Source text - German Herr Mustermann hat einen Antrag nach § 18b AufenthG gestellt. Unseres Erachtens ist ihm in Ausübung des der Behörden eingeräumten Ermessens eine Blaue Karte EU zum Zwecke einer seiner Qualifikationen angemessenen Beschäftigung zu erteilen. Das aus den nachfolgend dargestellten Gründen: Er ist Fachkraft mit akademischer Ausbildung im Sinne des § 18 Abs. 3 AufenthG, da er einen einem deutschen Hochschulabschluss vergleichbaren akademischen Hochschulabschluss besitzt. Es liegt mit dem Arbeitsvertrag der Mustermann GmbH ein konkretes Arbeitsplatzangebot vor. Aufgrund der Erfüllung der Anforderungen des § 18b AufenthG ist die Zustimmung der Bundesagentur für Arbeit entbehrlich und das Gehalt, das Herr Mustermann auf Grundlage des ihm von der Mustermann GmbH angebotenen Arbeitsvertrages mehr als 2/3 der jährlichen Bemessungsgrenze in der allgemeinen Rentenversicherung beträgt, nämlich monatlich EUR 10.000, mithin jährlich EUR 120.000 und keiner der in § 19f Abs. 1 und 2 geregelten Ablehnungsgründe vorliegt. Eine Berufsausübungserlaubnis ist – insbesondere für die zu besetzende Stelle –nicht erforderlich. Die Sicherung des Lebensunterhaltes des Herrn Mustermann ist derzeit durch ihm zur freien Verfügung stehendes eigenes Vermögen (vgl. die Angaben im von Herrn Mustermann gestellten Antrag), künftig darüber hinaus durch Ausübung der ihm von der Mustermann GmbH angebotenen Tätigkeit und ihre vertragsgemäße Entlohnung sichergestellt. Es besteht kein Ausweisungsinteresse. Herr Mustermann ist amtsbekannt im Besitz eines gültigen Passes und befindet sich rechtmäßig im Gebiet der Bundesrepublik Deutschland. Ein Asylantrag ist nicht gestellt. Anstellung des Herrn Mustermann als „Technical Supervisor“ Die Tätigkeit des Herrn Mustermann als „Technical Supervisor“ stellt eine seiner akademischen Ausbildung angemessene Tätigkeit dar. Die Mustermann GmbH beabsichtigt Herrn Mustermann als „Technical Supervisor“ einzustellen. Die Stelle ist dem Bereich „Technik“ zugeordnet.
Translation - English Mr John Doe has applied for a residence permit according to § 18b AufenthG (Residence Act).
In our opinion, in exercising the discretion granted to the authorities, he should be granted an EU Blue Card for the purpose of suitable employment corresponding to his qualifications.
The reasons for this are as follows:
He is a skilled professional with an academic education in accordance with § 18 (3) AufenthG, given that he possesses an academic university degree comparable to a German university degree.
There is a specific job offer with Mustermann GmbH as per the employment contract.
Due to the fulfilment of the requirements of § 18b AufenthG, approval from the Federal Employment Agency may be forgone, and
the salary offered to Mr John Doe by Mustermann GmbH exceeds two-thirds of the annual reference amount in the general pension insurance, that is, monthly EUR 10,000.00 corresponding to EUR 120,000 annually, and none of the reasons for rejection provided for in § 19f (1) and (2) apply.
A work permit is not required – especially for the position in question.
Mr John Doe is currently providing for his own livelihood using his own available assets (as indicated in Mr. John Doe’s application) and in future, it will be ensured through his employment with Mustermann GmbH and the contractually paid remuneration.
There exists no interest in expulsion.
Mr John Doe is known to hold a valid passport and his presence within the territory of the Federal Republic of Germany is legally permissible.
An asylum application has not been submitted.
Employment of Mr John Doe as a “Technical Supervisor”
The role of "Technical Supervisor" constitutes a suitable position corresponding to his academic education.
Mustermann GmbH intends to employ Mr John Doe as a "Technical Supervisor".
The position is assigned to the "Engineering" department.
