Art 35: La duración del período de exploración será de cinco años a partir del perfeccionamiento del contrato de operación. Si al vencimiento de los cinco años no se ha determinado producción comercial, no obstante haberse cumplido el Programa Exploratorio Mínimo, el Estado, a solicitud del Contratista, prorrogará una sola vez y hasta por dos años el período de exploración.

I feel that "commercial production" is not appropriate here. Does this mean whether sufficient hydrocarbons have been found to merit the commercial development of a reservoir/field? This law has been badly drafted but I am loath to read to much into the term. Am grateful for any suggestions, as I want to keep this translation as close to the original as possible. Badly drafted or not, this is a law.

@ Annie Just found this. I think 'commercial production' is ok, and 'determinado' could mean 'established'.

I think the translation of "producción comercial" is pretty obvious, but it's "determinado" I'm not sure about. Does it mean the field is actually in commercial production, or that they've decided to go ahead with it?

Commercial Production

I believe that commercial production is a good option since I don't find any other good answer to your problem. As you said, that law is badly drafted and if you want to keep as close to the original as possible "commercial production" might be a good answer.
