Source text - English AEROSOL ANTIPERSPIRANTS
BACKGROUND
[1] Antiperspirant compositions are generally applied to an axillary region of a subject person to limit perspiration and/or to limit or kill bacteria in this region. In this way, body odour caused by bacterial growth is eliminated or at least reduced.
[2] Antiperspirants can be delivered topically in liquid form as an aerosol. When these compositions are applied to the axillary region, the aerosol spray is deposited as fine droplets on the skin. Some of the droplets may be dispersed laterally in the spray and/or bounce off the skin, and so may not be deposited to form an effective antiperspirant layer on the skin. Such a dispersed spray/bounce-back phenomenon reduces the antiperspirant, anti-wetness efficacy of the aerosol antiperspirant composition by delivering less antiperspirant to the skin.
[3] There is therefore a need to provide improved aerosol antiperspirant compositions which have enhanced deposition on the skin and which can enhance the antiperspirant, anti-wetness efficacy of the aerosol antiperspirant composition.
BRIEF SUMMARY
[4] In a first aspect, provided is an aerosol antiperspirant composition comprising: at least one active antiperspirant ingredient, a bis-vinyl dimethicone/dimethicone copolymer, a silicone solvent, at least one fatty acid ester and at least one propellant.
[5] It has been found by the present inventors that the use, in an aerosol antiperspirant composition comprising at least one active antiperspirant ingredient and at least one propellant, of the combination of a bis-vinyl dimethicone/dimethicone copolymer, a silicone solvent, and at least one fatty acid ester, can increase the deposition of the at least one active antiperspirant ingredient on an axillary area of a subject from a dose of an aerosol spray comprising the composition.
[6] Optionally, the bis-vinyl dimethicone/dimethicone copolymer is present in an amount of from 0.1 to 0.75 wt%, further optionally from 0.15 to 0.3 wt%, typically from 0.2 to 0.25 wt%, based on the weight of the composition including the at least one propellant.
[7] Optionally, the silicone solvent comprises dimethicone.
[8] Optionally, the silicone solvent is present in an amount of from 0.5 to 5 wt%, further optionally from 0.75 to 2 wt%, typically from 0.9 to 1.25 wt%, based on the weight of the composition including the at least one propellant.
[9] Optionally, the at least one fatty acid ester comprises one or more esters of a C2-C5 alcohol and a C12-C20 fatty acid. In some embodiments, the C2-C5 alcohol comprises propyl alcohol. In some embodiments, the C12-C20 fatty acid comprises at least one fatty acid selected from myristic acid, palmitic acid and isostearic acid. In some embodiments, the at least one fatty acid ester comprises one of more of isopropyl myristate, isopropyl palmitate and isopropyl isostearate. Typically, the at least one fatty acid ester comprises a mixture of isopropyl myristate and isopropyl palmitate.
[10] In some embodiments, the isopropyl myristate and isopropyl palmitate are present in the mixture in a weight ratio of from 0.5:1 to 1:0.5, typically about 1:1.
[11] Optionally, the at least one fatty acid ester is present in an amount of from 0.5 to 7.5 wt%, further optionally from 2 to 5 wt%, typically from 3 to 4.5 wt%, based on the weight of the composition including the at least one propellant.
[12] In some embodiments, the composition further comprises a thickener comprised of an organic derivative of a hectorite clay. Optionally, the thickener comprises a trialkylaryl ammonium hectorite clay. Typically, the thickener comprises quaternium-18 hectorite. Optionally, the organic derivative of a hectorite clay is present in an amount of from 0.2 to 0.4 wt%, further optionally from 0.25 to 0.35 wt%, based on the weight of the composition including the at least one propellant.
[13] In some embodiments, the at least one active antiperspirant ingredient is selected from aluminium salts, zirconium salts and zinc salts. Typically, the at least one active antiperspirant ingredient comprises aluminium chlorohydrate.
[14] Optionally, the composition further comprises one or more ingredients selected from: a deodorant, a fragrance, a preservative, an emulsifier, an antioxidant and an emollient.
[15] In a further aspect, provided is an antiperspirant composition aerosol dispenser comprising the composition packaged in an aerosol container. Typically, the container is a pressurized aerosol container.
[16] In a further aspect, provided is the use of the composition as an antiperspirant.
[17] In a further aspect, provided is a method comprising applying the composition to the axillary area of a subject.
[18] In a further aspect, provided is a method of manufacturing the composition, the method including the step of: a. providing the bis-vinyl dimethicone/dimethicone copolymer, the silicone solvent, and the at least one fatty acid ester as at least one premixed gel; and b. mixing the at least one premixed gel with at least the active antiperspirant ingredient.
[19] In a further aspect, provided is the use, in an aerosol antiperspirant composition comprising at least one active antiperspirant ingredient and at least one propellant, of the combination of a bis-vinyl dimethicone/dimethicone copolymer, a silicone solvent, and at least one fatty acid ester for increasing the deposition of the at least one active antiperspirant ingredient on an axillary area of a subject from a dose of an aerosol spray comprising the composition.
[20] Typically, the bis-vinyl dimethicone/dimethicone copolymer, the silicone solvent, and the at least one fatty acid ester are provided as at least one premixed gel.
[21] Optionally the composition further comprises a thickener comprised of quaternium-18 hectorite.
DETAILED DESCRIPTION
[22] It should be understood that the detailed description and specific examples, whilst indicating embodiments of the invention, are intended for the purpose of illustration only and are not intended to limit the scope of the invention.
[23] As used throughout, ranges are used as shorthand for describing each and every value that it is within the range. Any value within the range can be selected as the terminus of the range.

[25] Provided is an aerosol antiperspirant composition comprising: at least one active antiperspirant ingredient, a bis-vinyl dimethicone/dimethicone copolymer, a silicone solvent, at least one fatty acid ester and at least one propellant.
[26] The bis-vinyl dimethicone/dimethicone copolymer, silicone solvent, and at least one fatty acid ester are present in an emollient-containing base for the antiperspirant composition.
[27] The aerosol antiperspirant composition is preferably substantially anhydrous, and comprises less than 2 wt% water, typically no more than about 1 wt% water, and most typically no added water apart from any water bound to the active antiperspirant ingredient.
Emollient-containing base
[28] The composition comprises an emollient-containing base. The base comprises emollients, including the at least one fatty acid ester, which may also function as gelling agents. Furthermore, the base comprises a silicone system including a bis-vinyl dimethicone/dimethicone copolymer and a silicone solvent. The base may also comprise other carrier components for the antiperspirant composition.
[29] As described above, the silicone system includes a bis-vinyl dimethicone/dimethicone copolymer (CAS No. 156065-02-0).
[30] In some embodiments, the bis-vinyl dimethicone/dimethicone copolymer is present in an amount of from 0.1 to 0.75 wt%, for example 0.15 to 0.3 wt%, typically from 0.2 to 0.25 wt%, based on the weight of the composition including the at least one propellant.
[31] As described above, the silicone system includes a silicone solvent. In some embodiments, the silicone solvent comprises dimethicone. The silicone solvent may be present in an amount of from 0.5 to 5 wt%, for example from 0.75 to 2 wt%, typically from 0.9 to 1.25 wt%, based on the weight of the composition including the at least one propellant. Other silicone solvents known to those skilled in the art may be employed in addition to, or instead of, dimethicone.
[32] As described above, the base comprises emollients, including the at least one fatty acid ester, which may also function as gelling agents.
[33] In some embodiments, the at least one fatty acid ester comprises one or more esters of a C2-C5 alcohol and a C12-C20 fatty acid. The C2-C5 alcohol may comprise propyl alcohol and/or the C12-C20 fatty acid may comprise at least one fatty acid selected from myristic acid, palmitic acid and isostearic acid. In some embodiments, the at least one fatty acid ester comprises one of more of isopropyl myristate, isopropyl palmitate and isopropyl isostearate.
[34] Typically, the at least one fatty acid ester comprises a mixture of isopropyl myristate and isopropyl palmitate. The isopropyl myristate and isopropyl palmitate may be present in the mixture in a weight ratio of from 0.5:1 to 1:0.5, typically about 1:1.
[35] In some embodiments, the at least one fatty acid ester is present in an amount of from 0.5 to 7.5 wt%, further optionally from 2 to 5 wt%, typically from 3 to 4.5 wt%, based on the weight of the composition including the at least one propellant.
[36] Typically, the bis-vinyl dimethicone/dimethicone copolymer, the silicone solvent, and the at least one fatty acid ester are provided as at least one premixed gel. The pre-mixed gel may comprise a mixture of two or more gel components, each comprising bis-vinyl dimethicone/dimethicone copolymer, silicone solvent and fatty acid ester.
[37] A first typical gel component comprises a premixed gel including bis-vinyl dimethicone/dimethicone copolymer, dimethicone and isopropyl myristate is available in commerce for example from Jeen International Corporation, NJ. USA under the trade name Jeelux DMIPM. A suitable premix gel includes 4 – 11 wt%, 37 – 47 wt% dimethicone, and 45 – 55 wt% isopropyl myristate.
[38] A second typical gel component comprises a premixed gel including bis-vinyl dimethicone/dimethicone copolymer, dimethicone and isopropyl palmitate is available in commerce for example from Jeen International Corporation, NJ. USA under the trade name Jeelux DMIPP. A suitable gel includes 5 – 13 wt% bis-vinyl dimethicone/dimethicone copolymer, 46 – 56 wt% dimethicone, and 35 – 45 wt% isopropyl palmitate.
[39] In a preferred composition a mixture of these first and second gel components is employed to provide the desired amounts of the bis-vinyl dimethicone/dimethicone copolymer, the silicone solvent, and the at least one fatty acid ester. For example, a 1:1 weight ratio of these first and second gel components may be employed.
[40] In some embodiments, the emollient-containing base further comprises other gelling agents and/or emollients. Examples of other gelling agents/emollients include, but are not limited to, waxes, esters of fatty acid and fatty alcohol, triglycerides, partially or fully hydrogenated soybean oil, partially or fully hydrogenated castor oil, other partial or fully hydrogenated plant oils, stearyl alcohol, propylene carbonate, or other cosmetically acceptable materials, which are solid or semi-solid at room temperature and provide a consistency suitable for application to the skin.
[41] In one embodiment, the composition comprises hydrogenated soybean oil in a typical amount of up to 5 wt %, more typically from 0.2 to 2 wt%, for example from 0.5 to 0.75 wt%, based on the weight of the composition. In one embodiment, the composition comprises C12-C15 alkyl benzoate in a typical amount of up to 5 wt %, more typically from 0.5 to 2 wt%, based on the weight of the composition.
[42] In some embodiments, the emollient-containing base further comprises a thickener comprised of an organic derivative of a hectorite clay, for example a trialkylaryl ammonium hectorite clay or quaternium-18 hectorite. In some embodiments, the organic derivative of a hectorite clay is present in an amount of from 0.2 to 0.4 wt%, typically from 0.25 to 0.35 wt%, based on the weight of the composition including the at least one propellant.
[43] The antiperspirant composition comprises at least one active antiperspirant ingredient, and optionally at least one active deodorant ingredient.
Active Antiperspirant Ingredients
[44] In some embodiments, the at least one active antiperspirant ingredient is selected from aluminium salts, zirconium salts and zinc salts. Any of the known aluminum containing antiperspirant active materials can be utilized in the composition of the invention.
[45] Antiperspirant actives include, but are not limited to, aluminum chlorohydrate, aluminum chloride, aluminum chlorohydrex polyethylene glycol, aluminum chlorohydrex propylene glycol, aluminum dichlorohydrate, aluminum dichlorohydrex polyethylene glycol, aluminum dichlorohydrex propylene glycol, aluminum sesquichlorohydrate, aluminum, sesquichlorohydrate polyethylene glycol, aluminum sesquichlorohydrate propylene glycol, aluminum-zirconium octachlorohydrate, aluminum-zirconium octachlorohydrex gly, aluminum-zirconium pentachlorohydrate, aluminum-zirconium pentachlorohydrex gly, aluminum-zirconium tetrachlorohydrate, aluminum-zirconium tetrachlorohydrex gly, aluminum-zirconium trichlorohydrate, aluminum-zirconium trichlorohydrex gly, and combinations thereof. Generally, any of the Category I active antiperspirant ingredients, listed in the Food and Drug Administration's Monograph on Antiperspirant Drug Products for over-the-counter human use (Oct. 10, 1973) can be used (21 CFR 350.10). In one embodiment, the antiperspirant active is aluminum chlorohydrate. In another embodiment, the antiperspirant active is aluminum zirconium tetrachlorhydrex propylene glycol.
[46] In other embodiments, the antiperspirant active is an aluminum salt and/or an aluminum-zirconium salt, such as those described above, that are further stabilized by betaine and a calcium salt. More information betaine and calcium salt stabilized antiperspirant salts can be found in U.S. Patent Application Publication No. 2006/0204463 to Tang et al. In other embodiments, the antiperspirant active, such as those described above, is selected to have a low metal to chloride ratio. Examples of these antiperspirant actives can be found in U.S. Patent No. 6,375,937 to Chopra et al. and in U.S. Patent Application Publication No. 2004/0109833 to Tang et al. In other embodiments, the type of salt of interest, an aluminum zirconium tetrasalt or octasalt free of glycine are used wherein aluminum zirconium salt is stabilized by betaine and has a metal to chloride ratio of 0.9: 1 to 1.3: 1 (and in other embodiments of 0.9: 1 to 1.2:1 or 0.9: 1 to 1.1:1). For the tetrasalt, the Al/Zr atomic ratio can be 3.2:1 to 4.1:1.0 and the betaine: zirconium mole ratio can be 0.2: 1 to 3.0: 1 (or in other embodiments of 0.4: 1 to 1.5: 1). Another salt that can be used is an aluminum chloride salt buffered by betaine, wherein the salt has a metal to chloride ratio of 0.9: 1 to 1.3:1 (and in other embodiments of 0.9: 1 to 1.2:1 or 0.9:1 to 1.1:1). For the octasalt the Al Zr atomic ratio is 6.2: 1 to 10.0: 1 and the betaine: Zr mole ratio is 0.2: 1 to 3.0: 1 (or in other embodiments of 0.4: 1 to 1.5:1). In one embodiment, in the case of a salt that contains zirconium, the betaine is incorporated during the synthesis of the salt so as to maximize the stabilizing effect this ingredient has (especially on the zirconium species). Alternatively, it can be post added to a glycine-free salt along with additional active phase ingredients to form a betaine stabilized active. Additionally, the antiperspirant active can be a calcium salt stabilized antiperspirant active. Examples of calcium salt stabilized antiperspirant actives can be found in U.S. Patent Application Publication No. 2006/0204463.
[47] Examples of commercially available glycine-free low M:C1 ratio tetrasalts and octasalts include, but are not limited to, REZAL(TM) AZP 955 CPG and REZAL(TM) AZP 885 respectively (both from SummitReheis Antiperspirant Actives of Huguenot, New York). A more detailed description of making such commercially available salts can be found for example, in U.S. Patent Nos. 7,074,394 and 6,960,338. Further examples of making these types of salt complexes are described in U.S. Patent Application Publication No. 2004/0198998 and United States Patent No. 7,105,691.
[48] Antiperspirant actives can be incorporated into compositions in amounts of 0.5 to 25 w% (on an actives basis) of the final composition, but the amount used will depend on the formulation of the composition. Generally at lower levels the antiperspirant active material will not substantially reduce the flow of perspiration as effectively, but will reduce malodor, for example, by acting also as an antimicrobial material. In certain embodiments, the base antiperspirant material can be designed to more effectively deliver the antiperspirant to the skin. In these situations, the amount of antiperspirant can be lowered but still deliver the same level of efficacy as a product with higher levels of antiperspirant. For an example of a composition that provides the same clinical efficacy at a 10 wt% antiperspirant level as other compositions that have a 17 wt% antiperspirant level, see the hydrocarbon/hydrogenated soybean oil gelled formulation in U.S. Patent Application Publication No. 2008/0187504A1.
[49] In certain embodiments, the amount of antiperspirant active is less than 12 wt% based on the total weight of the composition including the propellant. In other embodiments, the amount of antiperspirant active is from 0.5 to 10, 2 to 10 wt%, from 3 to 7.5 wt%, or from 4 to 5 wt%, based on the total weight of the composition including the propellant.
[50] In certain embodiments, the composition may include any known deodorant active. Examples of deodorant actives include, but are not limited to, antimicrobial actives, alcohols, 2,4,4'-trichloro-2'-hydroxy diphenyl ether (Triclosan), benzethonium chloride, polyhexamethylene biguanides, triethylcitrate, 2-amino-2-methyl-l-propanol (AMP), cetyl- trimethylammomium bromide, cetyl pyridinium chloride, farnesol (3,7, 1 1-trimethyl -2,6,10- dodecatrien-l-ol), N-(4-chlorophenyl)-N'-(3,4-dichlorophenyl)urea (Triclocarban), silver halides, octoxyglycerin (SensivaTM SC 50) and various zinc salts (for example, zinc ricinoleate), bactericides, and/or bacteriostats.
[51] The deodorant active can, illustratively, be included in the composition in an amount of 0-5% wt%, or 0.01-1 wt%, based on the total weight of the composition including the propellant. Triclosan can, illustratively, be included in an amount of 0.05 to 0.5 wt%, based on the total weight of the composition including the propellant.
Other Components
[52] Additional components of the antiperspirant compositions optionally include any components suitable for use in such compositions which are known in the art. Optionally, the composition further comprises one or more ingredients selected from: a fragrance, a preservative, an emulsifier, an antioxidant and an emollient.
Aerosol dispenser and propellant
[53] The aerosol antiperspirant composition is packaged in a dispenser comprising an aerosol container capable of dispensing the composition topically on to the axillary area of a subject. Such containers are known in the art. Typically, the container is a pressurized aerosol container.
[54] The composition further comprises at least one propellant which is a liquefied gas, typically a liquefied hydrocarbon such as one or more of butane, propane and isobutane, for example a mixture of these three propellant components.
[55] The least one propellant is typically present in an amount of from 80 to 95 wt%, for example about 85 wt%, based on the total weight of the composition.
Methods of Manufacture
[56] The antiperspirant compositions may be manufactured using methods known in the art. Typically, the ingredients are combined and optionally heated where components need to be melted. The components are mixed. Desirably, volatile materials such as fragrant materials are incorporated in the composition in the latter stages of a mixing cycle in order to avoid volatilisation thereof. After mixing, the composition may be poured directly into the dispensers and, after propellant addition, the container is capped to preserve the product until use.
[57] In a preferred embodiment, the bis-vinyl dimethicone/dimethicone copolymer, the silicone solvent, and the at least one fatty acid ester are initially provided as at least one premixed gel, and thereafter the at least one premixed gel is mixed with the at least the active antiperspirant ingredient, optionally together with other additional components of the antiperspirant composition. Then the liquefied gas propellant is added and the composition packaged in an aerosol dispenser.
Specific Embodiments
[58] This invention can be further illustrated by the following Examples of preferred embodiments thereof, although it will be understood that these Examples are included merely for purposes of illustration and are not intended to limit the scope of the invention unless otherwise specifically indicated.
Example 1
[59] In Example 1 the aerosol antiperspirant composition of Table 1 was produced.
[60] The two pre-mixed gel components DMIPM containing approximately 50% isopropyl myristate, 42% dimethicone, and 8% bis-vinyl dimethicone/dimethicone copolymer, and DMIPP containing approximately 51% dimethicone, 40% isopropyl palmitate, and 9% bis-vinyl dimethicone/dimethicone copolymer together provided in the composition a total amount of 1.176 wt% dimethicone and 0.224 wt% bis-vinyl dimethicone/dimethicone copolymer. The total amount of isopropyl palmitate in the composition was 2.10 wt% and the total amount of isopropyl myristate in the composition was 2.10 wt%.

[61] The aerosol antiperspirant composition of Example 1 was tested to determine its deposition efficacy onto a surface representing an axillary area of a subject.
[62] The testing was carried out by providing the aerosol antiperspirant composition in a conventional aerosol spray container, and spraying the composition onto a surface for a period of 2 seconds. The weight loss of the container was measured and the amount of the antiperspirant composition (minus the evaporated propellant) deposited onto the surface was also measured. The two measurements were compared, after accounting for the weight of propellant, to determine the proportion of the antiperspirant composition (minus the evaporated propellant) which was deposited onto the surface. This expressed a parameter, deposition efficacy, as a percentage amount of the total spray which was actually deposited on the surface. Three separate tests were carried out and the results were averaged.
[63] For the aerosol antiperspirant composition of Example 1, it was found that there was a deposition efficacy of 85 % onto the surface, as shown in Table 2.

Examples 2 to 6
[64] In Examples 2 to 6 the aerosol antiperspirant composition of Example 1 was modified by varying the total amounts of the two components DMIPM and DMIPP, which in turn provided varying amounts of the bis-vinyl dimethicone/dimethicone copolymer. The deposition efficacy was also measured for each of Examples 2 to 6 and the results, together with the respective amount of the bis-vinyl dimethicone/dimethicone copolymer, are shown in Table 2.
[65] From Table 2 it may be seen that the addition of the bis-vinyl dimethicone/dimethicone copolymer tended to increase the deposition efficacy.
Comparative Examples 1 and 2
[66] In Comparative Examples 1 and 2 aerosol antiperspirant compositions similar to Example 1 were formulated, except that these did not comprise either of the two components DMIPM and DMIPP. Accordingly, the compositions of Comparative Examples 1 and 2 comprised no bis-vinyl dimethicone/dimethicone copolymer or dimethicone.
[67] Comparative Example 1 was formulated in the test laboratory and Comparative Examples 2 was a commercially available aerosol antiperspirant composition with soy base.
[68] The deposition efficacy was also measured for each of Comparative Examples 1 and 2 and the results are as shown in Table 2.
[69] From Table 2 it may be seen that in Examples 1 to 6 the addition of the bis-vinyl dimethicone/dimethicone copolymer tended to increase the deposition efficacy as compared to the compositions of Comparative Examples 1 and 2.
[70] Without being bound by any theory, it is believed that the bis-vinyl dimethicone/dimethicone copolymer improves the deposition of the antiperspirant composition by providing cohesive forces in the mixture which result in a more compact spray, with fewer small spray droplet particles flying off laterally which would tend not to be deposited, and so in turn the compact spray is more directed towards the skin, thereby enhancing deposition efficacy. In addition, it is believed that the bis-vinyl dimethicone/dimethicone copolymer may reduce the bounce back of spray droplet particles from the skin, again thereby enhancing deposition efficacy.
[71] Furthermore, the composition of Example 1 provided the highest deposition efficacy of all of Examples 1 to 5 when the bis-vinyl dimethicone/dimethicone copolymer amount was below about 0.4 wt% It is noticed that when the silicone copolymer is increased too high, the product leaves a tacky feeling on skin when dispensed.
Examples 7 and 8
[72] In Examples 7 and 8 the aerosol antiperspirant composition of Example 1 was modified by alternately employing only one of the components DMIPM and DMIPP as shown in Table 3. The deposition efficacy was also measured for each of Examples 7 and 8 and the results, together with the respective amount of the bis-vinyl dimethicone/dimethicone copolymer, are shown in Table 3.

[73] From Table 3 it may be seen that the addition of the bis-vinyl dimethicone/dimethicone copolymer in either DMIPP or DMIPM had a similar deposition efficacy as compared to Example 2 which had the same total amount, 0.112 wt%, of bis-vinyl dimethicone/dimethicone copolymer and comprised a 1:1 by weight blend of DMIPP and DMIPM
[74] Examples 7 and 8 exhibited enhanced deposition efficacy as compared to Comparative Examples 1 and 2 due to the presence of the bis-vinyl dimethicone/dimethicone copolymer.
Comparative Examples 3 to 5
[75] In Comparative Examples 3 to 5 aerosol antiperspirant compositions similar to Example 1 were formulated, except that these did not comprise either of the two components DMIPM and DMIPP. Accordingly, the compositions of Comparative Examples 5 to 7 comprised no bis-vinyl dimethicone/dimethicone copolymer but did comprise dimethicone.
[76] Table 4 shows the amount of dimethicone in the aerosol antiperspirant compositions of Comparative Examples 3 to 5. For comparison, in Example 1 the dimethicone amount was 1.18 wt% based on the total weight of the composition including the propellant.
[77] The deposition efficacy was also measured for each of Comparative Examples 3 to 5 and the results are shown in Table 4.

[78] From Table 4 it may be seen from a comparison of Comparative Example 3 and Example 1, which had the same amount of dimethicone, that the addition of the bis-vinyl dimethicone/dimethicone copolymer tended to increase the deposition efficacy.
[79] Furthermore, it may be seen from a comparison of Comparative Examples 4 and 5 and Example 1 that increasing the amount of dimethicone, but in the absence of the bis-vinyl dimethicone/dimethicone copolymer, tended to increase the deposition efficacy but nevertheless the deposition efficacy was still lower than in Example 1. In other words, in Example 1 the total amount of silicone compounds, comprising dimethicone and bis-vinyl dimethicone/dimethicone copolymer, was lower than the total amount of silicone compound, comprising dimethicone, in Comparative Examples 4 and 5 but still provided enhanced deposition efficacy as a result of the addition of the bis-vinyl dimethicone/dimethicone copolymer.
[80] Therefore a comparison of Comparative Examples 3 to 5 and Example 1 shows that the bis-vinyl dimethicone/dimethicone copolymer tended to increase the deposition efficacy to a greater degree than dimethicone.
Examples 9 to 11
[81] In Examples 9 to 11 the aerosol antiperspirant compositions of, respectively, Examples 1, 7 and 8 were modified by substituting the Bentone 27 particulate clay thickener by Bentone 38, which is an organic derivate of hectorite clay. The respective same amounts of the components DMIPM and DMIPP were employed as shown in Table 5.
[82] The deposition efficacy was also measured for each of Examples 9 to 11 and the results, together with the respective amount of the bis-vinyl dimethicone/dimethicone copolymer, are shown in Table 5.

[83] From Table 5 it may be seen that the Bentone 27 particulate clay thickener as used in Examples 1 to 8 tended to increase the deposition efficacy as compared the Bentone 38 particulate clay thickener used in Examples 9, 10 and 11. In each case, the composition of Examples 9, 10 and 11 provided enhanced deposition efficacy as compared to Comparative Examples 1 and 2.
[84] Accordingly, the composition employing the Bentone 27 particulate clay and the bis-vinyl dimethicone/dimethicone copolymer amount of about 0.224 wt% tended to provide the best deposition efficacy for the aerosol antiperspirant composition without providing too high a level, greater than 0.4 wt%, of the bis-vinyl dimethicone/dimethicone copolymer.
CLAIMS
What is claimed is:
1. An aerosol antiperspirant composition comprising: at least one active antiperspirant ingredient, a bis-vinyl dimethicone/dimethicone copolymer, a silicone solvent, at least one fatty acid ester and at least one propellant.
2. The composition of claim 1 wherein the bis-vinyl dimethicone/dimethicone copolymer is present in an amount of from 0.1 to 0.75 wt% based on the weight of the composition including the at least one propellant.
3. The composition of claim 2 wherein the bis-vinyl dimethicone/dimethicone copolymer is present in an amount of from 0.15 to 0.3 wt% based on the weight of the composition including the at least one propellant.
4. The composition of claim 3 wherein the bis-vinyl dimethicone/dimethicone copolymer is present in an amount of from 0.2 to 0.25 wt% based on the weight of the composition including the at least one propellant.
5. The composition of any preceding claim wherein the silicone solvent comprises dimethicone.
6. The composition of any preceding claim wherein the silicone solvent is present in an amount of from 0.5 to 5 wt% based on the weight of the composition including the at least one propellant.
7. The composition of claim 6 wherein the silicone solvent is present in an amount of from 0.75 to 2 wt% based on the weight of the composition including the at least one propellant.
8. The composition of claim 7 wherein the silicone solvent is present in an amount of from 0.9 to 1.25 wt% based on the weight of the composition including the at least one propellant.
9. The composition of any preceding claim wherein the at least one fatty acid ester comprises one or more esters of a C2-C5 alcohol and a C12-C20 fatty acid.
10. The composition of claim 9 wherein the C2-C5 alcohol comprises propyl alcohol.
11. The composition of claim 9 or claim 10 wherein the C12-C20 fatty acid comprises at least one fatty acid selected from myristic acid, palmitic acid and isostearic acid.
12. The composition of any one of claims 9 to 11 wherein the at least one fatty acid ester comprises one of more of isopropyl myristate, isopropyl palmitate and isopropyl isostearate.
13. The composition of claim 12 wherein the at least one fatty acid ester comprises a mixture of isopropyl myristate and isopropyl palmitate.
14. The composition of claim 13 wherein the isopropyl myristate and isopropyl palmitate are present in the mixture in a weight ratio of from 0.5:1 to 1:0.5.
15. The composition of claim 14 wherein the isopropyl myristate and isopropyl palmitate are present in the mixture in a weight ratio of about 1:1.
16. The composition of any one of claims 9 to 15 wherein the at least one fatty acid ester is present in an amount of from 0.5 to 7.5 wt% based on the weight of the composition including the at least one propellant.
17. The composition of claim 16 wherein the at least one fatty acid ester is present in an amount of from 2 to 5 wt% based on the weight of the composition including the at least one propellant.
18. The composition of claim 17 wherein the at least one fatty acid ester is present in an amount of from 3 to 4.5 wt% based on the weight of the composition including the at least one propellant.
19. The composition of any preceding claim further comprising a thickener comprised of an organic derivative of a hectorite clay.
20. The composition of claim 19 wherein the thickener comprises a trialkylaryl ammonium hectorite clay.
21. The composition of claim 19 wherein the thickener comprises quaternium-18 hectorite.
22. The composition of any one of claims 19 to 21 wherein the organic derivative of a hectorite clay is present in an amount of from 0.2 to 0.4 wt% based on the weight of the composition including the at least one propellant.
23. The composition of claim 22 wherein the organic derivative of a hectorite clay is present in an amount of from 0.25 to 0.35 wt% based on the weight of the composition including the at least one propellant.
24. The composition of any preceding claim wherein the at least one active antiperspirant ingredient is selected from aluminium salts, zirconium salts and zinc salts.
25. The composition of claim 24 wherein the at least one active antiperspirant ingredient comprises aluminium chlorohydrate.
26. The composition of any preceding claim, further comprising one or more ingredients selected from: a deodorant, a fragrance, a preservative, an emulsifier, an antioxidant and an emollient.
27. An antiperspirant composition aerosol dispenser comprising the composition of any preceding claim packaged in an aerosol container.
28. The dispenser of claim 27 wherein the container is a pressurized aerosol container.
29. Use of the composition of any one of claims 1 to 26 as an antiperspirant.
30. A method comprising applying the composition of any one of claims 1 to 26 to the axillary area of a subject.
31. A method of manufacturing the composition of any one of claims 1 to 26, the method including the step of:
a. providing the bis-vinyl dimethicone/dimethicone copolymer, the silicone solvent, and the at least one fatty acid ester as at least one premixed gel; and
b. mixing the at least one premixed gel with at least the active antiperspirant ingredient.
32. Use, in an aerosol antiperspirant composition comprising at least one active antiperspirant ingredient and at least one propellant, of the combination of a bis-vinyl dimethicone/dimethicone copolymer, a silicone solvent, and at least one fatty acid ester for increasing the deposition of the at least one active antiperspirant ingredient on an axillary area of a subject from a dose of an aerosol spray comprising the composition.
33. The use of claim 32 wherein the bis-vinyl dimethicone/dimethicone copolymer, the silicone solvent, and the at least one fatty acid ester are provided as at least one premixed gel.
34. The use of claim 32 or 33 wherein the composition further comprises a thickener comprised of quaternium-18 hectorite.

ANTECEDENTES DE LA INVENCIÓN
Las composiciones antitranspirantes generalmente se aplican a la región axilar de una persona para limitar la transpiración y/o para limitar o eliminar las bacterias en esta región. De esta manera, el olor corporal causado por el crecimiento bacteriano se elimina o al menos se reduce.
Los antitranspirantes pueden aplicarse por vía tópica de forma líquida en aerosol. Cuando estas composiciones se aplican en la región axilar, la pulverización del aerosol se deposita en forma de finas gotas en la piel. Algunas de estas gotas pueden dispersarse lateralmente en la pulverización y/o rebotar en la piel, por lo que no se pueden depositar para formar una capa antitranspirante eficaz en la piel. Tal fenómeno de dispersión por pulverización/rebote reduce el antitranspirante, la eficacia anti-humedad de la composición antitranspirante en aerosol al proporcionar menos antitranspirante a la piel.

SUMARIO DE LA INVENCIÓN
En un primer aspecto, se proporciona una composición antitranspirante en aerosol que comprende: al menos un ingrediente activo antitranspirante, un copolímero de dimeticona bis-vinilo/dimeticona, un disolvente de silicona, al menos un éster de ácido graso y al menos un propelente.
Los presentes inventores han descubierto que el uso, en una composición antitranspirante en aerosol que comprende al menos un ingrediente activo antitranspirante y al menos un agente propulsor, de la combinación de un copolímero de dimeticona bis-vinilo/dimeticona, un disolvente de silicona y al menos un éster de ácido graso puede aumentar la deposición de al menos un ingrediente activo antitranspirante en la zona axilar de un sujeto con una dosis de un pulverizador en aerosol que comprende la composición.

En un aspecto adicional, se proporciona un método de fabricación de la composición, el método incluye la etapa de: a) tener el copolímero de dimeticona bis-vinilo/dimeticona, el disolvente de silicona y al menos el éster de un ácido graso al menos en forma de un gel premezclado; y b) mezclar al menos un gel premezclado con por lo menos el ingrediente activo antitranspirante.
En un aspecto adicional, se proporciona el uso, en una composición antitranspirante en aerosol que comprende al menos un ingrediente activo antitranspirante y al menos un agente propulsor, de la combinación de un copolímero de dimeticona bis-vinilo/dimeticona, un disolvente de silicona y por lo menos el éster de un ácido graso para el aumento de la deposición de al menos un ingrediente activo antitranspirante en la zona axilar de un sujeto con una dosis de un pulverizador en aerosol que comprende la composición.
Generalmente, se proporciona el copolímero de dimeticona bis-vinilo/dimeticona, el disolvente de silicona y por lo menos el éster de un ácido graso al menos en forma de un gel premezclado.
Opcionalmente, la composición comprende además un espesante compuesto de hectorita cuaternio-18.

En algunas modalidades, la base que contiene emoliente comprende además otros agentes gelificantes y/o emolientes. Ejemplos de otros agentes gelificantes/ emolientes incluyen, pero no se limitan a ceras, ésteres de ácido graso y alcohol graso, triglicéridos, aceite de soja parcial o completamente hidrogenado, aceite de ricino parcial o totalmente hidrogenado, otros aceites vegetales parcial o totalmente hidrogenados, alcohol estearílico, carbonato de propileno u otros materiales cosméticamente aceptables, que son sólidos o semi sólidos a temperatura ambiente y proporcionan una consistencia adecuada para su aplicación sobre la piel.
En una modalidad, la composición comprende aceite de soja hidrogenado en una cantidad normal de hasta 5% en peso, más generalmente de 0.2 a 2% en peso, por ejemplo de 0.5 a 0.75% en peso, basado en el peso de la composición. En una modalidad, la composición comprende benzoato de alquilo C12-C15 en una cantidad normal de hasta 5% en peso, más generalmente de 0.5 a 2% en peso, basado en el peso de la composición.

En general, se puede utilizar cualquiera de la Categoría I de ingredientes antitranspirantes activos, que figuran en la Monografía de la Administración de Alimentos y Medicamentos en Productos Médicos Antitranspirantes para uso humano de venta libre (10 de octubre de 1973) (21 CFR 350.10). En una modalidad, el compuesto activo antitranspirante es clorhidrato de aluminio. En otra modalidad, la sustancia activa antitranspirante de aluminio y zirconio es propilenglicol tetraclorhídrico.
En otras modalidades, el compuesto activo antitranspirante es una sal de aluminio y/o una sal de aluminio-zirconio, tales como las descritas anteriormente, que después se estabilizan con betaína y una sal de calcio. Se puede encontrar más información sobre las sales estabilizadas antitranspirantes de sal de betaína y calcio en la Publicación de Solicitud de Patente de Estados Unidos Nº 2006/0204463 de Tang et al. En otras modalidades, el compuesto activo antitranspirante, tal como los descritos anteriormente, se selecciona para que tenga una relación baja de metal/cloruro. Se pueden encontrar ejemplos de estas sustancias activas antitranspirantes en la Patente de Estados Unidos Nº 6.375.937 a Chopra et al. y en la Solicitud de Publicación de Patente de Estados Unidos Nº 2004/0109833 de Tang et al. En otras modalidades, el tipo de sal de interés, una tetrasal de circonio-aluminio u octasal libre de glicina se usan en donde la sal de aluminio y zirconio se estabiliza con la betaína y tiene una proporción de metal/cloruro de 0.9: 1 a 1.3: 1 (y en otras modalidades de 0.9: 1 a 1.2: 1 ó 0.9: 1 a 1.1: 1). Para la tetrasal, la relación atómica Al/Zr puede ser 3.2: 1 a 4.1: 1.0 y la betaína: relación molar de circonio puede ser 0.2: 1 a 3.0: 1 (o en otras modalidades de 0.4: 1 a 1.5: 1). Otra sal que se puede utilizar es una sal de cloruro de aluminio tamponado con betaína, en donde la sal tiene una relación metal/cloruro de 0.9: 1 a 1.3: 1 (y en otras modalidades de 0.9: 1 a 1.2: 1 ó 0.9: 1 a 1.1: 1). Para la octasal la relación atómica Al/Zr es 6.2: 1 a 10.0: 1 y la betaína: relación molar Zr es 0.2: 1 a 3.0: 1 (o en otras modalidades de 0.4: 1 a 1.5: 1). En una modalidad, en el caso de una sal que contiene circonio, la betaína es incorporada durante la síntesis de la sal a fin de maximizar el efecto estabilizante que tiene este ingrediente (especialmente en las especies de zirconio). Alternativamente, después se puede añadir a una sal libre de glicina junto con ingredientes de la fase activa adicionales para formar una betaína estabilizada activa. Además, el compuesto activo antitranspirante puede ser una sal de calcio estabilizado activo antitranspirante. Se pueden encontrar ejemplos de sales de calcio estabilizadas de activos antitranspirantes en la Solicitud de Publicación de Patente de Estados Unidos Nº 2006/0204463.
Los ejemplos de tetrasales y octasales con relación baja de M:C1 libre de glicina y comercialmente disponibles incluyen, pero no se limitan a Rezal (TM) AZP 955 CPG y Rezal (TM) AZP 885, respectivamente (ambos de SummitReheis Activos Antitranspirantes de Huguenot, Nueva York). Una descripción más detallada sobre cómo hacer tales sales comercialmente disponibles se puede encontrar por ejemplo en la Patente de Estados Unidos Nos. 7.074.394 y 6.960.338. Otros ejemplos de fabricación de estos tipos de complejos de sales se describen en la Solicitud de Publicación de Patente de Estados Unidos Nº 2004/0198998 y la Patente de Estados Unidos No. 7.105.691.
Los ingredientes activos antitranspirantes se pueden incorporar a las composiciones en cantidades de 0.5 a 25% en peso (sobre una base de activos) de la composición final, pero la cantidad usada dependerá de la formulación de la composición. Por lo general en los niveles inferiores el material activo antitranspirante no reducirá sustancialmente el flujo de transpiración con mayor eficacia, pero reducirá el mal olor, por ejemplo, actuando también como un material antimicrobiano. En ciertas modalidades, el material antitranspirante base puede ser diseñado para depositar más eficazmente el antitranspirante en la piel. En estas situaciones, la cantidad de antitranspirante se puede bajar, pero teniendo el mismo nivel de eficacia como un producto con niveles más altos de antitranspirante. Como ejemplo de una composición que proporciona la misma eficacia clínica a un nivel antitranspirante de 10% en peso como otras composiciones que tienen un nivel antitranspirante de 17% en peso, vea la formulación gelificada del aceite de soja hidrocarburo/hidrogenado en la Solicitud de Publicación de Patente de Estados Unidos Nº 2008/0187504A1.
En ciertas modalidades, la cantidad de sustancia activa antitranspirante es menor de 12% en peso basado en el peso total de la composición incluyendo el propelente. En otras modalidades, la cantidad de sustancia activa antitranspirante es de 05 a 10, de 2 a 10% en peso, de 3 al 7.5% en peso, o de 4 a 5% en peso, basado en el peso total de la composición incluyendo el propelente.
En ciertas modalidades, la composición puede incluir cualquier desodorante conocido activo. Los ejemplos de sustancias activas desodorantes incluyen, pero no se limitan a, sustancias activas antimicrobianas, alcoholes, 2,4,4'-tricloro-2'-hidroxi difenil éter (Triclosan), cloruro de bencetonio, biguanidas de polihexametileno, citrato de trietilo, 2-amino-2- metil-l-propanol (AMP), bromuro de cetil-trimetilamonio, cloruro de cetil piridinio, farnesol (3,7, 1 1-trimetil -2,6,10- dodecatrien-l-ol), N- (4-clorofenil) - N '- (3,4-diclorofenil) urea (Triclocarban), haluros de plata, octoxiglicerina (SensivaTM SC 50) y diversas sales de zinc (por ejemplo, ricinoleato de zinc), bactericidas y/o bacteriostáticos.
El recipiente con el activo desodorante, de manera ilustrativa, se incluye en la composición en una cantidad de 0-5% de % en peso, ó 0.01 a 1% en peso, basado en el peso total de la composición incluyendo el propelente. Se puede incluir triclosan, ilustrativamente, en una cantidad de 0.05 a 0.5% en peso, basado en el peso total de la composición incluyendo el propelente.
Otros Componentes
Los componentes adicionales de las composiciones antitranspirantes incluyen opcionalmente cualquiera de los componentes adecuados para uso en tales composiciones que son conocidos en la técnica. Opcionalmente, la composición comprende además uno o más ingredientes seleccionados de: una fragancia, un conservador, un emulsionante, un antioxidante y un emoliente.
Dispensador en aerosol y propulsor
La composición antitranspirante en aerosol se envasa en un dispensador que comprende un recipiente de aerosol capaz de dispensar la composición vía tópica en la zona axilar de un sujeto. Tales recipientes son conocidos en la técnica. Generalmente, el recipiente es un recipiente de aerosol a presión.
La composición comprende además al menos un agente propulsor, que es un gas licuado, generalmente un hidrocarburo licuado tal como uno o más de butano, el propano y el isobutano, por ejemplo una mezcla de estos tres componentes propelentes.
Al menos un agente propulsor está presente, por lo general en una cantidad de 80 a 95% en peso, por ejemplo aproximadamente 85% en peso, basado en el peso total de la composición.
Métodos de Fabricación
Las composiciones antitranspirantes se pueden fabricar usando métodos conocidos en la técnica. Generalmente, los ingredientes se combinan y es opcional si se calientan de cuando los componentes deban derretirse. Los componentes se mezclan. Deseablemente, a la composición se incorporan materiales volátiles, tales como materiales fragantes en las últimas etapas de un ciclo de mezclado con el fin de evitar la volatilización de los mismos. Después de mezclar, la composición, se puede verter directamente en los dispensadores y, después de la adición del propelente, el recipiente se tapa para conservar el producto hasta su uso.
En una modalidad preferida, el copolímero de dimeticona bis-vinilo/dimeticona, el disolvente de silicona y el éster de al menos un ácido graso se proporcionan inicialmente en forma de por lo menos un gel de premezclado, y después de esto al menos un gel premezclado se mezcla al menos con el ingrediente antitranspirante activo, opcionalmente junto con otros componentes adicionales de la composición antitranspirante. Luego se añade el propelente de gas licuado y la composición envasada en un dispensador en aerosol.
Modalidades específicas
Esta invención se puede ilustrar adicionalmente mediante los siguientes ejemplos de modalidades preferidas de la misma, aunque se entenderá que estos ejemplos se incluyen únicamente para fines de ilustración y no están destinados a limitar el alcance de la invención a menos que hay una especificación de lo contrario.
Ejemplo 1
En el Ejemplo 1 se produjo la composición antitranspirante en aerosol de la Tabla 1.
Los dos componentes DMIPM de gel pre-mezclados que contienen aproximadamente 50% de miristato de isopropilo, 42% de dimeticona, y copolímero de dimeticona bis-vinilo/dimeticona 8%, y DMIPP que contiene aproximadamente 51% de dimeticona, 40% de palmitato de isopropilo, y 9% copolímero dimeticona bis-vinilo /dimeticona juntos siempre en la composición en una cantidad total de 1.176% en peso de dimeticona y 0.224 % en peso de copolímero de dimeticona bis-vinilo/dimeticona. La cantidad total de palmitato de isopropilo en la composición era de 2.10% en peso y la cantidad total de miristato de isopropilo en la composición era de 2.10% en peso.

La composición antitranspirante en aerosol del Ejemplo 1 se ensayó para determinar la eficacia de deposición sobre una superficie que representa una zona axilar de un sujeto.
La prueba se llevó a cabo proporcionando la composición antitranspirante en aerosol en un contenedor pulverizador en aerosol convencional, y la pulverización de la composición sobre una superficie por un período de 2 segundos. Se midió la pérdida de peso del recipiente y también la cantidad de la composición antitranspirante (menos el propelente evaporado) depositado sobre la superficie. Las dos medidas se compararon, después de considerar el peso del propelente, para determinar la proporción de la composición antitranspirante (menos el propelente evaporadado) que se depositó sobre la superficie. Esto expresa un parámetro de eficacia, la deposición, como porcentaje del spray total que se depositó en realidad en la superficie. Tres ensayos separados se realizaron y los resultados se promediaron.
[63] Para la composición antitranspirante en aerosol del Ejemplo 1, se constató que había una eficacia de deposición de 85% sobre la superficie, como se muestra en la Tabla 2.

En los Ejemplos 2 a 6 de la composición antitranspirante en aerosol del Ejemplo 1 se modificó mediante la variación de los importes totales de DMIPM y los dos componentes DMIPP, que a su vez proporcionan cantidades variables del copolímero dimeticona bis-vinilo/dimeticona. La eficacia de deposición también se midió para cada uno de los Ejemplos 2 a 6 y los resultados, junto con la cantidad respectiva del copolímero de dimeticona bis-vinilo/dimeticona, se muestran en la Tabla 2.
De la Tabla 2 se puede observar que la adición del copolímero de dimeticona vinilo-bis/dimeticona tendió a aumentar la eficacia de deposición.
Ejemplos Comparativos 1 y 2
En los Ejemplos Comparativos 1 y 2 se formularon las composiciones antitranspirantes en aerosol similares al Ejemplo 1, excepto que estas no comprenden cualquiera de los dos componentes DMIPM y DMIPP. De acuerdo con esto, las composiciones de los Ejemplos Comparativos 1 y 2 no comprenden el copolímero dimeticona bis-vinilo/dimeticona o dimeticona.
El ejemplo Comparativo 1 se formuló en el laboratorio de ensayo y los Ejemplos Comparativos 2 eran una composición antitranspirante en aerosol comercializada con la base de soja.
También se midió la eficacia de deposición para cada uno de los Ejemplos Comparativos 1 y 2 y los resultados se muestran en la Tabla 2.
En la Tabla 2 se puede observar que en los Ejemplos 1 a 6, la adición del copolímero de dimeticona bis-vinilo/dimeticona tendió a aumentar la eficacia de deposición en comparación con las composiciones de los Ejemplos Comparativos 1 y 2.
Sin ajustarse a ninguna teoría, se cree que el copolímero de dimeticona bis-vinilo/dimeticona mejora la deposición de la composición antitranspirante proporcionando fuerzas de cohesión en la mezcla que resultan en un spray más compacto, con menos partículas de pequeñas gotas pulverizadoras disparadas lateralmente que no se depositan, y a su vez el spray compacto está más dirigido hacia la piel, mejorando así la eficacia de deposición. Además, se cree que el copolímero de dimeticona bis-vinilo/dimeticona puede reducir el rebote de las partículas de las gotas pulverizadoras en la piel, mejorando así la eficacia de deposición.
Además, la composición del Ejemplo 1 presentó la eficacia de deposición más alta de todos los Ejemplos 1 a 5 cuando la cantidad de copolímero de dimeticona bis-vinilo/dimeticona estaba por debajo de aproximadamente 0.4% en peso. Se observa que cuando el copolímero de silicona aumenta demasiado, el producto deja una sensación pegajosa en la piel cuando se dispensa.
Ejemplos 7 y 8
En los Ejemplos 7 y 8 la composición antitranspirante en aerosol del Ejemplo 1 fue modificada empleando de forma alternada solamente uno de los componentes DMIPP y DMIPM como se muestra en la Tabla 3. También se midió la eficacia de deposición también para cada uno de los Ejemplos 7 y 8 y en la Tabla 3 se muestran los resultados junto con la cantidad respectiva del copolímero de dimeticona bis-vinilo/dimeticona.

De la Tabla 3 se puede observar que la adición del copolímero de dimeticona bis-vinilo/dimeticona en cualquiera DMIPP o DMIPM tenía una eficacia de deposición similar en comparación con el Ejemplo 2 que tenía la misma cantidad total, 0.112% en peso, de copolímero de dimeticona bis-vinilo/dimeticona y comprendía un 1: 1 en peso de mezcla DMIPP y DMIPM.
Los Ejemplos 7 y 8 mostraron una eficacia mejorada de deposición en comparación con los Ejemplos Comparativos 1 y 2 debido a la presencia del copolímero de dimeticona bis-vinilo/dimeticona.
Ejemplos Comparativos 3 a 5
En los Ejemplos Comparativos 3 a 5 se formularon las composiciones antitranspirantes en aerosol similares a las del Ejemplo 1, excepto que éstas no comprenden cualquiera de los dos componentes DMIPM y DMIPP. De acuerdo con esto, las composiciones de los Ejemplos Comparativos 5 a 7 no comprendían copolímero de dimeticona bis-vinilo/dimeticona pero sí comprendían dimeticona.
La Tabla 4 muestra la cantidad de dimeticona en las composiciones antitranspirantes en aerosol de los Ejemplos Comparativos 3 a 5. Para la comparación, en el Ejemplo 1 la cantidad de dimeticona era de 1.18% en peso basado en el peso total de la composición incluyendo el propelente.
También se midió la eficacia de deposición para cada uno de los Ejemplos Comparativos 3 a 5 y los resultados se muestran en la Tabla 4.

En la Tabla 4 puede verse una comparación del Ejemplo Comparativo 3 y el Ejemplo 1, el cual tenía la misma cantidad de dimeticona, que la adición del copolímero de dimeticona bis-vinilo/dimeticona tendió a aumentar la eficacia de deposición.
Además, se puede observar a partir de una comparación de los Ejemplos Comparativos 4 y 5 y en el Ejemplo 1 que el aumento de la cantidad de dimeticona, pero en ausencia del copolímero de dimeticona bis-vinilo/dimeticona, tendió a aumentar la eficacia de deposición; sin embargo, la eficacia de deposición fue aún menor que en el Ejemplo 1. En otras palabras, en el Ejemplo 1 la cantidad total de compuestos de silicona, que comprende dimeticona y copolímero de dimeticona bis-vinilo/dimeticona, fue menor que la cantidad total del compuesto de silicona, que comprende dimeticona, en los Ejemplos Comparativos 4 y 5 pero aun así proporcionan una mayor eficacia de deposición como resultado de la adición del copolímero de dimeticona bis-vinilo/dimeticona.
Por lo tanto una comparación de los Ejemplos Comparativos 3 a 5 y el Ejemplo 1 muestra que el copolímero de dimeticona bis-vinilo/dimeticona tendió a aumentar la eficacia de deposición en un grado mayor que la dimeticona.
Ejemplos 9 a 11
En los Ejemplos 9 a 11 las composiciones antitranspirantes en aerosol de los Ejemplos 1, 7 y 8 respectivamente, se modificaron mediante la sustitución del espesante de partículas de arcilla Bentone 27 por Bentone 38, que es un derivado orgánico de la arcilla de hectorita. Se emplearon las respectivas cantidades iguales de los componentes DMIPP y DMIPM como se muestra en la Tabla 5.
También se midió la eficacia de deposición para cada uno de los Ejemplos 9 a 11 y los resultados, junto con la cantidad respectiva del copolímero de dimeticona bis-vinilo/dimeticona, se muestran en la Tabla 5.

En la Tabla 5 se puede observar que el espesante de partículas de arcilla Bentone 27, como se usa en Ejemplos 1 a 8, tendió a aumentar la eficacia de deposición en comparación con el espesante de partículas de arcilla Bentone 38 utilizado en los Ejemplos 9, 10 y 11. En cada caso, la composición de los Ejemplos 9, 10 y 11 proporcionó una eficacia mejorada de deposición en comparación con los Ejemplos Comparativos 1 y 2.
En consecuencia, la composición que emplea las partículas de arcilla Bentone 27 y la cantidad de copolímero de dimeticona bis-vinilo/dimeticona de aproximadamente 0.224% en peso tienden a proporcionar la mejor eficacia de deposición para la composición antitranspirante en aerosol sin proporcionar un nivel demasiado alto, mayor de 0.4 % en peso, del copolímero de dimeticona bis-vinilo/dimeticona.
NOVEDAD DE LA INVENCIÓN
Habiendo descrito la presente invención, se considera como novedad, y por lo tanto se reclama como propiedad lo contenido en las siguientes:
REIVINDICACIONES
Lo que se reivindica es:
1. Una composición en aerosol antitranspirante caracterizada porque comprende: al menos un ingrediente activo antitranspirante, un copolímero de dimeticona bis-vinilo/dimeticona, un disolvente de silicona, al menos un éster de ácido graso y al menos un propelente.
2. La composición de la reivindicación 1 caracterizada porque el copolímero de dimeticona bis-vinilo/dimeticona está presente en una cantidad de 0.1 a 0.75% en peso basado en el peso de la composición que incluye al menos un propelente.
3. La composición de la reivindicación 2 caracterizada porque el copolímero de dimeticona bis-vinilo/dimeticona está presente en una cantidad de 0.15 a 0.3% en peso basado en el peso de la composición que incluye al menos un propelente.
4. La composición de la reivindicación 3 caracterizada porque el copolímero de dimeticona bis-vinilo/dimeticona está presente en una cantidad de 0.2 a 0.25% en peso basado en el peso de la composición que incluye al menos un propelente.
5. La composición de cualquier reivindicación precedente caracterizada porque el disolvente de silicona comprende dimeticona.
6. La composición de cualquier reivindicación anterior caracterizada porque el disolvente de silicona está presente en una cantidad de 0.5 a 5% en peso basado en el peso de la composición que incluye al menos un propelente.
7. La composición de la reivindicación 6 caracterizada porque el disolvente de silicona está presente en una cantidad de 0.75 a 2% en peso basado en el peso de la composición que incluye al menos un propelente.
8. La composición de la reivindicación 7 caracterizada porque el disolvente de silicona está presente en una cantidad de 0.9 a 1.25% en peso basado en el peso de la composición que incluye al menos un propelente.
9. La composición de cualquier reivindicación precedente caracterizada porque al menos un éster de ácido graso comprende uno o más ésteres de un alcohol C2-C5 y un ácido graso C12-C20.
10. La composición de la reivindicación 9 caracterizada porque el alcohol C2-C5 comprende alcohol propílico.
11. La composición de la reivindicación 9 o la reivindicación 10 caracterizada porque el ácido graso C12-C20 comprende al menos un ácido graso seleccionado de entre el ácido mirístico, ácido palmítico y ácido isoesteárico.
12. La composición de cualquiera de las reivindicaciones 9 a 11, caracterizada porque el éster de ácido graso comprende al menos uno o más de miristato de isopropilo, palmitato de isopropilo, isoestearato e isopropilo.
13. La composición de la reivindicación 12 caracterizada porque al menos un éster de ácido graso comprende una mezcla de miristato de isopropilo y palmitato de isopropilo.
14. La composición de la reivindicación 13 caracterizada porque el miristato de isopropilo y palmitato de isopropilo están presentes en la mezcla en una relación en peso de 0.5:1 a 1:0.5.
15. La composición de la reivindicación 14 caracterizada porque el miristato de isopropilo y palmitato de isopropilo están presentes en la mezcla en una relación en peso de aproximadamente 1:1.
16. La composición de cualquiera de las reivindicaciones 9 a 15 caracterizada porque el éster de al menos un ácido graso está presente en una cantidad de 0.5 a 7.5% en peso basado en el peso de la composición que incluye al menos un propelente.
17. La composición de la reivindicación 16 caracterizada porque al menos un éster de ácido graso está presente en una cantidad de 2 a 5% en peso basado en el peso de la composición que incluye al menos un propelente.
18. La composición de la reivindicación 17 caracterizada porque al menos un éster de ácido graso está presente en una cantidad de 3 a 4.5% en peso basado en el peso de la composición que incluye al menos un propelente.
19. La composición de cualquier reivindicación precedente caracterizada porque además comprende un espesante constituido por un derivado orgánico de una arcilla hectorita.
20. La composición de la reivindicación 19 caracterizada porque el espesante comprende una arcilla hectorita de trialquilaril amonio.
21. La composición de la reivindicación 19 caracterizada porque el espesante comprende hectorita cuaternio-18.
22. La composición de cualquiera de las reivindicaciones 19 a 21 caracterizada porque el derivado orgánico de una arcilla hectorita está presente en una cantidad de 0.2 a 0.4% en peso basado en el peso de la composición que incluye al menos un propelente.
23. La composición de la reivindicación 22 caracterizada porque el derivado orgánico de una arcilla hectorita está presente en una cantidad de 0.25 a 0.35% en peso basado en el peso de la composición que incluye al menos un propelente.
24. La composición de cualquier reivindicación precedente caracterizada porque al menos un ingrediente activo antitranspirante se selecciona de sales de aluminio, sales de circonio y sales de zinc.
25. La composición de la reivindicación 24 caracterizada porque al menos un ingrediente activo antitranspirante comprende clorhidrato de aluminio.
26. La composición de cualquier reivindicación precedente caracterizada porque comprende además uno o más ingredientes seleccionados de: un desodorante, una fragancia, un conservador, un emulsionante, un antioxidante y un emoliente.
27. Un dispensador de aerosol composición antitranspirante caracterizado porque comprende la composición de cualquier reivindicación precedente envasada en un recipiente en aerosol.
28. El dispensador de la reivindicación 27 caracterizado porque el recipiente es un recipiente de aerosol a presión.
29. El uso de la composición de cualquiera de las reivindicaciones 1 a 26 como un antitranspirante.
30. Un método que comprende aplicar la composición de cualquiera de las reivindicaciones 1 a 26 en la zona axilar de un sujeto.
31. Un método de fabricación de la composición de cualquiera de las reivindicaciones 1 a 26, incluyendo el método la etapa de:
a. Proporcionar el copolímero de dimeticona bis-vinilo/dimeticona, el disolvente de silicona y al menos un éster de ácido graso por lo menos en forma de un gel premezclado; y
b. Mezclar al menos un gel premezclado por lo menos con el ingrediente activo antitranspirante.
32. El uso, en una composición antitranspirante en aerosol que comprende al menos un ingrediente activo antitranspirante y al menos un agente propulsor, de la combinación de un copolímero de dimeticona bis-vinilo/dimeticona, un disolvente de silicona y al menos un éster de ácido graso para aumentar la deposición del al menos un ingrediente activo antitranspirante en la zona axilar de un sujeto con una dosis de un pulverizador de aerosol que comprende la composición.
33. El uso de la reivindicación 32 caracterizado porque el copolímero de dimeticona bis-vinilo/dimeticona, el disolvente de silicona y al menos un éster de ácido graso se proporcionan al menos en forma de un gel premezclado.
34. El uso de la reivindicación 32 ó 33 donde la composición comprende además un espesante compuesto de hectorita cuaternio-18.

KARLA BEATRIZ PÉREZ SÁNCHEZ, CONCEDE UN DERECHO DE ACCESO A FAVOR DE LOS CONDÓMINOS DEL CONDOMINIO DENOMINADO “LAS VILLAS AKUMAL”, REPRESENTADOS POR LA SOCIEDAD SERVICIOS CAURA, S.A. DE C.V., LA CUAL A SU VEZ ES REPRESENTADA POR EL SR. ERNESTO ADRIÁN MARCOS HADJOPULOS (EN ADELANTE LOS CONDÓMINOS REFERIDOS COMO “LVA”), RESPECTO DE UNA PORCIÓN O ESPACIO DENTRO DEL INMUEBLE PROPIEDAD DE JADE, EN TÉRMINOS DEL PRESENTE, AL TENOR DE LAS SIGUIENTES DECLARACIONES Y CLÁUSULAS.
D E C L A R A C I O N E S
I.- Declara Jade que:
a) Es una persona moral constituida conforme a las leyes de México, con fecha 2 de febrero de 2011.
b) Que es legítima propietaria y poseedora del inmueble que a continuación se describe:
Lote 001, manzana 013 ubicado en el fraccionamiento Akumal Caribe, Etapa C, en el Municipio de Tulum, Quintana Roo con una superficie de 23,039.89 metros cuadrados y las siguientes medidas y colindancias: Al Norte en sesenta y tres punto cincuenta y tres metros con propiedad privada; Al Sur en sesenta punto sesenta metros en línea quebrada con calle sin número; Al Este en sesenta y nueve punto dieciocho más ciento sesenta y uno punto setenta y cinco más ochenta y ocho punto treinta y siete más seis punto noventa y uno más setenta y tres punto cincuenta y un metros con calle sin número; Al Oeste en cincuenta punto veintinueve más ciento setenta y dos punto diecinueve más cuarenta y cuatro punto cuarenta y cuatro y seis metros con Fidecaribe tres fracción uno.
Lo anterior de conformidad con la Escritura Pública No. 11,879, de fecha 10 de marzo de 2011, otorgada ante la fe del Lic. Miguel Ángel Ortiz Cardín, Notario Público No. 21 de Playa del Carmen. Quintana Roo, registrada en el Registro Público de la Propiedad y del Comercio del Estado de Quintana Roo bajo el Folio 32065 de fecha 11 de abril de 2011.
Al inmueble antes descrito se le denominará para efectos del presente como el “Inmueble”.
Se anexa al presente copia de la escritura antes mencionada, así como un plano del Inmueble, como Anexo 1.
c) Que es su deseo celebrar el presente, con el objeto de otorgar a LVA un derecho de acceso a una parte o porción del Inmueble, y recibir una contraprestación por dicho concepto, de conformidad con el plano que se anexa al presente como Anexo 2 y sujeto a los términos y condiciones referidos en este Contrato. A dicha porción del Inmueble se le referirá como el “Estacionamiento”.
d) Su representante cuenta con las facultades suficientes para la celebración del presente, mismas que no han sido revocadas o limitadas en forma alguna.
II.- Declara LVA que:
a) Mediante Escritura Pública No. 46,807 de fecha 10 de octubre de 2008, otorgada ante la fe del Lic. Marco Antonio Sánchez Vales, titular de la notaría 3 en Cancún, Quintana Roo, se creó el Régimen de Propiedad en Condominio denominado Las Villas Akumal. Asimismo en la Cláusula Quinta de dicha escritura se nombró a la sociedad Servicios Caura, S.A. de C.V. (en adelante referida como “SC”) como administradora del referido condominio. Se anexa al presente copia de la referida escritura como Anexo 3.
b) Mediante Escritura Pública No. 46,807 de fecha 10 de octubre de 2008, otorgada ante la fe del Lic. Marco Antonio Sánchez Vales, titular de la notaría 3 en Cancún, Quintana Roo, LVA otorgó a SC, en su carácter de sociedad administradora del referido condominio, poderes para pleitos y cobranzas. Se anexa al presente copia de la referida escritura como Anexo 4.
c) Mediante Escritura Pública No. 17,454 de fecha 4 de Mayo de 2005, otorgada ante la fe del Lic. Eduardo Adolfo Manautou Ayala, titular de la Notaría 123 en la ciudad de Monterrey, Nuevo León entre otros, poder general para actos de administración en favor del Sr. Ernesto Adrián Marcos Hadjopulos. Se anexa al presente copia de la referida escritura como Anexo 5.
d) LVA y SC reconocen y aceptan que Jade es legítimo poseedor y propietario del Inmueble, y es su deseo que Jade le otorgue un derecho de acceso al Estacionamiento y pagar por dicho derecho una contraprestación, de conformidad con el Anexo 2 y con los términos y condiciones del presente, y que la celebración del presente no le otorga derecho alguno sobre el Inmueble, con excepción de los expresamente establecido en este contrato.
En virtud de las anteriores declaraciones, las partes celebran el presente contrato al tenor de las siguientes:
C L Á U S U L A S
PRIMERA. Objeto y Obligaciones Específicas de las Partes.
En este acto Jade autoriza a LVA el acceso intermitente al Estacionamiento dentro del Inmueble propiedad y en posesión de Jade.
Para efectos de lo anterior, las Partes convienen en que exclusivamente los condóminos propietarios de unidades habitacionales privativas dentro del condominio referido en la Declaración II a) anterior, y sus visitantes o invitados, podrán tener acceso al Estacionamiento. En este sentido, ni LVA ni SC podrán ingresar al estacionamiento ningún otro objeto, maquinaria o bien mueble, ni llevar a cabo ningún tipo de construcción en el mismo.
El derecho de acceso al Estacionamiento que se otorga en este acto a los condóminos de LVA, será exclusivamente para el estacionamiento de vehículos de su propiedad o de su uso, en términos del párrafo anterior, admitiendo un máximo de 20 (veinte) vehículos a la vez, en un espacio de 13 (trece) metros cuadrados por vehículo, y en consecuencia los condóminos de LVA deberán estacionar sus vehículos en los espacios que para dichos efectos señale Jade, en términos del referido Anexo 2 del presente. Cualquier permiso o autorización que pudiese requerirse para el estacionamiento será responsabilidad de LVA y/o SC.
Ni SC ni LVA podrán, bajo ningún concepto o motivo, crear establecimientos o asentamientos permanentes o temporales dentro del Estacionamiento, ya sean fijos o móviles, ni podrán ingresar al mismo vehículos recreativos o que utilicen un espacio mayor a 13 (trece) metros cuadrados, ni ningún tipo de vehículo o artefacto que permita habitar en el de forma temporal o permanente, incluyendo vehículos o artefactos conocidos como “trailers”, “campers”, “RV”, tiendas de campaña, puestos móviles de venta, renta, comercialización o administración de bienes y/o servicios, y en general ningún vehículo distinto a coches o camionetas de uso personal.
Jade, sus empleados, directivos, representantes, asociados, accionistas o partes relacionadas tendrán en todo momento derecho de acceso al Estacionamiento, toda vez que el presente es exclusivamente para permitir el acceso intermitente del mismo por parte de los condóminos de LVA en términos del presente, pero sin que esto implique un uso exclusivo y continuo ni la entrega de la posesión del Estacionamiento a LVA o a SC.
Jade se obliga a diseñar y construir, a su propio costo y discreción el Estacionamiento, sin tener obligación alguna de llevar a cabo un mínimo de inversión ni un diseño u obras en específico, haciendo lo posible para conservar la vegetación y el estilo de las construcciones de Jade en el Inmueble. Lo anterior en el entendido de que Jade tiene como obligación en este sentido, únicamente el delimitar el área del Estacionamiento y de los espacios para vehículos, de la forma que considere conveniente.
Ni LVA ni SC podrán llevar a cabo ningún tipo de construcción, mejora o remodelación en el Estacionamiento, en el entendido de que en caso de que LVA o SC consideren que es necesario llevar a cabo algún tipo de construcción o mejora en el mismo, deberán manifestarlo así a Jade, y Jade decidirá sobre la realización de la misma, conviniendo en su caso las Partes respecto de los costos implicados.
Por su parte Jade podrá, en cualquier momento, llevar a cabo cualquier tipo de construcción, remodelación o mejora en el Estacionamiento en caso de considerarlo necesario, incluyendo la redistribución del mismo y de los lugares para el estacionamiento de vehículos de conformidad con los párrafos que anteceden, lo cual implicará la modificación del Anexo 2 del presente, de forma unilateral y discrecional por parte de Jade, siempre y cuando conserve los 20 (veinte) espacios de estacionamiento con la medida mínima de 13 (trece) metros cuadrados por lugar, y sin que esto implique la obligación de LVA o SC de cubrir dichos costos.
El derecho de acceso que en este acto se concede a LVA no será cedible ni traspasable por ningún título, ya sea oneroso o gratuito, para efectos de lo cual, Jade, a través de cualquiera de sus representantes, factores, dependientes, empleados o directivos o terceros que instruya para dichos fines, podrá llevar a cabo revisiones o inspecciones y solicitar a LVA, a cualquiera de los referidos condóminos de LVA o a SC a través de su representante, que acredite la propiedad o el derecho al uso y disfrute de los vehículos y/o personas que se encuentren en el Estacionamiento, y SC o LVA directamente deberá, en un plazo máximo de 3 (tres) días hábiles, proporcionar a Jade la información solicitada, con el objeto de comprobar que ni LVA ni SC han incumplido con sus obligaciones en términos del presente, en el entendido de que la falta de proporcionar dicha información en tiempo y forma se considerará como incumplimiento por parte de LVA y SC al presente.
Jade no será responsable de daños o pérdidas, totales o parciales, de los vehículos o bienes de LVA, de SC o de cualquier tercero que se encuentren dentro del Estacionamiento, ni por cualquier evento, acto o circunstancia que ocurra en el Estacionamiento, incluyendo desastres naturales o actos del hombre, ya que el manejo y administración del mismo corresponderá a LVA y SC, a menos que el hecho en cuestión sea imputable directamente a Jade o a sus representantes.
Asimismo Jade se obliga a, previa solicitud por escrito por parte de SC y siempre y cuando esto sea jurídicamente viable;
a) Ceder los derechos y obligaciones derivadas del presente, a la asociación de condóminos que al efecto se cree dentro del Inmueble, o en su defecto a los propietarios de unidades habitacionales o privativas dentro del régimen de propiedad en condominio que al efecto se cree dentro del Inmueble, con el objeto de garantizar a SC sus derechos bajo el presente. Dichas cesión no requerirá previa autorización por parte de SC, ni notificación por parte de Jade a SC, y se hará de forma total en caso de que se haga a la referida asociación de condóminos, o en su defecto de forma proporcional o parcial, si la cesión se hace a propietarios de unidades privativas, o;
b) Considerar el Estacionamiento, dentro del régimen de propiedad en condominio al cual se afecte o haya afectado el Inmueble, como unidad privativa propiedad de Jade, y a mantener dicha propiedad en tanto el presente contrato continúe vigente.
La cesión o cesiones referidas en el inciso a) anterior, deberán realizarse conforme Jade vaya vendiendo o comercializando unidades privativas en términos de dicha sección.
La creación o en su caso modificación al régimen de condominio referida en el inciso b) anterior deberá realizarse en un plazo que no exceda de 24 (veinticuatro) meses contados a partir de la celebración del presente.
Jade podrá elegir libremente entre cualquiera de las dos opciones antes mencionadas.
SEGUNDA. Contraprestación.
LVA y/o SC pagarán a Jade como contraprestación por el derecho de acceso objeto principal de este contrato, la cantidad de US$750.00 (Setecientos Cincuenta Dólares 00/00 moneda de curso legal de los Estados Unidos de América) mensuales. El pago se hará por meses adelantados, con las excepciones marcadas en este contrato.
Independientemente de lo anterior, LVA y SC gozarán de un periodo de gracia de 12 (doce) meses a partir dela firma del presente, durante el cual no pagarán la contraprestación referida en el párrafo anterior.
Asimismo las Partes convienen en que la contraprestación antes referida se incrementará cada 3 (tres) años de vigencia del presente, en la misma proporción que haya aumentado el índice oficial de inflación de los Estados Unidos de América, publicado por la dependencia del gobierno de dicho país autorizada para tales efectos, o en su caso su equivalente, por el periodo inmediato anterior de 3 (tres) años sumados y en conjunto, es decir, si la inflación sumada de los 3 (tres) anos anteriores es del 6%, (2% cada año en promedio) la contraprestación se incrementará en 6%.
TERCERA. Naturaleza del Contrato y Acciones Legales.
Las Partes convienen en que el presente contrato consigna exclusivamente un derecho personal de acceso a una porción del Inmueble propiedad de Jade, referida como Estacionamiento en términos de la cláusula PRIMERA anterior, que en todo caso podría tipificarse como “derecho de acceso a estacionamiento privado y de autoservicio, o servicio de estacionamiento”, y por ningún motivo será considerado como un contrato de arrendamiento, usufructo o derecho de uso goce y disfrute del Inmueble o del Estacionamiento, toda vez que el derecho de acceso será exclusivamente sobre una porción de un bien inmueble y sin derecho de establecer asentamiento temporal o permanente en el Estacionamiento.
Asimismo LVA, SC y Ernesto Adrián Marcos Hadjopulos, se obligan a que ellos, sus accionistas, representantes, directivos, empleados, representantes, comisionistas, factores, dependientes o partes relacionadas en cualquier forma, en un plazo que no exceda de 10 (diez) días hábiles a partir de la fecha del presente, pondrán fin y/o se desistirán de cualquier acción legal o proceso judicial que hubiesen intentado, ejercido, o interpuesto, en contra de Jade, sus accionistas, representantes, directivos, empleado o partes relacionadas en cualquier forma, y no se reservan ningún derecho o acción legal a ejercitar en su contra en relación con las Partes, el Inmueble y el Estacionamiento. Asimismo las Partes convienen en que el presente es el único documento que regula la relación entre las Partes con respecto al Inmueble y al Estacionamiento, y que refleja la situación jurídica de las Partes en relación al Inmueble y al Estacionamiento. LVA se obliga a que los nuevos condóminos se adhieran al presente.
El incumplimiento por parte de LVA, SC y Ernesto Adrián Marcos Hadjopulos se obligan a que ellos, sus accionistas, representantes, directivos, empleados, comisionistas, factores, dependientes, representantes o partes relacionadas en cualquier forma a su obligación consignada en el párrafo anterior, se considerará como causal de rescisión del presente, aplicando en consecuencia las penas por retraso y por incumplimiento señaladas en este contrato.
CUARTA.- Posesión.
Ambas partes reconocen que la celebración del presente y el derecho de acceso al Estacionamiento a favor de LVA, no otorgan de forma alguna la posesión del Inmueble o del Estacionamiento a LVA y/o SC, siendo simplemente un servicio de estacionamiento, y será Jade quién conservará la posesión de la totalidad del Inmueble, incluyendo el Estacionamiento, toda vez que el presente consigna exclusivamente un derecho personal y privado de acceso al Estacionamiento, de forma intermitente y bajo los términos y condiciones señalados en este contrato.
QUINTA. Vigencia.
La vigencia del presente contrato será de 20 años a partir de la fecha de celebración del mismo, al término de la cual LVA y/o SC deberán retirar del Estacionamiento cualquier vehículo o bien que se encuentre dentro del mismo, toda vez que Jade suspenderá de forma definitiva el derecho de acceso al Estacionamiento, procediendo en consecuencia en términos del presente para efectos de la suspensión de dicho derecho, a menos que las Partes con al menos 90 (noventa) días de anticipación celebren por escrito una prórroga de la vigencia del mismo.
SEXTA. Facturación e Impuestos.
Los impuestos, derechos o cualquier otra contribución que se genere con motivo del presente, corresponderá solventarlos a cada una de las partes en términos de la legislación vigente.
SÉPTIMA. Suspensión del Derecho de Acceso y Rescisión.
En caso de que se verifique algún supuesto de incumplimiento por parte de LVA o SC a sus obligaciones bajo el presente, Jade notificará esta situación a SC en su carácter de administrador del condominio y representante de LVA, en cuyo caso, SC y LVA tendrán un plazo máximo de 3 (tres) días hábiles para subsanar el incumplimiento o hecho, y en caso contrario, SC y LVA solidariamente deberán pagar a Jade como pena convencional por retraso en el cumplimiento de sus obligaciones o cumplimiento de forma distinta a la pactada, la cantidad de US$500.00 (Quinientos 00/100 Dólares, moneda de curso legal de los Estados Unidos de América) diarios, hasta que se subsane el incumplimiento o se rescinda o de por terminado el presente.
Por su parte, en caso de que Jade suspendiera el derecho o servicio de acceso al Estacionamiento sin causa justificada y sin que medie un hecho comprobable de incumplimiento por parte de LVA, SC o cualquier usuario del Estacionamiento, Jade deberán pagar a LVA como pena convencional por retraso en el cumplimiento de sus obligaciones o cumplimiento de forma distinta a la pactada, la cantidad de US$500.00 (Quinientos 00/100 Dólares, moneda de curso legal de los Estados Unidos de América) diarios, hasta que se reactive el servicio de acceso al Estacionamiento, o hasta que se declare la rescisión del presente.
Si el incumplimiento persiste por mas de 3 (tres) meses a partir de que cualquiera de las partes haya notificado el mismo, será causal de recisión del presente, y la parte en incumplimiento deberá pagar a la parte afectada una pena convencional igual al monto total de las contraprestaciones por devengarse a favor de Jade y a cargo de LVA y/o SC al momento del acto de incumplimiento, considerando la totalidad del plazo del presente, sin perjuicio de la pena por retraso en cumplimiento de sus obligaciones o cumplimiento de forma distinta a la pactada, en términos de los párrafos anteriores.
En el supuesto de incumplimiento por parte de SC y/o LVA y suspensión del acceso al Estacionamiento, SC y/o LVA, estas últimas se obligan a retirar todos los vehículos y/o bienes de su propiedad o de terceros que se encuentren en el Estacionamiento en un plazo de 48 (cuarenta y ocho) horas a partir de que se notifique la suspensión del derecho de acceso por parte de Jade, en el entendido de que de no hacerlo, facultan a Jade para que, a través de las autoridades correspondientes de tránsito de la localidad, retire dichos vehículos o bienes del Estacionamiento. Todos los costos implicados con el retiro de vehículos y/o bienes del Estacionamiento serán a cargo de LVA y/o SC.
Sin perjuicio de lo manifestado en los párrafos que anteceden, el incumplimiento a cualquiera de las obligaciones contenidas en cualquiera de las cláusulas del presente contrato será causa de rescisión del mismo, por lo que la parte afectada por cualquier incumplimiento podrá, a su entera discreción, demandar el cumplimiento forzoso del contrato o la rescisión del presente contrato más el resarcimiento en ambos casos de los daños y perjuicios ocasionados o cobro de penas convencionales, según proceda en términos de la legislación aplicable.
OCTAVA. Domicilios
LVA y SC señalan como su domicilio para oír y recibir notificaciones relacionadas con el presente, el ubicado en :
Para la interpretación y cumplimiento del presente contrato, las partes se someten a la jurisdicción y competencia de los Tribunales del fuero común de la Ciudad de Cancún, Quintana Roo, renunciando expresamente a cualquier otro fuero que con motivo de su domicilio presente o futuro, o por cualquier otra razón, pudiera llegar a corresponderles.

STATEMENTS
I. Jade states that:
a) It is a corporation organized under the Mexican laws, dated February 2, 2011.
b) It is lawful owner and possessor of the property described below:
Lote 001, manzana 013 located in Akumal Caribe, Phase C subdivision, in the municipality of Tulum, Quintana Roo with an area of 23,039.89 square meters and the following measurements and bounds: to the North sixty-three point fifty-three meters private property; to the South sixty point sixty meters broken line with no street number; to the East sixty-nine point eighteen plus one hundred sixty-one point seventy-five plus eighty-eight point thirty-seven plus six point ninety-one plus seventy three point fifty-one meters with no street number; to the West fifty point twenty one plus one hundred and seventy-two point nineteen plus forty-four point forty-four and six meters with Fidecaribe three fraction one.
The above in accordance with Public Deed No. 11,879, dated March 10, 2011, granted before Lic. Miguel Angel Ortiz Cardin, Notary Public No. 21 Playa del Carmen. Quintana Roo, registered in the Public Registry of Property and Commerce of the State of Quintana Roo under Folio 32065 dated April 11, 2011.
The property described above will be named for the purposes of this as the "Property."
It is attached herein a copy of the aforementioned deed, as well as a map of the property, as Appendix 1.
c) It is pursued to conclude this Agreement, in order to grant LVA a right of access to part or portion of the property, and receive a compensation in this respect, in accordance with the plan annexed hereto as Appendix 2 and subject to the terms and conditions referred to in this Agreement. This portion of the property will be referred to as the "Parking Lot."
d) Its representative has sufficient powers to conclude this Agreement, such powers have not been revoked or limited by no means.
II. LVA states that:
a) By Public Deed No. 46,807 dated October 10, 2008, granted before Lic. Marco Antonio Sanchez Vales, head of the notary 3 in Cancun, Quintana Roo, the Association Of Property referred to as Las Villas Akumal. Also in the fifth clause of this deed Caura Services, S.A. de C.V. (hereinafter referred to as "SC") was designated as administrator of the condo referred to herein. It is attached herein a copy of such deed as Appendix 3.
b) By Public Deed No. 46,807 dated October 10, 2008, granted before Lic. Marco Antonio Sanchez Vales, head of the notary 3 in Cancun, Quintana Roo, LVA granted SC, in its capacity as management company of such condo, powers for lawsuits and collections. It is attached herein a copy of that deed as Appendix 4.
c) By Deed No. 17,454 dated May 4, 2005, granted before Lic. Adolfo Manautou Eduardo Ayala, head of the Notary 123 in the city of Monterrey, Nuevo Leon, among others, general power for acts of administration on behalf of Mr. Ernesto Adrian Marcos Hadjopulos. It is attached herein a copy of that deed as Appendix 5.
d) LVA and SC acknowledge and agree that Jade is legitimate holder and owner of the property, and it is their desire that Jade grants right of access to the Parking Lot and pay a fee for that right, in accordance with Appendix 2 and the terms and conditions hereof, and the conclusion of this agreement does not grant any rights on the property, except as expressly provided in this agreement.
Under the above statements, the parties enter into this agreement pursuant to the following:
CLAUSES
FIRST: SUBJECT MATTER AND SPECIFIC OBLIGATIONS OF PARTIES
Jade hereby authorizes LVA intermittent access to the Parking Lot inside the property and property held by Jade.
For purposes of the foregoing, the Parties agree that only the custodial condominium owners in the condominium housing units referred to in the previous Statement II), and their visitors or guests may access the Parking Lot. In this sense, neither LVA nor SC may enter the Parking Lot other objects, machinery or furniture, or perform any construction on it.
The right of access to the Parking Lot that is hereby granted to the condominium owners of LVA will be exclusively for the parking of vehicles owned or uses by LVA, in the preceding paragraph, admitting a maximum of twenty (20) vehicles at the time, in a spot of 13 (thirteen) square meters per vehicle, and thus LVA condo owners must park their vehicles in the spots Jade has pointed for such effects, in terms of Appendix 2 hereof. Any permit or authorization that may be required for parking is responsibility of LVA and/or SC.
Neither SC nor LVA may, under any circumstances or motive, create establishments or permanent or temporary settlements inside the Parking Lot, whether fixed or mobile, and may not enter recreational vehicles or using space greater than thirteen (13) square meters, or any type of vehicle or device that allows living in temporary or permanent basis, including vehicles or devices known as "trailers", "campers, "RV", tents, mobile, rent, marketing or administration of goods and/or services stalls, and in general any vehicles other than cars and trucks for personal use.
Jade, its employees, officers, agents, partners, shareholders or related parties shall have the right to access the Parking Lot at any time, since this agreement is solely to allow intermittent access to it by LVA condominiums in the terms hereby, but without implying an exclusive and continuous use or delivery of possession of LVA or SC parking.
Jade is obliged to design and construct, at its own expense and discretion the Parking Lot, without any obligation to carry out a minimum investment or design or works in specific, making it possible to preserve vegetation and style of Jade in the property buildings. This in the understanding that Jade has an obligation in this regard, only to delimit the parking area and spots for vehicles, as convenient.
Neither LVA or SC may carry out any construction, improvement or remodeling in the Parking Lot, in the understanding that if LVA or SC considers it necessary to conduct some sort of construction or improvement thereon, shall they inform Jade, and Jade will decide on the performance thereof, agreeing the parties on the costs involved.
Meanwhile Jade may at any time carry out any construction, remodeling or improvement in the Parking Lot if deemed necessary, including its redistribution and spots for parking of vehicles in accordance with the paragraphs above, which will involve the amendment of Appendix 2 hereof, unilaterally and discretionary on behalf of Jade, provided that 20 (twenty) parking spaces with the minimum size of 13 (thirteen) square meters per spot, and without implying an obligation to LVA or SC to cover those costs.
The right of access hereby granted to LVA will not be assignable or transferable under any title, either onerous or free for which purpose, Jade, through any of its representatives, factors, dependents, employees, or directors or instruct third parties for such purposes, may conduct reviews or inspections and request LVA, any of the aforementioned condominium owners LVA or SC through their representative, proving ownership or the right to use and enjoy vehicles and/or people who are in the Parking Lot, and SC or directly LVA shall, within a period of three (3) working days, provide the information requested by Jade, in order to ascertain neither LVA nor SC have breached their obligations hereunder, on the understanding that failure to provide such information in a timely manner will be considered as failure of SC of this Agreement.
Jade is not liable for damage or loss of vehicles or goods of LVA, SC or any third party within the Parking Lot, total or partial, or for any event, act or circumstance which occurs in the Parking Lot, including natural disaster or man actions, as the management and administration of the Parking Lot will be under LVA and SC, unless the act in question is attributable directly to Jade or its representatives.
Jade also undertakes under written request by SC and provided this is legally feasible the following:
a) To grant the condo owners association the rights and obligations arising hereby, created within the property designated for such purpose, or otherwise to the owners of residential or private units within the regime of condominium created within the property designated for such purpose, in order to guarantee SC its rights hereunder. Such transfer shall not require prior authorization from SC, or notice from Jade to SC, and will be fully executed in case it is submitted to aforementioned condo owners association, or otherwise proportionally or partially, if the transfer is made to the owners of private units, or
b) To consider the Parking Lot inside the condominium property regime which is affected or has affected the property, as private unit owned by Jade, and keep this property as this agreement remains in force.
The assignment or assignments referred to in the preceding paragraph a), shall be in accordance to what Jade sells or markets in terms of that section.
The creation or modification of any condominium regime referred to in the preceding paragraph b) must be made within a period not exceeding 24 (twenty four) months from the conclusion of this agreement.
Jade may freely choose between any of the two options above:
SECOND. Consideration.
LVA and/or SC will pay Jade as consideration for the right of access, main object of this agreement, the amount of US $ 750.00 (Seven Hundred Fifty Dollars 00/00 legal currency of the United States of America) monthly. This payment will be made in advance each month, with the exceptions highlighted in this agreement.
Notwithstanding the foregoing, LVA and SC will enjoy a grace period of twelve (12) months after signing this agreement, during which they will not pay the compensation referred to in the preceding paragraph.
The Parties also agree that the consideration referred to above will be increased every three (3) valid years of this agreement, in the same proportion that has increased the official rate of inflation in the United States, published by the government agency of this country authorized for such formalities, or possibly equivalent, for the immediately preceding three (3) year period combined and together, that is, if inflation combined with the 3 (three) years is 6% ( 2% each year on average) the consideration will be increased by 6%.
THIRD. Type of agreement and legal action.
The Parties agree that this agreement assigns only a personal right of access to a portion of the property owned by Jade, referred to as the Parking Lot in terms of the FIRST clause above, which in any case could be categorized as "right of access to private parking and self-service parking or valet parking "and under no circumstances will it be considered as a lease, usufruct or right of use and enjoyment of property or parking, since the right of access will be exclusively on a portion of a property without right to establish temporary or permanent settlement in the Parking Lot.
Also LVA, SC and Ernesto Adrian Marcos Hadjopulos, their shareholders, officers, directors, employees, agents, brokers, factors, dependents or in any way related parties, within a period not exceeding ten (10) business days from the date hereof, are obliged to terminate and/or desist from any legal action or proceeding they had tried, exercised, or brought, against Jade, its shareholders, officers, directors, employees or related parties whatsoever, and no right or legal action is reserved to exercise against the Parties regarding the property and parking. The Parties also agree that this is the only document regulating the relationship between the Parties with respect to the property and parking, and reflects the status of the Parties in relation to the property and parking. LVA undertakes that new condo owners stick to this Agreement.
If failure to comply with this, LVA, SC and Ernesto Adrian Marcos Hadjopulos, their shareholders, officers, representatives, executives, employees, brokers, factors, dependents or parties related in any way agree to comply with the content in the preceding paragraph, which shall be considered as grounds for termination of this, accordingly applying the penalties for delay and for breach identified in this agreement.
FOURTH possession.
Both parties recognize that the conclusion of this agreement and the right of access to the Parking Lot in favor of LVA do not give possession of the property or parking LVA and/or SC under any circumstance, being simply a service of parking, and Jade will retain ownership of the entire property, including the Parking Lot, when this agreement exclusively assigns personal and private access to the Parking Lot, intermittently and under the terms and conditions set forth in this agreement.
FIFTH. Effectiveness.
The effectiveness of this agreement shall be 20 years from the date of conclusion of the agreement, which leads to LVA and/or SC to withdraw from the Parking Lot any vehicle, for Jade will definitively take away the right of access to the Parking Lot, and proceed, according to the terms herein, to take away that right, unless the Parties submit a written extension at least ninety (90) days prior to termination.
SIXTH. Billing and Taxation.
Taxes, duties or any other tax that is generated by this agreement, shall be covered by each of the parties in terms of valid legislation.
SEVENTH. Right of Access and Termination Suspension
In case any event of default by SC or LVA to their obligations hereunder, Jade will notify this situation to SC in its capacity as administrator of the condominium and LVA representative, in which case, SC and LVA have a maximum period of three (3) business days to rectify the event or fact; if not, SC and LVA shall severally pay Jade the amount of US $ 500.00 (five hundred dollars 00/100, legal currency of the United States of America) per day as penalty for delay in meeting their obligations or differently fulfill as agreed, until the default is rectified or this agreement is terminated.
Meanwhile, if Jade takes away the right or service to access the Parking Lot without just cause and without a verifiable fact failure of LVA, SC or any user of the Parking Lot, Jade must pay LVA the amount of US $ 500.00 (five hundred dollars 00/100, legal currency of the United States of America) per day as penalty as delay in fulfilling its obligations or differently fulfill as agreed, until the service to access the Parking Lot is reactivated, or until the termination of this agreement.
If failure persists for more than 3 (three) months as of either party has notified the failure, this will be grounds for rescission of the agreement, and the party in breach shall pay to the injured party a penalty equal to the total amount of consideration to be paid to Jade by LVA and/or SC at the time of the default event, considering the entire period of time herein, without prejudice to the penalty for delay in meeting their compliance obligations or differently as agreed, in terms of the preceding paragraphs.
In the event of default by SC and/or LVA and suspension of access to the Parking Lot, SC and/or LVA, are obliged to remove all vehicles and/or assets from their or others’ property in the Parking Lot within 48 (forty eight) hours after suspension of the right of access is notified by Jade, on the understanding that failure to do so, empowers Jade, through the appropriate local authorities, to remove the vehicle or parking assets. All costs involved with the removal of vehicles and/or property from the Parking Lot will be run by LVA and/or SC.
Subject to what is stated in the preceding paragraphs, breach of any obligation under any provision of this agreement will result in termination, so the party affected by breach may, at its sole discretion, demand full compliance of this agreement or its termination, plus compensation in both cases for damages caused or penalties charged, as appropriate in accordance with applicable laws.

NINTH. Jurisdiction.
For the interpretation and performance of this agreement, the parties submit to the jurisdiction of Common Law courts in the city of Cancun, Quintana Roo, expressly waiving to any other corresponding jurisdiction by reason of their current or future address, or further reason.

I am a freelance translator with more than 9 years of experience in the patents industry (pharmaceuticals) and technical matters such as engineering, oil and gas, and airports. I also have experience with the entertainment industry as a subtitler. I used to work as an interpreter-translator for an American company (PAE) for the Merida Initiative in Mexico along with the Bureau of International Narcotics and Law Enforcement (INL), and the American Embassy in security.
