Source text - Spanish Con las expresiones suplantación, usurpación o robo de identidad1 se pretende en este trabajo aludir al comportamiento delictivo consistente en que el autor utiliza los datos relativos a la identidad de otra persona para hacerse pasar por ella en el tráfico jurídico-económico2, datos que a veces se obtienen de forma fraudulenta y a veces en connivencia con el titular legítimo, en ocasiones para causar un perjuicio, patrimonial o de otro tipo, al titular o a otra persona, y en otras con finalidades distintas. Por su parte, el uso de nombre supuesto alude a la conducta consistente en hacerse pasar por otra persona carente de existencia real. En este trabajo nos centraremos en la suplantación de identidad y el uso de nombre supuesto que tienen como objetivo causar un perjuicio patrimonial al legítimo titular de los datos o a un tercero, prestando particular atención al fraude de tarjetas en el comercio tradicional y electrónico.

1 El término «identidad» se refiere, en la segunda acepción del Diccionario de la Lengua Española, al «conjunto de rasgos propios de un individuo o de una colectividad que los caracterizan frente a los demás». Ahora bien, en la actualidad el significado contemporáneo del término «identidad» ha asumido una connotación relacionada con el uso de las nuevas tecnologías llegando a incluir aspectos como el historial crediticio y de consumo, afiliación a partidos, sindicatos, seguros, servicios, etc. Es este significado más amplio del término el que interesa aquí.

Translation - English In this article, the terms impersonation, encroachment or identity theft1 refer to criminal behaviour patterns whereby the perpetrator obtains data relating to the identity of another person to impersonate said person in legal-economic transactions. 2 Data are sometimes obtained via fraudulent means and other times in collusion with the rightful data owners. Sometimes it is used to cause damage, financial or otherwise, to the legitimate data holder or to another person, and other times for different purposes. The use of a false name, refers to the conduct consisting of taking on a persona devoid of real existence. In this article we will focus on the act of impersonation and the use of false names with the aim of causing financial damage to the rightful data owner or to a third party, paying particular attention to credit card fraud in both traditional and e-commerce.
1The Oxford English Dictionary defines “identity” as “the set of behavioural or personal characteristics by which an individual is recognized.” Nowadays, however, the contemporary meaning of “identity” has, taken on a connotation relating to the use of new technologies that extends the traditional meaning to include such aspects as consumer and credit history, political affiliations, trade union membership, insurance, services. etc. It is this broader meaning that is inferred here.
2There is no clear distinction between what is known in the US as “identity theft", which is the illicit access to personal data, and “identity fraud”, which is the name given when this illegally obtained personal information is misused for illicit gain. Although it is noted that the former is often carried out in preparation for the latter.
