correction: which is too ultimative in tone
swisstell Nov 8, 2004:
ok but a) I would end differently with ".... be applied publicly or privately against said disturbance. b) I still prefer MAY over SHALL which is to ultimative in tone. The original is talking of the possibility i.e. MAY BE, not of the finality WILL BE
Non-ProZ.com Nov 7, 2004:
Please look at the area highlighted What do you think of this? ***and all means established by law or equitable fairness shall be applied**** against said disturbance, be it public or private.

How's that?

all means established by law or fairness may be applied

is a rather direct interpretation - but avoids the rather rough
"prosecution" suggested by you

agree Ana Brause : El único cambio que le haría es utilizar el término equity en lugar de fairness (by Law and Equity), refiere a recursos que se presentan en tribunales especiales. Aparece el término equidad cuando la versión va y vuelve del inglés.

all means provided by law or equity may be enforced

podrán ser aplicables todos medios establecidos por la ley o equidad = all means provided by law or equity may be enforced (against such nuisance...)

It looks like "public or private" pertains to the nuisance.
