsible for:
a) Giving its opinion on the University’s general guidelines at cultural level;
b) Giving its opinion on the creation, modification or extinction of Cultural Units;
c) Promoting interconnection between the University’s cultural programmes and initiatives and the programmes set up by other public or private institutions or bodies.
d) Submitting to the Rector the Cultural Units activities plan;
e) Submitting to the Rector the Cultural Units management model;
f) Proposing to the Rector the heads of the Cultural Units who should be considered for appointment;
g) Promoting coordination and cooperation among the Cultural Units;
h) Drawing up and approving its internal regulation, which shall be submitted to the Rector;
i) Giving its opinion on any other cultural matters submitted to it by the University’s governing or advising bodies, as well as by the Organic Units bodies;
j) Publicising all the initiatives promoted by the Cultural Council, as well as by the Cultural Units.
Article 61
(Composition)
The University’s Cultural Council shall comprise the following members:
a) The President, who shall be appointed by the Rector;
b) The heads of the Cultural Units;
c) A student, appointed by the Rector, after first hearing the Student Union;
d) Up to ten personalities with a relevant role at cultural level, appointed by the Rector, after first consulting the Cultural Council Standing Committee.
Article 62
(Proceedings)
1. The Cultural Council shall sit in plenary sitting at least once a year, and in standing committee with the periodicity provided for in the applicable regulation.
2. The Cultural Council Standing Committee shall comprise the President of the Cultural Council and the heads of the Cultural Units.
Sub-section III
Disciplinary Council
Article 63
(Definition and responsibilities)
1. The Disciplinary Council shall be the Rector’s advising body with regard to the exercise of disciplinary powers.
2. The Disciplinary Council shall be responsible for issuing opinions concerning the imposition of serious penalties.
Article 64
(Composition)
1. The Disciplinary Council shall be composed of the following members:
a) The Rector or a teacher appointed by him, who chairs it;
b) Two teachers or researchers;
c) Two students;
d) Two representatives of the non-teaching and non-researching staff.
2. The Disciplinary Council members shall be nominated by the elected representatives of the respective body at the University Senate, and shall be appointed by the Rector.
Article 65
(Terms of office)
The Disciplinary Council members’ term of office shall be four years for teachers and researchers, as well as for non-teaching staff; and two years for the students.
Article 66
(Proceedings)
1. The Disciplinary Council shall meet whenever it is called by its President.
2. The members of the Disciplinary Council are not entitled to abstain.
3. Attending the Disciplinary Council meetings is prior to any other duties, save in the cases as the law may provide.
Title IV
Units
Chapter I
General provisions
Article 67
(Units typology)
1. The University shall have different types of units, with different objectives, different structures, and they shall be, as well, different in what concerns their nature and the degree of autonomy they shall enjoy. The following are the University’s units:
a) The Teaching and Research Organic Units;
b) The Research Organic Units;
c) The Cultural Units;
d) The Services Units.
2. Furthermore, the University shall have Differentiated Units, which are different in objectives and nature from those mentioned in the previous paragraph, and which shall be created by the University or by the University and external entities, and which shall be entitled to autonomy and to their own structure, in accordance with their own statutes.
Chapter II
Teaching and Research Organic Units
Section I
Units
Article 68
(Framework)
1. The Teaching and Research Organic Units shall be the structures, with their own bodies and staff, through which the University accomplishes its mission in a particular area of knowledge, and where the teaching and research dimensions are emphasised.
2. The Teaching and Research Organic Units shall congregate coherent and adequate human and material resources for the development of their pedagogical and researching activities, through the implementation of autonomous projects or in partnerships with other units, falling within the University’s mission and goals.
3. The Teaching and Research Organic Units may, upon their own initiative or following to a resolution passed by the University governing bodies, share human and material resources, as well as set up collaboration projects, namely teaching, research, cultural and interaction with society projects.
Article 69
(The creation of Teaching and Research Organic Units)
1. The General Council shall be responsible for the creation of Teaching and Research Organic Units, subject to compliance, cumulatively, with the following criteria:
a) The identity, the differentiated nature and the need for its creation, considering its relevance for the pursuit of the University’s mission and goals;
b) The scientific coherence of the activity area;
c) The existence of a quality scientific and pedagogical project, which is compatible with other University’s projects;
d) The dimension and long-term growth of its human resources structure, considering the national and international standards for the respective knowledge field.
2. Exceptionally, Units with all the requisites defined in the previous paragraph may be created, under the Rector’s remit, and shall be governed by their own regulation, subject to the Rector’s approval, after first consulting the University Senate.
3. The Units created under the provisions of the previous section shall submit to the General Council, for approval, a development plan describing and accounting for their evolution towards autonomy.
Article 70
(Enumeration and designation of the Teaching and Research Units)
1. The University’s Teaching and Research Units shall be the following:
a) The School of Sciences;
b) The School of Engineering;
c) The Institute of Education;
d) The Institute of Arts and Human Sciences;
e) The Institute of Social Sciences;
f) The School of Economics and Management;
g) The School of Law;
h) The Health Sciences School;
i) The School of Architecture;
j) The School of Psychology;
k) The Nursing Higher School.
2. The Nursing Higher School shall be an Organic Unit with special features, which derive from its polytechnic nature, in what concerns, namely, the composition of its bodies and the academic career of its members.
Article 71
(Academic autonomy)
The Teaching and Research Organic Units shall enjoy scientific, pedagogical and cultural autonomy, and shall contribute to the fulfilment of the University’s strategic objectives in a specific area of knowledge.
Article 72
(Administrative autonomy and management responsibility)
1. The Teaching and Research Organic Units shall be entitled to administrative autonomy, within the scope and the extension defined in the present statutes, although they shall not hold financial autonomy.
2. The administrative autonomy and the management responsibility shall be translated into the capacity of its leaders to authorise the performance of expenses and definite administrative acts with regard to current management.
3. Current management acts shall be all those acts comprehended by the activity that Organic Units usually develop with a view to pursue their responsibilities.
4. Under the provisions of the law and of the present statutes, the acts which are of the exclusive responsibility of the University’s governing bodies shall not be considered as current management acts, as well as the authorisation to perform expenses exceeding, in amount and nature, the approved limits for execution.
5. The Units shall enjoy the following powers concerning financial management:
a) Drawing up, approving and executing the annual and multi-annual plans, budgets and other estimates concerning functioning allocations;
b) Drawing up the budget implementation plan and report;
c) Having access to the State general budget allocations, as well as to other revenues assigned to them the University’s competent bodies, in compliance with transparent mechanism as to safeguard the need to ensure financial cohesion and balance;
d) Disposing of the revenues from students’ fees concerning courses not leading to a degree, as well as of other revenues from projects and services provision, after deduction of the functioning general expenses charged by the University;
e) Authorising the performance of expenses within the limits set up by the competent governing bodies.
6. The Teaching and Research Organic Units shall be subject to the principle of efficiency with respect to resources use, to transparency and to compliance with the current provisions of the law.
Article 73
(Participation in the University’s financial resources)
1. The Teaching and Research Units participation in the University’s financial resources shall draw from the strategic plan, with a view to the vertical and horizontal financial balance.
2. The vertical financial balance shall aim at adjusting the Teaching and Research Unit’s resources to their responsibilities and dimension.
3. The horizontal financial balance shall aim at promoting the introduction of the necessary corrections to inequalities between the Organic Units, arising, namely, from different capacity to obtain revenues, different expenses needs as a result of the scientific and pedagogical nature of the Teaching and Research Organic Units.
Article 74
(Auditing and control)
1. The Units shall be subject to the University’s scrutiny, through the competent body.
2. The services shall give all the relevant information to the Teaching and Research Units as well as to the respective Sub-units.
Article 75
(Bodies and governing model)
1. The Units shall have their own governing bodies, shall be governed by their own statutes, in compliance with the law and the present statutes.
2. The following are the Teaching and Research Organic Units bodies:
a) The Unit’s Council;
b) The President;
c) The Scientific Council;
d) The Pedagogical Council.
3. If provided for in the units regulation, the following bodies may be added to the previous list:
a) The Management Council;
b) The Advising Council.
4. Polytechnic higher education Teaching and Research Organic Units shall have a technical and scientific council with responsibilities adjusted to the specific nature of these Units, in compliance with the law and the present statutes.
Article 76
(Unit’s Council)
The Unit’s Council shall be the collegial body which represents the Unit.
Article 77
(Responsibilities of the Unit’s Council)
The Unit’s Council shall be responsible for:
a) Defining the Unit’s general guidelines;
b) Approving the Unit’s internal regulation;
c) Approving the annual plan of activities, the budget, the activities report and accounts;
d) Electing the Unit’s president, in accordance with its own regulation;
e) Giving its opinion on the creation, modification and extinction of Organic Sub-units;
f) Performing all other responsibilities assigned to it by the Unit’s statutes.
Article 78
(Composition of the Unit’s Council)
1. The Unit’s Council shall consist of up to fifteen members as follows:
a) By, at least, 60 per cent of teachers and researchers holding a doctoral degree, which may include department directors and directors of research centres, as long as provided for in the Unit’s statutes;
b) By, at least, 20 per cent of students from the different study cycles;
c) By up to 10 per cent of representatives of non-teaching and non-researching staff.
2. The Unit’s Council may further include external members.
3. In the event that the result of the calculation to determine the Council’s composition has a decimal part, it shall be round down to the nearest integer.
Article 79
(The President of the Unit)
The President of the Unit shall be the uninominal body who runs and represents the Unit at the highest level.
Article 80
(Responsibilities of the Unit’s President)
The President of the Organic Unit shall be responsible for:
a) Representing the Unit before other University bodies and outside the University;
b) Directing the Unit’s services;
c) Exercising disciplinary power as set up by statute or as delegated to him or her by the Rector;
d) Drawing up the activities plan and budget, as well as the activities report and accounts;
e) Performing all other functions assigned to him or her by the law and by the Unit’s statutes.
Article 81
(Election of the Unit’s President)
1. The President shall be a Full or Coordinating Professor, or a Full or Coordinating Researcher, elected by the Unit’s Council, in compliance with the relevant regulation, and who shall serve a three years term of office, renewable only once.
2. The President may be, for sound reasons, elected from among the Full and Associated Professors, after decision passed by the Rector upon proposal from the Unit’s Council.
3. The President may be assisted by, up to three, vice-presidents, to whom he or she may delegate the responsibilities he or she thinks fit for the Unit’s proper functioning.
Article 82
(The Scientific Council and the Technical and Scientific Council)
1. The Scientific Council shall be the responsible for defining and superintending the scientific policy of the Teaching and Research Units of an academic nature.
2. The Technical and Scientific Council shall be responsible for defining and superintending the scientific policy of the Teaching and Research Units of a polytechnic nature.
Article 83
(Responsibilities of the Scientific and Technical and Scientific Council)
1. The Scientific Council shall be responsible for:
a) Defining the Unit’s research policy in the light of the University guidelines;
b) Approving the activities plans and the annual reports of their sub-units;
c) Approving the proposals for teaching staff admissions and contract renewal, as well as for researching staff;
d) Giving its opinion on teachers transfers;
e) Proposing the setting up of public calls for application of candidates for teachers’ admission, as well as juries’ qualification, after first consulting the concerned departments;
f) Deciding on the proposals submitted to it for juries’ qualification for postgraduate examinations;
g) Proposing juries’ qualification for other academic examinations;
h) Giving its opinion on the requests for the awarding of equivalence to doctoral degree and for proposing the qualification of juries to this effect;
i) Proposing the creation of new study cycles and approving the study plans concerning the creation or modification of study cycles in which the unit shall participate;
j) Deciding or giving its opinion on any other matter provided by the law and by the University’s regulations;
k) Performing all other functions under the provisions of the law and the present statutes.
2. The Technical and Scientific Council responsibilities shall be those laid down in the previous paragraph, except for subparagraph 1(h).
3. The Scientific or the Technical and Scientific Council may delegate to its President all the responsibilities it deems fit for the Unit’s proper functioning.
Article 84
(Composition of the Scientific Council)
1. The Scientific Council shall comprise a maximum of twenty-five members, broken down as follows:
a) The Unit’s President, who chairs it;
b) The representatives of the teachers and researchers pursuing the academic career, elected by the respective bodies, who shall correspond to, at least 50 per cent of the total members;
c) The representatives of the research centres associated to the Unit, acknowledged and positively assessed, in accordance with the law, who shall correspond to between 30 and 40 per cent of the total members;
d) The representatives of other full time teachers and researchers, elected by the respective bodies and holding a doctoral degree and hired for more than a year, who shall correspond to up to 10 per cent of the total members.
2. In the event that the result of the calculation to determine the Council’s composition has a decimal part, it shall be round down to the nearest integer.
3. The Directors of the Organic Sub-units may be invited to participate in the Scientific Council meetings, although they shall not be entitled to vote at any such meetings.
4. The representatives mentioned in subparagraphs 1(b), c and d above shall have a three years term of office.
5. The election of the Scientific Council members shall be done in accordance with the provisions of the regulation laid down to this effect, subject to the Rector’s approval.
Article 85
(Composition of the Technical and Scientific Council)
1. The Technical and Scientific Council shall comprise a maximum of twenty-five members, with the following distribution:
a) The President of the Unit, who chairs it;
b) The representatives of the teachers and researchers pursuing the academic career, elected by the corresponding bodies, who shall be, at least, 50 per cent of the Council members;
c) The representatives of the unit’s associated research centres, acknowledged and positively assessed, in accordance with the law, who shall be at least 20 per cent of the total members.
d) Those equivalent to full time teachers, having a working contract with the School for over ten years, who shall be up to 10 per cent of the total members.
e) Teachers holding professional qualification of specialist not included in the previous subparagraph, working full time, and having a working contract with the Institution for more than two years, who shall be up to 20 per cent of the total members.
2. In the event that the result of the calculation to determine the Council’s composition has a decimal part, it shall be round down to the nearest integer.
3. The Directors of the Organic Sub-units maybe invited to participate in the Technical and Scientific Council meetings, although they shall not be entitled to vote at any such meetings.
